NST Guarantee

If your School Tour is cancelled/delayed or you are stranded abroad due to an unexpected event, such as the Volcanic Ash Cloud situation, we will always seek to get you home safely as soon as possible or rebook your tour on analternative date that suits your plans.

Brochure prices - “From” prices in the brochure are based on off peak/term time dates & a minimum of 40 paying passengers. Supplements will apply for peak/term holiday travel. Extra charges apply for entrances/visits not listed as being included in the price. All prices have the Early Booking bonus deducted.

8. FORCE MAJEURE

ExceptwhereotherwisestatedintheseBookingConditions,weregretwecannotacceptliabilityorpayanycompensationwheretheperformanceorpromptperformanceofourcontractualobligationsispreventedoraffectedbyoryouotherwisesufferanydamage,lossorexpenseofanynaturewhatsoeverasaresultof‘forcemajeure’.IntheseBookingConditions,‘forcemajeure’meansanyeventwhichweorthesupplieroftheservice(s)inquestioncouldnot,evenwithallduecare,foreseeoravoid.Sucheventsmayincludewarorthreatofwar,riot,civilstrife,actualorthreatenedterroristactivity,industrialdispute,naturalornucleardisaster,adverseweatherconditions,fireandallsimilareventsoutsideourcontrol.

9. TRAVEL TICKETS & VOUCHERS

Thesearevalidinconjunctionwiththeparticulartravelarrangementsbookedandtheroutespecified.Norefundcanbemadeforlost,mislaid,unused,unendorsedorexpiredtickets,couponsorvouchers.Anydetailsgivenareprovisionalanddonotcommitanyairlinementionedtoprovidingaservice.

10. LIABILITY

Wewillonlyacceptresponsibilityforanypersonalillness,injuryordeathwhichresultsfromthenegligentactsoromissionsofanyservantoragent,oranysupplierworkingonourbehalfintheprovisionofservicesorfacilitiestoyouandwhilstactingwithinthescopeoftheiremployment.Wewillalsoacceptresponsibilityforthoseelementsofthetourarrangementswhichareunderourdirectcontrol,andfortheactsand/oromissionsofouremployees,agents,sub-contractorsandsuppliers.Wecanonlybeliablefortheprovisionofspecialrequestswherewehaveconfirmedtheiravailabilityinwritingbeforehand.Pleasenote,however,thatwedonotacceptliabilityforanyairorseacarrierswhoseindividualconditionsofcarriageapplyandareoftensubjecttointernationalagreements.Wecannotbeheldresponsibleforthelossofenjoymentoradditionalexpensesduetodelaysorchangesinanytravelarrangementsorotherserviceswhicharecausedbycircumstancesamountingto‘forcemajeure’(seeClause8).Ourliabilityinallcases(exceptthoseinvolvingillness,injuryordeath)islimitedto50%oftheinvoicedtourvalueperpassengerinadditiontoafullrefund.Wecannotbeheldresponsibleforthefailureorinabilityofanyequipmentorcomputerprogrammetorecogniseorcorrectlyinterpretor

Shouldyouoranymemberofyourpartyhavethemisfortunetosufferillness,injuryordeathduringtheperiodofyourtourarisingoutofanactivitywhichdoesnotformpartofthearrangementsmadebyus,weshall,whereappropriate,giveyoueveryhelpthatwecanbywayofinitialassistance,includinginitiallegalcostsassociatedtherewith,uptoamaximumvalueof€7,000/£5,000perbookingform.Youmustrequestsuchassistancewithin90daysfromthedateofthemisadventureandintheeventoftherebeingasuccessfulclaimforcostsagainstathirdpartyortherebeingsuitableinsurancepoliciesinforce,thecostsincurredbyusshallberecoverablefromyou.

11. COMPLAINTS PROCEDURE

Ifthereareanyproblemswithyourarrangementswhilstyouareaway,thePartyLeadermustimmediatelyinformthesupplieroftheservice(s)inquestion.Anyverbalnotificationmustbeputinwritingandgiventothesupplierassoonaspossible.Ifthesupplierisunabletoresolvethecomplaintorproblemtoyoursatisfaction,youshouldcontactusimmediatelyeitherattheofficeduringworkinghoursorviaour24hourdutyofficerout-of-hours.Untilweknowaboutaproblemorcomplaint,wecannotbegintoresolveit.Mostproblemscanbedealtwithquickly.Intheunlikelyeventthatthematterremainsunresolved,pleasewritetousimmediatelyonyourreturnandwewilldoourutmosttofindasatisfactorysolution.Noticeinwritingofanyclaimordisputemustbereceivedbyuswithin28daysofthedateonwhichthetourended.IfanydisputeonatourbookedwithNSTTravelGroupLtdcannotbeamicablysettled,itwillbepossibletoreferittoarbitrationunderaspecialschemearrangedbytheCharteredInstituteofArbitrators-IrishBranchonbehalfoftouroperators.Fulldetailsofthisschemeareavailableonrequest.Claimsforlessthan€1,270ortheSterlingPoundequivalentperBookingFormmaybepursuedthroughtheDistrictCourtSmallClaimsprocedure.TheapplicationforarbitrationandStatementofClaimmustbereceivedbytheCharteredInstituteofArbitrators–IrishBranchwithin9monthsofthedayofreturnfromthetour.

13. SUPERVISION

Whenyoubookwithus,youacceptfullresponsibilityforanydamageorlosscausedbyyouoranymemberofyourgroup.Fullpaymentforanysuchdamageorlossmustbepaiddirectatthetimetotheaccommodationownerormanagerorothersupplier.Ifyoufailtodoso,youwillberesponsibleformeetinganyclaimssubsequentlymadeagainstus(togetherwithourownandtheotherparty’sfulllegalcosts)asaresultofyouroranymemberofyourgroup'sactions.

PartyLeadersand/orotheradultsaccompanyingthepartyagreetoact‘inlocoparentis’atalltimesandwilladequatelysuperviseallmembersoftheparty.ItisthePartyLeader’sresponsibilitytoensurethat:

a)Nogroupmemberunder18consumesalcoholicbeverageswithoutpriorwrittenconsentoftheparent/guardian.

b)Nostudentsmokesoncoaches,inanyaccommodation,inanysmokefreeplacesorbehavesinanyotherwaywhichmaycauseafirehazard.

c)Allpartymemberswearthelapbeltsprovidedforalljourneysbycoach.(Notalwaysapplicabletocoachessourcedoverseas).

3. PAYMENT

16. PASSPORTS & VISAS

ThepassportandvisarequirementsapplicableatthetimeofprintingtoIrishandBritishCitizensforthearrangementsweofferareshownintheImportantNotessectionofthisform.HoweveritistheresponsibilityoftheGroupOrganisertoobtainthepassportandensureallgroupmembersnotincludedonanycollectivepassporthaveafullindividualpassport.

Exceptfordelaystoflights,intheeventofadelayinanytravelarrangementsincludedinyourtourlastinglessthan12hours,wewilleither(1)makearrangementsthereandthenasappropriatetoreduceanydiscomfort(forexampleprovidingyouwithamealvoucher)or(2)wewillprovideretrospectivereimbursementofreasonablecostsyouincurforrefreshmentsonproductionofreceipts.Inbothcasesifthedelaycausesyoutomissapre-bookedmealwherethedelayexceeds3hours,yourgroupwillbeentitledtolightrefreshments.Intheeventofadelayexceeding6hours,yourgroupwillbeentitledtoreceiveamainmeal.

18. SPECIAL REQUESTS

Anyspecialrequestsmustbeclearlynotifiedtousinwriting.Wedoourbesttomeetanyspecialrequestsmadebyyouandensurethattheseareforwardedtotheappropriatepersons.Wecannotguarantee,however,thatspecialrequestswillbefulfilledandfailuretodosodoesnotconstituteabreachofcontract.SpecialrequestswillonlybeheldtoformpartofthecontractbetweenyouandNSTTravelGroupLtdwhentheyhavebeenconfirmedinwritingtobeguaranteedbyNSTTravelGroupLtd.

19. MEDICAL PROBLEMS

Ifanymemberofyourgrouphasanymedicalproblemordisabilitywhichmayaffectyourarrangements,theGroupOrganisermustgiveusfulldetailsbeforeyouconfirmyourbookingsothatwecanadviseastothesuitabilityofthechosenarrangements.TheGroupOrganisermustgiveusfulldetailsinwritingatthetimeofbooking(ifnotalreadyconfirmedinwriting)andpromptlyupdateusofanychanges.Ifwereasonablyfeelunabletoproperlyaccommodatetheparticularneedsofthepersonconcerned,wemustreservetherighttodeclinetheirreservationor,iffulldetailsarenotgivenatthetimeofbooking,cancelwhenwebecomeawareofthesedetails.

20. DATA PROTECTION
