Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

The CA Contractor’s Board is making decisions that will have ramifications for all who ‘qualify’. More than one Registrar is also ‘aiming’ high in defeating some low-down activity… At it’s September meeting in Sacramento the CSLB took action on a number of issues, including setting up a Task Force to look at the duties and responsibilities of qualifying individuals. The discussion centered around a perceived lack of “understanding by license ap-plicants, licensees and the public on the minimum requirements of the individual qualifying on behalf of a firm (Responsible Manag-ing Officer (RMO) or Qualifying Partner (QP)”. The CSLB has determined that some “retiring” licensees are serv-ing as an RMO on a corporate license for a monthly fee but have “no direct involvement in the construction and business activi-ties”. To address this problem, the Board has recommended that: 1) information be distributed clarifying the duties and responsibilities of the qualifying individual; 2) pursue legislation to amend B&P Code 7068.1(d) to provide for disciplinary action “when a licensee or qualifier fails to comply with the duties and responsibilities the qualifying individual certified he/she would perform”; and 3) “establish a task force to further identify the scope of the problem; investigate suspected individuals who attempt to qualify multiple licenses; and explore administrative and legislative remedies.” We would also like to see the Task Force look at a fourth area to make clear that a Responsible Managing Officer is in compliance with the Board’s rules and regulations where, for instance, there are multiple ongoing projects some of which are overseen by his or her director of operations, project manager, superintendent, etc. The task force may want to look at what we perceive as a disturbing trend where attorney’s go to court to challenge a contractor’s legiti-mate compliance with Code Section 7068.1 in order to make a case for using what might be described as ‘draconian’ penalties in B&P Code 7031 (the section of law that deals with recovering compensa-tion and/or forcing a contractor to pay back all monies received on a contract if they’re determined to be “unlicensed”). Also, according to a recent Press Release, for the second time in three months, the California Contractors Board (CSLB) and Ari-zona Registrar of Contractors (ROC) joined with several other state licensing boards, including Nevada, Utah, and Oregon in a sting of unlicensed contractors advertising on Craigslist. The combined effort led to over 150 unlicensed contractor investigations. In CA

alone, 36 individuals were arrested and now face misdemeanor charges of contracting without a license, illegal advertising and/or requesting an excessive down payment. According to the Board, “eight of the phony contractors were issued Stop Orders”. Additionally, the participating Contracting Boards along with the National Association of State Contractors Licensing Agencies (NASCLA) again issued a nationwide consumer alert regarding irregularities on the Internet. According to CSLB Registrar Steve Sands, “While Craigslist serves as a valuable free tool for legiti-mately licensed and insured contractors, the number of illegal and deceptive ads is growing like wildfire”. The Arizona sting led to 9 unlicensed contractor investigations. The ROC routinely refers unlicensed contracting cases to the Maricopa County Attorney’s office for prosecution. Not only are these State agencies trying to protect consumers by deterring illegal construction activities, but they also aim to level the playing field for legitimate contractors in the industry. • Governor Signs ADA Reform Bill

SB 863 Becomes Law

Proudly, SB 863 (de Leon), which is the workers’ compensation

reform package, was signed into law yesterday. Since I had

worked closely with the governor, his staff and several of the key

architects to help make the workers’ compensation reform package

a reality, I was invited to attend the bill signing ceremonies.

The morning bill signing started promptly at 9:30 AM in San

Diego at a small printing plant, and then was repeated in the

afternoon at Disney’s headquarters inside a sound stage. Attached

are several of the pictures I took, including two of the thank you

signs to the side of the governor which listed our association as

one of the strong supporters of the reform package. Since I’m sure

that you won’t be able to zoom in and read the names ( because I

only had my I Phone camera) I’ve attached a handout that lists the

supporters.

So, will the package help reduce employer costs while also

increasing the benefits for the truly injured? Emphatically I

can state a strong YES! Indeed, as I reported two weeks ago,

at the worst case instead of a 12-18% increase in your workers’

compensation rates starting in January, the measure will reduce

employer costs by 1%. However, this is the number that the “bean

counters” used in the Workers’ Compensation Rating Bureau. It

does not reflect what the true savings will be once the myriad

regulations that have to be developed are fully implemented in

2014. As a matter of fact, I believe the savings will actually be

well over 10% or more. Oh, and towards achieving that goal,

I’m set to spend all day Tuesday, October 2nd in Oakland with

the Director of the Department of Industrial Relations (Christine

Baker) and the other interested stakeholders to develop the

regulations as quickly as possible.

Are there caveats to my claims? Certainly. For example, IF the

courts start “handing down” bad decisions that start to erode the

agreement, then all bets are off! So too, if “the bottom feeders”

that the reforms were targeted to “stamp out” figure out ways

around the new system, then that too could affect the savings.

But, you know, “hope springs eternal” that every action made

WILL result in the desired savings and that the reforms not only

survive, but THRIVE for the sake of the injured employees and for

the employers who have to “foot” the bill. This doesn’t mean that

there won’t be necessary “tweaks” made to the language in future

legislation. Surely this is a living document that will mean that

we will indeed have to make some adjustments along the way. But

that only means that we’re doing our best to ensure that the reform

package does what it is intended to do - save employers “chunks”

of money, while helping to provide the truly injured workers with

the benefits that they surely deserve! Stay tuned!

Governor Signs ADA Reform Bill

I am happy to report that the governor signed another important

bill today that we also strongly supported, SB 1186 (Steinberg

and Dutton), which is a measure intended to protect California

businesses from predatory legal action while improving access

for members of the disabled community. This bipartisan effort

became law immediately upon the Governor’s signature today, as

both houses of the Legislature passed the bill with overwhelming

support as an urgency measure.

The bill brings reform to the state’s disability access law by

prohibiting “demand for money” letters, where attorneys target

businesses with alleged minor access violations and demand a

quick monetary settlement in lieu of a more expensive lawsuit or

fixing the problem to improve access. Among other provisions,

the bill prevents attorneys from “stacking” multiple claims for

the same alleged violation in order to increase monetary awards,

while it also reduces statutory damages for businesses that fix

unintentional violations within 30 to 60 days.

“The whole point of our state and federal disability access laws

is to remove barriers for the disabled, giving them full and

equal access to businesses like everyone else. Up until now

unfortunately, it was often cheaper and quicker for business

owners to settle out of court than to remove those obstacles,”

said Steinberg. “SB 1186 will instead provide more incentives to

fix the violations and enhance accessibility. After many months

of working with business and disability rights advocates, this

compromise applies common sense to difficult issues.”

While the new law prohibits demand letters asking for money or

offers to settle, an attorney with a claim for damages can still send

a letter to a business pointing out the alleged violation and advise

the owner and/or tenant they “may be civilly liable for actual

and statutory damages for a violation of the construction-related

accessibility requirement.” Any complaint must also specify the

alleged barrier with the date and manner in which it denied access

to a person with a disability.

In addition, SB 1186 makes a distinction between intentional

and unintentional violations. While a business or property

owner would be eligible for reduced damages if the violation is

unintentional and is fixed within the statutory time frame, the

law preserves the full statutory damages liability for intentional

violations.

Safety Practices While Working on Excavation Sites Each year, trench collapses are one of the leading causes of injury and death on construction sites. Of these incidents, most of the victims were new employees who lacked training and guidance prior to entering the job site. Sadly, most accidents were preventable. Whether you are new or a seasoned employee, it is essential that you adhere to Occupational Safety and Health Administration (OSHA) regulations to ensure the safety of the entire work crew. Trench Requirements

• Trenches five feet or more in depth require a protective system.

• Trenches that are four feet or more require a safe means of entrance and exit.

• Trenches that are 20 feet or more require an exit system designed by a registered professional engineer.

Protective Systems The designated competent person should inspect the area and determine which protective system will suit the job site and soil most effectively. This is essential, as equipment movement, underground utilities and vibrations can cause a surcharge load on the sides of the trench, forcing it to cave in on the workers inside. The following are the most commonly used protective systems:

• Sloping: Protects workers by cutting back the trench wall at an angle inclined away from the excavation

• Shoring: Protects workers by installing aluminum hydraulic supports to prevent soil movement

• Shielding: Protects workers by using trench boxes to prevent cave-ins

In addition to one of these three safety measures, a low-traffic zone must be designated around the trench allowing only essential equipment to enter. This will minimize the amount of vibration to which the trench is exposed. Avoiding Accidents Excavation accidents can occur if the underground utilities are not located and removed prior to digging a trench. Contact your local one-call system to locate all of the utility lines. Then, label or remove them to prevent injury. Trench accidents can also happen if safe entrance and exit routes are not present or adequate for the situation. Workers may slip back into the trench as they are trying to climb up a ladder if it is unsupported, placed on a steep slope or is poorly built. To prevent injury while entering and exiting a trench, only the designated competent person should approve the structural device used. Workers should also place the ladder in a trench shield while trying to enter and exit to avoid a cave-in. By complying with OSHA regulations and following these safety precautions, the risk of injury at your job site will be greatly reduced. wants everyone on our team to keep safety in mind!
