HUDSON STREET DESIGN OF MARIN

While Hudson Street Design of Marin may sound like a new member of the Marin construction industry, it actually is really a Marin County institution and a proud member of the Marin Builders Association.

The Window Warehouse served the needs of North Bay contractors and homeowners alike for over twenty-five years. In January, 2010 Healdsburg Lumber Company (HLC Incorporated) purchased the assets of The Window Warehouse while keeping the capable and professional staff.

With the addition of a kitchen/ bath department and incorporating the services of Healdsburg Door & Sash, a full-service pre-hung door shop, The Window Warehouse needed room to grow. In January, 2011, Hudson Street Design of Marin opened its new doors in the old Breuner’s furniture store across from the Civic Center creating a state-of-the-art showroom with traditional and contem-porary kitchen and bath vignettes, commercial and residential windows from only the finest manufacturers, and customer doors that will dazzle and wow.

Hudson Street Design has quickly become the premier door, window, and kitchen/bath showroom in the Greater Bay Area with locations in Marin, Healdsburg, and the Napa Valley.

In last week’s update, I included copies of two new bills

that have been introduced which should be of interest to

most contractors. One in particular, AB 1514 (Bonnie

Lowenthal), is a bill pertaining to excavation that would

expand the entities that can bring an action of enforcement

against a violator of the existing Government Code

Section 4216 et seq, to also include the Public Utilities

Commission (PUC). I want to stress, while expanding the

law to include the PUC is certainly something that would

only serve to ‘pile on,’ the remainder of the language

within the legislation cites existing law. To refresh your

memory, current Government Code Section 4216.2 states,

4216.2. (a) (1) Except in an emergency, any person

planning to conduct any excavation shall contact the

appropriate regional notification center, at least two

working days, but not more than 14calendar days, prior

to commencing that excavation, if the excavation will be

conducted in an area that is known, or reasonably should

be known, to contain subsurface installations other than

the underground facilities owned or operated by the

excavator and, if practical, the excavator shall delineate

with white paint or other suitable markings the area to be

excavated.

(2) When the excavation is proposed within 10 feet of

a high priority subsurface installation, the operator of

the high priority subsurface installation shall notify the

excavator of the existence of the high priority subsurface

installation prior to the legal excavation start date and

time, as such date and time are authorized pursuant

to paragraph (1) of subdivision (a) of Section 4216.2.

The excavator and operator or its representative shall

conduct an onsite meeting at a mutually-agreed-on time

to determine actions or activities required to verify the

location of the high priority subsurface installations prior

to start time.

(b) Except in an emergency, every excavator covered

by Section 4216.8 planning to conduct an excavation on

private property may contact the appropriate regional

notification center if the private property is known, or

reasonably should be known, to contain a subsurface

installation other than the underground facility owned or

operated by the excavator and, if practical, the excavator

shall delineate with white paint or other suitable markings

the area to be excavated.

So how is excavation defined in the law?

(b) “Excavation” means any operation in which earth,

rock, or other material in the ground is moved, removed,

or otherwise displaced by means of tools, equipment,

or explosives in any of the following ways: grading,

trenching, digging, ditching, drilling, augering, tunneling,

scraping, cable or pipe plowing and driving, or any other

way.

Under current law, Government Code Section 4216

authorizes the Attorney General, a district attorney, or

the state or a local agency that issued a permit to excavate to bring

an action for the enforcement of a civil penalty against an operator

(utility) or excavator who negligently or knowingly and willfully

violates these and related provisions. Current law (Government Code

4216.6 prescribes the fines as:

(a) (1) Any operator or excavator who negligently violates this article

is subject to a civil penalty in an amount not to exceed ten thousand

dollars ($10,000).

(2) Any operator or excavator who knowingly and willfully violates

any of the provisions of this article is subject to a civil penalty in an

amount not to exceed fifty thousand dollars ($50,000).

Oh, and besides these aforementioned penalties, a violator can also

be cited by the Contractors’ State License Board for a violation of

Government Code 4216 as well!

One other thing you should know is the definition of excavator

according to the law:

4216 (c) Except as provided in Section 4216.8, “excavator” means

any person, firm, contractor or subcontractor, owner, operator,

utility, association, corporation, partnership, business trust, public

agency, or other entity that, with their, or his or her, own employees or

equipment performs any excavation.

Here Come the Feds

Expect to see a lot more legislative activity in this area of the law in the

years ahead. Certainly, last year’s San Bruno disaster has played a role

in this increased activity, even though the cause of the explosion had

nothing to do with excavation! Even more importantly is the fact that

the Federal Pipeline and Hazardous Materials Safety Administration

(PHMSA) published in the Congressional Record back in October,

2009 comments about perceived problems around the country with

states not enforcing better excavation enforcement standards which,

in-turn, has resulted in damage to utility lines (and to other providers’

facilities) as well as injuries or death in some instances. PHMSA

believes that much of these problems could be resolved if all excavators

(which includes contractors and utilities) notified the Regional

Notification Centers (One Call Centers) to have locations properly

marked prior to excavating.

To this end, PHMSA is seeking to encourage states to strengthen

their excavation damage prevention laws and to adequately enforce

their respective laws. Toward this goal and in response to language

included in the Pipeline Inspection, Protection, Enforcement, and

Safety (PIPES) Act of 2006 (Pub. L. 109-468), PHMSA intends to

issue criteria and procedures, through a rulemaking proceeding, for

determining whether states are adequately enforcing their damage

prevention laws, and for conducting federal enforcements if necessary.

Finally, in response to the introduction of AB 1514 and the anticipation

of possible federal action, I hosted a meeting at the Capitol last

Thursday with all of the utilities, contractor associations, legislative

staff members and other interested stakeholders (about 37 in all)

to sit down and discuss this issue in its entirety. I also invited

Assemblywoman Bonnie Lowenthal’s staff to come and give a

presentation to the group about her bill.

After it was all said and done, the group decided to leave ‘well enough

alone’ and wait for the feds to propose something instead of moving

forward with legislation this session. It was felt that anticipating what

the feds might expect in state legislation would be premature at best.

Oh, and almost everyone in the meeting “hated” the idea of the PUC

becoming involved. Stay tuned!

Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc.

Abe Lincoln first wrote about fooling some of the people all the time and all the people some of the time. About the only person who can ‘fool’ you any-time is…you. When you seek out advice going to the source is the best way to learn. However, some people get ‘fooled’ by ignoring the facts to hear what they want to be true… I regularly visit The Contractor’s Board Headquarters in Sacramento. While hand-delivering applications for cli-ents, I often overhear discussions taking place between contractors and CSLB staff. Sometimes these discus-sions also take place among contractors waiting in line. On a recent occasion, one contractor conversed with both and herein lays the question: When should I listen to the CSLB and when is it advisable to instead listen to the fellow contractor? In this particular case the person at the public counter gave the contractor correct information. The question related to an unsolicited mailing the contractor received promising a waiver of the license exam. The skeptical contractor was rightly told what was required; when he can make application and what the law is regarding an exam waiver. Yet, not two seconds later, he begin talking to another contractor in receipt of the same letter who basically told the first contractor to ignore everything he was just told by the CSLB employee. As contractor #1 is exiting the building he thanks contractor #2 for “all the great information” and tells him he’ll go with his suggestions. The problem as “contractor #1” will soon discover, is that by listening to “contractor #2” his application and request for a waiver will almost certainly be denied. The CSLB is not perfect; they have been known to make errors; however, beware the contractor who is sure they have all the answers. In my many years assist-ing the construction industry, I cannot count the times

I’ve heard the words: “A contractor friend of mine told me….” only to learn they were given incorrect informa-tion. Q: I am familiar with a contractor who is renting his license to a company however, I don’t think he’s the least bit involved with any of their projects. I know this because he tried to recruit me to do the same thing. He told me there are a few agencies on the Internet that line up Responsible Managing Officer’s (RMO), and set them up with contractors that may not otherwise qualify for a license. Is this legal? This contractor has his own active license and I know he uses it daily. Aren’t RMO and RME qualifiers supposed to oversee the contract? How can the CSLB let contrac-tors get away with this? A: Contractors can qualify more than one license at a time if they own at least 20% of each entity. This would explain how this contractor could qualify as a RMO yet continue to use his own personal license. If he owned less than 20%, the State would have required that his license be inactivated. This inactivation would be re-quired in almost all instances if he were a RME. I believe the vast majority of qualifiers are legitimate; however, “renting” a license in the way you describe does happen. The CSLB is aware that some contrac-tors are likely abusing the system and I believe they are investigating. You may want to pass this information on to the CSLB who can determine if the arrangement is allowed. While knowledge is power, knowing where to go for the answers is half the battle. Working from a boom lift or cherry picker comes with its share of potential hazards. These risks are compounded when you add power lines to the mix. Electrocution from contacting power lines is responsible for nearly half of all boom lift-related deaths. When performing electrical work with a lift, it is extremely important that you use the proper precautions to keep yourself and those around you safe from unnecessary injury.

Basic PrecautionsIn any situation where a boom lift or cherry picker is used, there are some basic precau-tions to keep in mind:• Test the lift controls each day prior to use to ensure that they are in the proper working order.• Wear a body belt as part of a tether-ing or restraint system with a lanyard attached to the boom or basket.• Do not exceed the boom and basket load limit set by the manufacturer.• Never climb or sit on the sides of the basket; always keep your feet firmly planted on the floor.• Avoid sudden, jerky movements that could cause the basket to collide with nearby objects, such as power lines.

Proper Protective EquipmentWhen working on or near lines, use the fol-lowing personal protective equipment:• Insulated hard hat• Voltage-rated shoes • Rubber gloves and sleeves• Insulated tools

Insulated BucketsBoom lifts designed for electrical work have

additional insulation to protect against electri-cal currents. However, the insulation may only protect certain parts of the lift.• A basket liner only protects the por-tion completely covered by the liner. Conduc-tive materials that extend beyond the liner can conduct electricity, rendering it ineffective. Most buckets have a small section at the top (which should be noted by the manufacturer) that uses metal for support and is not insu-lated.• Never try to modify or alter the insu-lation on a basket. It could reduce its level of protection.

When Working From the GroundWhile a majority of the dangers involved with boom lifts come from working in the basket, workers on the ground are also at risk for in-jury. To stay safe when working below or near a lift, keep the following in mind:• Watch for falling objects when the boom is directly overhead.• Avoid making unnecessary contact with the vehicle. If the operator in the bucket makes contact with a power line, electricity could be conducted through the lift.• Always be conscious of the boom’s movements. Alert the operator if you see potential hazards.• Do not operate the boom from the ground unless there is an emergency.• If performing work near a road way, make sure that traffic is properly directed away from the lift. Collision with the lift can eject the operator from the basket or force the basket into nearby power lines.• Be ready to respond in case the operator gets into trouble.
