“Well, Mrs Bloggs, the trouble is that surveyors are such pessimistic littlepeople that they always seem to manage to find something wrong.” Thisremark was made by an estate agent to a disgruntled vendor client whoseperception was that the sale of her house had been jeopardised by anunfavourable survey report commissioned by her purchaser. To a point, theobservation is fair enough but perhaps it would seem less condemnatoryof surveyors if ‘pessimistic’ was replaced by something like ‘realistic’. Ifthere is such a thing as a perfect property, one has yet to meet the surveyorwho actually inspected it. The fact is that there is always something eitherwrong now or which could give trouble in the future. This should notsurprise because – amongst other things - houses are built in often porousmaterials which expand and contract differentially on moisture/temperaturechanges and because nature’s plants and creatures are forever fighting forliving space and food sources (and houses provide plenty of opportunitiesto these hungry cohabitants).

Even if whoever said that house purchase is for most people the largestmonetary commitment of their lifetime probably didn’t have any children, intruth house purchase is generally an expensive enough business. It isprobably self evident that if you know nothing much about, say, cars itcould be prudent to have someone who does to check out an intendedsecond hand car purchase and surely the same argument is valid for housestoo. If the argument should be extended to consideration of whether ornot to have children is beyond the scope of this paper.

A surveyor inspecting a house will report in detail commensurate withinstructions received. Thus, if undertaking a mortgage inspection on theinstructions of a Bank or Building Society lending money to the buyer, thesurveyor’s primary concern is in the market value of the security. So far asstructural issues are concerned, the surveyor owes a legal duty of care tothe buyer (as well as to the client Bank) to notify of major structural defectswhich an ordinarily competent surveyor (distinct from an ordinarilycompetent anything else) undertaking such an inspection might be expectedto discover. This means that unless there is a big and obvious-to-a-surveyordefect then the surveyor is unlikely to report specifically on defects.

At the other end of the spectrum of inspections and costs is a Building Survey.This requires the surveyor to take the closest possible look at the property(without damaging or destroying it ) and the Report details all structuralelements of the property (eg roof, chimneys, rainwater goods, walls, joinery,loft space, floors and so on) and its environment. Defects will be identified(eg there is a crack in the wall) and comment made (eg it is not serious or itis serious and xyz is the recommended course of action). Warnings will often be incorporated (eg materials used for a particular roof covering areexpected to last for only x years and although this roof is presently watertight you should expect to have to replace within about y years).

Typically a Building Survey will comment on Services (drains, electric and gasinstallations, etc) on the basis of the surveyor’s visual inspection only butspecialist tests will be recommended where appropriate. Typically the meatof a Building Survey Report on an ordinary house will be contained in about20 pages of fairly close typed foolscap pages.

For those requiring more than a mortgage inspection from a surveyor, aBuilding Survey may be the only sensible option if the property is pre-about1850 or if it is unusually large or of unusual construction. However, about30 years ago the Royal Institution of Chartered Surveyors identified thatfor many purchasers the costs of a Building Survey might not be justifiedand so was born an intermediate level of Survey inspection known thesedays as a Homebuyers Report. The biggest difference between this and aBuilding Survey is in the form of Report with its reduced narrative andcosts. For example, a Homebuyers Report will not give dimensions,arrangements and explanation of roof rafters, purlins and struts but it will– like a Building Survey- identify if there is anything wrong and, if so, whatought to be done about it. Again, all structural elements are dealt with andServices are inspected only visually. For purchasers of flats the reality isthat a Homebuyers Report is the only practical option for a greater detailthan Mortgage Inspection Report. The main reason is that a flat occupiespart only of a building.

Are you a landlord of residential property? Perhaps you are atenant? In either case are you aware of the new rules relating totenant’s deposits? A landlord can no longer take money from atenant to hold as a security deposit unless it is covered by aTenancy Deposit Scheme (TDS).Although the Rules came intoforce more than a year ago, at Attwater and Liell Solicitors wefind that many landlords and tenants are still not aware of therequirements. Failure to comply could be very expensive indeedfor a Landlord.

A TDS is designed to:

• safeguard tenants’ deposits; and

• facilitate the resolution of disputes arising in connection withsuch deposits.

There are two different types of authorised schemes :-

1. Custodial SchemesUnder custodial schemes, the tenant pays the deposit to thelandlord who is then required to pay the whole of this amountinto a designated scheme account. The scheme administratorwill hold the deposit until it is paid to the tenant or landlord,in accordance with their agreement or following a court order,after the tenancy has ended.

2. Insurance-Based SchemesUnder insurance-based schemes, the landlord retains thedeposit and this is only transferred into a scheme if there is adispute with the tenant at the end of the tenancy. The schemewill then hold the deposit until the dispute is settled. Whenthe tenant and landlord reach agreement, the administratorwill distribute the deposit amount to the relevant party. Thescheme will need to pay the tenant regardless of whether thelandlord has transferred the deposit to the scheme asrequired. There will be a cost for a landlord to belong to aninsurance-based scheme. This fee or premium will be set bythe scheme administrator.

Both types of scheme must make available alternative disputeresolution mechanisms so that those involved can try to resolvedisputes over the return of deposits without resorting to the courts.

Any amount of money taken by a landlord from a tenant whichacts as a security deposit is covered by the new rules, even if thepayment is referred to as something different.

Landlords must:

• deal with the deposit in accordance with an authorised scheme; • comply with the initial requirements of the scheme within 14days; and • provide the tenant with the appropriate information relating tothe deposit within 14 days of receiving the deposit.

Until this is done, the landlord will not be able to regainpossession of the property using the usual ‘notice only grounds’for possession. Under Section 21 of the Housing Act 1988 alandlord can obtain an order for possession of an assuredshorthold tenancy at any point after the first six months of thetenancy, providing any fixed term has expired and they give thetenant at least two months’ written notice.

If a landlord has not arranged for a deposit to be dealt with inaccordance with an authorised scheme or provided the tenantwith the relevant information within 14 days of receiving thedeposit, the tenant can apply directly for a court order for thelandlord to repay the deposit to them or pay it into a custodialscheme. If the landlord has failed to comply with these provisionsby the date of the court hearing, the court must make the orderas requested and order the landlord to pay the applicant anamount equivalent to three times the deposit within 10 days.

Landlords of properties let to assured shorthold tenants mustmake arrangements to comply with the new rules and haveprocedures in place to ensure that deposit monies are dealt withcorrectly.

WHAT IS CHANCEL REPAIR LIABILITY Under a law originally created during mediaeval times, the Church atparish level can claim contributions from land owners to repair thechancel of the local church. This type of liability has existed unchangedsince the Reformation. The liability impacts on land in over 5,200 parishesin England and Wales and currently the liability is estimated to affect 3.5million acres of land.

LEADING CASE The liability has been highlighted under the recent House of Lordsdecision in the case Aston Cantlow v Wallbank when Mr & Mrs Wallbankwere obliged to pay a contribution in excess of £200,000 plus legal costs.Mr and Mrs Wallbank inherited their property but one field on theproperty was deemed to be “rectorial property”. This made theWallbank’s lay rectors of the local church and therefore by virtue of theChancel Repairs Act 1932 they were liable for the repair of the chancel.

LAND REGISTRATION ACT 2002Under transitional provisions Chancel Repair Liability will affect land eventhough it is not registered at the Land Registry. After 2013 this liabilitywill only impact upon new owners of registered land if it is protected byan entry at the Registry.

The Law Society is calling for the abolition of Chancel Repair Liability andits replacement with a more sensible system for funding the maintenanceof historic buildings.

Chancel Repair Liability is unsatisfactory for a number of reasons since itis difficult to ascertain the existence or extent of the liability, increases the

cost of conveyancing and is discriminatory because it only benefitschurches of one denomination

Insurance is often recommended as the solution and policies are on offerfrom most general title indemnity insurers. There are often conditionsimposed and those involved should not approach the Church whatsoeverregarding the matter and the existence of a policy should not bedisclosed. Failure to observe these conditions could invalidate the policy.

While the situation is wholly unsatisfactory and yet a further burden onthe house buying and selling process it seems to be the only way (unlessthe Government abolishes the Act) to deal with a problem which is likelyto remain with us at the very least until 2013.

One difficult issue for conveyancers is that the number of actual claims isvery small and in the leading case the actual liability was expressly referredto in the title deeds. It may be easy to explain this liability to a prospectiveowner in a rural area but it is a very difficult matter to justify to aprospective owner who is buying a flat in a built up area.
