MINUTES Thornbury Township Board of Supervisors Meeting Wednesday, August 19, 2015

The Thornbury Township Board of Supervisors held a Public Meeting on Wednesday, August 19, 2015, at the Township Administration Building, 6 Township Drive, Cheyney PA.

Chairman Raith called the meeting to order at 7:08 p.m. with a salute to the flag.

Attendees: 12 APPROVAL OF CHECK REGISTERS On a motion by James Kelly, seconded by James Raith, and carried unanimously, the General Fund check register in the amount of $114,960.14, for the period July 16, through August 19, 2015, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by James Raith, and carried unanimously, the Sewer Fund check register in the amount of $35,498.18, for the period July 16, through August 19, 2015, was approved. Chairman Raith called for public comment. There was no public comment. BOARDS AND COMMISSSIONS

PARKS & RECREATION Joe Burke was not present and they did not meet in July.

HISTORICAL COMMISSION

Ric Miller reported Mike Payton’s resignation and their recommendation to have Dave Miller complete his term. Rob Lukens from Chester County’s Historical Society died August 1st and we are looking for a donation. The Quilt Project and Oral Histories are in the works and we recently met with representatives of the Delaware County and Chester County Historical Societies to determine if they would be interested in partnering with us on our Oral Histories Project. Both expressed interest.

PLANNING COMMISSION

Jim Quinn was not present and they did not meet in July.

SEWER COMMITTEE Ted Jacquet was not present and they did not meet in July.

ENVIRONMENTAL ADVISORY COUNCIL Rich White reported they did not meet in July, but are discussing wet land remediation in Barrett’s Meadow.

LIBRARY BOARD Jean Mackenzie was not present but her report was submitted.

AGENDA ITEMS On a motion by James Kelly, seconded by James Raith, and carried unanimously, Ordinance 2015-2, amending the Thornbury Township, Delaware County, Zoning Code, Chapter 27, as amended, to amend Article 3, to rezone certain property within the Township, from C-Commercial District to R-1 Residential District, from R-1 Residential District to C-Commercial District, and from Q-1 Quarry District to C-Commercial District, and to update the Official Zoning Map of Thornbury Township to reflect such rezoning, was approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith asked Ken for a post hearing notice.

On a motion by James Kelly, seconded by James Raith, and carried unanimously, Ordinance 2015-3, amending the Thornbury Township Delaware County, Zoning Code, Chapter 27, as amended, by repealing Article 15 Floodplain Conservation District and re-enacting Article 15, Floodplain Conservation District with new and amended provisions required to comply with the minimum standards and requirements of the National Flood Insurance Program and the Pennsylvania Flood Management Act, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by James Raith, and carried unanimously, accepting the extension granted on the "Crane" Subdivision, extending the present action date from September 8, 2015, to December 7, 2015, was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly, seconded by James Raith, and carried unanimously, the Copier Contract with Heritage Business Systems, Inc., as set forth in their CoStars Contact (# 001-047) Proposal dated August 11, 2015, was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly seconded by James Raith, and carried unanimously, Advertising for Bids for the 2016-2018 Recycling Contract, as per specifications and conditions set forth in the contract requirements, was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly seconded by James Raith, and carried unanimously,

the 2015-2016 Inter-Municipal De-Icing Salt Contract with Cargill De-Icing Technology, at a set price of $62.85 per ton, delivered, was approved. Chairman Raith called for public comment. There was no public comment

On a motion by James Kelly seconded by James Raith, and carried unanimously,

authorizing the Township Engineer to advertise for Public Comment on the “Goose Creek Basin, MS4 TMDL Plan”, was approved. Chairman Raith called for public comment. There was no public comment.

PUBLIC COMMENT

Jeanette O’Hanlon mentioned the dead grass in her yard and asked if it could possibly be PennDot’s fault, even though she spoke to Mr. Carbutt about it, who had confirmed speaking with PennDot, and had informed her that PennDot did not conduct any road edge spraying in that area. She asked that the Township continue to look into it, to which Chairman Raith agreed. She then complained about Steve Botella driving across Mrs. Templin’s yard despite a Court Order. Chairman Raith explained that it was not our jurisdiction and that it is a property dispute handled by the court system. Mrs. O’Hanlon then suggested that the Township no longer do business with a contractor that ignores Court Orders. Chairman Raith said that we will take that into consideration. George Morley wanted to give an “Atta-Boy” to Jeff Seagraves and thanked him for getting the owners of the road edge embankment by Stone Ridge Road, to cut back their weeds in a timely manner.

STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Jeff Seagraves

The Township Manager’s Report was submitted and is attached. Jeff commented that the fall newsletter was mailed out, the fishing derby will be October 17th. We recently held a movie night and another is scheduled for August 28th with Makin Music, and the last summer event of the season will be the September 24th fireworks. He also mentioned the Crabfest was a great success this year. He then reported about notification from Sunoco Pipeline Logistics, regarding upcoming line work and that we will keep the residents informed. There was no comment on the manager’s report.

TOWNSHIP ROADMASTER’S REPORT – Lindsey Price The Roadmaster’s report was submitted and is attached. Lindsey asked for an OK to proceed with the installation of a new electric line and service at 90 Station Road. He also reported that the 2015 Road Program will begin in August. There was no comment on the roadmaster’s report. On a motion by James Kelly, seconded by James Raith, and carried unanimously, Accepting the bid from Commercial Line & Electric to perform the required work at 90 Station road, for a total of $8785.00, was approved. Chairman Raith called for public comment. Rich White asked about the line use. Chairman Raith explained.

TOWNSHIP TREASURER’S REPORT – Amanda Gattuso The Township Treasurer’s Report was submitted and is attached. Amanda reported and there was no comment on the Solicitor’s report. On a motion by James Kelly, seconded by James Raith, and carried unanimously, the Treasurer’s Report for July 31, 2015, was accepted as presented. Chairman Raith called for public comment. There was no public comment.

TOWNSHIP SOLICITOR’S REPORT – Kenneth Kynett, Esq. The Township Solicitor’s Report was submitted and is attached. Ken reported and there was no comment on the Solicitor’s report.

TOWNSHIP ENGINEER’S REPORT – Mike Ciocco, PE The Township Engineer’s Report was submitted and is attached. Mike reported the road program to start Monday. There was no comment on the Engineer’s report.

TOWNSHIP SEWER ENGINEER’S REPORT – Charles Faulkner, PE The Township Sewer Engineer’s Report was submitted and is attached. Chuck reported that the line on Dilworthtown Road was located, the Tap-in performed and will be inspected. There was no comment on the Sewer Engineer’s report.

On a motion by James Kelly, seconded by James Raith, and carried unanimously, the resignation of Mike Payton from the Thornbury Township Historical Commission, effective September 16th, and the appointment of Dave Miller to complete his term, was approved. Chairman Raith called for public comment. There was no public comment.

MANAGER’S REPORT

8-19-15

1. We received a complaint regarding two vacant properties in the township. One required attention to the grass which was taken care of last week and the other required replacement of a pool gate which was done last week as well. We are working to make contact with the banks that are currently in ownership of the properties.

2. The easements for two properties associated with the Andover Off-site low pressure line. The agreements have been reviewed by the Solicitor and we expect them to be executed by the residents for our next meeting.

3. We held our annual Crabfest on Friday July 24, 2015. The event was well attended., 4. We held Movie night at Thornbury Park on Saturday August 8, 2015. There were over 100

people in attendance. We have another event scheduled for Friday August 28, 2015. Makin’ Music will start off the event at 7:00PM and they will be followed by the showing of “Wreck it Ralph”.

5. We were contacted by the Glen Mills Schools regarding partnering on community Service to be performed by students from the school. I have contacted several of our Boards and commissions to solicit projects for the students.

6. We received notification from Sunoco Logistics that they are planning to do some line work on the 12 inch line that traverses a portion of the township. They are planning the work for Friday august 28, 2015. They have indicated that they will contact the residents adjacent to the line. We are doing so as well.

7. The Fall Township Newsletter was mailed out the week of August 10th. 8. We are currently working on the Children’s Fishing Derby. I have been in contact with The

Sporting Gentleman located at 128 Glen Mills Road. They have indicated that they are interested in partnering on the event.

9. We are recommending that the Board of Supervisors approve advertisement of t of the Recycling contract, as well as the Goose Creek basin portion of the MS$ plan.

10. We recommend that the Board of Supervisors accept the bids for the 2015-16 Salt contract. The low bidder was Cargill at $62.85 per ton.

11. We recommend that the Board authorize executing the copier contract with Heritage Business Systems Inc. . The new contract will take effect January 2016 and is a five year contract. The cost is $299.00 per month. This copier is offered under Co-Stars contract 001-047.

12. We have received the resignation of Mike Payton from the Historical Commission and recommend that the Board accept Mr. Payton’s resignation. His term expires in December 2015.

13. We received a 90 day extension request from Alyson Zarro, the attorney for the Crane Subdivision, extending the deadline to December 7, 2015.

THORNBURY TOWNSHIP Public Works Department Report – Week Ending August 14, 2015

1. Routine maintenance performed throughout the Township, including mowing of Parks.

2. Performed maintenance on equipment.

3. Repaired road edge washout on Locksley Road due to storm damage. Repaired with Riprap.

4. Creek Road has been marked out for milling and paving by PennDOT. They anticipate beginning project within next few weeks.

5. Cleaned up down trees along Luckenbach Trail at request of EAC.

6. Clearing out old equipment at Salt Storage Building. Three dumpsters have

been utilized to date.

7. Inlet repairs ongoing. Tall Trees and Cherry Creek Developments are complete. Currently working on Greenbriar Development.

8. 2015-16 Salt Contract has been awarded to Cargill – see attached. Ordered 1,200 tons of salt.

9. Received pricing to have electricity installed in the Barn at 90 Station Road. See attached.

10. Currently in the process of obtaining pricing to replace storm water drainage pipes at driveway entrance of 90 Station Road.

11. Road Program to begin September 27, 2015.

12. Spoke with representative of Sun Logistics Pipe Line regarding venting pipes at Andover Pump Station on August 28, 2015 between 8:00 a.m.-4:00 p.m. Will notify all surrounding property owners. Requested that a representative of Sun Logistics attend the Board of Supervisors’ meeting on August 19, 2015.

REPORT OF THE ENGINEER July Workshop Meeting August 19, 2015

Work completed for the period:

Grading and Road Encroachment Permits – Reviewed several plans for grading and road encroachment. Continuing construction inspections of various properties.

Planning Commission – Continued working with members on Pipeline Ordinance.

Subdivision Plans: Wills - No further submission has been received. Lawler Subdivision - Awaiting revised plans. Crane Property – Issued review letter on revised plan submission and awaiting response.

Floodplain Ordinance – Revised Draft Ordinance per PC & DCED. Anticipate schedule as follows: June 10 – Planning Commission made a recommendation for approval. June 17 – Supervisors authorize sending Ordinance to the County for 30 day review. July 15 – Supervisors authorize advertisement for Public Hearing at August 19th Meeting. July 17 – 30 day DCPD comment period expires. DCPD recommends approval. July 8 – PA DCED has approved the Revised Floodplain Ordinance as compliant. August 19 – Supervisors hold hearing on Floodplain Ordinance and can adopt that

night or hold off, if necessary, and adopt on September 2, 2015 (deadline for FEMA).

Andover – Concrete restoration sample location has been reviewed and recommended for approval on curbs only with an extended maintenance bond period for those areas. Storm sewer video inspection has been reviewed and requires numerous repairs prior to acceptance. Public Improvement repair work (curb, sidewalk, and roadway) has begun in an effort to prepare for the roadway dedication process.

Romill Associates – Parking lot base, curbing and storm sewer is completed. Working on finishing up remainder of site work.

Mill Creek – Awaiting work to continue. Reviewed site for deficiencies and preparing list.

Greenbriar V – Dallet Tract – New punch list was issued and recommendation on escrow reduction was forwarded for consideration.

Road Program 2015 – Contracts have been executed and approved by PA DOT. Contractor expects to start work on August 24, 2015.

Snow & Ice Contract – Awaiting return of Contracts from Knight Brothers for execution.

3 Keswick Drive – Drainage improvement work on Keswick and Slitting Mill Road has been certified by the engineer of record. Final inspection during a rain event will be performed prior to recommendation of permit closeout.

90 Station Road – Sketch plan for roadway drainage improvements is with Roadmaster.

Barrett’s Meadow – Reviewed PA DOT wetlands mitigation plan with committee. Sent updated list with concerns to PA DOT along with a status update request.

Commercial District – Legal descriptions completed for revisions to boundaries of the commercial districts. Reviewed by Planning Commission. Ready for Ordinance Hearing on August 19, 2015. Sunoco Logistics – Attended informational meeting with Sunoco. New 16” and 20” pipelines for liquid propane, ethane and butane are proposed through open space of Andover and behind Duffers and along their existing pipeline in that area. New valving proposed at existing valve site behind duffers. In discussions with Sunoco officials and engineers, they stated that no odor or sound would be associated with the proposed improvements in Thornbury. No new pump stations proposed within Delaware County. NPDES MS-4 - Goose Creek Basin TMDL Plan – Request for Authorization to advertise for public comment on the “Goose Creek Basin MS4 TMDL Plan” on or about September 1, 2015. Plan required to be submitted by December 31, 2015. Required compliance within 15 years of permit, currently yields year 2028 to meet reduced phosphorous rates.
