MINUTES Thornbury Township Board of Supervisors Meeting Monday, January 5, 2015

The Thornbury Township Board of Supervisors held a Public Meeting on Monday, January 5, 2015, at the Township Administration Building, 6 Township Drive, Cheyney, PA.

Chairman Raith called the meeting to order at 7:13 p.m. with a salute to the flag. PRESENT: James H. Raith, Chairman

Number of Attendees: 18 Chairman Raith announced that that the Board previously held a brief Executive Session this evening regarding legal matters. APPROVAL OF CHECK REGISTERS On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the General Fund check register in the amount of $50,713.09, for December 18, 2014 through January 5, 2015, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $15,071.89, for December 18, 2014 through January 5, 2015, was approved. APPROVAL OF MINUTES

On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Wednesday, December 17, 2014 Work Session minutes were approved as presented. Chairman Raith called for public comment. There was no public comment.

BOARDS AND COMMISSSIONS

PARKS & RECREATION Joe Burke was not present, Chairman Raith commented that Joe Burke has the evening off.

HISTORICAL COMMISSION Ric Miller wished everyone a Happy New Year and reported their meeting elections.

PLANNING COMMISSION

The Planning Commission did not meet. SEWER COMMITTEE Ted Jacquet wished everyone a Happy New Year and had nothing to report. ENVIRONMENTAL ADVISORY COUNCIL

Rich White was not present. LIBRARY BOARD Jean Mackenzie briefly commented on the report submitted and mentioned a position open. JR. SUPERVISOR Nikki Avella reported The Rustin girls varsity basketball team won on Jan 3rd at Garnet Valley with a score of 61 - 38. The DuPont Kids Club has been visiting the children ranging from ages 5 to 18 with winter crafts and have been raising money by having bake sales. They have also been helping out the Interact Club with their bake sale to raise money for families in need with children who are very sick. Vice Chairman Kelly thanked Nikki and welcomed her to the Board.

AGENDA ITEMS

On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously,

Advertising proposed Ordinance 2015-1, authorizing the participation of Thornbury Township in the PSATS Unemployment Compensation Group Trust, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, authorizing the Township Manager to attend a continuing education training course in Harrisburg, from January 12th through the 15th, was approved. Chairman Raith called for public comment. There was no public comment. PUBLIC COMMENT Eric Friedman asked if his zoning matter was under review. Chairman Raith said that it has been passed onto our Solicitor for review and will be discussed at our next meeting.

STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Jeff Seagraves

The Township Manager’s Report was submitted and is attached. Jeff thanked the Board for reappointment and mentioned a great staff for 2015 and welcomed Nikki Avella. Chairman Raith asked about the PennDot meeting and Jeff replied there were Army Corp issues being addressed. TOWNSHIP ROADMASTER’S REPORT – Lindsey Price The Roadmaster’s Report was submitted and is attached. There was no comment on the roadmaster’s report. Lindsey thanked the Board for reappointment. TOWNSHIP SOLICITOR’S REPORT – Kenneth Kynett, Esq. The Township Solicitor’s Report was submitted and is attached. There was no comment on the solicitor’s report. Ken thanked the Board for reappointment. TOWNSHIP ENGINEER’S REPORT – Mike Ciocco, PE The Township Engineer’s Report was submitted and is attached. There was no comment on the engineer’s report. Mike thanked the Board for reappointment.

TOWNSHIP SEWER ENGINEER’S REPORT – Charles Faulkner, PE

The Township Sewer Engineer’s Report was submitted and is attached. . There was no comment on the sewer engineer’s report. Chuck thanked the Board for reappointment and welcomed Nikki.

MANAGER’S REPORT

1-5-15

1. Work has been scheduled to start on 1-5-14 for the surge valve installation at the Mill Creek Pump Station.

2. I am seeking approval from the Board of Supervisors to attend the Residential plumbing academy at the PSATS Educational Center from January 12 to 15.

3. We have a Zoning hearing scheduled for Monday February 2, 2015 for an appeal to construct a residence at 369 Glen Mills Rd.

4. We are working on plans for our annual volunteer Recognition dinner. We have tentatively set the date for January 25, 2015.

5. We met with representatives of Penn DOT and their consultants to further discuss the proposed wetland mitigation at Barrett’s Meadow.

6. We are currently working on some new activities for residents for the upcoming year. The first is a “Parents Night Out”. Parents will be able to drop their child or children off to the township building and enjoy a night out while their children are entertained by an activity.

Township Solicitor, Kenneth D. Kynett Esquire, files the following report for January 5th, 2015: 1. Keswick Drive – Sent written notice to property owners with opportunity to cure run-off conditions created by property owners’ grading activity. 2. Outdoor Dining Ordinance – Discussed the general Zoning Code and status of the draft ordinance process and hearings held to date with counsel for Andover Homeowner’s Association.

3. Right-to-Know Requests – Discussed RTK requests filed in connection with the Guilday 5-lot subdivision project and pipeline regulations and directed the Open Records Officer to forward to me for further legal review.

4. Templin, et al – Spoke with counsel for Ms. Templin regarding suit filed by Ms. Templin against the DiNenno family. Also discussed Animal Control Officer capture of Ms. Templin’s dog for running free beyond the property lines, with the Township and with Ms. Templin’s counsel.

REPORT OF THE ENGINEER December Workshop Meeting January 5, 2015 Work completed for the period: Grading and Road Encroachment Permits – Reviewed several plans for grading and road encroachment. Continuing inspections of properties under construction. Andover – We have received information for concrete restoration in lieu of replacement. The information provided was solely the locations of developments where the material had been utilized. No information with regard to the date in which it was installed was provided, nor was any information with regard to the product itself provided. I will forward the request for additional information to the Developer. It would appear all other work will be completed in the spring. Wills - No further submission has been received. Lawler Subdivision - Awaiting revised plans. Planning Commission – Continued working with members on Pipeline Ordinance. Crane Property – No further action by the Developer. Romill Associates – Work on the retaining walls is continuing and stormwater work has begun. Mill Creek – Awaiting work to continue in the spring. 103 Lockley Road – Provided guidance to Township as requested. Road Program 2014 – All Paving is complete. Completion report has been forwarded to and approved by PADOT. Awaiting final paperwork from contractor for close out.

ENGINEER’S REPORT REGARDING WASTEWATER ISSUES

January 5, 2015

East Side Sewer District

NPDES Permit Renewal for WWTP

We are continuing to complete the necessary documents for renewal including

coordination for the required analytical testing.

Guilday Subdivision

A meeting was held with the Developer and his new contractor, Steve Botella

Construction and Excavation on December 16, 2014 to review the remainder of the work

to be completed. The Developer has not provided any timeframe for the commencement

of this work.

Gricco Subdivision – 205/209 Locksley Road

Both laterals were successfully tested on December 22, 2014. As-built drawings of the

lines within the Township right-of-way remain to be submitted.

Greenbrier Phase V (Dallet)/Squire Cheyney Farm

We are continuing to review the video inspection of the sanitary sewer system through

the Squire Cheyney Farm Developement. In addition, we also recently received as-built

plans of the pump station.

West Side Sewer District

Mill Road Pump Station Surge Relief Valve

A meeting with the contractor and Concord Township was held on December 16, 2014 to

review the logistics and coordination with Concord for the proposed work. The

installation is tentatively scheduled for the week of January 5, 2015.

Audi of West Chester

Construction is underway on this facility. We will continue to work the Developer to

resolve the remaining outstanding items.
