Thornbury Township Board of Supervisors Meeting Wednesday, April 6, 2011
The Thornbury Township Board of Supervisors held a Public Meeting on Wednesday, April 6, 2011, at the Township Administration Building, 6 Township Drive, Cheyney, PA. Chairman Raith called the meeting to order at 7:00 p.m.

Number of Attendees: 17 Chairman Raith introduced Jack Kerry and also Nick Roheleder who was invited to sit in on the meeting. He then announced that the Board previously held a brief Executive Session this evening regarding legal matters.
APPROVAL OF CHECK REGISTERS
On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the General Fund check register in the amount of $43,181.67 for March 17, 2011 through April 6, 2011, was approved. Chairman Raith called for public comment. There was no public comment.
On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $20,369.54 for March 17, 2011 through April 6, 2011, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Open Space Fund check register in the amount of $500,000.00 for March 17, 2011 through April 6, 2011, was approved. Chairman Raith called for public comment. Jessica Raymond asked what that was for. Chairman Raith explained that it was toward the recent purchase of open space from the Cannon property at Cheyney Rd. and Glen mills Rd.

On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sinking Fund check register in the amount of $18,711.38 for March 17, 2011 through April 6, 2011, was approved. Chairman Raith called for public comment. There was no public comment.
APPROVAL OF MINUTES
On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Wednesday, March 16, 2011 Work Session minutes were approved. Chairman Raith called for public comment. There was no public comment. BOARDS AND COMMISSSIONS Park and Recreation Board Joe Burke was not present but Chairman Raith mentioned speaking to Mr. Burke about the recent Antiques Appraisal’s success and the upcoming Easter Egg Hunt at Thornbury Park on the 16th. HISTORIC COMMISSION Eric Miller reported that they recently helped residents with historic property questions, gathered information on the Station Road proposed Historic District for the Board’s review. He then announced that the Timeline Sign Contract was awarded and the signs should be ready to unveil at the July 4th Celebration. Chairman Raith added that the Board will be addressing the Sign Ordinance soon. PLANNING COMMISSION Jim Bulkley reported that they did not meet last session but at the previous meeting spoke of solar and wind alternatives and ignored geo thermal. He announced the new Paaby Subdivision on Westtown Rd and is also continuing with Guilday. SEWER COMMITTEE Ted Jacquet reported that they drafted a letter to the residents at Fox Lair regarding a conceptual study of proposed routings and cost estimates for sewer infrastructure in their neighborhood. Chairman Raith mentioned the property adjacent to the Guilday Subdivision has applied for septic and wants to look into extending the sewer infrastructure to that property, to alleviate an on-site system. Mr. Seagraves mentioned that he had already been in contact with Ward Guilday about that issue. Chairman Raith asked the Sewer committee to follow up.

Environmental Advisory Council Al McCann reported their recent trail clearing was a success and their present plans for the next one will be in 2 weeks. They also revised their present open space recommendation list. Chairman Raith offered the help of the Township Professionals. LIBRARY Report Patty Hunsecker reported children, adult and teen membership is growing and they are closer to obtaining a credit card device. AGENDA ITEMS Chairman Raith and Jeff Seagraves announced that on behalf of Thornbury Township, we are very proud to present John Eagan, Chief of the Parkside Police Department, a well deserved recognition award for over forty years of dedicated service to the residents of Delaware County. Mr. Eagan was then presented his award. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the recommendation from the Historic Commission to waive a Historic Resource Impact Study at 325 Thornton Road, HRP #126 was accepted and approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the award of Sludge Hauling Contract No.S2011-01, to Aqua Wastewater Management, for a two year period, for the unit price of $.0636 per gallon of sludge hauled, at an estimated 500,000 gallons per year, at a projected cost of $63,600 for the two year period, was approved. Chairman Raith mentioned the savings. Chairman Raith called for public comment. There was no public comment. Chairman Raith then mentioned that it was a savings from our current contract. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, Resolution 11 of 2011, authorizing the Open Space purchase of approximately 13.065 acres of land from Scott and Sarah Cannon, located at 594 Cheyney Road, Glen Mills, Pennsylvania, was approved and adopted. Chairman Raith added that this property was # 7 on the Township’s Open Space Plan and with it’s proximity to Thornbury Park, will serve the township in many ways. Chairman Raith called for public comment. There was no public comment. PUBLIC COMMENT Jessica Raymond asked when the Treasurer will report. Chairman Raith explained that he reports on the second meeting of the month. Maureen McCann complimented the new floor. Chairman Raith elaborated.

TOWNSHIP MANAGER'S REPORT- Jeffrey Seagraves
The Township Manager’s Report was submitted and is attached. There was no comment on the manager’s report. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the authorization of Township Manager Jeff Seagraves to sign Subordination Agreements as they come before the Township, on behalf of the Board of Supervisors, was accepted and approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith asked Mr. Seagraves to move forward with setting up appointments for interviewing persons interested serving on our Boards and Commissions recently vacated seats TOWNSHIP ROADMASTER’S REPORT – Lindsey Price The Township Roadmaster’s Report was submitted and is attached. There was no comment on the roadmaster’s report. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the purchase of a rear tine tiller, for a cost not to exceed $850.00 to be used at the Township Complex and Thornbury Park for the purpose of making flower beds, mulching trees and tilling infield, was approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith commended the work of the Public Works Department. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the purchase of 30 yards of black organic root mulch at $22.00 per yard, delivered at a cost of $660.00, and 30 yards of screened topsoil at $24.00 per yard, delivered at a cost of $720.00, for a total cost of $1,380.00, from Mulch Works of Aston, was approved. Chairman Raith called for public comment. There was no public comment. TOWNSHIP SOLICITOR’S REPORT – Robert P. Anderman, Esq.
The Township Solicitor’s Report was submitted and is attached. There was no comment on the solicitor’s report.
TOWNSHIP ENGINEER’S REPORT – Elizabeth Catania, PE
The Township Engineer’s Report was submitted and is attached. There was no comment on the engineer’s report. Ms. Catania commended John Eagan.

TOWNSHIP SEWER ENGINEER - Justin Scarth,PE
The Township Sewer Engineer’s Report was submitted and is attached. There was no comment on the sewer engineer’s report. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the 2011 TV Inspection Contract awarded to the lowest bidder, Pipe Services Corporation of West Chester, PA at $0.80 per linear foot of pipe inspected, for an approximate total price of $5,160.00, based on estimated quantities, was approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith commented that we were successful with this in Thornbury Hunt. Vice Chairman Kelly mentioned Brandywine Convention and Visitors Bureau is sponsoring a ”Walk for the Wounded” benefiting wounded veterans and spoke of their fundraiser at Rose Tree Park scheduled for May 21st. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, a donation of $1000.00 to the fundraiser “Walk for the Wounded” was approved. Chairman Raith called for public comment. There was no public comment.

MANAGER’S REPORT 4-6-11
1. We received the preliminary report that was requested from Pennoni on High
Point and Fox Lair Drives. The sewer committee has made a request regarding a letter to be sent to residents of the fox lair development.
2. We have a settlement for the Cannon Property scheduled for April 12, 2011. 3. I received an inquiry from representatives of the Glen Mills Schools to reduce the
number of homes in the Purple Martin Drive housing cluster. They requested the approval to reduce the number of houses in that development for 58 to 44. We reviewed their process moving forward. We are awaiting their submission.
4. I met with Chip Vaughn to discuss the cleaning of the low pressure line in Andover. We will participate in this cleaning as a large portion falls outside of the footprint of the Andover subdivision.
5. Letters were sent last week to residents that are delinquent in their sewer bill payments. These ore residents that are currently using public sewer, but have not kept current in their payments for use.
6. We have secured a speaker the Memorial Day Ceremony. 7. We received two suggestions and four volunteers in response to our new addition
to the web site. We have forwarded the information to the appropriate e parties and will follow up on both the suggestions and the letters of interest.
8. I contacted representatives from both AFLAC and Allstate to schedule appointments to speak with our staff about supplemental insurance coverage.
9. We met with Kevin Wiley and representatives of TD Bank to discuss possible use of their services. We sent information last week and they are to send a proposal within the next week.
10. I am awaiting another proposal for the preventative maintenance contract before a recommendation is made to the Board of Supervisors.
THORNBURY TOWNSHIP Public Works Department Report – Week Ending April 1, 2011
1. Sign Replacement Project remains ongoing. 2. Pothole Repair Project remains ongoing. 3. Three Golden Cedar Pine Trees have been planted at Thornbury Park. 4. Performed spring cleanup at Palmer Arboretum. 5. Replaced broken water lines at Comfort Station and sink in men’s room at
Comfort Station. Opened Comfort Station for the season. 6. Waiting for mini-whirl for Tot Lot at Thornbury Park and a list of certified
equipment installers from Game Time. 7. Built podium for Township’s use. 8. Met with Jerry Daudert from the Lion’s Club. Mr. Daudert is in charge of
Memorial Day Services. 9. Met with Ric Miller regarding the placement of the time-line signs at
Thornbury Park. One final meeting will be held with representatives of the Park and Rec Board, Historical Commission, Historical Committee and Public Works Department.
10. Recommend the closing of the entrance to Bonner Park off Blossom Hill due
to it becoming a dumping area for large trash and a hang out area after dusk. 11. Reviewed all Park Permits for athletic field with Township Secretary.
Permits have been issued with new policies and rules attached.

Solicitors Report
April 6, 2011 The Township Solicitor, Robert P. Anderman, Esquire, reports as follows: I. WEST SIDE SEWER DISTRICT – MORTGAGE RECORDING The Solicitor has now recorded fifty-four (54) mortgages which represents all of the mortgages given to the Solicitor to record. There are still a number of property owners who have not contacted the Township which will require the filing of a lien against the property when properly authorized by the Board of Supervisors. The Township Staff is presently working with a number of the property owners in order to resolve the matter. II. PENSION PLAN ORDINANCE In this matter, the Board of Supervisors has authorized the Solicitor to advertise this Ordinance for consideration at the public meeting on April 20, 2011 and the advertisement has been forwarded to the newspaper. In this matter, the Solicitor recommends that the draft Ordinance be revised in order to reference the particular plan which the Board of Supervisors is adopting and also the retirement plan should be reviewed by a non- beneficiary staff member. III. CANNON PROPERTY – OPEN SPACE The Solicitor has scheduled a settlement on this property for April 12, 2011 at 10:00 a.m. at the offices of the Title Company, Land Services USA, Inc. located at 602 East Baltimore Pike, Suite 100, Media, Pennsylvania. The Title Company requires a Resolution authorizing the purchase of the property which will be prepared by the Solicitor, approved by the Title Company and submitted to the Board of Supervisors for adoption.

Blantyre - Completing periodic erosion and sedimentation inspections. Developer hasbeen notified of the need to repair silt fences and has complied.
Mill Creek - All work has been substantially completed. Completing periodic erosionand sedimentation inspections. Grading and Encroachment Permits - Working with the Township Licenses andInspections on several permits.
Andover - Completing sedimentation and erosion control inspections. Houseconstruction is continuing.
Greenbriar - Dallett V - Scheduled walk through with Kevin Moran of Orleans to go overthe deficiencies.
Cheyney University - The geothermal field work is completed. Topsoil will be spreadand sediment basin will be removed upon stabilization. Grading plan revision has beensubmitted for consideration (March 30) and will be reviewed.
Joseph Gricco - Received land development plans for a combined driveway for theLocksley Road property. A waiver of the separate driveway requirement is beingsought. The applicant has been asked to address this item.
Collins Subdivision - PaDOT comments must be addressed.
Wills - Plans have been received and reviewed. The Applicant has added a drivewayonto Skyline Drive.
Cherry Creek - Met with representatives of the three developers to discuss sidewalkconditions. Developers to prepare a response for the Boards consideration. TheSolicitor has forwarded a letter to request resolution of the matter. I am not aware of anresolution.
PaDOT Liquid Fuels - Reviewed PADOT street list for accuracy. A few streets havebeen added. The Secretary is researching files for deeds of dedication.
Road Program - The list of streets have been inspected and a preliminary cost estimatehas been prepared.
Paaby subdivision - Plans for subdivision have been received and will be reviewed forthe next planning meeting.

REGARDING WASTEWATER ISSUES
April 6, 2011
2011 TV SEWER INSPECTIONS
Pennoni has received quotes from three contractors for the TV inspection of approximately 6,450
linear feet of 8-inch sewer lines in Cobblestones and the Brinton Lake Colony (see attached
summary). Copies of the original bids were forwarded to the Manager. It is recommended that
the contract be awarded to the lowest bidder (Pipe Services Corporation) who performed the TV
inspection work in 2010.
Recommended Motion:
I move that the 2011 TV Inspection Contract be awarded to the lowest bidder, Pipe
Services Corporation of West Chester, PA at $0.80 per linear foot of pipe inspected for
an approximate total price of $5,160 based on estimated quantities.
2011 SLUDGE HAULING CONTRACT
The current Sludge Hauling Contract expires on April 30, 2011. Pennoni has worked with the
Manager to solicit bids that are to be opened on April 4, 2011. Pennoni will review the bids and
provide a recommendation to the Board at that time.
CHAPTER 94 REPORTS
Pennoni has prepared the Chapter 94 Reports for the East and West Side Sewer Districts. Copies
have been submitted to the DEP.
SEWER DEDICATION
Pennoni has received a letter requesting the preparation of a ‘punch list’ for Phase V of the
Greenbriar Subdivision. Pennoni performed an inspection of the manholes on March 18th. We
will coordinate our findings with the Developer as we await the televised inspection and as-built
plans.
WEST SIDE SEWERS
Pennoni prepared a brief feasibility study for providing sewer service to the residents along Fox
Lair Lane. A copy of the preliminary findings that were submitted to the Sewer Committee for
review is attached.

Pennoni received three unit price bids for the proposed Sanitary Sewer Inspection Project. Pipe Services Corporation was the low bidder with bid price of $0.80 per linear foot of pipe inspected (both on-road and off-road). The total cost of work based on an estimated length of 6,450 feet would be $5,160. It is recommended that the work be awarded to the low bidder, Pipe Services Corporation, for the 2011 Annual Televised Sewer Inspections. Attached are some sketches showing two alternatives for connecting the residents along Fox Lair Lane to the West Side
Sewers via a low pressure sewer system.
Alternate 1 does not require any easements, but will require a Highway Occupancy Permit for the section along Brinton
Lake Road. This option is expected to cost approximately $90,000 to construct (this figure does not include the lateral or
pump cost for each resident).
Alternate 2 is expected to cost approximately $75,000 to construct. However, it will require some additional easements
and the cost for these are NOT included in this number. (Again, this figure does not include the lateral or pump cost for
each resident).
