smuggling during the last three years till date; and

Minister for Interior and Narcotics Control (Ch. Nisar Ali Khan):(a) It is not correct. The smuggling of livestock has decreased because of thesteps detailed at part (b).

(b) To stop smuggling of livestock, the following steps have been takenby the Government:—

(a) Enhanced patrolling between the posts, surprise nakkas onfrequented/un-frequented routes to strictly check cross bordermovement by unwanted elements /stop smuggling.

(b) Maximum smuggling routes to Afghanistan have been blockedthrough developing a 10 feet wide and 8 feet deep, 453kilometers long ditch on Pakistan-Afghanistan border.

(c) Cancellation of all existing quotas of livestock issued to thebutchers of border belt. New quotas based on joint surveycarried out by all stake holders to ascertain the requirement ofbeef / mutton for districts of border belt, have been issued andare being implemented through joint efforts.

(c) In 2015-16, efforts were foiled to smuggle about 3200 animals toAfghanistan, Be HQ Frontier Corps Balochistan and HQ Frontier Corps KP, intheir areas of responsibility.

Will the Minister for Planning, Development and Reform be pleasedto state:

(a) the performance made by the Government for the improvementof Human Development Index (HDI)/indicators since 01-01-2013;and

(b) the details of plans made to improve the HDI in the near future?

Minister for Planning, Development and Reform (Mr. Ahsen Iqbal):(a) The subject of human development has primarily been devolved to the provincesafter the 18th Amendment. However, the Federal Government has taken variouspolicy initiatives to improve Human Development Indicators in the country.Pakistan’s performance in the human development remains below par and it willgradually improve. The individuals involved in research per million of populationalso improved from 196 in 2005 to 329 in 2013. Number of degree awardinguniversities has increased from 54 in 2000 to 160 in 2013. Total enrollment inhigher education in 2014 stood at almost 1.2 million students representing about 5percent of the age cohort of 17-23 year old in the country which is a significantincrease over 2.6 percent in 2002.

(b) Moreover, the government has allocated Rs.20 billion for MDG’sand Community Development, increased allocations for HEC in recent years (Rs.14billion in 2011-12 to Rs.27 billion in 2014-15), opening of campuses/ sub-campusesof public sector universities in every district headquarter to enhance access tohigher education, National Endowment Scholarship for Talent (NEST) to provideaccessibility to quality education on need cum talent basis for deserving students,establishment of National Curriculum Council for uniformity of educational andcurriculum standards across the country, Modernization and Standardization ofExamination system to improve quality of education, Scaling Up Nutrition (SUN)movement to improve nutritional situation, Science Talent Farming Scheme (STFS)for 300 students per annum from all over Pakistan, Holding of National Games toexplore young sporting talent, establishment of Cancer Hospital in Islamabad aresome initiatives to improve Human Development conditions in Pakistan withadequate budgetary allocations.

The long-term road map for socio-economic development is prepared bythe Planning Commission through extensive consultations with provincialgovernments and people from all walks of life. In Vision 2025 the social capitaland human development is made the first pillar and presents a comprehensiveapproach to addressing human and social development gaps with an emphasis ondeveloping human and social capital to take full advantage of Pakistan’s youthbulge.

(a) the total number of Dispensaries constructed/established underthe Social Action Programme in District Buner;

(b) the total number of Dispensaries out of the same are functionalat present;

Minister for Planning, Development and Reform (Mr. Ahsen Iqbal):(a) Pakistan Social Action Program (March 1994-Dec 1997) was a multi-donorfunded project (World Bank, Netherland etc) to improve basic social servicesover the period of five years by the Govt. of Pakistan with provincial governmentsas major implementing agencies. A total of 08 civil dispensaries were establishedin District Buner.

(b) (c) & (d) In the wake of 18th constitutional amendment, health servicedelivery, execution and implementation including operation and maintenance is theresponsibility of the Provincial Government (Health Department, Govt. of KhyberPakhtunkhwa).

Will the Minister for Finance, Revenue, Economic Affairs, Statisticsand Privatization be pleased to state the steps taken by the presentGovernment for timely delivery of pension to the pensioners?

Minister for Finance, Revenue, Economics Affairs, Statistics and

Privatization (Mr. Muhammad Ishaq Dar): To facilitate pensioners and timelydelivery of pension, Federal Government has introduced Direct Credit System(DCS) for payment of pension. In this system, amount of pension of the pensioneris deposited directly in his bank account, opened in any scheduled bank, including

National Saving Centers for this purpose. It will enable a pensioner to draw monthlypension without preferring a pension payment claim at the bank. The pensionerhas the option to get ATM Card issued from the bank and use it as per hisconvenience. It is applicable to both retiring as well as existing pensioners.

2. *Mrs. Shahida Rehmani:

Will the Minister for Finance, Revenue, Economic Affairs, Statisticsand Privatization be pleased to state:

(a) the total amount of loans obtained by the Government from theAsian Development Bank (ADB) since 01-01-2013 alongwithterms and conditions and the head-wise utilization thereof; and

(b) (i) The Minister for Interior held 22 sessions/ meetings of the NationalCounter Terrorism Authority (NACTA) during the last two years.

(ii) NACTA held its 35 in house meetings during the last two years.

(c) The educational qualifications and experiences of officers working inNACTA is at annex-B.

Customs duties are collected on import of goods into the country. Therate of duty is not affected by the type of importer i.e. industrial large scalemanufacturer or commercial. 6. *Ms. Belum Hasnain:

Will the Minister for Finance, Revenue, Economic Affairs, Statisticsand Privatization be pleased to state:

(a) the justification for imposing 10 percent Capital Gains Tax(CGT) within five years as announced in the Finance Act, 2016indicating also its impacts on the Real Estate Market and theSellers in the country; and

(b) whether it is a fact that the withholding tax on the purchase ofthe property has been increased; if so, its reasons as well as itsadvantages for the investors?

Minister for Finance, Revenue, Economics Affairs, Statistics and

Privatization (Mr. Muhammad Ishaq Dar): (a) The Federal Government isempowered under Clause 47 of Part-I of the Fourth Schedule to the Constitutionof the Islamic Republic of Pakistan, 1973 to legislate upon taxes on all income(s)other than agricultural income. Therefore, imposition of tax on gain /income arisingfrom the disposal of immovable property under the head “Capital Gains” undersection 37(1A) of the Ordinance falls within the domain of the Federal Government.Furthermore, there is a dire need to bring the income emanating from the disposalof immovable property into the tax net because a large quantum of untaxed moneyis parked in the real estate sector whereas the tax contribution of this sector ishardly commensurate with its revenue yielding potential. The World Bank in itsreport has accentuated this fact by stating that during the Financial Year 2013-2014, Rs. 204 Million or a mere 0.02 % of the tax revenue emanated from CapitalGains Tax.

Prior to the Finance Act, 2016 capital gains tax was imposed on propertiesheld upto a period of 2 years, whereas, through the Finance Act,2016 the holdingperiod of immovable property subject to CGT was extended upto a period of 5years. Subsequently, however, the holding period of property subject to CGT hasonce again been reduced to a period of 3 years through the Income Tax (FourthAmendment) Act, 2016. Moreover, rate of 10% has also been amended and hasbeen reduced to 5% for immovable property acquired before July 1, 2016 and10%, 7.5% and 5% rates have been specified for properties acquired after July 1,2016. The enhancement in holding period of immovable property subject to CGTfrom 2 years to 3 years has, ostensibly, no adverse impact on the real estatemarket /sellers of immovable property as is evident by the fact that the number ofsales of immovable properties subject to collection of tax from sellers under section236C of the Ordinance witnessed an increase from 88,088 transactions (July 15to Dec 15) to 97,058 transactions (July 16-Dec 16).

(b) The withholding tax on the purchase of property under section 236Kof the Ordinance, which was previously 1% and 2% for filers and non-filersrespectively (in cases where value of immovable property exceeds Rs. 3 million)has now been enhanced to 2% and 4% for filers and non-filers respectively throughthe Finance Act, 2016. The rationale behind such increase is that a large quantum

of untaxed money is being invested in the real estate sector whereas the taxcontribution of this sector is not commensurate with its revenue generating potential.The withholding tax rate on purchase of property under section 236K of theOrdinance has primarily been increased as a revenue generating measure, however,it would be beneficial to mention that this tax is adjustable in the hands of thepurchasers which means that the tax - collected is refundable if there is no taxliability at the time of filing of return or is adjusted against tax liability if any. Moreover,simultaneously the threshold of applicability of withholding tax on purchase ofproperty under section 236K of the Ordinance has been enhanced from Rs. 3million to Rs. 4 million which offers greater advantage for small investors becausecurrently the purchase of immovable property upto Rs. 4 million is not subjectedto collection of tax under section 236K of the Ordinance, whereas, previouslysuch threshold was Rs. 3 Million. Due to the increase in threshold for collection oftax from purchasers of immovable property, more buyers have been ousted fromthe purview of section 236K of the Ordinance, thereby, affording such buyersgreater benefit.

On the directive of Prime Minister, the project was transferred to ICTA inNovember, 2015. Revised PC-I was prepared at a cost of Rs. 151.313 millionand submitted to Planning, Development & Reforms Division for approval.

(b) After approval of revised PC-I by CDWP, work on computerizationof land record would be started and completed within two years.

Privatization (Mr. Muhammad Ishaq Dar): (a) It is affirmed thattelecommunication sector is one of the highest tax collecting sectors in terms ofWithholding Taxes and has paid Rs. 43,082 Million in Withholding taxes u/s 236of the Income Tax Ordinance, 2001 for the Tax Year 2015.

However, as far as the sector’s own taxes are concerned, Telecomcompanies are declaring losses in their Income tax returns and are paying minimumtax / alternate corporate tax only. So, these companies, in their own capacity,cannot be termed as highest taxpayers.

For the Tax Year 2015 Minimum tax /alternate corporate tax paid / adjustedby different telecom companies for the Tax Year 2015 is Rs. 5,994 Million.

Sales Tax on telecom services is collected by the Provincial RevenueAuthorities in respective provinces whereas Federal Excise Duty is leviable thereononly in Islamabad Capital Territory (ICT). Further, sales tax on supply of sims isalso collected from telecom companies. Following is the collection for the TaxYear 2015:

(b) No double taxation is being collected/charged by the cellularmobile companies:

i. At the time of recharge, all telecommunication companies are chargingwithholding Income Tax @ 14% on both post-paid and prepaidservices u/s 236 of the Income Tax Ordinance, 2001. The withholdingtax so discharged is adjustable/Refundable against the income taxdue from the consumer.

ii. Federal Excise Duty @ 18.5 % on telecommunication services isalso collected by telecom companies. This FED @ 18.5% isdeducted/charged against the balance amount on card for eachtransaction as noted below:

a. On 10 % service charges deducted at the time of feeding ofscratch card.

b. On call charges when a call is made from Islamabad capitalterritory.

iii. There is no double taxation in the aforesaid arrangement since incometax which is a tax on income is refundable/adjustable and FED is atax on consumption.

The biometric devices provided to the branches are equipped withmultipurpose functions i.e. marking of attendance of employees, verification ofidentity of pensioners and customers for account opening. Implementation ofbiometric attendance is in process and will take six months time to manage theamendments in the software, while the other two functions are working properly.

Sales Tax and Federal Excise:

Not admitted. Imposition of sales tax at a higher rate has direct co-relationwith hike in prices of commodities. However, to keep the prices of essentialcommodities in check, the Federal Government has granted total exemption fromsales tax to essential commodities in use by common man and wherever possiblesales tax at reduced rate has been imposed on essential commodities.

This is evident from the fact that meat, poultry, fish, eggs, vegetables,pulses, fruits, spices, produce of milling industry like flour, rice, etc. are totallyexempt from sales tax with the exception of those sold in retail packing and undera brand name. Similarly, dairy products are exempt from sales tax with the exceptionwhere the same are sold in retail packing and under a brand name which too aresubjected to reduced sales tax rate of 10%.

Medicines and interventional equipment and apparatus for treatment ofalmost all the diseases are totally exempt from sales tax.

Sugar, a major commodity of common man’s use is subject to reducedsales tax rate of 8%. Likewise, finished articles of textile and leather are alsosubject to reduced sales tax rate of 5% given consideration to common man’sneeds, exception being imported finished articles of leather and textile.

It may be noted that the Federal Government has also kept POL productsin check and impact of increase in international Prices has been mostly absorbedby the government and not fully passed to the end user.

Customs:

Essential food items and other commodities forming part of the averagehousehold’s budget have always been accorded concessionary treatment in thecustoms tariff to provide relief to the common man. For instance, basic food itemssuch as grams, lentils, pulses, beans, potatoes, onions, tomatoes, garlic, cauliflowersetc. are all importable at 0% customs duty under Part VII, Table-A of the 5thSchedule to the Customs Act, 1969 (Annex-A). Similarly, essential non-fooditems such as Kerosene Oil, and various gas fuels are also subject to 0% Customsduty under the above referred Schedule.

According to Pakistan Bureau of Statistics, the essential commodities thatcontributed to the increase in the CPI (July-November 2016) are grams, pulses,potatoes and other fresh vegetables, sugar, and eggs. However, as mentionedabove, import of these commodities, excluding sugar and eggs, is subject to 0%

Customs duty, therefore, the contribution of imports towards rising inflation isnegligible. As far as sugar and eggs, included in the CPI, are concerned theirimport during July-November 2016 was only 3000 MT and 1 MT respectively.These meager import quantities vis-a-vis the domestic demand/production do notjustify any linkage between general increase in commodity prices and levy of dutyat import stage.

Economic and Political Comparison of Gwadar and Chabahar Ports

Gwadar Port is located on the Gulf of Oman, close to the entrance ofPersian Gulf. It is a deep warm water sea port, about 460-kilometer west ofKarachi and approximately 75-kilometer east of Pakistan border with Iran. It isstrategically between the oil-rich Middle East, the economically shortest route tothe oil-rich Central Asian States through land-locked Afghanistan, and heavilypopulated South Asia. It is at the mouth of the Gulf through which 40 per cent ofworld’s daily oil passes.

Gwadar Port has the capacity to handle large crude containers of up to500,000 tonnes deadweight. It would promote economic development in thecountry and would provide vast employment opportunities to the locals. Theestablishment of Free-Trade and Economic Zones and Export Processing Zonewould attract foreign investment, and employment opportunities to the local people.Gwadar would generate massive revenues for the Balochistan province. It wouldbecome a trade hub, once road and rail links are linked to the rest of Pakistan,Afghanistan and Central Asia. Pakistan has future plan for development of Gwadarto cater foreign trade of the Central Asian Republics and the Xingjian and theSichuan provinces.

Chabahar Port is situated on the Makran Coast of the Sistan and Balochistanof Iran and is officially declared as a free trade and industrial zone by the Iraniangovernment. The port has received India investment upto $131 million. Its locationis at the most secure and closet route to Central Asia and Afghanistan market.Berths in Port of Chabahar include general cargo and bulk. Berth capacities rangefrom 2,000 to 2,500 tonnes. Chabahar Shahid Beheshti Jetty has a length of 600metres and can berth four vessels of up to 25,000 gross tonnage and 11-metredraught simultaneously.

The countries of Central Asia will likely benefit from both Chabahar andGwadar. Diversifying its import and export routes is a logical economic and politicalstep. Although one should not exaggerate the economic benefits to be reaped. Asfor the competition between the two ports, it will not be a “winner take all” outcomebut rather one port earning the greater share of trade.

The criteria for energy projects is based on location of rawmaterial, cost of logistics and load centre proximity on Commercial feasibility.Regardless of location, electricity generated is put into national grid. Based on the above it cannot be established that the blasphemy laws areaffecting minorities in the country.

Moreover, Government of Khyber Pakhtunkhwa has reported as under:

(a) As present, no case regarding misuse of blasphemy law has beenreported / registered in Khyber Pakhtunkhwa.

However, the final selectionis made on the basis of the persons competence, experience on MRP system andon the basis of his/her marks in the interview conducted by the DepartmentalSelection Committee.

Government of Pakistan has initiated a number of development projectsin energy, transport infrastructure and Gwadar under CPEC in various parts of thecountry in 2016-17. CPEC projects timeframe has been divided in three parts:

Short-term projects : 2014-2020

(Early harvest projects to be completed by 2017-18)

Medium-term projects: 2021-2025

Long-term projects: 2026-2030

Since 01-01-2014, Twenty Five (25) participants from Ministry of TextileIndustry were nominated for various foreign training courses by Economic AffairsDivision. all except Syed Abbas Mehdi, Manager (RDA), MP-III, Ministry ofTextile Industry,Government of Pakistan were regular employees. Thenomination of Syed Abbas Mehdi was received through his Ministry. The casewas considered by the Foreign Training Committee, in which three candidateswere nominated as principals. Syed Abbas Mehdi was classified as contractual inthe agenda and was proposed as the Alternate Candidate against Principal-I (Ms.Qurrat-ul-Ain, ACIR, RTO, Rawalpindi). The Chinese Embassy conveyedapproval of all the three principal candidates. However, later the Chinese Embassyapproved the name of Syed Abbas Mehdi as principal. It is important to point outhere that the final selection of the candidates is the discretion of the concernedEmbassy/Donor.

(b) Contract Employees are not covered under the definition of CivilServants in accordance with Civil Servants Act,1973, as such they are not entitledfor foreign training and scholarships. They are also not eligible for training abroadunder Technical Assistance Programme, which is exclusively meant for CivilServants only (Annex-A).

(c) All the training courses offered to EAD come under the technicalAssistance to Government of Pakistan offered by various donors agencies,therefore, there is no financial liability on part of Government of Pakistan.

Minister for Planning, Development and Reform (Mr. Ahsan Iqbal):(a) The Honorable Prime Minister of Pakistan, in All Parties Conference held on28th May, 2015 announced the construction of CPEC Western Route on priority.The Western route alignment starting from Burhan to D.I.Khan and onwards wasexplicitly announced to be constructed at the earliest.

So far, the National Highway Authority has successfully implemented 285km Western Corridor from Hakla –D.I.Khan (Yarik), which is divided into five(05) packages with simultaneous construction and early completion. Four (04)out of five (05) packages are under implementation, however, one package requires

model study owing to bridge construction over river Indus which is nearingcompletion.

Subsequent CPEC Western alignment beyond D.I.Khan i.e. 50 km Yarik –Sagu, the detailed design of a green field alignment has been completed. Similarly,the detailed design of last leg from Manikhwa to Zhob has also been completed.The middle section passing through Dhannasar is being investigated for possiblerealignment under the advice of local notables. The PC-1 shall be processed assoon as the design alignment is finalized.

From Zhob to Kuchlak, the existing road is in good condition and additionalcarriageway shall be constructed adjacent to the existing road under CPEC shortterm arrangement. From Kuchlak–Quetta–Surab, most of the road has beenimproved under the USAID programme, which includes Kuchlak Bypass, (04)bridges, weigh station and toll plazas. Construction of additional carriageway isplanned and procurement of Consultant for detailed design in being processed.

Economic Zones are part of Long Term Plan while Railways projects andfiber projects are part of Medium Term Plan.

(b) Feasibility studies as well the detailed design of D.I. Khan (Yarik) toHakla (285 km) has been completed. From Yarik to Zhob, the detailed design isnear completion. Consultant for feasibility study of Zhob to Kuchlak is underprocurement process.

(c) The proposed Industrial Parks/SEZs received from Provincialgovernments are at annex-I.

(d) The land (for Highways) is acquired for Hakla- D.I.Khan (Yarik).From Yarik-Zhob, the detailed design and PC-1 for land is under process. FromZhob-Kuchlak, Sec. 4 of land acquisition act, is ready for six (06) out of seven(07) districts present of this section.

(e) M/s NESPAK is working from D.I. Khan –Zhob. From Zhob toKuchlak, the procurement of Consultant is under process.

(f) The agreement was signed with M/s NESPAK on 25th June, 2015which are Pkg I to V of D.I. Khan-Hakla.

Minister for Finance, Revenue, Economic Affairs, Statistics andPrivatization (Mr. Muhammad Ishaq Dar): (a) it is factually not correct thatpoor widows are not receiving financial assistance under BISP. Since the inceptionof the programme, BISP has provided cash grants to more than 5.4 millionbeneficiary families which include 330,189 widows across Pakistan.

In 2010-11, a more sophisticated and objective approach of PovertyScorecard based on Proxy Means Test (PMT) was adopted and a door to doorsurvey using this Scorecard has been conducted, The Poverty Scorecard generatesa poverty score from 0 to 100 for each surveyed household, based on assetsavailable with the household. Therefore, lower the score, poorer the householdwill be. A out off score of 10.17 was set as eligibility criteria for BISP. A householdwithin the cut off score range of 0 to 16.17 is considered as ‘eligible’ for cashgrants by BISP. The cash benefit is provided to the adult ever married women,including widows, possessing a valid CNIC within an ‘eligible’ household.

It is also pertinent to mention that coverage and targeting accuracy ofBISP’s poverty survey was authenticated by various third party evaluations doneby reputed national and international firms.

with volatile law and order situation in the region have traditionally been misusedby the smuggling mafia. However, the quantum of smuggling into Pakistan throughthe border areas cannot be ascertained precisely.

(b) (1) Despite all odds, the Government is making all out efforts to controlthe menace of smuggling through multi pronged enforcement measures with specialreference to renewed border management mechanism on the western border withAfghanistan. Pakistan Customs is pursuing concerted anti-smuggling strategy whichincludes intelligence sharing and joint operations with the help of other LawEnforcement Agencies. As a result of the above efforts put in by the FBR in anti-smuggling operations, tangible results have been achieved which can be judgedfrom the following figures of seized smuggled goods;

(2) Steps taken by the Government to control smuggling are as under:

(i) FBR vide SRO 1090(1)/2010 dated 01-12-2010, has entrustedanti-smuggling powers to F.C (Khyber Pakhtunkhaw including FATA)to carry out anti-smuggling operations within 20 K.M of theinternational border.

(ii) The Political Administration of FATA has also been entrusted anti-smuggling powers under the Customs Act, 1969 to check the in-flow of smuggled goods in the bordering tribal belt.

(iii) The anti-smuggling powers have also been given to Pakistan CoastGuards vide SRO No.42(1)/2014 and Pakistan Maritime SecurityAgency vide SRO No.43(I)/2014 dated 20-01-2014 to checksmuggling in the coastal areas/ high seas.

(iv) Available resources and manpower, although meager, have beenpooled up for optimum use. The Director General of Intelligence &Investigation (Customs)-FBR has been assigned to coordinate anti-smuggling activities with other Law Enforcement Agencies.

(v) Major entry points/smuggling routes in the country are being monitoredthrough check posts and mobile anti-smuggling units manned byPakistan Customs with the assistance of Law Enforcement Agencies.

(vi) A dedicated Customs Border Enforcement (CBE) unit has been setup at Torkham Custom Station for vigilance on undocumented trade.

(vii) Scanners have been installed at land border custom stations at Chaman(Baluchistan) and NLC Terminal at Jamrud (Khyber Agency) forscanning of cargo.

(viii) Enroute tracking and monitoring of movement of all Afghan Transitcontainers / vehicles is being carried out under Tracking andMonitoring of Cargo Rules, 2012 notified vide SRO 413(1)/2012dated 25-04-2012.

(ix) A Joint Maritime Information Organization (JMIO), comprisingmembers of all Law Enforcement Agencies, working under theMinistry of Defence has been established at Karachi to address theissue of smuggling in coastal areas/ high seas.
