District will take steps to com-ply with state and federal reg-ulations regarding studentstaking standardized assess-ments, even as the state examthat prompted a letter from astate agency will change dueto a provision in the statebudget bill.
The situation wasexplained by GermantownSchool District administratorsat the Aug. 10 School Boardmeeting.
The Badger Exam wasadministered to studentsstatewide in grades 3 to 8 dur-ing the spring semester. TheGermantown School Boardapproved a request Feb. 23 tocreate a special notice to par-ents informing them that theycan opt their children out ofthe tests.
“We are required to pro-vide the tests, but parents havethe ability to opt out,”Germantown SuperintendentJeff Holmes said at the Feb.23 meeting.
In a June 30 letter to thedistrict, Deputy StateSuperintendent of PublicInstruction (DPI) MikeThompson said that state andfederal laws require all dis-tricts to administer assessmentexams to all students in the dis-trict. While there is an "optout" provision under state lawin which parents can decidenot to have their children takethe exam, no such opt outclause exists with the federallaw.
"Evidence indicates theGermantown School Districtactively solicited or encour-aged parents to opt their chil-dren out of assessments, inclear violation of the federallaw requiring assessments,"Thompson stated. He thennoted that 81 percent of dis-trict students did not take theBadger Exam.
"These actions jeopardizesignificant federal funding forthe Germantown SchoolDistrict and for all other schooldistricts in the state,"Thompson stated.

The Germantown School Boardapproved adding a third first grade class atRockfield Elementary School for the com-ing school year Aug. 10.
In a memo to the board, Director ofHuman Resources Cynthia Coley andRockfield Principal Dana Croatt noted theboard approved two classes of students foreach grade at the school except for thirdand fifth grade, which would have threeclassrooms. However, they noted that thefirst grade classes would have 26 and 27students. They are recommending to movethe early childhood instruction to the artclassroom to open up another classroom,with art instruction being held through "art
on a cart" for one year until construction iscompleted for an additional classroomspace at the school.
Insurance contracts renewedThe board renewed the district health
insurance contract with Humana Aug. 9.According to information read by boardmember Tom Barney, there will be a 5 per-cent employee contribution while thedeductibles will be increased from $1,000to $2,000 for a single individual and from$2,000 to $4,000 for a family coverage.The contract includes a $200 reward for asingle plan with the attainment of "silvervitality status" and $300 for reaching that
status for someone with a family plan.Barney said the Insurance Committee
said through Humana, the district can get adiscount of as much as 10 percent,depending on how many people in the dis-trict attain silver status.
"That could be money well spent,"Barney said.
The board also approved the long termdisability contract with Madison NationalLife, under which the month benefit per-centage will be reduced from 90 percentto 60 percent. Also renewed was life insur-ance, retiree life, voluntary life, dependentlife and voluntary short time disability forthe coming school year.
Resignations acceptedThe board approved the resignation of
Andrew Bavlnka. Bavlnka was an Englishteacher at the high school and also servedas the boys cross country coach. He recent-ly was named associate principal atMuskego High School. Harris Jones hasbeen named interim boys cross countrycoach for the coming year.
The board also approved the resigna-tion of Jennifer Grosse, who served as amusic teacher at Amy Belle and Rockfieldelementary schools for the past five years.

Little damage from brief tornadoThe National Weather Service con-
firmed Aug. 11 that a tornado toucheddown briefly in the village of Germantownthe previous day.
Ben Herzog, a meteorologist with theNational Weather Service Office inSullivan, said an EF0 (zero) tornadotouched down around 2:12 p.m. Aug. 10in an area near Lovers Lane and MaryButh Lane. The tornado traveled less than amile and no damage was reported.
Tim Halbach of the National WeatherService was in the village Aug. 11 andconfirmed information about the tornado.
Herzog indicated there some downed treelimbs, but said that there was otherwise"very limited damage.
Senior Center seekingvolunteer van drivers
The Germantown Senior Center is look-ing for volunteer van drivers for the SeniorVan Program. Volunteers must have a validWisconsin driver's license and a clean driv-ing record. He added that the agency is placingGermantown in "high risk status" for notmeeting the federal requirements and stat-ed the district had to submit a "written planof corrective action delineating the specificsteps the district will implement to ensureall students have access to all federallyrequired assessments, and that access isnot hindered by district policy or communi-cation."
The School Board approved a letter tothe agency detailing is plan of action. In aletter to the agency dated Aug. 11, Holmessaid "although the district disputes the con-tention that it actively solicited or encour-aged parents to opt out of the referencedpupil assessments or that district policy'resulted in 81 percent' of students optingout of the assessments, the district is confi-dent that our plan is compatible with theDepartment's expectations and willaddress the concerns identified in the Dr.Thompson letter.
The letter then details steps the districtwill take to prepare students for the stateassessment, including practice tests forteachers and students, providing opportuni-ties for teachers to include exam practicesas part of lesson planning, and providingappropriate test materials for students.
The letter also details steps the districtwill take to communicate with parents, staff
and the community regarding state assess-ments.
While the Badger Exam was adminis-tered to students in grades 3-8 last year, aprovision of the Act 55 state budget billwill pre-empt its use this coming schoolyear. Tom McCarthy, communications offi-cer for the state Department of PublicInstruction, confirmed last week that a newtest will be required in place of the BadgerExam for the coming school year. He saidthe state Departments of Public Instructionand Administration have requested bids forthe assessments through the request forproposal process.
"At this time, that process is still underway and a new assessment has not beenselected," McCarthy stated

The Richfield Historical Society is spon-soring a vintage baseball game and clas-sic car show on Sunday, August 16. Thisevent will take place at the RichfieldHistorical and Nature Park. Attending this

This annual walk raises money for theScleroderma Foundation, GreaterChicago Chapter, which provides support,education and research for sclerodermapatients. Scleroderma is a chronic, oftenprogressive, autoimmune disease in whichthe immune system attacks its own body.The disease can cause thickening and tight-ening of the skin. In some cases it causesserious damage to internal organs includ-ing the heart, lungs, kidneys, esophagusand gastrointestinal tract. These organsmay slowly harden until they become inef-fective. Some treatments can help with cer-tain symptoms, but there is still no cure forscleroderma. The disease affects three tofour times as many women as men.

One thing will remain the same forGermantown football this year.
"Just hard nosed football and gettingafter it. That's what we do," GermantownCoach Jake Davis said during an Aug. 10interview. "We're going to make hay onoffense and stop you on defense. That'swhat we try to live on."
There will be plenty of new faces for theGermantown team this year. Three-yearstarting quarterback Dwayne Lawhorn, Jr.graduated and Davis said he wasn't set onthe personnel for the position.
"We've got guys that played," Davissaid. "We (don't have) an overabundanceof experience, that's what we're going tohave to make up for this year. But we'll getthere."
He added that "there's been guys wait-ing in the wings" for the opportunity. I thinkthey're ready to go."
The program also remains strong withthe number of participants, as there are 60players on the varsity squad and 130 play-ers in the overall program.
The team will be tested right away, asthey play at Kenosha Indian Trails Aug. 21and host Waukesha Catholic Memorial thenext week before beginning North ShoreConference play. Davis said the teamcame into practice prepared, as severalplayers participated in 7-on-7 competitions.
Davis indicated that the schemes onoffense and defense will likely remain thesame.
“We are what we are. We have a our
base system offense, we are flexibleenough to adapt within our system. I wouldexpect the same Germantown football,"

A new season will feature a newoffense for Menomonee Falls football.
During an Aug. 11 interview, CoachDan Lutz said the team has a "totally newoffense" along with changes to the specialteams.
Lutz moves in the head coach positionafter serving as an assistant with the pro-gram for the past three years. Lutz was ahead coach at Brookfield Academy for fiveyears prior to coming to the Falls program.
"It's been a real good transition,"Lutzsaid.
Starting quarterback Bryce McMurtryreturns and is accompanied by a new set ofreceivers. Three linemen return and thedefensive back return.
"It's a combination (of new and return-
ing starters) on both sides of the ball," Lutzsaid.
Falls has a numbers advantage for itsprogram, as Lutz noted he had to ordermore helmets for this season. There are 87players on the varsity and junior varsitysquads. Lutz said tradition and a largernumber of seniors coming out for the pro-gram are part of the reasons for the largenumber of players.
While much is new, a first goal remainsthe same.
"Our first goal is always to make theplayoffs," Lutz said. "Do well, get a winningconference record, that's goal number one(which will qualify the team for the play-offs). Then after that, we'll see."
Lutz said his team "will be aggressive,we'll play with our heart and we'll playwith guts."

"A mainstay of this program has beenour weight room and it has kept us com-petitive and it's getting us opportunities tobe successful," Damato said. "The seniorsdid an outstanding job of holding theirteammates accountable and we're hopingit's going to pay off."
The program has also held its own in
the number of players out for the program.There are around 43 players on the fresh-man teams while the youth program thatprecedes high school play is at the highestlevel in many years. There are around 65players on the varsity roster.
The offense continues to be the Wing Twith the play action pass while defensiveschemes remain the same. Damato said thespecial teams is "ahead of schedule."
This year's team returns three starterson offense and six starters on defense.
"We have some inexperience but we
have some great attitudes and some kidswho are competing day in and day out fora position," Damato said. "Going into thescrimmage (at Waukesha West Aug. 14)should tell us a lot about who we have mov-ing forward. I don't think I've ever gone intoa scrimmage with so many question marks,but at the same time in saying that it's not abad thing -- it's all about competition andthere's opportunity there with those ques-tion marks. The kids understand that."
Heading into the Waukesha Westscrimmage, Damato now has the advan-tage of the turf surface in the school's new
athletic center."It nice having both (turf and natural
grass fields), we've never had both. This isnew for us," Damato said.
For all the change, this season Damatosaid Hamilton will seek to produce itsbrand of hard, physical football.
"If the kids come and continue to workday in and day out, they're going to putthemselves in a position to be successfuland compete for every game," Damatosaid.
