Supplement Bo. 2 to €ije $ata$tme d5a?ette iBo. 1207 of 2ttU 3|uty, 1942. DEFENCE: REGULATIONS, 1939. ORDER, No. 62 OF 1942, BY THE HIGH COMMISSIONER UNDER REGULATION 49. IN EXERCISE of the powers vested in him by regulation 49 of the Defence Regula- tions, 1939, the High Commissioner has been pleased to authorise the use of the land described in the Schedule to this Order for military purposes for three years as from the date hereof, subject to extension by Order of such period if necessary. 2. Any members of His Majesty's Naval, Military or Air Forces, or their author- ised agents or servants may do such acts or works upon the said land as are necessary for the purposes aforesaid. 3. During the said period, no person shall exercise a right of way over the said land (other than the right specifically reserved by paragraph 5 of this Order), or any other rights thereto which he may have been enjoying previously whether by virtue of an interest in land or otherwise, save with the prior consent of the Officer Com- manding His Majesty's Forces in Palestine or his authorised representative or the Hirings Officer, Gaza Area, Gaza. 4. During the said period no person shall allow or permit pasture cattle to.tres- pass on the said land. 5. During the said period, the public may exercise a right of way over the high- way along the beach only between the hours of 4 p.m. avid 8 a.m. daily. 6. The following rules regarding the composition, functions and procedure• of the Jewish Cooperative Advisory Council are published for general information :—

Composition 1.—(1) The Jewish Cooperative Advisory Council (hereinafter of Jewish referred to as the Council) shall consist of : Coopeartive Advisory Council. (a) The Registrar of Cooperative Societies, who shall• be the

Chairman of the Council ; The Jewish Inspector, of Cooperative Societies; The Auditor of the Department of the Registrar of Coopera­

tive Societies; • The Examiner of Banks ;

(hereinafter referred to as "ex-officio members");

(b) 12 persons (hereina fter referred to as " un official members")...: ־

(2) The unofficial members shall be nominated for a period of three years in the first instance, one third of them retiring annually. Retir ing members shall be eligible for renomination.

There shall be a Secretary to the Council who shall be appointed by the Chairman.

2. A n y member who fails to attend three consecutive meetings of the Council without providing reasons satisfactory to the Chair­man, shall be considered as having resigned and his place wi l l be filled.

3. —(1) Unofficial members of the Council •shall receive such allowances for attendance at meetings as the H i g h Commissioner may determine.

(2) Such allowances shall be paid out of the general revenues of the Government of Palestine.

4. —(1) Meetings of the Council shall be held at such times and places as the Chairman shall from time to time appoint.

(2) Reasonable notice of the time and place of meeting shall be given to all members.

(3) A t all meetings of the Council eight members, of whom at least one shall be an ex-officio member, shall constitute a quorum.

(4) The Chairman shall preside at all meetings of the Council at which, he is present.

(5) I n the absence of the Chairman, the Jewish Inspector of Cooperative Societies shall preside. If he also is absent, one of the remaining ex-officio members wi l l be chosen by the meeting to preside.

5. It shall be the function of the Council to act i n an advisory and consultative capacity to Government in matters appertaining to the Jewish cooperative movement in all its aspects and to examine and report upon any legislation referred to it by Govern­ment.

6 . — ( a ) The normal procedure of the Council w i l l be to appoint from among its members a d hoc committees to deal with specific problems appertaining to the Jewish cooperative movement under the chairmanship of a member of the Council. I n case of urgency a committee may be appointed by the Chairman; but the membership of such a committee shall be subject to ratification by the Council at its subsequent meeting. I f not so ratified, the committee shall be dissolved and its membership altered in accordance with the decision of the Council ; its report if already compiled shall not be tabled.

(b) A l l committees wi l l submit their statements, recommend­ations, findings and resolutions to the Chairman of the Coun­c i l .

Competence of members •to ask questions or move motions.

Notices of motions and questions.

7. It shall be competent for any member of the Council to put formal questions or to give notice of motion on matters appertaining to the Jewish cooperative movement.

Provided that the Chairman may refuse to accept any question or notice of motion if in his opinion ׳.' .

(a) the subject matter of such question or motion is not suf­

ficiently relevant to the Jewish cooperative movement, or

(b) acceptance would be contrary to the public interest.

8. —(1) Notices of motions or questions may be sent to the Sec­

retary to the Council , and if received not less than seven days be­

fore any meeting the}' shall be included in the agenda of that meeting.

(2) A l l such notices must be in writ ing.

Proceedings to be regarded as confidential.

9. —(1) Previous notice having been given under rule 8, motions relating to the Jewish cooperative movement shall, if seconded by any other member, be debated and voted upon by the Council.

(2) When a motion for debate has been proposed, debated and disposed of, it shall not be competent for any member, without special leave of the Chairman, again to propose such motion within three months.

(3) A member who has proposed a motion may withdraw the same by leave of the Chairman.

10. Every member shall address his observations to the Chair­

man and shall confine such observations to the subject under dis­

cussion.

11. Amendments of and additions to these Pules may be made by a majority of votes at any meeting of the Council provided that notice of such addition or amendment has been duly given as i n the case of motions. Provided further that no such amendment, or ad­

dition shall become operative unless and until it has received the approval of Government.

12. Proceedings of the Council and committees shall be regarded as confidential provided that the Chairman of the Council may in his discretion grant permission for the publication of information received in reply to questions submitted under rules 7 and 8, or received bv committees in the course of their investigations.

I N E X E R C I S E of the powers vested in them by section 99 of the Municipal Corporations Ordinance, 1934, the Municipal Commission of Ramallah have made the following by­laws :—

1. These by­laws may be cited as the Ramallah (Price Control of Foodstuffs) By­laws, 1942.

2. I n these by­laws :— "Munic ipa l Counci l" means the Municipal Commission of

Ramallah. "Munic ipa l A r e a " means the Ramallah Municipal Area.

3. The Municipal Council may from time to time fix the maximum price at which any or all of the foodstuffs listed in the Schedule hereto may be sold whether by wholeslae or retail within the municipal area.

4. The Municipal Council, having fixed the maximum price of any foodstuff listed in the Schedule hereto, shall publish the price thereof by posting notices in Engl ish and Arabic, at the following­

places :—­

(i) The Offices of the Municipal Council ׳ • ;­:, ;(ii) The District Offices;

(iii) The Post Office; (iv) The Public Markets; (v) A n y place which' the Chairman deems fit.

5. Where the Municipal Council has, in accordance with by­

law7 3 of these by­laws, fixed the maximum price of any foodstuff listed in the Schedule, no person shall sell such foodstuff at a price exceeding that so fixed.

6. Every vendor of foodstuffs listed in the Schedule hereto for which maximum prices have been fixed by the Municipal Council shall keep in a conspicuous position on his premises or at his stall a price­list clearly marking the price of each class of food sold by h im, as fixed and published by the Municipal Council under by­laws •3 and 4 of these by­laws.

7. A n y person who either by himself or by his servant, em­

ployee or agent, contravenes the provisions of by­law 5 or 6 of these by­laws, shall be guilty of an offence and on conviction shall be liable to a fine not exceeding twenty pounds.

I N E X E R C I S E of the powers vested in me by Regulation 46 of the Defence Regula­tions, 1939, I , C H R I S T O P H E R W I L S O N B R O W N , Controller of Heavy Industries, being a Competent Authority for the purpose of the said regulation, do hereby order as followTs :

1. This Order may be cited as the Defence (Control of Scrap Citation. Non-Ferrous Metals) Order, 1942.

2. "Licensed Scrap Dealer" means the holder of a valid Scrap Interpretation. Dealer's Licence granted b\* the Controller of Heavy Industries under the provisions of paragraph 8 of the Defence (Control of Engineering, Bui ld ing and Hardware Material) Order, 1942.

3. The prices at which scrap non-ferrous metals may be sold by a licensed scrap dealer shall not exceed the prices set forth in the third column of the Schedule hereto opposite the particular material described in the first column of the said schedule.

4. A n y person, other than the holder of a valid licence granted by the Controller of Heavy Industries under the provisions of para­graph 6 of the Defence (Control of Engineering, Bui ld ing and Hardware Material) Order, 1942, to use scrap non-ferrous metals,, who has in his possession or under his control any of the scrap non-ferrous metals described in the first column of the Schedule hereto to an amount in excess of twenty kilograms shall on or before the 14th day of Ju ly , 1942, make a declaration in writ ing to the Con­troller of Heavy Industries which shall state the amount of each scrap non-ferrous metal in his possession or under his control and the place at which such scrap non-ferrous metal is stored.

5. The Order of the Competent Authority dated the 5th day of :Revocation. February, 1942, published in the Palestine Gazette N o . 1167 of 12th February, 1942, is hereby revoked.

I N E X E R C I S E of the powers vested in m e by regulation 4 6 of the Defence Regula­

tions, 1 9 3 9 , I , Controller of Heavy Industries, being a Competent Authority for "The purpose of the said regulation, do hereby order as follows :—

1. This Order may be cited as the Defence (Control of E n g i n ­

eering, Bui ld ing and Hardware Material) (Amendment) Order (No. 2 ) , 1 9 4 2 , and shall be read as one with the Defence (Control of Engineering, Bui ld ing and Hardware Material) Order, 1 9 4 2 , hereinafter referred to as the principal Order.

2 . Paragraph 1 0 of the principal Order is hereby revoked and replaced as follows :—

" 1 0 . A n y person having in his possession or having under his control at any premises in Palestine any controlled mate­

rial shall within 1 4 days from the 1st Ju ly , 1 9 4 2 , or within 7 days from the date on which any such controlled material shall thereafter come into his possession or under his control, other­

wise than by means of a permit granted under paragraph 3 of this Order, submit to the Controller a signed declaration stating the quantity of each kind, type and size or grade of such con­

trolled material :

Provided —

(i) that nothing in this paragraph contained shall be deemed to apply to such stocks of controlled material as may reasonably be required for the personal use of such person;

(ii) that for the purpose of this proviso the term 'person' shall not include any company, or association or body of persons corporate or unincorporate."

3 . The Firs t Schedule to the principal Order is hereby amend­

ed by :—

(i) The deletion of the words "rubber and rubber substitutes" appearing under the heading " I M P O R T E D F O R E S T P R O D U C T S " and by the substitution therefor as folkrws : "Rubber , in ­

(2) If any licence granted under this Order is revoked by the Licensing Author­

i ty, the holder of the licence shall forthwith deliver up the licence as directed by the Licensing Authority.

10. Nothing i n this Order shall render unnecessary the grant of any other licence required by law in respect of the premises licensed hereunder.

11. A l l establishments shall be classified by the Licensing Authority at the time of issue of the licence required under paragraph 3 hereof i n accordance with the classification set out in the Second Schedule hereto.

12. The licensee of any premises licensed under this Order shall display at the entrance of such premises in a prominent place visible to all persons entering the premises a copy of the licence issued to him by the Licensing Authority, surmounted by the letter of the class of establishment, for which he has been licensed, at least six inches in height.

j_ A (!)—3־ n y person who is informed by or on behalf of the Licensing Authority that his application for the grant of a licence, under paragraph 3 hereof, in respect of his establishment has been approved by the Licensing Authority, shall submit to that Authority for approval a price list of all food or drink to be served by such person at or from his establishment and of all other charges to be made by him on customers frequenting his establishment.

(2) If the Licensing Authority approve such price list, it shall be in force for a period of three months as specified on the approved list in the manner indicated in paragraph 15 hereof.

14. The Licensing Authority may delete from any price list submitted to that Authority for approval for the purpose of this Order, any article or commodity, for which the proposed charge appears to the said Authority to be excessive, and where any article or commodity is so deleted from the price list the licensee shall not serve or cause to be served or allow to be served that article or commodity at or from his ­establishment until a price list for a subsequent period of three months is approved for his establishment under paragraph 15(3) hereof or until a price list for any period is approved for his establishment under paragraph 15(4) hereof.

15. —(1) The approval by the Licensing Authority of a price l is t for the purposes of this Order shall be indicated by the stamping of the price list with the official stamp of the Licensing Authority.

(2) A price list approved by the Licensing Authority for the purposes of this Order (hereinafter referred to as "approved price l ist") shall be valid only during the period for which ' i t ׳ i s so approved, as specified within the stamp affixed on the price list by that Authority.

A price list so approved shall not subsequent to such approval be altered in any manner whatsoever, except when application is made under sub­paragraph (3) hereof for approval of a price list for a subsequent period of three months or when a new price list for any period is submitted under sub­paragraph (4) hereof.

(3) A n y licensee of an establishment who, after the approval of his price list under paragraph 13 hereof, desires to obtain approval of a price list for any subsequent period of three months shall apply to the Licensing Authority, at such time as may be prescribed by that Authority, and shall submit with his application the price list for which approval is applied for.

(4) Notwithstanding anything in the preceding provisions of this Order, the Licens ing Authority may require the licensee of any establishment to submit for ap­proval a new price list at any time the Licensing Authority may deem fit and the licensee shall comply with such a request.

16. The charge which may be made by any establishment licensed and classified under this Order for any food, meal or service, or the concomitants thereof, sold or furnished by such establishment shall not exceed the amount specified in the ap­proved price list of such establishment :

Provided that in addition to the amount so specified in that price list, there may be made in respect of any food or drink served in such establishment, a charge for service not exceeding 10% of the amount specified as aforesaid.

17. —(1) The licensee of premises licensed under this Order shall not at or from such premises serve or cause to be served or allowr to be served any customer wi th any food or drink without first invit ing his attention to the approved price list and to the -charges to be made in respect of the food or drink in accordance with that price list.

(2) A t least two copies of the approved price list shall be displayed in prominent places i n every room in which food or drink is served on such licensed premises.

18. Notwithstanding anything contained in this Order, the total charge which may be made by any establishment licensed and classified under this Order for any food, meal or service, or the concomitants thereof, sold or furnished by such estab­lishment to any one person at any one time shall not exceed the maximum amount specified in the Second Schedule hereto in respect of the class in which such estab­lishment is so licensed and classified.

19. A n y police constable, or any officer of the Department of Food Control author­ised in that behalf in writ ing by the Food Controller, may at any time enter and inspect any establishment wdth a view to securing compliance with the provisions of this Order.

20. A n y person who, either by himself or his servant, employee or agent, con­travenes or any person who aids, abets or solicits any person to contravene any of the provisions of this Order shall be guilty of an offence under the Defence Regula­tions, 1939.
