One day around 3:30 I randomly passed by the Marin Builders Association, knowing nothing about it I decided to take a peek. I walk in and the lovely lady at the counter says:”Oh, you’re early” I say: “For what?”“The party doesn’t start till 4” she tells me. I leave for a bit and come back a little after 4.

Apparently I stumbled upon a new member meet-n-greet. It is funny how things happen like that. The catering looked first class with good wine to boot; already starting to like this place I thought to myself. I talked to a few people and asked some questions to get a better under-standing of what the MBA was all about. Everyone was very nice. Before I left I tossed my business card in a bowl. A few days later I received a call telling me that I had won a free one-year membership. I would like to express a sincere THANK YOU! to the MBA staff; it has been a pleasure to meet you.

About me: I am the sole owner of John Romaidis Construction. Primarily my projects consist of residen-tial remodels.I am the classic example of working through the ranks. Starting as a laborer, moving on as an apprentice carpenter, then a journeyman, and receiving my Contractors license in 2002…I still throw on my tool belt once in a while.Over the years, I had the good fortune of having some very skilled carpenters take me under their wings and teach me the trade. An eagerness to learn, an appreciation for craftsmanship as well as working on high-end projects most of my career certainly helped me climb that ladder. Although the work is hard I am truly grateful for the opportunities that have been given to me.

Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.

Does a “C-10” need Worker’s Comp if he hires a contract ‘installer’? CA offers a ‘family waiver’ but what about Arizona or Nevada? John Lennon is credited with saying ‘life happens while you’re making plans’, and our first contractor is discover-ing that. The government bureaucracy isn’t required to keep your address up to date, you are. Failing to do so can have some serious consequences…

Q: I noticed this morning that my license has expired. We have jobs going right now under contract with this license. Since we did not receive this renewal in the mail, I asked our Responsible Managing Officer (RMO) to contact you so we could get a copy of the renewal application and hopefully get it posted before it expires. He assured me he had a plan to overnight it to you and you would run it over to CSLB in time. Looks like it didn’t happen. Do I need to stop all work under contract until this gets fixed?

A: We talked with the RMO regarding this issue; however, the re-newal was not sent through our office. We picked up a copy of the renewal application at the CSLB and emailed it to your Qualifier. He called a few days ago to say that the renewal was inadvertently sent overnight directly to the CSLB (and he did not retain a copy). Since, we did not have a chance to review the document before sub-mission, I cannot say if all items were correct. Unfortunately, since the license now shows “expired”, you technically should stop all work until the license is back in good standing. Assuming there are no problems with the renewal (i.e. proper signatures/fees, corporate status), it should be processed soon. If there is an issue, the CSLB will reject the application, send a letter detailing the problem, and require payment of a delinquent fee.

Q: I was wondering if I could get an answer to a question about Worker’s Compensation. If a “C-10” license holder hires an instal-lation company to come in and do a particular job, and that com-pany does not have a license, is it the responsibility of the “C-10” license holder to provide Worker’s Compensation Insurance? Or is it the responsibility of the unlicensed company to carry it? Thank you for your time. I look forward to hearing back from you.

A: Generally speaking, if you hire someone it’s ultimately your responsibility to make sure they’re covered by Worker’s Compensa-tion. If they are covered through another licensed contractor, this is fine. However, since UNLICENSED “contractors’ rarely cover their employees, if someone gets hurt, they’re probably going to come after your insurance.

Q: My father recently retired and I was able to replace him on our CA license with a waiver of the exams. I have worked for the com-pany for over 15 years. We need to do this same process for our Nevada and Arizona licenses; can you help with that?

A: We would be happy to help you with the application process in Nevada (NV) and Arizona (AZ); however, while CA allows individuals who are a close family member (son, daughter, spouse, etc.) to waive the exams, NV and AZ aren’t as generous with grant-ing these waivers. The only way either State will grant a waiver is if you’ve been listed as the Qualifier on a NV or AZ license within the last 5 years, or if you have been licensed for at least 5 years and have passed an equivalent exam in CA or UT. In other words, these states do not have a “family waiver” option.

Also In This Update• Attention Contractors! Off-Road Equipment Regulation Training Dates Set by CARB

The Correct Approach to Combat the Underground EconomyWe all know that the “Underground Economy” is killing many legitimate businesses in and around the state. While legitimate contractors do everything “above boards” by reporting all payments made to an employee, paying workers’ compensation and so on, the “Underground Economy” of both licensed and unlicensed contractors pays their employees with cash “under the table,” doesn’t pay workers’ compensation and does everything else that they can get away with to avoid paying “their fair share” of the burden. In an effort to combat this serious problem (which is estimated to be as large as $120 billion in California alone!), we are continually working with the Contractors’ License Board, the Department of Insurance, the Department of Industrial Relations, the Labor Commissioner, the Employment Development Department, Franchise Tax Board, Board of Equalization and many other state and federal agencies to “level the playing field” through new legislation as well as through regulations.

Admittedly, SOME well-intentioned laws or regulations have ended up “biting” the legitimate contractors while the “dirt bags” (my description) continue to thrive without bothering with the new burden. Having seen how the best of intentions can come back to haunt us, I have become much more skeptical of creating new laws and regulations and instead continually seek to find new ways of better utilizing existing laws and regulations.

A “text book” example of this applies to a bill that the Laborers introduced earlier this year. AB 1794 (Williams) was introduced in late February and originally would have required that all employers hiring new employees to file a new form with their workers’ compensation carrier within 20 days (the original bill said 15 days but that was then amended to 20) alerting them to the new hire. The logic was that if the contractor were audited

at the end of the year and it was learned through the audit that a contractor employed more workers than he reported, it would be a violation of the law that would be reported back to the Contractors’ Board, et al.

After talking this bill “out” with many of you and with several of my colleagues, I determined that this would become a new law of unintended consequences against honest contractors. So, back to the “drawing board” we went to meet with the Laborers to “re-craft” this bill.

I’m happy to report that I believe that we have found a much better solution to accomplish the same goal, but without further burdening legitimate contractors. Under current law, all employers are required to file a notice with the Employment Development Department (EDD) within 20 days of employment of new hires either by submitting a copy of the employee’s W-4 form, a form provided by the department, or any other hiring document transmitted by first-class mail, magnetically, or electronically. The original purpose of this requirement was for unemployment insurance purposes which EDD administers.

Since this form is already being filed, it would only take authorization through legislation allowing EDD to share this information with the Joint Enforcement Strike Force on theUnderground Economy (which consists of the previously discussed departments such as the Contractors’ License Board et al). This way when they are performing investigations, they can quickly access the filings through EDD to ascertain if the contractor was reporting his employees properly or not. If there’s a void in the reporting from a contractor, the dirt bag gets nailed which hopefully translates into one less illegal competitor to deal with in the future. Oh, and to make sure that this new law goes as planned, I requested (and just received from the Laborers) the ok to put a 4 year sunset on the law. This way, it officially dies in 4 years if things don’t work out as planned.

Tips for Teens in Construction The construction industry ranks third in the number of work-related youth fatalities, but you can help lessen or even eliminate this statistic by paying attention to all safety guidelines. The Basics

• If you are younger than15, you cannot work on construction sites by law.

• Make sure you have clear instructions on each and every task. If you do not understand, ask someone before beginning.

• Never perform a task you have not previously been trained to do.

• Trust your instincts about dangerous situations.

• Never work alone. • Make sure your personal protective

equipment (PPE) is properly sized. • Always work under proper supervision. • Stay sober and drug-free. • Try to familiarize yourself with the

federal and state youth employment laws; a good resource is the Department of Labor (www.dol.gov).

Prohibited Jobs Certain jobs are declared hazardous by the Fair Labor Standards Act (FLSA) and are therefore prohibited for youth under age 18. Specifically relevant for construction workers are:

• Driving a motor vehicle • Operating power-driven woodworking

machines (including drills and nail guns) • Operating forklifts, cranes, hoists or

elevators • Operating power-driven circular saws,

band saws and guillotine shears • Wrecking, demolition and shipbreaking

operations • Roofing operations • Excavation operations

Know the Hazards There are six main hazards you need to be aware of in the construction industry:

• Machines and tools – Moving machine parts have the potential to cause severe injuries. Any machine part, function or process that may cause injury must be safeguarded. Teens under age 18 should not be using this equipment, but it is important to be aware of the dangers regardless.

• Confined spaces – There are many instances in which workers must squeeze in and out of narrow openings and perform tasks while cramped or contorted. Suffocation is a main concern when doing these jobs.

• Electrocution – Overhead power lines are a main concern when working in construction. They carry tens of thousands of volts of electricity. Certain equipment (such as aluminum paint rollers or metal ladders) conducts electricity and can be fatal.

• Falls – Falling is the most common cause of death for construction workers. Fall protection is vital when working at heights above six feet.

• “Struck-by” – The second most common cause of death is being struck by an object or vehicle. It is important to pay close attention to alarms and horns when on the job.

• “Caught-between” – Be sure to stay alert when working around any large objects that might move. Being crushed is a scary but very real hazard on a construction site.

Before beginning any job, make sure that you understand the proper safety procedures and policies on the job site. Your supervisor can answer any questions you may have. Safety should always be your top concern.

You may work to earn spending money, buy a car, save for college or gain work experience. Whatever the reason, plans for your job and for your future don’t include you getting hurt.

Empleos prohibidos Según la Ley de Normas Laborales Justas (Fair Labor Standards Act) algunos trabajos son declarados como peligrosos y, por consiguiente, están prohibidos para los jóvenes menores de 18 años. Lo siguiente es específicamente pertinente a los trabajadores de la construcción:

• Conducir un vehículo • Operar máquinas eléctricas para trabajos de

carpintería (incluidos los taladros y las pistolas de clavos).

• Operar carretillas elevadoras, grúas o elevadores.

• Operar sierras circulares eléctricas, serruchos de banda y guillotinas.

• Realizar operaciones de demolición y desguace.

• Realizar operaciones de techado. • Realizar operaciones de excavación.

Conocer los riesgos Existen seis riesgos principales que debes tener en cuenta en la industria de la construcción:

• Máquinas y herramientas – Las partes de máquinas en movimiento tienen el potencial de producir lesiones graves. Cualquier parte de máquina, función o proceso que puede producir lesiones puede estar protegida. Los adolescentes menores de 18 años no deben usar estos equipos pero, independientemente de ello, es importante conocer los riesgos.

• Espacios reducidos – Existen muchas instancias en las que los trabajadores pueden entrar y salir de aberturas estrechas y realizar tareas mientras están restringidos o retorcidos. La sofocación es la principal preocupación al realizar estos trabajos.

• Electrocución – Las líneas de alto voltaje que se encuentran en lo alto implican una importante inquietud al trabajar en la construcción. Estas líneas tienen decenas de miles de voltios de electricidad. Determinados equipos (como los rodillos de pintura de aluminio o las escaleras de metal) conducen electricidad y pueden ser mortales.

• Caídas – Las caídas son la principal causa de muerte para los trabajadores de la construcción. La protección contra caídas es muy importante al trabajar en alturas superiores a los seis pies.

• “Golpes accidentales” – La segunda causa más común de muerte es ser golpeado por un objeto o vehículo. Es importante prestar mucha atención a las alarmas o bocinas al trabajar.

• “Atrapamiento” – Asegúrate de estar alerta al trabajar en torno a objetos de gran tamaño que podrían moverse. Ser aplastado es un peligro atemorizante pero muy verdadero en las obras de construcción.

Antes de comenzar un trabajo, asegúrate de entender los procedimientos de seguridad adecuados y las políticas del lugar de trabajo. Tu supervisor puede responder las preguntas que tengas. La seguridad siempre debe ser tu principal preocupación.
