The village of Richfield last week answeredclaims filed by the entity seeking to fill the site ofan abandoned quarry on Scenic Drive.
Richfield Village Administrator Jim Healyread a statement at the June 18 Village Boardmeeting regarding recent action involvingScenic Pit, LLC, which wants to install fill at thesite of the onetime quarry along the road.
Scenic Pit LLC received state approvals forclean fill to be placed at the location and hasargued that it does not need village approvals
on any items related to the project. The villagehas disputed the position by Scenic Pit LLC.Scenic Pit LLC sought a temporary restrain-
ing order against the village June 5 but it wasdenied by Washington County Circuit JudgeAndrew Gonring.
During the June 18 board meeting, Healysaid another telephone conference is sched-
uled for June 19. Healy also responded to a June 15 filing in Washington County Circuit byScenic it counsel in support of a temporaryrestraining order.
Healy, reading from a statement, cited asworn affidavit from Thomas Zoulek of ScenicPit LLC is working with a contactor to dispose ofapproximately 5,000 truckloads of clean clay.The affidavit cited “village interference” in theScenic Pit plans. Healy said village legal coun-sel filed a response during the afternoon of
June 18.Healy, reading from the statement, saidScenic Pit “has not exhausted available admin-istrative remedies of law before filing thisaction. (Scenic Pit) has not petitioned the vil-lage for a zoning change or a zoning vari-ance.”
Healy added that Scenic Pit has been told
by state officials that they need a stormwaterand erosion control permit from the village, butthey have not completed the applicationprocess.
Healy added that Scenic Pit officials didnot serve the village with a notice of injury andclaim of damages as is required by law.
“The village did not have notice that itwould be sued,” Healy said.
After reading the statement, Healy addedthat the village has spent $28,563 in legal fees
related to the Scenic Pit issue so far this year.He added that he will provide an update on thematter to the village each month.
Several residents also spoke against the fill-ing of the property.
“I’m here to oppose the landfill,” one resi-dent said during a public comment section ofthe meeting. She said that nearby roads were
not made to handle trucks that woulding to the site.
Resident Danah Zoulek of Scresponded to objections, stating the“zero concerns” from the DeparNatural Resource air quality control sthe agency's mine restoration staff “asupports what we’re doing.”
Zoulek said the installation of clethe site will benefit the village, as thehas been for sale for 10 years and “d
have been chased away.”Resident Steve Mahler said he is ately opposed to the landfill. I th(Village) Board for your help so far iing the community.”
He then added: “I want to presquiet that is part of this community.

Behind a recent national honor for Super Steel is thework that made that honor possible.The Milwaukee-based company, located at 7900 W.
Tower Ave , was listed at number 8 on the Fabricator FAB 40list. It is the third year in a row the company has made thelist.
Heather Krugler, a spokesperson for the company, saidthe honor "validates the work we do each day. GERMANTOWN POLICE BLOTTER
The Germantown Village Boardapproved a motion to allow for privateinspection and repair of private lateralsthrough funds provided by the MilwaukeeMetropolitan Sewerage District (MMSD).
According to information from villagestaff, the MMSD launched the PrivateProperty Infiltration and Inflow program in2010, which will seek to address the inflowof water into sewer laterals. However, thevillage has used only $65,599 of the$885,615 available from the MMSD.
The village’s Utility Advisory Committeeand the Public Works and HighwayCommittee recommended that the villagepay for 100 percent of the repairs with the
MMSD funds, and that the program wouldapply only to residential properties.
Village Engineer Brionne Bischke saidconcerns were raised at the committee levelabout the equitability and sustainability ofpaying for 100 percent of the cost.
“One of the equity concerns is that oncethe money is expended, future residentswho want this program won’t have moneyor assistance to help them out, even thoughthey are wastewater utility users,” Bischkesaid.
Trustee Terri Kaminski said she votedagainst the proposal in the Public WorksCommittee. Kaminski said the MMSD fundswould be focused on three neighborhoods.
“If we pay 100 percent of these later-als, we will not have enough money toeven do all the homes in these areas, if theyneed to be done,” Kaminski said.
She further explained there were alsoinflow and infiltration problems in otherareas of the village.
“What are we going to do for them?”Kaminski said.
Trustee Rick Miller said he supportedthe motion in commission because he didn’tbelieve there would be enough residentswho would opt to participate in the pro-gram if they had to split the cost.

The Germantown RecreationDepartment and GHS Band Director JamesBarnes are providing community instrumen-talists ranging from incoming high schoolfreshmen to adults an opportunity to cometogether, rehearse, and perform a varietyof music as part of the GermantownCommunity Band.
The season includes five rehearsals andthree “Concerts in the Park” performancesas well as five rehearsals in winter for theDecember holiday performance at GHS.
Members should have playing experi-ence with music at the high school level orshould be presently enrolled as a highschool band member. Any musician can
come and rehearse.Regular rehearsals willbe in the Germantown High School BandRoom 158 from 6:30 to 8 p.m. on June 15,22, 29; July 6, 13, 27,and Aug. 3.Performances will be on Wednesdayevenings at 7 p.m. on July 1, 15 and Aug.5 at Firemen’s Park and are open to thepublic (if rain the concert will be in the KMSGym).

The Germantown girls softball team advanced to the state tournament this year,losing to DeForest in the Division I quarterfinal 5-4. Germantown finished the season with a 23-6 record.
It was the fourth straight year Germantown appeared in the state tournamentand the sixth overall. Kurt Raguse and Amy Barbiaux are the co-coaches of theGermantown team.

The Menomonee Falls girls soccerteam topped Homestead 2-1 in overtime ina sectional final at Brookfield Central June13. In the process, the team continued apostseason run that has taken the Indiansfrom fifth place in the Greater MetroConference to state tournament qualifier.
"In the regular season, we were a littleoff but we came into the tournament say-ing we were going to change it and we'regoing to come back. We called it our'path of revenge,'" forward Kylie Sprechersaid. "We just wanted to keep going asfar as we can."
The postseason run included wins overHomestead and Hamilton, both of whomdefeated Menomonee Falls during the reg-ular season.
"It's just amazing, it's so surreal,"added Maggie Greifenkamp. "We could-n't ask for anything more."
The day was all the more special forGreifenkamp and the six other seniors onthe team, who graduated from
Menomonee Falls during a ceremonywhich started at 4 p.m. and was finishingup at just before 6 p.m. The seniors on theteam left the ceremony toward the end toget to the game, which was pushed backtwo hours from its original 5 p.m. start.
Menomonee Falls got on the boardfirst as Sprecher converted an assist fromMaggie Greifenkamp inside theHighlanders penalty box to give
Menomonee Falls a 1-0 lead at the 42ndminute. With that goal, Sprecher set therecord for most goals in a season whichhad been set the year before by RachelClayton.
During the second half, MenomoneeFalls continued to press, as Sprecher madeseveral runs, with Menomonee Falls get-ting two shots on goal near the 79thminute.
While Menomonee Falls attempted tokeep the ball out of their side of the field inthe closing minutes of the game,Homestead pressed and Jordan Ellerbrockconverted an assist from Coco Wiencekwith less than two minutes remaining.
But Menomonee Falls scored less thana minute into the first overtime, asSprecher sprinted toward the Homesteadgoal. The ensuing shot deflected off anoth-er Menomonee Falls player before it wasdeflected into the net by a Homesteaddefender.
Menomonee Falls then held the leadfor the next 19 minutes to earn its first tripto the state tournament.

Stein, it is the second improbable postsea-son run in less than a year, as Steincoached the boys team to a runner-up fin-ish in the state tournament in the fall. Thisyear's girls team had only three playersplaying in the same position as last year.
"I think this year the connection andbond between the guys and girls pro-grams — they believe," Stein said. "They'reall great friends and juniors and seniors,
they want it for each other."Stein said he took the seniors on the
girls team aside and mentioned thatexpectations for the boys team weren'thigh either heading into their season.
"Why can't we do it, and they did,"
