Whereas,the conditions worsenedat the end of the week as runoff from otherstreams,etc. startedto enterthe low-lying neighborhoodsand waterwayscausingextremelydeepwatersin severallocations;and
Whereas,On Saturday,January19, acall Caine in from a residentof the ChinquapinGrove Community sayingthat BarnettRoad was still coveredwith six to eight feet of watermaking it impassablefor the residentswho had patiently waitedfor severa!clays hoping theflood waterswould recede. Flooding of that that type had not occurredon Barnett Road inover 20 years so it was unexpectedfor the high waters to stay so long. Trappedresidentsneededto be ableto meetthenecessitiesofeverydaylife suchasbuying groceries,gettingtoappointments,anddriving to work; and
Whereas, over thenext 24 hoursvolunteer firemen from Avoca, Bluff City, l-lickoryTree, and421 rose to the call, with the assistanceofSullivan County EMA, to pump around500,000gallonsof water off ofBarnettRoad. Thesefire departmentsdo not normally do thistype of serviceand went beyond the call to assistwith what was available to them. Thewillingnessand hardwork neededto allow residentsto travel Barnett Roadis a teal testimonyto the type of volunteerswho are a partof theselire departmentsand honorablecitizens ofSullivan County.
Now, therefore, I, SteveGodsey,Mayorof Sullivan County, andtheSullivan CountyBoardofCommissioners,do herebythankand commendall oftheheroesfrom Hickory Tree,Avoca, 421, and Bluff City Volunteer Fire Departmentsfor their unselfish efforts andcommitmentto goingbeyondthe call to assistSullivan Countyresidentsin a time ofneed.

third partiesfor damagesreceivedby burstingor leakingof waterpipes,roof leaks,fire or any other
casualtyto any improvementor personalpropertypresentlylocated on the premisesor hereinafter
locatedor constructed;or for othercasualtyor for damagesresulting from any negligenceof Lessee
or any third party, or any occupant,invitee or user of the premises,or from any spectatoror any
otherpersOnwhomsoever.
8. (a) Lesseeshall save harmlessand indemni& Lessor from and againstall loss,
liability, claim and/orexpensedue to injury to personor propertythatmay be incurredby Lesseeor
any third partyby reasonof any accidentor from any damage,neglect,or misadventurearisingfrom
or in any waygrowing out of the use,misuseor abuseof thepremisesdemisedherein,and Lessee
will maintain adequateinsurancefor suchpurposes,including generalpublic liability insurancein
the minimal amounts set forth in subsection(b) of this paragraph. Lesseeshall also maintain
adequateinsuranceto cover thecontentsof any building or strttcturepresentlyexisting or hereafter
constructedon the aforedescribedpremisesutilized by Lesseeor third parties,or for theirpurposes.
Lessorshall not be liable to Lesseeor to any otherpersonfor injury, claim, lossor damageto any
propertyor to anyperson,for whichloss Lesseeshall insureandsaveharmlessLessorfrom anyand
all loss andlorliabilities whatsoever.
(b) Lesseeagreesto maintain at all times during the term of this LeaseAgreement
general public liability insurancein the minimal amount of OneMillion Dollars ($1,000,000)per
personandOneMillion Dollars ($1,000,000)peroccurrenceand shall list Sullivan Countyas an
additionalinsuredon thepolicy.

WHEREAS, in compliance with Public Chapter 561 of the General Assembly of the State ofTennessee the Sullivan County Commission previously established the Occupational Safety and Health
Program for the Employees of the Sullivan County government; and
WHEREAS,such program was established in the year of 1975 and the State of Tennessee hasrequested that all counties update their plans.
NOW THEREFORE BE iT RESOLVED that the Board of County Commissionersof SullivanCounty, ‘Tennessee,assembledin Regular Sessionhereby approvesthe following amendmentstothe Occupational Safety and Health Program for the Employees of the Sullivan CountyGovernment as follows:
TITLE: This section shall provide authority for continuing and administering theOccupational Safetyand I-Iealth Program for the employeesof Sullivan County.
PURPOSE: The County Commission in electing to update their established programplan will mandate an effective occupational safety and health program for its employeesand shall:
1. Provide a safeand healthful place and condition of ernploynient that includes:a) Top ManagementCommitment and Employee Involvement;b) Continually analyzethe worksite to identify all hazardsand potential hazards;c) Develop and maintain methods for preventing or controlling existing or potential
hazards; and,d) Train managers,supervisors,and employeesto understand and deal with worksite
hazards.2. Acquire, maintain, and require the use of safety equipment, personal protective
equipment and devicesreasonablynecessaryto protect employees.3, Make, keep, preserve, and make available to the Commissioner of Labor and
Workforce Developmentof the State of Tennessee,his designatedrepresentatives,orpersonswithin the TennesseeDepartment of Labor and Workforee Development towhom such responsibilities have been delegated,adecjuaterecords of all occupationalaccidents and illnessesand personal injuries for proper evaluation and necessarycorrective action as required.
4. Consult with the State Commissioner of Labor and Workforee Development withregard to the adequacyof the form and contçnt of records.

ResolutionRequestingThat State LawmakersClosely PeruseThe Details Of The AffordableCareAct So As Not To ReduceThe Amount Of MedicareFundsCorning Into TennesseeAnd ItsAdditional EffectsOn HospitalsAnd Medicaid Patients
Whereas,the Affordable CareAct (ACA) and subsequentfederal legislationhavereducedthe amountthe federalgovernmentreimbursesTennesseehospialsto care lhr Medicarepatients by $5.6 billionover the next 10 years;and
Whereas,hospitalsagreedto acceptthesecuts in exchangefor expandedhealthinsurancecoveragethatwould reducethe hospitalcostof had debtandcharity carenow beingprovided; and
Whereas,in 2011 alone,the costofuneompensatedcarein ‘lennesseehospitalswas$2.5 billion; and
Whereas,other measuresbeing consideredin Washingtonwould raisethe Medicarehospital cutsto$7.4 billion; and
Whereas,manyhospitalswill not he ableto functionas a full serviceacutecarehospitalandsonicmaybe lotted to closealtogether;mid
Whereas,the hospitals in Sullivan County would he negativelyimpacted by a total of $327 milliondollars over ten ~‘ears($227 million in approved cuts plus $100 million in further cuts underconsidelation)and if theseproposedMedicareetlts oceuned,would havea substantialnegativeimpactto the communityof SullivanCountyin termsoflay off of employeesandcutsin medicalservices.
Whereas,thesecuts not only will impacthospitals,but alsothe communitieswherethey are located;and
Whereas,Tennesseestandsto lose90,000jobs (over 3,600jobs in SullivanCountyalone) in a 10-year
periodwith thecuts alreadyin law andotherscurrentlypending;and
Whereas,rural hospitalsareespeciallyvulnerableto the AC\ cuts;and
Whereas,the i~derulgovernmentwonId pay the lb II cost of the expansionfor the first Ui tee years,followed by a decline in the federal share to 95 percent,94 percent, 93 percent and 90 percentinsubsequentyears;and
Whereas,while the cost to the state to expandcoveragefor 5.5 years would be $199.1 million,Tennesseewould receive$6.4billion from the federalgovernmentto fund expansion;and
Whereas,the cuts to hospitals are unsustainablewithout the expansionof Medicaid coverageinTennessee.
NOW THEREFORE BE IT RESOLVED that the Board of County Commissionersof SullivanCounty, Tennessee,assembledin Regular Sessionhereby requests that TennesseeLawmakerscarefully examine the details of the Affordable Care Act and make decisions that do not todamagehospitals,Medicare and Medicaid patients in the State
WaiverOfRulesRequested
This resolutionshall take effect from andafter its passage.All resolutionsin conflict herewithbe andthesamerescindedinsofaras suchconflict exists.
