I have a confession to make...Although I am a qualified solicitor and have been drafting wills for other people since I was about 23 it was notuntil I was 42 that I actually made my own will. My wife and I could not agree which unfortunate members of ourfamily should bring up our daughter if we were both to shuffle off this mortal coil. In the end we simply decidednot to die – and in fairness our plan worked well, although there were one or two scary moments on the M25when my wife did question the wisdom of our decision.

It was only when we had to travel abroad for the first timewithout our daughter that we decided we really needed tofinalise our wills. I try to make that sound as if it was arational decision upon which we both agreed. In reality itwas my wife who delivered an ultimatum. She said shewould not get on the plane unless we had both signed ourwills – which was hardly a ringing endorsement for thesafety record of Easyjet but I could understand where shewas coming from.

Amazingly some two thirds of the people who die inBritain every year do so without having made a will – theequivalent of more than 1,300 every day. Why is this?

I suppose most of us have a natural aversion to thinkingabout death and some people, like me I have to admit, aresuperstitious and think that by making a will they aretempting fate. Ironically the statistics show exactly theopposite. On average people who make a will live longer

than those who die intestate, so you could argue thatmaking a will adds to your chances of living longer!

When I heard this statistic I thought the Law Societyshould use it as part of a great advertising campaign.“Make a will and add two years to your life expectancy”may not be quite as catchy (or as unintentionally amusing)as “Keep a bit on the side with Nationwide” but it mighthave attracted a few more clients through our doors. If I’mhonest my suggested slogan may be stretching the truth,but making a will does not affect your chances of dyingand it is always a positive thing to do for those you love.

Another common misconception is that people don’t needto make a will as the government will sort out everythingfor them. Well to a certain extent this is true. Thegovernment has set down strict rules for who gets what ifyou die intestate. The problem is that these rules may notreflect what you wanted. You run a horrible risk that yourestate will end up in the wrong hands and it could allultimately go to the government (boo hiss). Whilst thismight please George Osborne I somehow suspect it is notwhere you would have chosen to give your money.

Certainly if you are living with someone who is not yourspouse or civil partner the problem is particularly acuteas they will not automatically be entitled to a share of yourmoney. Similarly your friends, distant relatives andfavourite charities will also lose out as they will notreceive anything under the intestacy rules.

If you have young children then a will really is essential.You need to make it clear who will be responsible as

guardians for their upbringing and who should look afterand invest your money for them until they are old enoughto do so themselves.
