PLANS for a bigger, better police stationat St Francis Bay are progressing well.

Kouga Executive Mayor Booi Koerat saidthe municipality had met with the Depart-ment of Public Works last week to ensurethat the project was on track.

“The aim is to complete the preplanningby the end of February next year, so thatconstruction can start in the 2012/13 finan-cial year,” he said.

He said the municipality and Depart-ment were finalising the Service LevelAgreement (SLA) for the new police station.

“The SLA is necessary to ensure that themunicipality has the capacity to cater forthe service requirements of the develop-ment, including, water, sewerage, electrici-ty, roads, stormwater and refuse removal,”he explained.

He said the Department had already sub-mitted a site development plan for the new

station, which will be built on the cornerof St Francis Drive and Tarragona Avenue, and that the final building plans should besubmitted by February next year.

“The other outstanding matter is theownership of the land where the police sta-tion is to be built,” the mayor said.

“The land was supposed to have beentransferred to the St Francis Bay Transi-tional Local Council (TLC) whenSantareme was developed, but the TLC didnot do so. Consequently, the land is still re-gistered in the name of the disbandedSantareme Homeowners’ Association andmust now be transferred to Kouga so thatwe can transfer it to the Department.”

According to the site development plan, the new police building will have a totalfloor area of 1 750m². This includes a servicepoint (214 m²), office space (36 m²), crime in-vestigation unit (82 m²), crime preventionunit (176 m²), cells (382 m²) and a wash bay.

With a trackrecord spanning nearly 40 years, HartenbergShiraz enjoys an unmatched reputation forhigh-end quality and above all, consistency. The ability to age gracefully is a commonthread that runs through all 36 vintages pro-duced todate atHartenberg.Manyof the older

wines are still drinking well after 20 and 30years. For Carl, Hartenberg’s winemaker ofthe past 17 years, this is the most finite mea-sure of quality. “We feel that only after fouryears does the variety start to give one aglimpse of the locked-away potential lurkingin the bottle,” said Carl.

Have your will drafted free of chargeARE you making arrangements for your year-end holiday? Did you recently buy a house orflat? Did you get married this year or move inwith your companion? Then you should ensurethat your affairs are in order by having a willdrafted by an attorney – for free.

From October 17 - 21 attorneys participating

in the National Wills Week initiative will draftbasic wills for members of the public free ofcharge. More than 1 000 attorneys’ firmsthroughout South Africa are participating inthe National Wills Week project.

The aim of National Wills Week is to high-light the importance of having a valid will in

place to ensure that the wishes of testators aretaken into account when they die, and thattheir assets are disposed of according withtheir wishes.

Also, this initiative is to encourage membersof the public who would not normally make useof the services of an attorney, or who may hesi-tate to approach an attorney for various rea-sons, to consult an attorney.

Why approach an attorney to draft yourwill? An attorney has the necessary knowledge and

expertise to ensure that your will is legally va-lid and complies with your wishes. An attorneycan also advise you on any problem which mayarise with regard to your will. Often a will isnot valid because the person who drafts it doesnot have the necessary legal knowledge to en-sure that the requirements of the law are met.

What could happen to your estate if you diewithout a valid will?If you die without leaving a valid will, your as-sets will be distributed according to the provi-sions of the Intestate Succession Act. The pro-visions of this Act are generally fair and ensurethat your possessions are transferred to yourspouse and children.

But, the following problems may arise if youdie without leaving a will:.Your assets may not be left to the person ofyour choice..It can take a long time to have an executorappointed. The executor who is appointed maybe somebody you may not have chosen your-self..There could be extra and unnecessary costs..There could be unhappiness and conflictamong members of your family because thereare no clear instructions on how to distributeyour assets.

During Wills Week attorneys participatingin the National Wills Week project will drafta new, basic will for members of the public forfree. Attorneys will not amend or redraft exist-ing wills.

The contact details of attorneys participat-ing in the National Wills Week project can beaccessed on the LSSA website at www.LS-SA.org.za.

YOUR PROPERTY QUESTIONS ANSWERED

Agent lets owner downPROPETY POSER ASK THE EXPERTS

ONE of our readers is unhappywith both a recent tenant of herproperty and the letting agentwho initially secured and handledthe tenant.

It appears that the agent introducedthe candidate and assured the readerthat she was suitable and that all cred-it checks had been properly per-formed. The reader was satisfied withthis and signed the lease agreement.

At first everything went smoothly. The rental was paid on time and thereader had no other issues with thetenant. However, from the thirdmonth problems arose. The rentalpayments were made on the seventh

of the month or even later and thereader soon realised that a few thou-sand rands worth of damage hadbeen caused to the property.

The agent was not very helpful inrecovering the late rental payments. After doing some investigation of herown, the reader discovered that thistenant had judgments against hername and was in fact not suitable, de-spite the agent’s initial claims to thecontrary. The reader then decided totake steps of her own to rectify thesituation. The tenant eventually va-cated the premises of her own ac-cord, but left the last month’s rentalunpaid and the damage to the proper-ty unrepaired.

The reader issued summonsagainst the defaulting tenant, but thesheriff could not find any goods to at-tach to satisfy the judgment that hadbeen obtained.

It transpired that the ex-tenantwas now also unemployed so her sa-lary could not be garnished to repaythe outstanding amounts.

The whole experience has left thereader out of pocket and she wouldlike to know where her remedy lies.

We are not told what exactly theterms of the agreement between thereader and the letting agent were orwhether a written contract was con-cluded, says Wanda Hayes from Hui-zemark Jeffreys Bay.

“Nevertheless, it does appear thatcertain representations were madeby the agent. The landlord acted up-on these representations and suf-fered damages as a result.”

Hayes questions whether the rea-der would have concluded a rentalagreement with any tenant who didnot have a clean credit record.

“It appears that creditworthinesswas a clear requirement set by thereader and that she would not haveentered into an agreement withsomeone who did not comply.”

Herman Pieterse from Jan VisserAttorneys in Jeffreys Bay says theremay therefore be scope for a contrac-tual claim for damages against the

letting agent.“This would most likely be for

breach of the terms of the agreement, which involved finding a creditwor-thy tenant.”

The proof of the breach is quite clearin the tenant’s subsequent misconductdespite the agent’s false assertion ofher good standing, says Pieterse. “Al-ternatively, our reader may have adelictual action against the agent, based on the misrepresentations thatwere made. When the rea-der acted onthese misrepresentations, it led to thedamages that were incurred.”
