Whereas,Elliott Kilgore hasbeenmarried to hiswife, Shirley,for 57 years. Theyaretheparentsoffoursons,and now haveninegrandchildren,andsix greatgrandchildren;and
Whereas,Elliott Kilgore hasbeena public servantfor Sullivan County,havingbegunwork in theSheriffsDepartmentin 1973, four months prior to his official retirementfrom the Army. Hebeganas a jailer, and worked up through the ranks becominga Sergeant,Captain, and thenadvancedto ChiefDeputy. Heretired in 1997; and.
Whereas,Elliott Kilgore continuedto be.a servantto Sullivan County by running for a CountyCommissionseatin 1998. Hewas electedand servedthreeterms— a total of 12 yearsin the 10thCommissionerDistrict. Dueto healthissues,he chosenot to run in 2010.

WI TEN[AS, the increasing costs ot’ providing the necessary services to Sullivan County residents hasincreased dramatically while revenue has not kept up with the needs; and
WHEREAS,the enactment of a Wheel Tax in Sullivan County will more fairly and equitably distributethe funding among residents rather than requiring property owners alone to hear the entire burden ofneededrevenuefor County servicesthat must he performed; and
WHEREAS, in the realizattonthat theextrarevenueis needed,we believe it to he very important that thecitizens of Sullivan County havean opportunity to make their voicesheardby addressingand making adecisionon this proposalat theballot box; and
WHEREAS, charginga Wheel Tax of $50.00 annually on commercial vehicles, $25.00 annually onpassengervehicles,and $15.00annuallyon all othervehicleswill bring in the neededrevenueto greatlyassistin funding SullivanCounty’s requiredservicesin a fair manner to all citizens.
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners of SullivanCounty, Tennessee,assembledin Regular Session,hereby requests that approval be made to, put aWheel Tax on the November2912election ballot.

BE IT RESOLVE!) by the Board of County Conimissionenof Sullivan County, l’ennesseethat:
SECFION I. The resolution of the county legislative body of Sullivan County, Tennessee,imposinga local sales and usetax as authorized tinder the provisions of TennesseecodeAnnotated,§~67—6—701 through 67-6-712, adopted by the county legislative hotly at a regular meeting of record inMinute Book Ii, page406, is amended to levy a local sales and usetax at a rate of 2.7S%2.5%,notto exceed the maximum percentage as stated in the RETAILERS TAX ACt’, Te;tnecseeCodeAnnotaled§67-6-702,asamended,exceptas limited or modified by statute.
SECTION 2. If a majority of those voting in the election required by Tenne.~seeCode Annotated§67-6-706,vote for the increasein the tax imposed by this resolution, collection of the increased taxlevied by this resolution shall begin on the first day of the month occurring thirty (30) or more daysafter the county election commission makesits official canvassof the election returns.
SECTiON 3. The Department of Revenueof the State of Tennesseeshall collect the additional taximposed by this Resolution concurrent with the collection of the state tax and the local tax nowbeing collected for Sullivan County, in accordancewith rules and regulations promulgated by theDepartment.
SECTION 4. The County Mayor is hereby authorized to contract with the flepartment of Revenuefor tbe collection of the additional tax imposed by this Resolution, and to provide in the contractthat the department may deduct from the tax collecteda reasonableamount or percentageto coverthe expenseof the administration and collection of the tax.
SECTION 5. In the event the tax is collectedby the Department of Revenue,suits for the recoveryof any lax illegally assessedor collec!edshall he brought against the stateCommissionerof Revenueand the County Mayor.
SECTION 6. A certified copy of this Resolution shall be transmitted to the I)epartment of Revenueby the County Clerk forthwith and shall be published one time in a newspaper of generalcirculation in Sullivan County prior to the election called for in Section 2 hereof.

I have some good news regarding the dental equipment. Dan Street has reviewed T.CA. regarding the disposal of thedental equipment. He has reviewed both T.C.A. 12-3-1005 & 5-7-101. He is basing his analysis on T.C.A. 5-7-101 CountyPowers Generally which states:
Each county may acquire and hold property forcounty purposes, and make all contracts necessary or expedient for themanagement, control and improvement thereof, and for the better exercise of its civil and political powers, and maymake anyorder for the disposition of its property.

WHEREAS, the SheriffsOffice hasbeenactively reviewing various inmate GPS monitoringsystemsin an effort to get an educatedunderstandingof how these systemswork, and todeterminethecost savingsandor cost involved for Sullivan County. Currentcost for housinganinmateis an estimated$44 dollars per day for a healthy inmateandmuch higher for an inmatewith healthconditions. d. Capable of storing at least five days of data should the wireless communication signal becomeunavailable to the devtce

g. Has an alert feature for the offender to contact the supervising agency.
h. Device is housed in a small one-piece, lightweight complete GPS device with no removable internalparts and is securely attached around the offender’s ankle with minimal training of supervisingagents.
i. Battery powers the device for at east 48 hours on a single charge from a non-removable batterywhile receiving one GPS location point each minute and downloading data to the Central InformationSystem at least once every 10 minutes when the offender is compliant. Instances of violation musttransmit immediately to the Central Computer Database Application.
j. Battery recharged through a charging coupler that plugs into a standard AC electrical outlet.
k. Battery completely recharges in one hour or less with a means of notifying the offender of the fullycharged battery status.
I. Device manufactured under 50 9001-2008 standards.
m. Program identification is non-erasable,
n. Water resistant up to 50 feet.
o. FCC certified, evidenced by an issued FCC number.
p. Able to detect, record and report the deliberate interference with the device’s ability to receive theGPS signal and the ability to detect, record and report instances when the offender is interfering withthe OPS signal.
q. Hardware and software enhancements are made by the vendor at least twice each year at noadditional cost to the agency.
r. Vendor’s software shall be certified from the Department of Defense Information Technology SecurityCertification and Accreditation Process (OITSCAP) and the Statement of Auditing Standards No. 70:Service Organizations (SAS 70), as well as compliant with the Federal Information ProcessingStandards Pub. 80053 (FIPS).

WHEREAS, Sullivan County has provided this servicethrough the Highway Departmentinyearspastfor our residentsasanadditionalmethodof keepingtheCountyneatandcreatingsafertravel for driverswhouseourCountyroadsand highways; and
WHEREAS,the Sullivan County Flighway Departmentand manyCounty Commissionershavereceivednumerouscallsandoverwhelmingrequestsfrom County residentsto resume the brushpickup servicein SulltvanCounty;and
WHEREAS, the Sullivan County Highway Departmentis well equippedand prepared toreinstatethis service,operatingon an organizedschedulewith effectivemethodsfor maintainingthevariousCountyroadsthatneedattentionandrespondingto residentrequests;and
WHEREAS, the Sullivan County Highway Departmentlawfully maintainsSullivan Countyhighwaysand roadsonly; this excludesall city and stateroadsfrom any maintenanceand/orservicesprovidedby theSullivan CountyHighwayDepartment;and
WHEREAS,thebrushpick up serviceprovidedby Sullivan Countyis intendedfor exclusiveuseby Sullivan Countyresidentsonly. The Sullivan County HighwayDepartmentwill not pick upany limbs, trees,or brushcut commerciallyby contractorsor any professionalserviceproviders.It is theresponsibilityofall contractorsand/or commercialprofessionalsto carryout appropriatedisposalprotocolsofany unwantedmaterialsorwastecreatedby theirservicesrendered;and
WHEREAS,Sullivan Countyresidentsare to cut thebrushand/orlimbs into manageablepiecesno longerthan 10-12feet in lengthand createa neatstackalongsidetheSullivan Countyroad oftheir addressat a safe distancefrom the road but within the County Right-Of-Wayavoidingcable/powerlines and polesthat may obstructthe claw of the brush truck from reachingthebrushpile for pick up. HighwayDepartmentDispatchis thencalledto requestpick up; and
WHEREAS,Sullivan Countyresidentstrust and dependon theirelectedofficials to act in theirbest interest and provide neededservicesthat promote safety and sanitation; brush pick upenhancesthe attractiveappearanceofour Countyroadwaysand keepsthem free ofdebriswhilehelping residentsto disposeofunwantedrubbish.
