RESOLUTIONto Authorize the Establishment of County Commission and ConstableDistricts
WHEREAS,the Redistricting Committee at the direction of the Sullivan County Commissionhas considered the district boundaries of Sullivan County Commissioners andConstablesandhasrecommended that the districts be adjusted to match those of the Sullivan County Board ofEducation; and
WHEREAS,the Sullivan County Commission does herby concur with the recommendation ofthe Redistricting Committee.
NOWTHEREFOREBE IT RESOLVEDthat the Board of County Commissioners ofSullivan County, Tennessee, assembled in Regular Session hereby establish that membersof the Sullivan County Commission and Sullivan County Constables shall be elected fromthe same seven districts as defined by the boundaries for the Sullivan County School Boardmembers; thereby creating districts allowing Commissioners, Constables, and SchoolBoard Members to maintain the same physical boundaries. The districts for School Boardof Sullivan County are depicted on an official redistricting map for Sullivan Countyprepared pursuant to Tennessee Code Annotated, Section 5-1-110. A copy of theredistricting map is attached as Exhibit A to this resolution and is incorporated herein asreference.
BE IT FURTHERRESOLVEDthat the new boundaries for Commissioner and Constabledistricts as defined above shall be effective for the 2018 general county election, andnothing in this Resolution shall be construed as abridging the status of any office holderprior to the end of such person’s current term of office.
BE IT FURTHERRESOLVEDthat three Commissionersand three Constables shall beelected at large per district wherein the candidates seek election for a total of 21Commissioners and 21 Constables serving Sullivan County. The top three candidates foreach office receiving the greatest number of votes in each district shall be elected.
BE IT FURTHERRESOLVEDthat the Mayor shall notify the Sullivan County ElectionCommission of this action and shall provide any additional information that may berequested.
BE IT FURTHERRESOLVEDthat prior to the next general election the Sullivan CountyElection Commission shall print Exhibit A and a legal description in a newspaper of

WHEREAS, the income produced in these operationsis anticipated to be approximately$110,000;

WHEREAS, Sullivan County has provided health insurancecoverage for County retiree’smeetingcertaincriteria in yearsof servicefor manyyears andconsolidatedtheplans into oneMedicareAdvantagePlanaspreviouslyapprovedin 2010;and,
WHEREAS,a numberof theretireeshavelocated in other partsof Tennessee,aswell as,otherstatesresultingin adifferentcostofthesamebenefitsbaseduponthelocationoftheretiree.(Forexamplethe sameplancostsmore in Knoxville than it doesin the Sullivan Countyvs. the sameplanmaybe lessexpensivein Florida); and,
WHEREAS,questionshavebeenpresentedto the designatedagencyrepresentingthecounty inenrolling the retiree’s as to thesedifferencesin cost of the designatedbenefitsbased uponlocation.
NOW THEREFOREBE IT RESOLVEDTHAT theintentof this body is to fund thesamebenefitsat the cost it is priced in Sullivan County and any additional cost due to theretiree’s location is to be absorbedby the retiree;additional, any less cost baseduponlocation cannotbe applied to a retiree’s other coverageplans (therefore,resulting in asavingsto the County).

RESOLUTION to approvea budgetamendmentto supplementfunding for AmbulanceServiceFund (EMS) for the 2016 fiscal year
WHEREAS,over the past 15 years Sullivan County hasbeenable to fund routineoperationsalong with capital expendituresfor the Ambulance Service (EMS Fund) primarily fromcollections;and,
WHEREAS,ashasbeenreportedto you over thepastyear our EMS Fund’sability to operateasin the pastdependingupon collection to cover the cost of operationshasbecomeincreasinglydifficult; and,
NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners ofSullivan County, Tennessee, assembled in Regular Session, hereby authorizes anamendment to the 2015-16 FY budget to transfer $350,000 from the General Fund to theEMSFund. Account codes to be assigned by the Director of Accounts and Budgets.
This resolutionshall takeeffect from and after its passage.All resolutionsin conflict herewithbeandthesamerescindedinsofarassuchconflict exists.

WI-IEREAS, Sullivan Countycurrentlymaintainsa 0.016-acreRight-of-Way thatbordersMary LouDuncan’s property (Tax Map 55, Parcel 037.00) on Old l3eidleinan Road in Bristol as seenonattachedmap; and
WHEREAS.Sullivan County doesnot have usefor said Right-of-Wayand no longer wkhes to beresponsiblefor the maintenanceof the same;and
WHEREAS,Mary Lou Duncan wishesto take possessionof the property that comprisessaid Right-ol—Way and has signedthe Waiver and Releasewaiving any interest in the maintenanceof saidRight-of-Wayby Sullivan Countyand waiving any claim for damagesfor the closureof said Right-of-Way; and
WHEREAS.Mary Lou Duncanis the only propertyownerthat adjoinsthis Right-of-Way;and
WI-IERLAS, the closure of this portion of Beidleman Road has been approvedby the Sullivan(:ounty PlanningCommissionandthe Sullivan County ExecutiveCommittee;
NOW TIIEREFORI. BE IT RESOLVED by the Sullivan County Board of Commissionersmeetingin RegularSessionthat Sullivan Countyshallclosethis section of Old BeidlemanRoadand surrenderCounty Right-of-Way as indicatedon attached map, and the County Mayor isherebyauthorizedto executea Quitelaim Dcccl transferringany interestSullivan Countymayhavein thepropertyfrom Sullivan Countyto Mary Lou I)uncan.
This resolution shall take died from and alter its passage. All resolutions in conflict herewith heand the same rescinded insofar as such conflict exists.
