Have you considered what wouldhappen if you, your partner or yourparents were incapacitated and unableto manage their own affairs?

This can happen for a number of reasons, the most obvious perhaps isthrough dementia or Alzheimer’s. However, anyone can be incapacitatedmentally at any age, perhaps due to brain injury caused by a road accident.

Whatever the reason, when tragedy strikes the affected persons family couldfind that they have no legal authority to deal with the bank accounts andfinances of their relative. Therefore, if for example a husband becomesmentally incapacitated, unless in joint names, his wife would not haveaccess to the funds in his accounts or his investments. This may leave herwithout money to pay household expenses etc. In a worse case scenario shemay not be able to sell the family home to move to a more suitable one.

None of us know when such an event may strike and so as boy scouts say“be prepared”

At the moment it is possible to prepare an Enduring Power of Attorney(EPA) which gives whoever you appoint, the power to act on your

behalf either now or in the future. The EPA can be restricted toprovide that whoever you appoint has no power over your

accounts and affairs now while you are healthy andcompetent. The EPA would only come into force if andwhen you became mentally incapacitated. If thishappened the EPA must be registered with the PublicGuardianship Office. But if you never become mentallyincapable, then the EPA is never “activated”

The benefit is that you can chose while you arecompetent who you wish to look after your affairs eg apartner, trusted relative or friend, if problems occur in

the future.

Once you have become mentally incapacitated you can no longermake an EPA.

At present it is a fairly straightforward process but from October2007 it will no longer be possible to create new EPAs ( existingones will still be valid)

Instead a Lasting Power of Attorney (LPA) will have to becreated. This will have two parts to it, one to cover the personsproperty and financial affairs and one to cover welfare and careneeds. A different person could therefore be appointed to cover

the different aspects of the LPA. As the formalities are morecomplex the cost of creating the LPA are likely to increase.It may therefore be worth considering arranging an EPA nowbefore these changes take place.
