Although the Global scene may look gloomythese events are generally out of our directcontrol. Sooner or later some balance isrestored to the market and a down-turn becomesa ‘boom’ once again. Therefore, one can eitherwait indefinitely and make no decision regardingproperty or simply try and interpret the localmarket and turn uncertainty to an advantage.

Since the start of the New Year our Company hasbeen actively involved in discussing all the optionswith our clients. We are now receiving a solidstream of quality property onto the market asmore of our clients realise that ‘life does go on’and whatever the Global position maybe, familyneeds and work requirements have greater priority,whether the circumstances are perfect or not.

Many of our clients have adjusted the price of theirproperties to reflect this new mood, fortunatelythe bulk of our purchasers appear to neither‘sub-prime’ borrowers or, indeed, financiallyoverwhelmed. Fortunately our geographicalrelationship with The City and the fact that theGreen Belt lung of Epping Forest protects us fromurban sprawl, creates a high demand forproperties in our area. These factors play animportant role in maintaining the desirability ofour area and ensures that there is always ademand for our supply of properties.

It is worth noting that the huge investment onour doorstep for the Olympics creates a rippleeffect, which in turn creates even greaterdemand for homes in our area.

One of the most important documents to beincluded in the HIP is the Energy PerformanceCertificate (“EPC”). These Certificates areprepared by Energy Assessors, who have in depthknowledge and practical understanding of theenergy efficiency of properties.

Caroline Hall, an Energy Assessor with EPC Essex(www.epcessex.co.uk) is a supplier of EPCs to

Whiskers and explains the role of an EnergyAssessor :-

“The Energy Performance Certificate (EPC) is not apass or fail as many perceive. It is a gradingbetween A – G. The average grade in the UK is Ewhich is at the lower end of the scale, whichcomes as a surprise to many. Grade A is thehighest energy efficient rating you can achieve.

The main driver behind the grade will be the ageand type of construction of the property, and alsothe heating source. Solid brick walls are not asenergy efficient as cavity insulated walls, also

mains gas and oil tend to fare better than LPG.There are a number of factors that

contribute towards finding Purchaserstheir dream home and currently theEnergy Efficiency is not top of the list.Location, aspect, style, size andcondition are all higher priorities formost but it will be interesting to monitor

if the energy efficiency becomes ahigher priority in the future.

Over the years building regulations have tightenedup on energy efficiency and that is why new buildsperform better.

The basic inspection involves the following :-

• Ascertain the construction of the property

The inspection takes an average of 50 minutes,depending upon how complex the home is and howmany extensions have been added over the years.

Along with the current energy rating, theCertificate will show recommendations that thepotential Purchaser could carry out to saveemissions and money and this potential saving isshown on the Certificate.

A common question by Vendors is do I have tocarry out these recommendations before I sell? Theanswer to this is No. These are recommendationsto the Purchaser for consideration only”.

One of the most common myths in English law isthat there is such a thing as a ‘common lawmarriage’. It simply doesn’t exist and thismisapprehension has led the Law Commission tosuggest proposals giving additional rights tocohabiting couples.However, until any changes in the law are made (which could be several yearsaway), cohabited will continue to have few rights. When a marriage or civilpartnership breaks up or one partner dies, the rights of the respective partnersare relatively clear. When the relationship of a couple who have been livingtogether breaks up or one of them dies, the difference between a legally-recognised partnership and an informal one becomes all too obvious.

A recent case involved two barristers who had lived together. When they splitup, long and expensive court proceedings were necessary to decide theappropriate apportionment of the two properties they owned, both of whichwere held in the name of one partner.

On the death of an unmarried partner not only do the intestacy laws make noprovision for the surviving partner to inherit from the estate of their partner,but also the surviving partner does not benefit from the exemption fromInheritance Tax that would apply if the deceased’s estate passed to a spouse orcivil partner.

Indeed, in order to receive anything at all, the surviving partner may well haveto go to court to show that they co-owned assets which in some cases mayhave been paid for by both partners but were owned in one name only. Thesurviving partner may also have to show that they qualify for financialprovision to be made out of the estate under the Inheritance (Provision forFamily and Dependants) Act 1975, which is designed to protect thedependants of people who die without leaving adequate financial provisionfor them. In any event, the surviving partner may face severe financial pressurewhilst a claim is ongoing, even if it is ultimately successful.

For example, consider the recent case of a woman who had lived with heralcoholic partner for nearly three decades before moving out, shortly before hedied, because she feared for her safety. He left no will. Had they been married,the situation would have been simple. However, in this case the woman wasforced to go to court to prove her entitlement to financial provision, which wasresisted by her late partner’s family.

WHAT CAN BE DONE TO PREVENT SUCH PROBLEMS?One easy and inexpensive solution is to make a cohabitation agreement. Thisis a contract, between two people who live together, which sets out theiragreement on the division of their combined assets. It is sensible whencohabiting with anyone, without the protection afforded by marriage or civilpartnership, to enter into a cohabitation agreement so that ‘who owns what’is clear. This is not only important if a relationship breaks down, but also if onepartner dies.

WHAT SHOULD THE AGREEMENT CONTAIN?Like any contract, it should state who it is between, how long it is intended tolast and that it is intended to be legally binding. If there are assets (e.g. yourhome) which are to be dealt with in a particular way, these should bespecifically mentioned and details provided as to how they are to be dealt withon death or on break-up of the relationship. It is not uncommon for a coupleto sell one of their properties when they move in together, with the propertythey live in being retained in the name of the original purchaser. In such cases,it is sensible to decide if the non-owning spouse’s contribution is to be treated,for example, as a loan or if they are entitled to a percentage of theproperty value.

The ownership of all significant assets – bank accounts, insurances, specificvaluables etc. – should be considered. Details of income and expense sharingarrangements should be included if possible and if there is the intention thatone partner should support the other, this should also be mentioned, as shouldany financial arrangements regarding family members.

It is obvious that a cohabitation agreement is normally best considered intandem with your will. There are tax planning and other issues to consider –for example, you might think about writing any death in service benefits orinsurances in trust for your partner.
