Representing Holimont was Corey A. The application for the use variance was submitted on October 19, 2011. The location of the proposed development is 36 Adams Street, Ellicottville NY. The use variance application is two-fold in that HoliMont is seeking an expansion of a non-conforming use as well as a modification of non-conforming use. Complicating things, the Adams St. parcel is located within two districts, one a “low density” and the other a village residential zoning district. Last month, Cattaraugus County legislators approved a request to borrow $1.6 million to update the county’s public safety communications system to narrowband. This migration to narrowband is the direct result of a nation-wide mandate issued by the Federal Communications Commission. In an effort to ensure more efficient use of the VHF and UHF spectrum, effective January 1, 2013, this mandate requires that all public safety land mobile radio (LMR) systems cease operating using the current technology and begin using 12.5 kHz efficiency technology. So what does this really mean? Currently, the majority of UHF and VHF LMR licensees operate using 25 kHz efficiency technology. However, the UHF and VHF frequency bands are congested with limited spectrum available for system expansion or implementation of new systems. The migration requires licensees to operate more efficiently, either on narrower channel bandwidths or increased voice paths on existing channels. This will allow the creation of additional channel capacity within the same spectrum, and therefore support more users. The migration to narrowband is not only mandatory, but also necessary. After the 2013 deadline, the current technology will not function properly, and the county would face potentially hefty fines if not compliant. As of January 1, 2013, those not operating at 12.5 KHz efficiency will be in violation of the Commission’s rules and could be subject to FCC enforcement action, which may include admonishment, monetary fines or loss of license. The FCC mandate does not affect fire departments, but the new system for the Cattaraugus County Sheriff’s

At 7:30 this morning the outside temperature was a crisp 25 degrees – enough to coat everything in a thin layer of sparkling white ice. And I mean everything – my mums out on the deck (they were on their way out anyway), the lawn (no more mowing y’all – love it!), our late Fall trees, and (unfortunately) my car windshield, (where did I put that scraper?). But the sun was also shining brightly, illuminating the frost and showing us all Mother Nature’s palette of colors is truly endless. Absolutely beautiful… I love this time of year in the Enchanted Mountains. Sure, it’s chilly and requires you to bundle up a bit more, get up in total darkness, and start the whole process of getting ready for the next season coming. But

it’s a wonderful time to be alive – the cold air is exhilarating and the cool sunny afternoons are – well – way cool, man. The character of our little village reflects the changing seasons perfectly. Everything, and everyone, is in transition now. It’s almost like the village knows we only have another month or so before things get really busy again. And as our farmer friends love to say “You gotta make hay when the sun shines”. I simply love these “shoulder times” between seasons. So, dear readers, my message this week is to stay busy, be as happy as you can, and enjoy this wonderful, albeit cool, time of the year. Oh, yes… And don’t forget to buy yourself a new ice scraper! Until next week… JZ

The Ellicottville Lady Eagles varsity soccer team is heading to the Section 6 play-offs this Friday at 5:00pm in Pioneer. They play rival North Collins for a bid to compete for the regional title. The team, who finished 12-3-1 and second in their league in the regular season under head coach Mary Neilon, has already played North Collins twice. Coach Neilon spoke about the games, saying “we beat them 1-0 here in Ellicottville and then we went to their field to play the last regular season game and tied 0-0; this is going to be a tough battle”. When asked what the team needs to do to get the win, Neilon stated “We need to play a strong, total team effort and not let them get under our skin with their physical nature”. Assistant coach Tammy Eddy, who has coached since 1993 resonated Neilon‘s comments on Collins’ tough style when she commented that “I think we have a team that can beat North Collins. I think it’s not an easy game though, they are definitely a physical team”. Both coaches feel that a victory is within reach, as long

as the team continues to play as the powerful unit they’ve developed. Coach Neilon likes to let her team’s play speak for their ability, though she did state that “I think we can play well enough to win, we just need to bring that A game”. Coach Eddy said that “we can win this game, but it’s not going to be a cake-walk”. Conveniently, the team “seems to be getting it really together right now, which is good timing with the coming playoffs” says coach Neilon. When asked about the key to the team’s success, assistant coach Eddy confidently speaks of the girls’ unity, “I think the fact that they work together as a team is their strong point. There isn’t really a superstar player and I think that helps-sometimes when you have that type of player and they get shut down, your whole team is done. What we have is quite a few different girls scoring this year and that’s going to carry us through this game with North Collins”. It’s said that experience breeds confidence, if that is true, head coach Mary Neilon should be brimming with it. This is her 27th year as head coach, and she is readying to compete in her 22nd region 6 play-off tourney. She has brought 11 Far West Regional

titles back to Ellicottville and 4 New York State Class D titles; her continuing legacy is one of substantial grit. In fact, she coached now assistant coach Tammy Eddy when she was an Ellicottville Eagle. Coach Eddy has nothing but praise for Neilon, saying “She’s amazing; she is one of the best coaches I’ve ever known and does an awesome job with the girls. Mary has had the best program in the county for a long, long time”. She continues, “I’ve learned a lot from Mary’s coaching style, soccer is a big piece of it, but it’s really about being responsible and playing as a team and getting along with your team. That’s the core of our sport mentality here”. Friday night at 5pm, the Eagles will have the opportunity to take coach Neilon one step closer to her 22nd section 6 regional title. They’ve played as a team all year, and their commitment to “a group effort and unity on the field” will very possibly bring home a title. This Friday, the 4th, take the trip to Pioneer, pay the four dollar fee, and watch a team play their hearts out for each other and a coach that has given nearly three decades of her time to teaching young women both on and off the field.

Open House & Ski SwapSaturday, Nov. 5th at Allegany Nordic from 10am-2pm

Allegany Nordic will host an open house and ski swap at the Summit Warming Hut of Allegany State Park on Saturday 11/5 from 10am-2pm. The event is open to the public. Skiers who are familiar with the Art Roscoe Trails and cross-country skiing, as well as those who want to become a part of the fun, are invited to stop by and share in the excitement of the upcoming season. The day of fun and camaraderie will include christening the new trail roller purchased with member contributions and donating it to the park, tours of the new summit storage building, hiking and biking the newly renovated trails, a ski swap and refreshments. There is great excitement within Allegany Nordic about the upcoming ski season at Allegany State Park. Major enhancements to the cross-country skiing program have been realized in the off-season including renovation of the trail system with heavy equipment and the construction of summit storage for trail grooming equipment. Both are expected to positively impact the skiing experience on the Art Roscoe Trails. Park personnel and equipment were deployed on the trail

system this summer to address trail erosion, drainage and damage from the missing-person search in the Fall of 2010. Portions of Sweetwater, Ridge Run and Patterson were graded and ditched. New drainage was added in two trouble spots on Christian Hollow. “This is a big accomplishment by the park,” said Andy Dickson, co-organizer of Allegany Nordic. “The work done by the park will go a long way to address year’s of heavy use, make the trails safer for skiers and reduce the likelihood of damage to grooming equipment. We are truly grateful for the park’s attention to the trails and appreciative of the hard work by park personnel.” The second and much anticipated improvement to the ski program is the construction of summit storage for grooming equipment. A building to store the LCM Cat, Skidoo Scandic and grooming implements located in close proximity to the summit trail head will greatly reduce costs and improve the timeliness of grooming operations. Equipment has previously been stored at the Red House operations barns nearly two miles from the trail system. Construction is currently in progress and is expected to be

well along by 11/5. Funds for the storage facility were provided through a capital account funded by the operations of J-Con Parks, the private operator of concessions at several WNY parks including the trail-side ski rental and food service operations at the Art Roscoe Trails. Dickson continued, “Summit storage has the potential to greatly improve the skiing experience at Allegany State Park. We can’t thank J-Con Parks and park management enough for these investments in the cross-country trails and facilities. We are on target for one of the best ski seasons in recent memory and it’s time to celebrate!” The ski swap will take place between 11am and 1pm. It is a great opportunity to turn extra equipment into cash or for first-timers to pick up a good pair of used skis and meet other skiers.Allegany Nordic organized five years ago advance the sport of cross-country skiing on the Art Roscoe Trails of the Allegany State Park. It is accomplishing its mission in various ways including advocacy, equipment donations, volunteer trail work and reporting trail conditions. For more information, visit www.alleganynordic.org

Sheriffs Receive AwardDaniel French and Dale Westfall Awarded after Training Conference

Pictured above is Sheriff Jack Mahar, Rensselaer County Sheriff’s Office and Association President, left, and Chris O’ Brien, Executive Director, New York State Sheriffs’ Asso-ciation Institute, Inc., right, presenting an award certificate to Daniel French, 2nd from left, and Dale Westfall, 2nd from right, of the Cattaraugus County Sheriff’s Office.

Seventy jail administrators from across New York State recently attended an annual training conference in Saratoga Springs, NY, sponsored by the New York State Sheriffs’ Association and the New York State Sheriffs’ Association Institute. These conferences are conducted annually, and provide officers not only the chance to receive training, but to meet with their colleagues around the state and discuss common issues. The Sheriffs’ Association and the Sheriffs’ Institute offer this annual training conference to help jail administrators learn about advances in correctional practices and discuss issues of mutual concern. Representatives of several State agencies,

such as the New York State Commission of Correction, the Division of Criminal Justice Services, the State Department of Corrections, and the Department of Civil Service, shared their perspectives on new laws and practices with the jail administrators. The participants also had presentations on a the Sheriffs’ VINE program, which allows victims to obtain real-time information about the incarcerated status of offenders; mental health services for county jail inmates; disability benefits for correction officers; employee discipline; video court appearances; immunization practices which can promote inmate health care; delivery of medication to inmates; and

leadership strategies. The principal speaker was Carrie Hill, former counsel to the Utah State Department of Corrections, and a nationally known lecturer and consultant on jail legal issues. Rensselaer County Sheriff Jack Mahar, who also serves as President of the New York State Sheriffs’ Association, said that “Sheriffs remain committed to providing education and training to advance the professionalism of all aspects of our Sheriffs’ Offices.” Yates County Sheriff Ron Spike, who also serves as the Chairman of the Board of Directors of the New York State Sheriffs’ Association Institute, said that “these programs provide vital training to our county jail administrators, and the strong attendance this year attests to the value that these training programs have for all Sheriffs’ Offices across the State.” The training conference is the best way for jail administrators to exchange ideas and discuss correctional practices, and the Sheriffs of New York State remain committed to provide this training to those who work so hard to keep our communities safe and secure. The program is offered without fee to participating counties, which only cover the costs of lodging and meals for their employees.

If you’re the sort of person for whom Winter can’t come soon enough, or loves to turn out gourmet meals for family and friends, or loves to curl up in front of a fire with a good book and a glass of wine, or has to be the first person on the lift every morning, or loves to rest tired achy muscles in a hot tub or sauna (because you were the first person on the lift), or if you’re like all of the above: have I got a house for you. Perched high up on Upper Road, just off Holiday Valley Road, this home is just a snowballs throw from Holiday

Valley, perfect for getting your freshies (fresh power, in case you didn’t know). But this house has more going for it than proximity to the slopes. With four bedrooms and three full baths, it’s got plenty of room for family and guests. The bottom floor has a large family room; one end has hooks and benches for stowing snow gear. The sauna has its own shower, and next to it a half bath. There is a large bunk room that can sleep six. Up a short flight of stairs is the main level. Two more bedrooms are on this floor, and a full bath. The living room has a view through the trees to Holiday Valley so you can keep and eye on the ski conditions. At the far

end is a wood burning fireplace for curling up with your iPad. Along the interior wall is a fill bar with wine storage. The high open beam ceiling adds a touch of alpine lodge to the room. Outside are two large decks on each end of the house. The one off the kitchen holds the barbeque and outside eating area, while the other deck has a built in hot tub. This house had a distinct chalet feeling to it, and yet it’s too big and too sophisticated to really be called a chalet. Let just say it’s just about the perfect ski house. For more information on this home contact Amy DeTine at 716-583-3769 or Ciji Riley at 716-244-8924 both are at ERA Vacation Properties

Top Right, Exterior: An interesting roof line and large decks give this chalet style home a modern twist. The third deck with the hot tub can be seen in the shadows on the far left. Bottom Left Living Room: The late morning sunlight floods the living room through the large bank of windows. A wood burning fireplace is at the far end of the room. The windows run all the way over to the dining area, and frame the view of Holiday Valley. Bottom Center, Dining Room: Just off the living room the dining area has room for an oversized dining table. Guests at the table can see Holiday Valley. Note the earth toned stone tile floor. Bottom Right, Kitchen: Beautiful cabinets set off the Viking gas range with griddle, and the side by side sub zero refrigerator. The Corian counter tops tie it all together, and make for an efficient kitchen.

There are many families in our communities that are struggling with financial challeng-es due to unemployment, are the working poor and those who are dealing with illness. Thanksgiving for most of us is the day we look forward to feasting on a Tradtional Turkey Dinner surrounded by those we love- family and friends. There are families in our com-munities that will not be able to celebrate the festive Thanksgiving meal because they are not able to purchase the turkey and all the trimmings that make this such a special holiday Cattaraugus Community Action, Inc (CCA) is requesting donations of turkeys from the community which will enable us to provide families in need with a Thanksgiving Dinner. Please bring the turkeys to CCA, 25 Jefferson Salamanca NY or call 945-1041 Ext 138 by November 9th 2011.

A western New York and Ellicottville trademark just got even more desirable. Watson’s Chocolates newest location at the Seneca and Allegany Casino in Niagara Falls opened its doors on Oct. 27, 2011. The new outlet that started filling with boutiques last November now contains Watson’s ninth western New York location. Before the new outlet location, the casino carried Watson’s Chocolates in its 24-hour shop. “We’ve carried the product for a couple of years now and it’s always been a popular seller,” said Tony Astran, casino publicity manager. Last year alone Watson’s had $200,000 in sales with just a few shelves. Now with an entire boutique dedicated to Watson’s, officials expect sales to double. Besides sales and revenue, the Casino brought Watson’s in to add to guests’ existing excitement. “Being a premier destination for entertainment and to have that total resort feel, we want to be able to offer more reasons for people to stop in and stay,” Astran said. “Also, making the experience even better for existing guests is important.

National Family Caregivers Month – observed every November – is a nationally recognized month that seeks to draw attention to the many challenges facing family caregivers, to advocate for stronger public policy to address family caregiving issues, and raise awareness about community programs that support family caregivers. It has been said that there are only four kinds of people in the world — those who have been caregivers, those who

currently are caregivers, those who will be caregivers and those who will need caregivers. Unfortunately, this is not an exaggeration. According to the National Family Caregivers Association (NFCA), over 65 million people are family caregivers in any given year, providing caregiving services valued at $375 billion annually for those caring for older adults. A family caregiver is defined as someone who cares for a chronically ill, disabled, or elderly loved one.

During National Family Caregivers Month, reach out to a family caregiver you know, whether a neighbor, relative, co-worker, or a friend, and offer them a helping hand. For more information on National Family Caregivers Month, support services for family caregivers, and the Department of the Aging’s Caregiver Support Group, please contact Stacy Lockwood at the Cattaraugus County Department of Aging at 716- 373-8032 or 1-800-462-2901.

When you have places filled with great gaming and entertainment like Seneca Niagara and have fantastic chocolate you can get seven days a week it just adds to the fun.” The outlet along the 4th Street side of the casino holds various stores, including Yankee Candle, Swarovski Crystal, Tim Hortons Café and Bake Shop / Cold Stone Creamery and the TEN store, Astran said. There is always a possibility that Watson’s Chocolate could open at another casino location in the future. “Our TEN store had become so popular when it opened in

2010 in that this past summer we opened a location in Allegany,” he said. “(Watson’s) already seems to be a big hit among our guests,” he said. However, to enjoy the shops you don’t need to play or stay at the casino, but playing is definitely a plus. The entire outlet is open Sundays through Thursdays from noon to 8 p.m. and Fridays and Saturdays noon to midnight. Items range from around $2 to $20 and up for gift baskets, and may be purchased with cash, credit cards or Seneca Players Club Points. For more information, visit www.watsonschocolates.com.

Coming off the heals of a “very successful busy summer” the Silver Fox restaurant is heading into the winter season with a couple of events that promise a bit of education, some excellent food, and first class libations. On November 11th at 7:30 they will team up with E-ville Spirits Wine Shop to host a wine and food pairing evening. Select wines will be paired with some of the restaurant’s gourmet food selections. “We’re trying a new style of wine. They’re organic, using no chemical fertilizers, and natural compost” says Mike Nickolson owner of Silver Fox. He explains that organic wines

have a lower sulphide content, . Some of the pairings will include: Apple Brined smoked Salmon with five count Prawn Scampi style paired with Cono Sur Certified Organic Cabernet and Carmenere; Boar Chop Char Grilled with a Bordelasie Sauce paired with Cono Sur Vision Cabernet Sauvignon. Dessert will be Shiraz Poached Pears paired with Kessler Riesling. On November 17th the plans call for a scotch and food pairing evening. According to Mike. “It’s different for us to think about having scotch with food, after all they drink scotch with food in Scotland. We need to open our eyes.” Mike promises an educational and tasty

evening. Sample pairings are: Glenlivet 12 year old scotch with mushroom Gnocchi; Glenlivet 21 year old scotch with Smoked Salmon, capers, eggs and red onions; and Aberlour 18 year old scotch with Pork Osso Bucco with Orzo. Mike points out that many of the barrels they use for aging scotch in Scotland come from the US. The barrels are used white oak bourbon barrels that have been charred on the inside. “This gives the scotch a smokey flavor and color.” The Silver Fox boasts one of the better wine lists in the area, “We have regional wines, varietals, and wines of the world, as well as our reserve list,” says Mike. The reserve list includes exclusive hard to find wines including Opus One, and Quintessa. “Made to perfection” is how he describes the food at the restaurant. He points out they are “one of a select group of restaurants” that serve dry aged steaks. Dry aging is a process in which beef is cured in specially controlled meat lockers to produce exceptionally tender steaks. In describing the restaurant, Mike says, “we try to serve new and cutting edge products. We serve choice and prime steaks, that we custom cook to create the best steak you can possibly get.” He goes on to add, “from our wine to our bourbon, everything is top notch.” Starting December 15th the restaurant will be open six days a week, closing only on Tuesdays.

Day Light Savings Time is Coming up on November 6th!

Doug Arrowsmith

They’re still there. The Occupy Wall St. protest has turned into a multi-headed movement and there’s no stopping it. You can gas them out but they’ll be back. You can beat them down but they’ll be back. You can mock them all you want but their numbers are growing and, in reality, there’s many more of them then there are of you. Who are they? What do they want? Well, the short answer is that they are us. They are the 99%. They are the folks who cook your food. They are the families that have been foreclosed. They’ve been laid off. They’ve been denied health care or simply cant afford it. They are the people who start and finish revolutions. They’re the hungry and the homeless. They’re veterans who have served, been curtly thanked and spit out the other end. They are the heroes of 9/11 who you now call freeloaders. Most importantly, they (we) are coming to a town near you. I

take that back. We’re already here. Who are they? They’re the folks who were kicked out of their houses by the Steven J. Baum Law Firm of Amherst NY. The who? The Steven J. Baum firm is the states largest foreclosure law firm. They are currently under investigation by the NY Attorney Generals office and recently agreed to pay $2 million in fines to resolve a Department of Justice investigation into whether it had filed “misleading pleadings, affidavits and mortgage assignments” on behalf of lenders. Last year the law firm held a cute little Halloween party where employees decided to dress like homeless people. In the hallways of their offices they erected a cardboard shanty town and named it “Baum Estates.” An outraged employee took pictures from the party and sent them to the New York Times. She recognized the crass indifference of those who have never known what it means to lose everything. She is the movement. The Occupy Wall St. movement has been accused of trying to incite “class warfare.” The problem with that statement lies in the fact that we’ve been the victims of class warfare. Recent census numbers prove that. The income gap in this country continues to widen. The rich keep getting richer and the poor stay poor. They tell us that we should be happy to have any job at all. We are. Then, inevitably, when they go belly

up they send their lobbyists to Capital Hill and THEY beg for more government handouts while We’re being kicked out of our homes. We cant afford lobbyists. When they want to expand their businesses they beg for more tax breaks that we have to pay back. Where’s my bailout? Where’s my tax break? They tell us that they cant afford the new Health Care Bill but they’re retirement packages keep getting bigger and bigger while our 401k’s are being looted. To quote Jim Morrison: “They’ve got the guns but we’ve got the numbers.” The FOX News Goons would like everyone to believe that the Occupy Wall St. folks are all lazy hippies and freeloaders. That’s obviously not true. They are teachers, truckers, firefighters, cops and ex cops, grandmothers, Union members, students, young and old. They are a perfect cross section of American society. There’s even a rising number of former Tea Party members who have joined the movement. They haven’t switched sides. They’ve just joined the group that hasn’t been politicized yet. Last week the protestors were joined by 93 year old folk legend Pete Seeger. While supporting himself with two canes he stood with friends in the freezing cold and led the crowd in a rendition of “This Land is Your land.” A fitting song to join generations and a nation together in a struggle that can and will be won. Village attorney Bob Simon and Mr. Auerbach. The two men seemed to have a history

with each other, one that spilled over into the night’s meeting. To emphasis his point that the proposed development will not affect the village’s “character”, Mr. Auerbach commented that “Ellicottville is synonymous with skiing, to say otherwise is almost ingenious”. This is true for some, and possibly not

so true with others, who see Ellicottville as synonymous with local community and their home. There will be a public meeting on the issue December 6, 2011 at 5:30pm (the meeting location is still undecided due to a large expected attendance). The meeting was called to an end at approximately 6:30pm.

cooperation and planning, and will attempt to identify projects that demonstrate the greatest potential for job growth in the region, while removing some of the bureaucratic red tape that slows business growth. The Western New York Regional Council is one of ten regional councils Gov. Andrew M. Cuomo created by Executive Order as part of a plan to redesign the relationship between the state government and businesses by shifting the approach from a top-down development model to a community-based approach that caters to the regions’ assets. Gov. Cuomo had stated that Albany has imposed a one-size-fits-all economic development plan statewide, without taking each region’s specific strengths and challenges into consideration, and that his new approach

Cont. from front page

Regional would empower individual areas to chart their own course for job creation and growth. The shift attempts to harness the knowledge and skills of local business leaders, and empowers each region to set their own plans and priorities. Each of the ten Regional Councils will develop an economic development plan that addresses the critical issues and opportunities unique to each region while increasing efficiency. Under the previous system, dozens of state and local agencies managed New York State’s economic development efforts, but under recent changes to the state’s economic development grant application process, the regional councils can apply for state funding to support projects they determine are integral to their regional strategy. The new Consolidated Funding Application makes projects eligible for grant money and tax credits from dozens of existing programs, and totals about $1 billion. Satish K. Tripathi, University at Buffalo president, and Howard A.

Zemsky, managing partner at Larkin Development Group, will co-chair the Western New York Regional Council, which includes Allegany, Cattaraugus, Chautauqua, Erie and Niagara counties. In addition, Lt. Gov. Robert Duffy will chair each regional council, in concert with the regional co-chairs, and the council’s membership will include local leaders from business, academia, labor, agriculture, community-based organizations, and nonprofit groups. The ten Regional Councils cover the Capital Region, Central New York, Finger Lakes, Long Island, Mid-Hudson, Mohawk Valley, New York City, North Country, Southern Tier, and Western New York, and are based on existing Empire State Development and Department of Labor regional boundaries. To learn more about the Regional Councils, please visit www.nyopenforbusiness.com.
