Whereas,theYuchi Tribewasdocumentedby a Spanishexplorerin what is nowcentralTennessee.Europeancolonial recordsfrom the17th centurynotetheYuchi; and

Whereas,both historical and archaeologicalevidenceexistsdocumentingseveralYuchitowns in the 18th century. Among thesewasChestoweein southeasternTennessee.In 1714,

As the earlyinhabitantsof this greatland, the native peoplesofNorth America playeda uniquerole in theshapingof ourNation’s historyand culture. Theirunique spiritual, artistic and literary contributionstogetherwith their vibrant customs andcelebrationsenlivenandenrichourland”.

BackgroundTodaywewill considertwo different resolutionsthat affect storageandmaintenanceoftheSullivanCountyArchives. Oneresolutionpertainsto creatingadditionalstoragespacebehindthemain courthouse,refenedto as the “old jail.” The secondresolutionisdescribesamethodofraisingfluids dedicatedto thearchivesmission.

Problem Discussionsin duringvariouscountygovernmentmeetingshaverevealedthefollowingproblems: -

I. Accessibility.Manyarchivesarenoteasilyaccessibleandnotproperlycataloged.Severaldocumentsarestoredin alocationknownasthe“Sullivan House”approximatelyfive miles from theCourthouseandthearchivist’ office.

2. Fundingshortfall. Thereis only onearchivistandshealsoserves.asihaCountyTourismofficer, No costdataor referenceto thecountybudgethavebeencitedin eitheroftheproposedresolutions,butboththePublic RecordsCommissionandCountyCommission“apparently”agreethatashortageofstoragespaceexists.

3. Cataloging. Thedifferencebetweenrecordkeepingandarchivemaintenanceis not clear.ApparentlymuchofthecourthouseandSullivanHouseis devotedto recordstoragethat

- maynotberelatedto thelegalrequirementsto permanentlymaintainspecificrecords-

(archives). Wemaybe storingrecordsthatarenotrequiredto bemaintained. If so, itcomplicatestheissueofadequatestoragespaceandaccessibility.

4. No writtenplan. The CountyCommissionhasnotreceivedawrittenplanorbeenverballybriefedon a comprehensiveplanto addresstheproblemscitedabove,nor havewe receiveddetailedinformationregardingthecostsof implementinganyproposedsolutions. -

5.- LackofcoordinationbetweenCountyDepartmentsandthePublicRecordsCommission.Further,thefundingresolution,while legallypermittedunderstatelaw, would imposefeeson Countyresidentsfor servicesthat arenotdirectly relatedto subsequentarchiving.

RecommendationTheCountyCommissionshouldtakeno actionuntil adetailed,writtenplan(including costs)is submittedto theCommission,Recordkeepingis an executivefunction. TheCountyCommissionhasonly afindingandgeneraloversightrole. However,severalCountyDepartmentsareaffectedby this issue,(essentiallyall thatarerequiredto maintainrecordsthattransitioninto archivestatusatsomepoint),The CountyPublic RecordsCommissionalsoplaysan importantandlegallyproscribed role in archivemaintenance.Therefore,recommendthattheCountyMayor servesasthecoordinatorofajoint Countyeffort to resolvethis situationandsubmitadetailed,coordinatedplan to theCommissionwithin 60 daysofthis meeting.

WHEREAS,the Sullivan County Health Department has received a grant from the State of Tennesseeinthe amount of $267,200to provide Tobacco Prevention Servicesfor the community. The SullivanCounty Health Departmenthas also receiveda grant from the State of Tennesseein the amount of$21 1,500to provideservicesfor childrenneedingTennCareservices,of which $174,400wasalready inthe budget. The Sullivan County Health Departmenthas also rcceived a grant from the State ofTennesseein the amountof $461,400to provide emergencypreparednessservicesto the community, ofwhich $388,300was already in the budget. The Sullivan County Health Departmentalso receivedaChronic Diseaseand School Health grant from the State of TN for $70,600,to provide servicesto helppreventchronicdiseasesin schoolagechildren;and

WHEREAS,thesefundsare 100%Thndedby the Stateof Tennessee.

4. TheChurchagreesthat thepayment ofthesumstated in Section 1 above,shall be in full

and final satisfaction of any rights or claims relating to the Board’suseofthe Church’s

parking facility.

5, This Agreement shall terminate if saidschool shall be permanently closedby theBoard.

6. The parties agree thatthe Churchshallhave the right toadd to, changeormodi~rits exist-

ing structures, or parking lot astheChurchdeems necessary. Notwithstanding suchaddi-

tions, changes or modifications, the Board shall retain theright to usetheChurch’sparking

WHEREAS, Tennessee Code Annotated (T.C.A) Section 9-3-405, encourages countygovernmentsto establishan independentAudit Committee, and provides that the TennesseeComptrollerof the Treasury(Comptroller)mayrequire an Audit Committeein countiesthat (I)are in noncompliancewith the accountingand financial reporting standardsrequired by theGovernmentAccountingStandardsBoard or (2) haverecurring findings from the annual auditfor thiee or more consecutiveyears that are determinedby the Comptroller’s office to be amaterial weaknessin internal control or material noncompliancewith governmentauditingstAiiddtds;and

WHEREAS, the Comptrollerand the GovernmentFinanceOfficers Associationof the UnitedStatesand Canadarecommendsthat all county governmentsestablishan Audit Committeeas abest practiceand to assistthe County Commissionin the oversightof the public funds andfinancial reportingprocess;and

WhEREAS, the Sullivan County Commissionrealizesthe need, especiallyin today’s currentenvironmentof fewer available resources,for increasedtransparencyand accountability ofpublic funds, and that the County Commission is ultimately responsible for ensuring thatmanagementis meetingits internalcontrol andfinancial reportingresponsibilities;and

WHEREAS, the County Commissionfinds it to be in the bestinterestsof Sullivan County toestablishan Audit Committee;

NOW ThEREFOREBE IT RESOLVED by the County Commissionof Sullivan County,meetingthis 21stdayof January,2014 that:

SECTION I. Pursuantto the provisions of tC.A. §9-3-405, the County CommissionofSullivan County does herebyestablishan Audit committeeto provide independentreview andoversight of the county’s financial reporting processesand the county’s internal controls, areview of the externalauditor’s report and follow up on management’scorrectiveaction, aridcompliancewith laws,regulations,and ethics.

SECTION 2. The Audit Committeewill consist of three (3) members(no fewer than threemembers),to be comprisedof membersof theCounty Commission,citizensof Sullivan County,or a combinationof both. To insurethe committee’sindependenceandeffectiveness,no AuditCommittee member will he an elected official (with the exception of elected countycommissioners),employee,spouseof an official/employee,or personthat eominglesassetswithan official/employeeof Sullivan County. While committeemembersneednot he accountants,they shouldpossesssufficientknowledgeand experiencein finance,business,andaccountingto

dischargethecommittee’sduties. Themembersof the Audit Committeeshallbe appointedbythe County Commissionto staggeredtwo (2)yearterms. To establishstaggeredterms,theinitialmembersof thecommitteeshallbe appointedso that half ofthemembersserve2 year termsandhalfserve1 year terms. Thereafterall members shall be appointed to serve2 yearterms,

SECTION3. Meetingsof theAudit Committeeshall be held in accordancewith the provisionsofT.C.A. §9-3-405. Meetingsshall be subjectto theopenmeetingsprovisionsofT.C.A. Title 8,Chapter44, exceptthat upon a majority vote of those membersin attendancefor the publicportion of a meeting,theAudit Committeemay hold confidential,nonpublicexecutivesessionsto discussthefollowing itemsasauthorizedin T.C.A. §9-3-405;

(1) Itemsdeemednot subjectto public inspectionunderT.C.A. §~10-7-503and10-7-

504,and all othermattersdesignatedasconfidentialorprivileged;

(2) Currentorpendinglitigation and pendinglegal controversies;

(3) Pendingor ongoingauditsor auditrelatedinvestigations;

(4) Informationprotectedby federallaw; and

(5) Mattersinvolving thereportingof illegal, improper,wasteful,or fraudulentactivityunderT.C.A. §9-3-406,wherethe informant has requestedanonymity.

The Audit Committeewill follow RobertsRules of Order. Eachyearat its first meeting, thecommittee will elect a chairman, vice-chairman,and secretary. Meeting agendaswill bepreparedby the chairman andprovided in advanceto membersalongwith appropriatebriefingmaterials.Minutesof the Audit Committeemeetingswill be filed in theoffice of CountyClerk.

SECTION 4. The--committeeshall have accessto the servicesof a financial expert,eitherthrougha committeememberor an outsideparty engagedby the committeefor this purpose.Such financial expert should, through both education and experience,and in a mannerspecifically relevantto thecountygovernmentsection,possess(1) anunderstandingof generallyacceptedaccountingprinciples andfinancial statements;(2) experiencein preparingor auditingfinancial statementsof comparableentities; (3) experiencein applying such principles inconnectionwith theaccountingfor estimates,accruals,andreserves; (4) experiencewith internalaccountingcontrols;and(5) anunderstandingof Audit Committeefunctions.

SECTION 5. The dutiesandresponsibilitiesof the Audit Committeeare:

(a) To carefully review, uponcompletionof thecounty’sannualaudit, all audit findingsin audit reportandconsultwith theexternalauditorsregardingany irregularitiesanddeficienciesdisclosedin the annual audit. The Audit Committeeis empoweredtomeet with managementto discuss-audit findings and/or disagreementswith theexternalauditors. The committeeshould satis~’itself that appropriateand timelycorrective action has been taken by management to remedy any identifiedweaknesses.The committeeshoulddeterminewhatcorrectiveactions,if any, shouldbe recommendedto the CountyCommission.

(b) To considerthe effectivenessof the internal control system,including informationtechnologysecurityandcontrol,reviewthe effectivenessof thesystemfor monitoringcompliancewith laws andregulations,and reviewthe processfor communicatingthernunty’sethicspoliciesto countypersonneland monitoringcompliancetherewith.

SECTION 6. The Audit Committee will be adequatelyfunded to carry out the duties andresponsibilitiesas setout in this Resolutionandunderapplicablelaw.

SECTION 7. This resolutioncreatingthedutiesandresponsibilitiesof theAudit Committeehasbeensubmittedto the Comptrollerprior to approvalby this legislativebody, andthis resolutionconformswith the reportissuedby the Comptroller.

(a) The county legislative body of any county which creates a county records commission has the

power to appropriate such funds as may be required for the carrying out of the purposes of this

chapter including, but not limited to, the purchase or leasing of equipment, the equipping of an office

and the payment of the expenses thereof, the furnishing of secretaries and clerical help and the

employment of expert advice and assistance.

(b) In any county, if the county legislative body creates a county records commission, then the

county legislative body is authorized to:

(1) Appropriate such funds as may be required for carrying out of the purposes of this chapter,

including, but not limited to, the purchase or leasing of equipment, the equipping of an office and the

payment of the expenses of the office, the furnishing of secretaries and clerical help, and the

employment of expert advice and assistance; and

(2) Establish and collect, through all entities creating public records, as defined in ~ 10-7-403, an

archives and record management fee not to exceed five dollars ($5.00) per document filed. Funds

collected through this fee must be designated exclusively for duplicating, storing, and maintaining any

records required by law to be permanently kept.

WHEREAS,this dedicatedlaw enforcementofficer exhibitedextraordinarydevotionto duty, outstandingloyalty, fine leadership,andmeticulousattentionto detail in all his duties;and

WhEREAS, throughouthis careerwith theTHP, TrooperMyers always exhibitedcompassion,caringand concernfor all thosewith whom he camein contact,often going that extramile to personallyhelpthosewho were lessfortunate;and

WhEREAS, Trooper Myers was an avid University of Tennesseeand NASCAR fan and was acommunity leaderas a memberof theAppalachianExpressBarberShopChorusand the JerichoShriners;and

WHEREAS, as a Shriner his time, skills and efforts were exhibitedby his supportof the children andyouth helpedandcaredfor by theShrinersHospitalsfor Children; and

WHEREAS, TrooperMyers was a Sunday SchoolDirector and an active memberof Virginia AvenueBaptist Church,Bristol, where he spentcountlesshours in many endeavorson behalfof the churchandthecommunity;and

WHEREAS, this dedicatedlaw enforcementofficer’s life was cut short from injuries he receivedin ahead-oncollision on June25, 2012causedby an impaireddriver; and

WHEREAS,TrooperMyers,a devotedfamily man, is survivedby his wife of 26 years,ChestaleneB.Myers,threechildren and four grandchildren;and

WHEREAS,Barry R. Myershasleft behindan indelible legacyof integrity in public life, compassionandloyalty in privatelife, diligenceanddedicationin all hisendeavors;and
