Annexure 1

TERMS OF REFERENCE FOR SERVICE PROVIDER 1. Background

The Uplands Irrigation and Water Resources Management Sector Project (UIWRMSP) (ADB Loan 3289-CAM) is supporting the Royal Government of Cambodia’s strategy to enhance economic growth in the project area through the rehabilitation, modernization, and climate proofing of selected existing irrigation systems in the provinces of Battambang and Kampong Thom. The outcome of the project is enhanced water and agriculture productivity in the project provinces. The project outputs are: (i) enhanced efficiency and climate resilience of irrigation systems; and (ii) improved management of water resources.

Output 1: Enhanced efficiency and climate resilience of irrigation systems consists of the rehabilitation, modernization, and climate proofing of at least three irrigation systems in the provinces of Kampong Thom and Battambang. The cultivated area of the systems is expected to increase to 29,500 hectares (ha) from a baseline of 13,500 ha. This output will include the rehabilitation and modernization of the Taing Krasaing and O Kra Nhak irrigation systems in Kampong Thom and the Prek Chik irrigation system in Battambang. The physical improvement covers installation of pump systems and distribution channels, installation of structures and gauges for water flow measurement, control and distribution, construction of drainage facilities, and laser land leveling of about 2,000 ha.

Output 2: Improved water resource management includes the following key activities:

Formation and development of farmer water user communities (FWUCs); Installation of hydro-meteorological (hydromet) stations in the watersheds and flow

measurement networks in the irrigation systems; Provision of training to staff of the Ministry of Water Resources and Meteorology

(MOWRAM), Provincial Departments of Water Resources and Meteorology (PDWRAMs), Ministry of Agriculture, Forestry, and Fisheries (MAFF), and FWUCs;

Modernization of canal operations; Design and implementation of joint reservoir operation (JOROP) of linked systems in

Kampong Thom and Battambang provinces; and Provision of training to FWUCs on operation and maintenance (O&M) of canals,

management of FWUCs, orientation on climate variability and change, and water management.

2. Services Required for the Formation and Development of FWUCs

Pursuant to the FWUC Sub-decree of March 2015, a FWUC shall be established and registered with MOWRAM for each irrigation system in Cambodia. The FWUC, whose members are the farmers within the command area of the irrigation system, shall be responsible for the operation and maintenance (O&M) of the irrigation facilities delegated to them by the PDWRAM/MOWRAM through an agreement between the FWUC and PDWRAM.

FWUCs are voluntary organizations established and managed by the farmers in each irrigation scheme. Irrigation schemes are jointly managed by PDWRAMs and the farmers. The first step in establishing a FWUC is the orientation and agreement of the farmers on the sharing of benefits and burden in the management of the irrigation system between the Government (through PDWRAMs) and the farmers. The FWUC Statute and agreements for division of asset responsibility between the PDWRAM and the local authorities are required to provide the legal basis for FWUCs to carry out their O&M roles and responsibilities in the irrigation scheme with clarity. The agreements shall be the product of informed and collective decision-making (ICDM) among stakeholders, particularly the farmers, represented by the FWUC.

The services required for the formation of FWUCs shall be provided by a qualified local NGO, university, research institution, or local consulting firm, which will be recruited by the Project Management and Implementation Consultant (PMIC) following ADB’s Consultants’ Qualification Selection (CQS) procedure with bio-data and technical proposals. The payment for the service provider shall be charged against the Provisional Sum component of the MOWRAM-PRIMEX consulting services contract. Interested entities must provide amplified Expressions of Interest (EOIs), which include the information showing that they are qualified to perform the services, giving the entity’s general experience in similar assignments and CVs of key personnel with academic background, experience in similar assignments, knowledge of local conditions, etc. EOIs and CVs must be submitted using the format shown in Attachment 1 and Attachment 2.

3. Overall Schedule of FWUC Formation

The project aims to actively involve the farmers, through the FWUC, in all activities of the project from design, construction supervision, and eventually O&M of the completed irrigation schemes. The early participation of the FWUCs in project activities and development is expected to build up the farmers’ sense of ownership of the project and their aspiration to operate and maintain the irrigation system. The overall timeframe of FWUC formation is generally ONE YEAR. This involves the mobilization of the farmers to form the FWUC until the FWUC is registered with MOWRAM. These Terms of Reference (TOR) refer the activities covering a timeframe of one year.

4. Subproject Information

The UIWRMSP has three subprojects where FWUCs will be formed and developed. Table 1 presents the basic statistics and status of implementation of the subprojects.

5. Scope of Work

The service provider will be engaged to carry out the activities involved in mobilizing, organizing, and developing the FWUC in the three subprojects described above in accordance with the established FWUC Sub-decree and the FWUC Development Policy and Guidelines of MOWRAM. The service provider will carry out all prescribed activities in mobilizing and organizing the farmers into a MOWRAM-registered FWUC within the allocated timeframe of one year. The scope of services include: (i) orientation and mobilization of farmers, (ii) organization and election of FWUSGs, FWUGs, and SSC, (iii) election of FWUC and advisory group, and (iv) registration of the FWUC with MOWRAM and local government authority.

(i) Orientation and mobilization of farmers include: (a) identification and listing of farmer-beneficiaries; (b) orientation of farmers on the project, participatory irrigation management and development (PIMD), irrigation management transfer (IMT), government policy on FWUC, gender development, organizational benefits and advantages of organized FWUC, etc.; and (c) delineation, formation, and development of farmers Sub-groups and Groups;

(ii) Organization and election of farmer water user groups (FWUGs), farmer water user subgroups (FWUSGs), and Statute Sub-committee (SSC), including: (a) election of leaders in each FWUSG and FWUG; (b) election of SSC; (c) drafting of FWUC statute; and (d) dissemination of FWUC statutes in all villages within the FWUG;

(iii) Election of FWUC and advisory group, including: (a) organizing the FWUC and holding elections of the leaders; (b) selection of advisory group of the FWUC; (c) training the FWUC and advisory group on its roles and responsibilities; and (d) ratification of the FWUC Statute and dissemination to all villages within the irrigation scheme;

(iv) Registration of FWUC with MOWRAM and local government authority, including all

activities and documentation under the FWUC Sub-decree that will result in the recognition of the FWUC as a legal entity that could transact business and enter into contract or agreement with the government (through PDWRAM) and any other private entity.

5.1 Strategy in Farmers’ Mobilization and FWUC Organization

The general strategy in mobilizing and organizing the farmers is described below:

(i) One FWUC is organized in each irrigation system, hence, there shall be three FWUCs in UIWRMSP.

(ii) One FWUG is delineated and organized within the command area of one secondary canal (SC). When the SC area is small, a FWUG could also cover more than one SC.

(iii) One FWUSG is delineated and organized within the command area of one or more tertiary canal (TC).

In the Taing Krasaing subproject in Kampong Thom, there are three SCs that will be developed by the project, namely: Chhroab, Korkoah, and Tipou. In addition, the existing CAVAC area adjacent to the Chhroab area was provided with a distribution network (SC, TC, and off-takes) in 2013 or 2014. A FWUG was also organized within the CAVAC area during the construction of the distribution facilities. In Okra Nhak, there are two small main canals (MCs) and several SCs over the entire system command area of about 1,500 ha. In Prek Chik, the project will develop two civil works packages of SCs to cover about 11,000 ha of the target command area of about 20,000 ha. Table 2 presents the number and coverage of the distribution network that will be constructed by the project. This will

define the work area and scope of the service provider. The existing FWUG in the CAVAC area will be involved in the activities in the adjacent Chroab SC area.

5.2 Implementation Procedures and Methodology The mobilization of farmers and formation of FWUCs consists of 10 specific activities. These are discussed below while the succeeding sections shows the steps followed as shown in the FWUC Sub-decree.

This consists mainly of: (i) Initial meeting with PDWRAM, District Officials, and Commune and Village leaders to introduce the project, discuss FWUC formation, and set orientation schedules of villages; (ii) conduct of meetings in each village to orient villagers on the project objectives and scope, stakeholders’ responsibilities, PIMD, IMT, FWUC policy, and organization, FWUC sub-decree, gender and development, etc., and (iii) discuss in details the FWUC Sub-decree, Prakas # 306 of MOWRAM. This will cover all villages within the subsystem. By the end of each village orientation, the community organizer (CO) would have identified five possible candidates for membership in the SSC.

2. Listing of farmers and delineation of FWUSG and FWUG

The main objective is to prepare the list of farmers on the map and delineate them on the FWUSG and FWUG. A hard copy of the aerial photo of the relevant area will be provided by PMIC. This includes meetings with authorities for assistance in delineating the group following the hydraulic boundaries of the sub-system and appropriate groupings for FWUSG and FWUG. The listing of farmers is done faster with the aid of aerial photos in group discussions within each village.

3. Election/organization of FWUSGs

The number of FWUSGs will be clearer after Activity No. 2. Candidates for FWUSG representatives come from each block within the FWUSG. Elections are done separately in each FWUSG. At least 30% women should be in the FWUSG representation.

4. Election/organization of FWUG

The number of FWUGs is as delineated in Table 2. The election will be done in the presence of local authorities on a date and location set with them. Candidates for FWUG are the elected leaders in the FWUSG.

5. Election of SSC The SSC, while an ad hoc committee, is very important as it would author the FWUC statute. Each village within the sub-system has two representatives in the SSC. These are elected from the potential candidates identified during the orientation activities in Item No. 1. The date and location of the election of SSC members is set with local authorities who will witness the election proceedings.

6. Formulation and dissemination of the FWUC statute

Once the SSC is formed, several meetings with them will be conducted for the formulation of the draft FWUC statutes. The draft statute is then disseminated to each village within the sub-system. The SSC representative from each village will make the presentation assisted by the CO.

7. Election of FWUC and selection of Advisory Group

The FWUC leaders are elected from the FWUG leaders. FWUC election is held four times, separately by secret balloting – the first is for the FWUC Leader, then for the First Deputy Leader, then for the Second Deputy Leader, and the fourth is for the Treasurer. The FWUC Advisory Group members are selected to represent the district level of PDWRAM, the commune chief, and village leaders within the command area of the system. The structure of the FWUC, the list of names of FWUC leaders and advisory group, and the roles and responsibilities will be included in the documents acknowledged by the local authorities.

8. Training of FWUC and Advisory Group on roles and responsibilities

The objective is to familiarize the leaders and advisory group on their roles, responsibilities, and authorities as prescribed in the FWUC Sub-decree. This also includes the preparation of the five-year work plan of the FWUC.

9. Ratification of FWUC statute The draft FWUC statute will be finalized incorporating the recommendations of the villagers collected during the dissemination in Item no. 6. This, together with the FWUC work plan, is then subject to ratification of the village leaders, FWUC leaders, SSC members, and local authorities.

10. Registration of FWUC with MOWRAM

The collection and compilation of all documents required for the registration of the FWUC with MOWRAM is a major activity. The supporting documents include: (i) layout map; (ii) FWUC statute/by-laws; (iii) FWUC organizational structure; (iv) acknowledgment letter from district officials; and (v) sub-decree on establishment, dissolution, role, duty, and procedures of FWUC. Other information that is maintained at the FWUC office includes: (i) list of FWUC leaders and advisory group with address and contact number; and (ii) list of farmers with address and farm area in the Blocks, FWUSG, and FWUG.

The eight steps of FWUC formation, as shown in the FWUC Sub-decree, are also presented here as additional reference.

Step 1: Disseminate the information about FWUC formation

Orientation on project for local authorities o Meet the concerned local authorities to:

- Inform them about the project objectives, scope, and fund sources; - Show the map of the irrigation system; - Illustrate/explain the FWUC supporting documents; - Mainstream gender in the process of FWUC formation; and - Set orientation schedules of villages.

Step 2: Demarcate the command areas of the irrigation system.

Step 7: Finalize FWUC statute and action plan.

Ratification of FWUC Statute o Meet with the SSC and the concerned authorities to finalize the draft FWUC statute and

five-year action plan; and o Disseminate the finalized statute among the beneficiaries in the target villages.

Step 8: Registration of FWUCs

Registration of FWUC with MOWRAM o Meet with the concerned authorities to:

- Ask for approval and signature on the FWUC statute, acknowledgment letter, and other supporting documents;

o Register the FWUCs with MOWRAM.

5.3 Deliverables

The service provider will prepare and submit, in both English and Khmer, the following documents when engaged:

(i) Detailed work plan and overall target S-curve for the duration of services; (ii) Monthly progress report within the first week of the succeeding month. This will show

the activities undertaken by each CO and the output of each activity including the overall implementation status of the services. The daily timesheets of the personnel.

(iii) Cumulative Activity Report to support each payment claim. This includes original copy of attendance sheets of participants on conducted meetings with stamp of Commune Leader, summary number of participants segregated by gender per activity, pictorial record of work progress per activity. The number of participants per activity should be at least 95% of target;

(iv) List of farmers with farm area in each SC arranged according to FWUSG and FWUG; (v) Accomplished aerial photo with the farmers’ names and farm area (hard copy of the

aerial photo relevant to each SC will be provided by PMIC); (vi) List of leaders with address and contact number of the FWUSG, FWUG and FWUC; (vii) List of Advisory Group with address and contact number; (viii) Approved Statute of the organized FWUC; (ix) Draft agreement between FWUC and PDWRAM relating to the O&M of the irrigation

system duly certified by the FWUC leader and PDWRAM Director; and (x) Contract Completion Report within the first two weeks upon conclusion of the one

year.

5.4 Cooperation

The activities of the service provider shall be supervised by the PMIC. The collaboration and coordination with PMU and with provincial and district authorities and departments in the conduct of the activities are encouraged. The work shall be implemented with the community leaders and local authorities in the subprojects/secondary canals.

6. Requirements for the Service Provider

6.1 Team Composition and Required Inputs

The service provider shall be a local NGO, a local university, or a local consulting firm. The estimated team composition and required inputs for the entire contract duration, from 2016-2017, are summarized below.

6.2 Duties, Responsibilities, and Qualifications

(i) Senior Community Organizer/Team Leader (SCO/TL) The Senior Community Organizer/TL must have a graduate degree in Social Work/Development, Rural Development, Community Development, or related fields and have at least five years of experience in community organizing and development projects in Cambodia and/or neighboring countries. The TL shall be familiar with FWUC formation and development, have a working knowledge on the FWUC Sub-decree of the Royal Government of Cambodia (RGC), and proficient in both the English and Khmer languages. The TL shall hold office in one of the project provinces, preferably in Kampong Thom, and shall visit the other province on a monthly basis. The specialist has working knowledge and experience in the application and conduct of participatory processes and methods appropriate for formation of FWUCs, such as transect walk, focus group discussions (FGDs), problem tree identification, community mapping, etc. As Team Leader, he/she will provide overall direction for the community organizing activities of each CO and monitoring of field activities and performance of all team members. Specifically, he/she will be responsible for the following:

(a) Take overall responsibility in the mobilization and formation of each FWUC within the prescribed timeframe;

(b) Provide technical leadership and overall management in the execution of the work in the field;

(c) Prepare the detailed approach, strategy, methodology, and work plan for the assignment;

(d) Prepare orientation and training modules, provide support in the conduct of such and make sure that these modules are identical and consistent in all subprojects;

(e) Conduct periodic visitation and provide technical and motivational support to field staff; and

(f) Undertake process monitoring and prepare required reports and deliverables.

(ii) Community Organizers (5)

The COs should have at least a graduate degree in social work, community development, education or related fields and have at least three years of experience in community organization or social works. They will be responsible in carrying out the specific activities in the formation and development of FWUSG and FWUG in the secondary canals assigned to them. They will provide coordinated assistance and support to the Team Leader in the formation of the FWUC in each subproject. The community organizers shall stay in their area of assignment, preferably in the centrally located village of the secondary canal as is usual good practice in community organizing work. In order to ensure their mobility, the COs shall bring their own motorcycle as service vehicle in the conduct of the activities in the assigned area. A fixed monthly allocation for the motorcycle O&M and house rent shall be included in the reimbursable out-of-pocket expenditures of the CO and the TL.

7. Time Schedule

The activities in the mobilization, formation and development of FWUC shall be undertaken within one year – from mobilization of the service provider up to completion of the registration of the FWUC with MOWRAM, including the preparation of the draft agreements on O&M, as shown below.

8. Payment Schedule of the Service Provider The payment of the service provider will be related to the accomplishments of field activities and the submission of deliverables as follows:

(i) 10% of contract amount upon signing of contract and submission of work plan and overall target S-curve for the duration of the services;

(ii) 30% of contract amount upon submission of list of farmers in each SC and/or MC arranged according to FWUSG and FWUG (completed activities no. 1 and 2 of FWUC formation);

(iii) 20 % of contract amount upon completion of FWUSG and FWUG elections in all three subprojects (completed activities no. 3 and 4 of FWUC formation);

(iv) 20% of contract amount upon submission of ratified FWUC statute and election of FWUC in each of the three subprojects (completed activities no. 5, 6, 7, 8 and 9 of FWUC formation);

(v) 10% of contract amount upon submission of registration documents of each FWUC to MOWRAM (completed activity no. 10 of FWUC formation); and

(vi) 10% of contract amount upon submission of Contract Completion Report together with all documents related to the work.
