The Mendocino Transit Authority (“Owner”), will accept State-ments of Qualifications (“Statements”) for professional design services of its Solar Canopy Project (“Project”), by or before Tuesday, August 14, 2012, at 3:00 p.m., at its Administrative Of-fice, located at 241 Plant Road, Ukiah, California, at which time the “Statements” will be publicly opened and read aloud. Owner reserves the right to reject any and all “Statements” and to waive any non-substantive irregularities.

Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.

When a client says they will ‘take our word for it’ there is no greater compliment. With more than 30 years assisting contrac-tors at Capitol Services we know the greatest measure of suc-cess is satisfied customers. It’s just one of the reasons contrac-tors often come back with another question knowing they will find an answer…

Q: I used to work for our local Builder’s Exchange and because of that, I know you’re the right person to address this question to: If a contractor is using their last name as their business name – “Smith Construction Company” owned by John Smith - is a fictitious busi-ness name statement required?

A: I looked up the individual you are referring to and he is licensed under the company name of “Smith Construction Co”. The CSLB does not require proof that he has a fictitious business name on file; however, we suggest that he file a dba with the city or county where he is doing business.

Q: You helped us get our license in CA, NV, and AZ and we’ve had an issue come up recently. We have re-structured our corporation and ownership has shifted. Are we required to inform the Contrac-tors Board or file something with the Secretary of State’s offices to inform them of the change?

A: Nice to hear from you again. You’re not required to inform the CSLB or the Secretary of State of your ownership changes. How-ever, if officers have changed, then you should update both the Con-tractor’s Board and the Secretary of State in all three states. Please note that ownership changes may affect tax liability so we suggest also conferring with a tax specialist.

Q: At a school in the State of Nevada, a 1 sq ft of possible ACM drywall/joint compound was removed without a contractor’s license for abatement; can they be cited for that? Isn’t non-regulated asbes-tos less than 10 sq ft?

A: The Nevada Statute that deals with your question states that if a licensed contractor who is engaging in activity for the abatement of asbestos has not obtained a contractor’s license, which is classified

for the removal of asbestos (sub-classification A-23), the licensed contractor may not: “Remove more than 25 linear feet or 10 square feet of asbestos-containing material, as defined in 29 C.F.R. 1926.1101(b)”

Q: I just purchased a company, which provides construction mate-rials to contractors. The company never had a contractor’s license and I was told they did not require one. Now a contractor who wants to use our materials says he thinks I should be licensed and does not want to accept my bid unless I can prove whether a license is required. He has read your column for years and said he’ll take you at your word to settle this issue. Do I need a license?

A: Based on our discussion, it does not appear your company is required to hold a contractors license since you’re only supplying these materials. To cite ‘chapter and verse’ in the B&P Code, 7052 states a contractor’s license is not required for any person “who only furnishes materials or supplies without fabricating them into, or consuming them in the performance of the work of the contrac-tor”

Workers’ Comp Reform Package To Be Released Next WeekAny contractor paying for workers’ compensation for his/her employees knows the roller coaster ride that rates have been on over the past several decades. Indeed, things were so bad that then Governor Arnold Schwarzenegger, as one of his first major actions as governor back in April of 2004, approved a major reform package which dramatically reduced rates. As is par for history of the system in California, the savings achieved in the reform package have slowly but surely been whittled away over these past eight years. So too, there have been some serious flaws or other needed improvements in the 2004 reform package that needed to be addressed. One of the most contentious has been the permanent disability (PD) payments provided to injured workers. While the unions have pressed for payment increases and study after study have supported that “tweaks” needed to be made, nothing has changed.

While the Schwarzenegger Administration “held the line,” it seemed apparent that a union-friendly Brown Administration would change all that. To the current Administration’s credit however, starting with last year’s “batch” of bills, Governor Brown has vetoed virtually all of the proposed cost driver bills stating that without meaningful offsets to the proposed cost drivers, he would not sign any of them.

Segue to 2012. There have been again myriad cost-driver bills that were introduced; however, most have fallen out by way of the legislative process. During this year there have also been rumors that the governor’s workers’ comp point person, Christine Baker who is the Director of Industrial Relations, was working behind the scenes to craft a meaningful workers’ comp reform package. Christine’s work was intended to address the PD benefit payments, along with several other savings offsets that would result in a win-win for both sides (translated to mean help to the truly injured workers without further burdening already struggling

employers).

Although the exact wording of the proposed reforms has not been released yet (it is supposed to be contained in a “gut and amend” bill next week), I do know some of the generalities of the package which were contained in a “scoop” article in The Workers’ Comp Central this morning that support what I have been told. Here are the highlights:

• The reforms would shave $1.4 billion in system costs through provisions, such as eliminating adjustments for age and future earning capacity in calculating permanent disability awards, implementing fee schedules for outpatient surgery centers, interpreters and copy services, and requiring all medical disputes go to independent medical review panels.In return, injured workers would get $700 million in increased permanent disability benefits. In some cases, permanent disability benefits would be increased by 67%. A 47-year-old worker with a significant shoulder and upper extremity injury and a 44% whole person impairment would receive an award of $88,000 under the proposed changes, compared to $52,670 under the current Permanent Disability Rating Schedule.The same worker with a 20% whole person impairment would be entitled to a $40,000 award, compared to $33,130 under the current system.in exchange for the increase in award, there will be no future earning capacity modifier, no adjustments for age and no sleep, sex or psyche add-ons. The 15% bump up/bump-down would also be eliminated.

• Other provisions on the cost-savings side include a transition to an Official Medical Fee Schedule that uses Medicare’s Resource-Based Relative Value Scale (RBRVS), instituting a $150 lien filing fee and requiring that liens be filed within 18 months of service. Reforms would also add language saying any medical provider network approved by the administrative director of the Division of Workers’ Compensation is presumed to be valid and that failure of notice is not sufficient for a worker to seek treatment outside of the network.

• Another change would add to the Labor Code a new section requiring all disputes over treatment, surgery or prescriptions to go

to independent medical review (IMR). The review process would not involve a physical exam and require a 30-day turnaround. The independent review decision would be adopted by the administrative director as the decision, and the only grounds for appeals would be fraud, bias or conflict of interest.

• IMR decisions would have to be based on evidence-based treatment guidelines.

• The employer would pay a flat fee of less than $500 for the independent review, but would not be liable for any self-procured treatment before there is an IMR evaluation.

• The reform proposals would also address the recent Valdez decision by stating that a self-procured medical report can’t be the sole basis of an award for compensation, but issues raised in the self-procured report must be addressed by either the primary treating physician or a qualified medical evaluator. To address concerns over medical control, the reform proposal would state that an employer must be granted an expedited hearing within 14 days if an employee seeks treatment outside of a medical provider network. New language would also say that a network is presumed to be valid if it is approved by the administrative director.

• Reforms would also add language stating that an employer’s failure to provide notice of the network “shall not be a basis for the employee to treat outside the network unless it is shown that the failure to provide notice resulted in a denial of care.” If a worker is not entitled to treat outside the network, the employer will be absolved of liability for the treatment or its consequences.

• Medical provider networks will be required to provide a “medical access assistance” service to help injured workers get treatment and appointments.

• Proposed billing and system reforms would require billing disputes go through an independent bill-review process that is set up and contracted by the Division of Workers’ Compensation. Providers would have a limited time to object to billing adjustments and there will be a limited right to appeal any bill-review decisions.

• Liens would have to be filed within 18 months from the date of service under the reform proposal, and no lien could be filed unless a bill was submitted first. The bundling of liens would also be prohibited, and a $150 lien filing fee would be instated.

The proposal would create new fee schedules for outpatient surgery centers, home health care and copy services. In addition to a fee schedule,

interpreters would also have new licensing requirements under the proposal.

Under other provisions of the proposal:1. QMEs would be limited to 10 locations to prevent so-called phantom

QMEs operating out of hundreds of offices.2. Employers will select and pay for transportation, limited to 70 miles

from the injured worker’s home or county of residence.3. Entities other than claims administrators will be prohibited from

owning ancillary services. For example, an applicants’ attorney can’t own or have an interest in a copy service.

4. The requirement of obtaining a second opinion for spinal surgery is eliminated.

5. Interpreters would have to be certified by Division of Workers’ Compensation and would have to pay a fee to the division for that certification.

I will report back in next week’s update with what I receive in terms of specifics from Christine on the proposed reforms. Although there should be “lots” of support for these proposed reforms, remember that workers’ comp is a “cash cow” for special interests who have literally “raped and pillaged” the system at the expense of employers and injured workers. With the Legislature’s session due to close on August 31st, there is not a lot of time to get this package done, particularly since there is no doubt that the special interests who will lose the most from these proposed reforms will be throwing out the “heavy hardware” in an attempt to kill the package.

These are the types of battles I love to fight, especially since you the employers, will be on the “right” side!!!!

On Another Front With Christine Baker - The Underground EconomyAs The Director of the Department of Industrial Relations, Christine Baker oversees everything from the Labor Commissioner to all of the programs and departments battling the underground economy that has been crippling all of you who continue to “play by the rules” during these incredibly tough economic times. Christine has asked me to serve on an advisory committee that is being created to come up with new and creative ways to fight the underground economy. I will be traveling to Oakland next Wednesday, August 15th to participate in the committee’s first meeting. Following is the body of her invitation letter to me:August 6, 2012

LETF hopes to foster partnerships in the community to develop successful lead referrals. Additionally, LETF is aware that it takes more than enforcement to fight the underground economy, which is responsible for an estimated $12 billion tax gap in California. LETF would like to undertake a statewide educational campaign for workers and employers about their rights responsibilities, and we would like your ideas.

We anticipate that the commitment involved in serving on the advisory committee will include an initial meeting and perhaps one additional follow-up meeting after a strategy has been developed. Details of the initial meeting:

CARB Advisory Regarding U.S. EPA Authorization to Enforce the In-Use Off-Road Large Spark-Ignition Engine Fleet RegulationThis notice is to inform Large Spark-Ignition (LSI) equipment operators of the Air Resources Board’s (ARB) intent to commence enforcement of all requirements of the In Use Off Road Large Spark-Ignition (LSI) Engine Fleet Regulation (LSI Fleet Regulation or Regulation). The regulation was filed with the California Secretary of State in May 2007, at which time the requirements of the LSI Fleet Regulation came into effect and were fully enforceable except for those parts of the Regulation that required United States Environmental Protection Agency (U.S.EPA) authorization under the federal Clean Air Act. U.S. EPA granted California authorization on April 4, 2012. With the issuance of this authorization, those provisions are now enforceable as well. ARB anticipates that it will commence the enforcement process slowly, initially auditing a small number of facilities for training purposes. Full scale enforcement will commence following the completion of training near the end of this year.

Background

On May 25, 2006, ARB adopted the In-Use Off-Road Large Spark-Ignition Engine Fleet Regulation (LSI Fleet Regulation or Regulation). The LSI Fleet Regulation establishes fleet average emission level standards for operators of in-use fleets of forklifts, industrial tow tractors, industrial sweeper/scrubbers, and pieces of airport ground support equipment (GSE) powered by LSI engines. The Regulation also establishes recordkeeping requirements. Under section 209(e)(2) of the federal Clean Air Act, California may enforce its own emission standards and other requirements related to the control of emissions from off-road engines and equipment not conclusively preempted by section209(e)(1) – new locomotives and engines and new off-road engines less than 175 horsepower used in farm and construction equipment and vehicles – so long as it first applies for and receives authorization from the Administrator of U.S. EPA. Avoid Heat Illness When it is hot outside, your body temperature can rise to dangerous levels. Normally, your body cools itself through sweating. However, in hot and humid weather, sweating is not enough and the result can be a heat illness. Staying Cool Follow the suggestions below to stay cool when working in hot weather: • Wear loose, light-colored clothing and

some type of hat. • Adapt to working in hot conditions

gradually, especially if performing strenuous tasks.

• Take breaks in the shade when possible, and remove any outer protective gear you may be wearing.

• Avoid overexerting yourself during peak temperature periods (midday).

• Drink liquids frequently, even if you don’t feel thirsty - at least eight ounces every 20 to 30 minutes. Choose water, fruit juice or sports drinks and stay away from liquids containing caffeine, which can dehydrate you.

Recognizing the Symptoms There are three forms of heat illness, each with its own distinct symptoms: • Heat Cramps – severe muscle spasms

in the back, stomach, arms and legs, which are attributed to the loss of body salt and water during periods of heavy perspiration

• Heat Exhaustion – heavy sweating, cool or pale skin, nausea, headache, weakness, vomiting and fast pulse

• Heat Stroke – high body temperature, sweating stops, red and often dry skin, rapid breathing and pulse, headache, nausea, vomiting, diarrhea, seizures, confusion or unconsciousness

Providing Treatment It is essential to treat heat illness as soon as possible. If you are feeling any of the above symptoms, inform a co-worker and ask for help. If you suspect that a fellow worker has any of these conditions, follow the first-aid suggestions below: • Heat Cramps – Move the victim to a

cooler area and allow them to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Exhaustion – Move the victim to a cooler area and keep them lying down with their legs slightly elevated. Cool their body by fanning and applying cool, wet towels. If conscious, allow the victim to drink approximately six ounces of water every 15 minutes. Follow up with a medical examination.

• Heat Stroke – You or a bystander should immediately call an ambulance. Meanwhile, move the victim to a cooler area, remove their outer clothing, immerse them in cool water or apply cool, wet towels or cloths to the body. Do NOT give them liquids. If medical help is delayed, call the hospital for further instructions while waiting. Heat stroke is life-threatening, so it’s important to move quickly!

Safety Reminder The risk of heat illness increases with age, poor diet, being overweight, insufficient liquid intake, poor physical condition and/or when taking medication. Never take salt tablets without your doctor’s approval. Be aware of weather conditions when you will be working outside so that you can be prepared with appropriate clothing and beverages. If you are working outside and start to feel any adverse symptoms, inform your supervisor and take a break.

Heat illness can be a serious threat. Your best defense is to learn how to stay cool when the weather heats up.

Evite la enfermedad por calor Cuando hace calor afuera, la temperatura de su cuerpo puede aumentar a niveles peligrosos. Generalmente, su cuerpo se refresca solo mediante la transpiración. Sin embargo, en un clima caluroso y húmedo, la transpiración no es suficiente y el resultado puede ser una enfermedad por calor. Mantenerse fresco Siga las sugerencias a continuación para mantenerse fresco cuando trabaje en un clima caluroso: • Use ropa floja, de colores claros y algún

tipo de sombrero. • Adáptese a trabajar en condiciones

calurosas gradualmente, en especial si realiza tareas agotadoras.

Suministro de tratamiento Es esencial tratar la enfermedad por calor lo antes posible. Si siente algunos de los síntomas anteriores, infórmele a un compañero de trabajo y pídale ayuda. Si sospecha que un compañero de trabajo tiene alguna de estas condiciones siga las recomendaciones de primeros auxilios que presentamos a continuación: • Espasmos por calor: mueva a la víctima a

un área más fresca y dele de beber aproximadamente 6 onzas de agua cada 15 minutos. Prosiga con un examen médico.

• Agotamiento por calor: mueva a la víctima a un área más fresca y manténgala recostada con las piernas levemente elevadas. Enfríe su cuerpo abanicándolo y aplicando toallas húmedas frías. Recordatorio de seguridad El riesgo de enfermedad por calor aumenta con la edad, la mala alimentación, el sobrepeso, la ingesta insuficiente de líquidos, la mala condición física y/o la medicación. Nunca tome píldoras de sal sin la aprobación de su médico. Esté atento a las condiciones climáticas cuando trabaje al aire libre para poder estar preparado con la ropa y bebidas adecuadas. Si se encuentra trabajando al aire libre y comienza a sentir algún síntoma negativo, infórmele a su supervisor y tome un descanso.

La enfermedad por calor puede ser una amenaza seria. Su mejor defensa es aprender a mantenerse fresco cuando el clima se pone caluroso.
