I. Part one
1. Executive Summary
The Kosovo Prosecutorial Council for the purpose of implementing the strategic plan 2016 - 2018 and in function of exercising the legal mandate issues an annual work plan.
The Work Plan for 2018 contains the introductory part describing the mandate and organizational structure of the Kosovo Prosecutorial Council (Council), with particular emphasis on its vision and mission.
The second part of the plan sets out the objectives of the Council for 2018, these specific, measurable and achievable objectives. The plan alsoincludes the objectives and activities of the Secretariat of the Council and the Prosecution Performance Evaluation Unit (PPEU).
The third part of the plan concretizes objectives through activities, indicators, responsible bodies and timeframes.Adoption of a work plan like this is based on recognized standards for drafting plans, likely will facilitate easier development of previously set activities, but will create opportunities that Council's actions to be at the highest level regarding the provision of conditions and providing services to the State Prosecutor. Monitoring and overseeing the implementation of Council policies and decisions, through planning as in this plan, will be easier to be applied as well.
During drafting of this plan, the Council considers the challenges that may arise regarding the possibility of legal changes, the need for amending sub-legal acts as well as budgetary resources and human capacities.
Ultimately, the Council also takes into account the expectations for supporting donors and partners in the realization of this plan.

2. VisionThe Council's vision is the continuous work to achieve the high standards and values of professionalism, accountability, integrity, honesty and transparency in Kosovo's prosecutorial system, through policy-making decision-making thatensuresitsindependence,impartialityandefficiency.
3. MissionThe Council's mission is to provide an efficient and effective system ofinvestigation and prosecution by merit-based recruited prosecutors, assessed on the basis of results in work and supervised by high standards, as well as providing adequate human and infrastructural resources.
4. Values
As an independent institution, the Council is characterized by the following values:• Realization of the mandate independently and without interference from the outside;• Ensuring comprehensive representation and respect for diversity;• Possessing functional capacity for policy and strategy development;• Being transparent in decision making;• Promoting equal access to prosecutorial system services to all without distinction;• Realization of duties and mandate based on international human rights standards;• Continuous advancement of the administration and management system;• Promoting cooperation and respecting international standards regarding planning and accountability and• Provisionofprofessional,efficient,effectiveandlaw-basedservices.

5. Legal basis and compositionThe Council is established by Law no. 03 / L-224 on Kosovo Prosecutorial Council. From January 1st, 2016, according to the Law on Amendments to Law no. 03 / L-224 on the Kosovo Prosecutorial Council (Law No. 05 / L-035), the Council consists of thirteen (13) members, ten (10) of whom are prosecutors, and three (3) non-prosecutor members. With the current legal basis, the Council consists of:
• ChiefStateProsecutorexofficio(exofficio);• Seven (7) members prosecutors, one (1) from each Basic Prosecution;• One (1) member prosecutor from Appellate Prosecution;• One(1)memberprosecutorfromSpecialProsecutionOffice;• One (1) member lawyer from Kosovo Chamber of Advocates;• One (1) member, university professor of law faculties and• One (1) member representing civil society.
The Council is chaired by the Chairman who is elected from among the prosecutor members of the Council, with a term of three (3) years, without the right of reelection.The Chairman of the Council submits annual public reports at least once a year on the performance, actions, cost and budgetary needs of the prosecutorial system, and organizes the procedure for selecting the members of the permanent committees under this law, enabling the Council a transparent and responsible process of their proposals and appointments.
6. Duties and competences of the Counci The main responsibilities of the Council are as follows:• Ensures that prosecutors act independently, professionally and impartially in the performance of their functions;• Recruits and proposes to the President candidates for appointment and reappointment for prosecutors, including the Chief State Prosecutor;• Assesses, promotes, disciplines, proposes dismissal, transfers and provides support for the training of prosecutors;• In cooperation with the Academy of Justice, establishes standards for recruiting, organizing and announcing the preparatory exam for thequalificationofprosecutors;• IncooperationwiththeOfficeoftheChiefStateProsecutordevelops prosecutorialpoliciesandstrategiesfortheeffectivefightagainst criminality;• In cooperation with the State Prosecutor prepares and oversees the budget of the prosecutorial system

II. Part two
1. Objectives of the Kosovo Prosecutorial CouncilThemaingoalof theCouncil is tocontinuously increasetheefficiencyandeffectiveness of the policy orientation and strategic plans of the prosecutorial system. This goal will be accomplished through continuous analysis of the functioning of the prosecutorial system in close cooperation with the State Prosecutor specifying detailed, measurable and timely activities for the implementation of these policies and strategic plans. This goal will be achieved through the implementation of the tasks and objectives set by the Council for 2018, as follows:

I. Strengthen of administration, management and accountability in the CouncilFor the purpose of more efficient and accountable administration andmanagementofprosecutionofficesinKosovo,theCouncilintendstoproceedwith the adoption of sub-legal acts, policies, decisions and strategic plans. Moreover, the Council has already established effective practices for recruiting prosecutors, disciplining and evaluating their performance and these practices will be further advanced in 2018. The Council will continue to improve the working conditions of prosecutors and administrative staff in so that they can exercise their functions independently, professionally and impartially.

Following the consolidation of the standing basis of the permanent Committees, a more dynamic work is planned for permanent commissions and ad hoc commissions, which will oversee the implementation of Council decisions through periodic reporting of these committees to the Council.
Pursuant to the Council's Regulation on the Activities of the Council, the Council in 2018 will hold meetings based on the needs and dynamics established by the Council itself, its committees and the State Prosecutor.In addition, with the aim of advancing budget planning and expenditure system, planning and rightful distribution of human resources and providing the necessary services, the Council, with the assistance of the Secretariat and the State Prosecutor, will make decisions in more advanced and accountable administration and management function.
II. Systematic oversight of the prosecutorial systemCommittees operating within the Council in their work plans for 2018 will ensure that the priorities planned by the Council are realized within the timeframes. In this regard, the committees will monitor the implementation of laws, sub-legal acts and Council policies in the prosecutorial system, recruitment, transfer, promotion and enforcement of disciplinary measures. Commissions will furthermore oversee the preparation of budget requests and the budget review process, including the implementation of training programs for prosecutors after assessing the performance of prosecutors. An active role in the process of monitoring the strategies, policies and decisions of the Council is expected to be provided by the Council Secretariat and the Prosecution Performance Evaluation Unit. The Council can form working groups to achieve the goals set by this objective.
III. Increasing the number of state prosecutors During 2018, the Council plans to recruit 10 new prosecutors. This process is preceded by the analysis of the necessary number of prosecutors. This analysis is based on the number of criminal reports received at work, the rate of prosecutors, advancement and transfer processes as well as the positions released from retirement of prosecutors and budget capacities.The Council shall ensure that this process is conducted in accordance with the principles of competition, merit, professionalism, transparency and full confidentialityasprovidedforintheRegulationonRecruitmentofProsecutors.

IV. Transfer and promotion of prosecutorsCareer development in the prosecutorial system remains one of the main objectives of the Council. According to this objective, during 2018, after analyzingtheneedsatdifferentlevelsofprosecutionofficesanddepartments,theCouncil, inconsultationwith theStateProsecutor'sOffice,willdevelopprocesses for the advancement and transfer of prosecutors. All of these processes are expected to be preceded by a prior planning and preliminary decisions by the Council.
V. Strengthen of the prosecutorial performance evaluation systemIn accordance with the legal regulation, the Council will continue to further increase the prosecutorial performance evaluation process. The aim of the Council is that the performance evaluation of prosecutors be positively oriented and affect into increase of the accountability and professionalism of prosecutorsandimprovetheirefficiencyandeffectiveness.In addition, the Council will continue to promote prosecutors performance evaluation policies and standards to ensure that poorly performing prosecutors are instructed for adequate training at the Kosovo Academy of Justice. An assessment of the current criteria and procedures will be subject to an adequate assessment by the Council and its committees.
VI. Further development of the disciplinary system of prosecutorsThe Council will continue with policies that ensure transparent and professional procedures for prosecutors’ discipline. Its actions the Council plans to implement efficientlybyestablishingappropriatemechanismsinsupportoftheDisciplinaryCommission, but also by providing adequate guidance to prosecutors depending on the situations when they are or may be involved in disciplinary violations.The Council will closely monitor the legislative developments regarding the disciplinary responsibility of the prosecutors and, in the light of these developments, will develop policies; sub-legal acts and takes appropriate decisions
VII. Implementation of the electronic case management system (TIK/ SMIL)It’s been time since the electronic management system of cases known as TIK/SMILhasbeenidentifiedasoneofthemostseriousandpriorityprojectsof the prosecutorial system.

Currently, staff, prosecutors and experts (local and foreign) are working intensively to ensure that the case management system is ready to be applied to the State Prosecutor as well. Year 2018 is a decisive year for operation of this system, so the Council will compile an intensive agenda of work and actions that will be taking throughout this year so that prosecutors and responsible staff implement this system without hesitation.
VIII. Creating a model for managing work processes in the prosecutorial system The Council, with the aim to improving the work and efficiency of theprosecutorialsystem,plans toestablishaworkflowmanagementmodel. In2018 thismodelwillbeapplied in theareaofbudget,financeandgeneralservices.Themodelwilldefinedefinitions,descriptions,and interactionsofkey processes and derived sub - processes. Furthermore, responsibilities andqualitymeasureswillbedefined includingperformanceappraisalsandimprovement opportunities.
IX. Increase of professional skills of prosecutors and administrative staffIncreasing the professional skills and abilities of prosecutors and administrative staff will continue to be a priority of the Council for 2018. In this context, in coordinationwith theOfficeof theChiefStateProsecutor and theKosovoAcademy of Justice, the Council will work on drafting an ambitious training orientation plan for prosecutors for 2019. This plan will be based on the training policy adopted by the Council.
The Council will engage in further advancing of knowledge and increase of skills of prosecutors and administrative staff in order to bemore efficient,effective, ethical and professional in their work.
The Council, in cooperation with the State Prosecutor and the Kosovo Academyof Justice,will strengthen theOffice forTrainingCoordination inthe framework of the PPEU with the aim of more rigorous monitoring of the implementation of training programs and their impact on prosecutors and administrative staff.
The Council will ensure that prosecutors of specialized departments attend adequate training.

X. Advancing communication with the public and the mediaIn 2018, the Council will pay particular attention to the advancement of structures within the prosecutorial system that deal with public and media relations and promotion of the work of the Council and State Prosecutor.To achieve this goal, the Council will recruit media officials who will dealexclusively with improving the relations and work of the prosecutorial system with the public and the media. After the recruitment of officials, they willbe trained by professional organizations such as the Academy of Justice, IKAP and similar for public relations, communication strategy and promotion techniques of the work of the Council and State Prosecutor. Within this objective, the implementation of the prosecutorial system strategy prepared inthepreviousyearwillalsoplayasignificantrole.In order to ensure public access to information, the Council will continue to hold open meetings for the public and the media as well as provide information of interesttothepublicthroughbrochures,monthlybulletinsandofficialwebsites
XI. Improvement of physical infrastructure and information technology and communicationThe Council will continue to improve the physical infrastructure, information and communication technology in 2018 in order to provide optimal conditions for the work of prosecutors and support personnel.During 2018, the Council will commit itself to conclude the construction of the Prosecutor'sOfficefacilityfortheGjakovaBasicProsecutionOffice.The council will also renovate the SPRK facility, respectively installation of windows, heating and air conditioning system, while the necessary actions will be undertaken regarding the security of the permanent facility for the CouncilandOfficeoftheChiefStateProsecutor.In addition, the Council will implement the software for more efficientadministration of the logistics system, respectively means of transport of the prosecutorial system of Kosovo. It will also apply the software for electronic prosecutorsfilemanagement.
XII. Strengthening cooperation with national and international institutions The Council will continue to increase cooperation with state institutions of the Republic of Kosovo as well as with all local and international organizations in order to achieve its objectives.

Deeper cooperation, the Council will hold with the Assembly of Kosovo, Government of Kosovo, Kosovo Judicial Council, the Kosovo Academyof Justice, Ministry of Justice, Ministry of Finance, Ministry of European Integration, and Ministry of Public Administration, Advocates Chamber of Kosovo, Kosovo Police and other public bodies of Kosovo.
The Council will enhance cooperation with donor organizations and international partners. In this regard, through coordination meetings with donor as well as bilateral meetings, we will intensify intensive cooperation with all donors and partners who supports the prosecutorial system as well as those that provide support to the justice sector.
Special attention will be paid to the implementation of current donor projects as well as the proposal of new projects through which the capacities of the Council and State Prosecutor will be raised in terms of applying the highest international standards in implementation of our mandate. Moreover, the Council will also provide its resources in terms of meeting the obligations arising from European integration processes and any other state obligation.

2. Objectives of the Kosovo Prosecutorial Council
The Kosovo Prosecutorial Council Secretariat is established to assist and implement the Council's rules, regulations and policies regarding the management, budget and administration of prosecutions. The Secretariat proposes to the Council new policies, rules and regulations whenever necessary for efficient and effective administration of prosecutions. To accomplish itsmandate,for2018thesecretariathasdefinedthefollowingobjectives:• Strengthen the departments of the Council Secretariat;• Transfer and advancement of administrative personnel;• Recruitment of administrative personnel;• Assessment of the performance of administrative personnel• IncreaseefficiencyinprovidingservicestotheCouncilandState Prosecutor• Supervising the services provided by the administration of the prosecutorial system services. I. Strengthen the departments of the Council Secretariat The Secretariat will be engaged in strengthening of departments through implementation of standard operating procedures for all functions and activities oftheCouncil'sadministration.Furthermore,professionalstaffingcapacitieswillbestrengthenedinordertodeliverservicesefficientlyandprofessionally.
II. Transfer and advancement of administrative personnelThe budget for the prosecutorial system according to the projections for 2018 enables the realization of administrative staff advancements, enabling the career development of administrative personnel. In this regard, the Secretariat will initially implement the process of advancement of administrative staff. As needed, the transfer process will be implemented. These processes will preceded by the needs assessment and development of action plans setting deadlines, actions and units responsible for their realization.
III. Recruitment of administrative personnelBased on the staff allocation plan and the allocated budget, the Secretariat will implement recruitment procedures for new administrative staff based on the needs of the prosecutorial system.

In order to accomplish this process with objectivity and respect for meritocracy, the Secretariat will cooperate with the authorities that monitor the work of the prosecutorial system.
IV. Performance assessment of the administrative personnelThe performance assessment will be based on the objectives set out in the individual plans of each staff member. As outlined in this work plan, regular assessment is made in the last period of the year, in which case individual performance of each employee in the prosecutorial system administration will bemeasured.Thisactivitywill,therefore,servetoassessthefulfillmentoftheoverall objectives of the prosecutorial system.
V. IncreaseefficiencyinprovidingservicestotheCouncilandStateProsecutorInordertoprovideefficientandeffectiveservicestotheprosecutorialsystem(Council and State Prosecutor), the Secretariat, in addition to meeting the needs of staff, will be engaged in the quality of services as per detailed earlier planning. In this regard, plans and Standard Operation Procedures, resources and the approved budget will be used, focusing on their proper use.
VI. Supervising the services provided by the administration of the prosecutorial system servicesThe Secretariat aims to increase the accountability of the administration of the State Prosecutor and the Council through conducting regular visits and meetings and systematic oversight of the services accomplished. Consequently, reports will be prepared for the Council with the findings,conclusions and recommendations regarding the administration of the prosecutorial system.

3. Objectives of the Prosecutorial Performance Evaluation UnitThe Kosovo Prosecutorial Council's Prosecutorial Performance Evaluation Unitfortheyeardefinesthefollowingobjectives• The ongoing support of the Council in the administration of prosecutions;• Continuous support to the recruitment, appointment, reappointment, transfer, promotion and performance evaluation of prosecutors; • Advancing the statistical data system; • Advancing training needs assessment and co-ordination of prosecutorial participation in training.
I. The Council's continued support to the administration of prosecution officesPPEU will provide support to the Commission on the administration of prosecutions in the oversight of prosecution records, the manner of registration of cases, the number of cases and persons and the harmonization of statistical reportssenttotheOfficeofStatisticsofthePPEU.PPEU also will prepare periodic and annual reports on the work of State Prosecutor with a focus on criminal reports cases inherited, accepted and accomplished by prosecutors at all levels of the prosecutorial system, relevant prosecution departments including the applicants of these criminal report.PPEU also prepares a report on the characteristic criminal offenses, part of the inter-institutional follow-up mechanism for the harmonization of statistical data, including characteristic criminal offenses.PPEU will also prepare analysis of the necessary number of prosecutors in the prosecutorial system of the Republic of Kosovo. This analyze is drafted by taking into account the received number of cases in the State Prosecutor, performance of prosecutors, achievements and lacks found in the prosecution's work in recent years, and the necessity of improving the qualitative and quantitative aspect of the prosecution's performance.

Continued support to the recruitment, appointment, reappointment, transfer, promotion and performance evaluation of prosecutorsPPEU provides administrative support to the Council in the recruitment, transfer and advancement of prosecutors. In this regard, analysis will be carriedoutandactionplanswillbedrawnupfortheefficientadministrationofthese processes.

The preparation of adequate reports on these processes and the updating of the database will be part of the activities of this unit.
III. Advancing the statistical data systemThe compilation of statistical reports on the work of the State Prosecutor is one of the main activities of the PPEU. Therefore, in 2018, work will be done on the implementation of the electronic case management system (TIK / SMIL). Until the full implementation of this system, the PPEU will continue to maintain and monitor the functioning of a manual case registration system through registers. In particular, the statistical data will be processed on time andhavearealisticpictureoftheworkofprosecutionoffices.
IV. Advancing the training needs assessment and co-ordination of the participation of prosecutors in the trainingIncrease of the professional capacities and practical skills of prosecutors and administrative personnel of the prosecutorial system is a priority of the Council for 2018. In order to make this possible, the PPEU will be engaged in evaluatingtrainingneeds,identifyingtrainingbeneficiariesandcoordinatingparticipation, in close cooperation with the Academy of Justice and other institutions and partners supporting the prosecutorial system in this process.
