MINUTES Thornbury Township Board of Supervisors Meeting

Wednesday, October 6, 2010 The Thornbury Township Board of Supervisors held a Public Meeting on Wednesday, October 6, 2010, at the Township Administration Building, 6 Township Drive, Cheyney, PA. Chairman Raith called the meeting to order at 7:00 p.m., with a salute to the flag. PRESENT:

On a motion by James Kelly, seconded by James Raith, and carried

unanimously, for the approval of nominating and appointing Sheri Perkins to the Board of Supervisors. Chairman Raith called for public comment. There was no public comment. Sheri Perkins was then nominated, appointed and sworn in by Judge Richard Cappelli. Mr. Raith and Mr. Kelly both congratulated Ms. Perkins

APPROVAL OF CHECK REGISTERS

On a motion by James Kelly, seconded by Jim Raith, and carried unanimously, the General Fund check register in the amount of $58,358.66 for September 16, 2010 through October 6, 2010, was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly, seconded by James Raith and carried unanimously, the Sewer Fund check register in the amount of $19,529.57 for September 16, 2010 through October 6, 2010, was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly, seconded by James Raith, and carried

unanimously, the Escrow Fund check register in the amount of $10,769.82 for September 16, 2010 through October 6, 2010, was approved. Chairman Raith called for public comment. There was no public comment.

APPROVAL OF MINUTES

On a motion by James Kelly, seconded by James Raith, and carried

unanimously, the September 15, 2010 Work Session Meeting minutes were approved. Chairman Raith called for public comment. There was no public comment.

BOARD/COMMISSION REPORTS

Parks & Recreation Board- Joe Burke

Mr. Burke congratulated Ms. Perkins and then stated that the Board had met on September 28th to discuss their upcoming events, the Fishing Derby Saturday

October 9th and the Halloween Parade and Fall Festival on October 24th.

Historical Commission – Ric Miller Mr. Ric Miller congratulated Ms. Perkins and then stated that the Commission is currently working on creating an additional Historic District at Station Road and had met with Wise Preservation Planning to discuss the procedure. Upon completion, they will then request approval from the Board of Supervisors. The Commission is also working on updating the Historic Resource Inventory and would like to add additional resources to the list. Other current projects include the Fraser Ruins stabilization enhancement, the sign ordinance and the Time Line Project at Thornbury Park. In closing Mr. Miller informed the board that the Historic Commission had recently nominated John Miller as their Vice Chairman.

Planning Commission – Jim Bulkley Mr. Bulkley congratulated Ms. Perkins and then stated that they met on September 22nd and discussed the Carbutt subdivision and mentioned including proposed areas for sidewalks or walking paths in front of both lots. They also discussed the Guilday Subdivision and addressed the public sewers and on site septic issues as well as steep slopes, ingress and egress. The Wills subdivision was also discussed regarding legal documents presented by Carol Wills supporting her ability to access Skyline Drive from one of the proposed lots. Finally, Mr. Bulkley discussed their efforts in addressing accessory structures for solar panels and or windmills. James Kelly inquired about the sidewalks mentioned for the Carbutt subdivision and Mr. Bulkley replied that Mr. Carbutt will be requesting a waiver but they wanted to have him include the proposed walkways in his plan for future consideration.

Sewer Committee- George Morley Mr. Morley congratulated Ms. Perkins and then stated that their committee met on September 23rd and the 29th and the meetings went well but they continue to have concerns regarding the content proposed in the agreements drafted by the township for the West Side Sewer Development. Mr. Morley then stated that they also had some discussion regarding a possible next phase being introduced in Fox Lair.

Environmental Advisory Council – Allen McCann Mr. McCann congratulated Ms. Perkins and then mentioned their recent trail clearing was a successful effort and that their next one will be Saturday, October16th. Ms. Perkins asked where it will be held and Mr. McCann replied at Tall Trees.

Library Report – Patty Hunsecker Ms. Hunsecker was not present but Mr. Raith mentioned that she had submitted her report and that the library recently added 7 new members.

AGENDA ITEMS

On a motion by James Kelly, seconded by James Raith, and carried

unanimously, for the approval and execution of the Assignment and Bill of Sale for the Thornbury Township Sewage Facilities associated with the Greenbriar Development and authorization of the release of Performance Bond No.327000741 to Orleans Homebuilders. Chairman Raith called for public comment. There was no public comment.

PUBLIC COMMENT

Ted Jacquet asked about acceptable recyclable plastics to which Mr.Seagraves replied that we were waiting to hear from the DEP. Ms. Patty Voorhees of 445 Glen Mills Rd inquired about the Grinder pump agreement and the type of plumber required to install them. She also asked about a list of potential contactors that the township might supply her with and also sought clarification of when the payments were due. Mr. Seagraves answered that we were expecting a sample agreement from the DEP to review for comparison for any revisions that might be made to our agreements. He then stated that the grinder pump payments would be needed by October 15th2010 and the other payment due by November 17th 2010. Maureen McCann commented on pedestrians walking in the street at night in Thornbury Hunt and not on the sidewalks presenting a safety issue. Mr. Raith said that a note will be sent to their HOA.

STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Jeffrey Seagraves The Township Manager’s Report was submitted and is attached. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, for appointing Susan Daudert as a full time employee effective immediately, the Board accepted and approved the full time position. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, a 60 day Extension Request on the “GUILDAY” Subdivision, extending the present action date to December 5th 2010, was accepted and approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins,and carried unanimously, a 30 day Extension Request on the “CARBUTT” Subdivision, extending the present action date to November 5th 2010,was accepted and approved. Mr. Seagraves mentioned the Fishing Derby this Saturday. Ms Perkins offered the services of an electrician to install an electrical outlet to the sign at the comfort station for the tree lighting at Thornbury Park this year. TREASURERS REPORT- Peter Barsz The Treasurers Report was submitted and is attached. Mr. Kelly made a motion to accept the Treasurers Report and it was seconded by Ms. Perkins. Chairman Raith called for public comment. There was no public comment. Maureen McCann questioned the date on the report. ROADMASTER’S REPORT – Lindsey Price The Roadmaster’s Report was submitted and is attached. Chairman Raith spoke to The Supervisors in Thornbury Township Chester County regarding the remainder of the paving that needed to be done to Dilworthtown road near Cheyney University. Mr. Kelly commented on the nice job the Public Works Department did on the storm and flood cleanup.

TOWNSHIP SOLICITOR’S REPORT – Robert P. Anderman, Esq. The Township Solicitor’s Report was submitted and is attached.

TOWNSHIP ENGINEER’S REPORT – Elizabeth Catania, PE The Township Engineer’s Report was submitted and is attached. Ms. Catania mentioned a productive meeting with Ted McCandless regarding a resolution for a master plan contractor road program. She also mentioned a meeting on Friday regarding a change order on additional tonnage for the Road Program.

SEWER ENGINEER – James McCann, PE The Township Sewer Engineer’s Report was submitted and is attached. Mr. Seagraves mentioned that the sinkholes due to rain will be taken care of. Chairman Raith requested that Ms. Perkins receive all clearances and a copy of the Carbutt Subdivision and Conditional Use application.

Public Works Department/Road Master’s Report Week Ending October 1, 2010

__________________________________________________________________ 1. Performed routine maintenance throughout the Township. 2. Road edge cutback of trees and tall grasses for right of way throughout the

Township remains ongoing. 3. Removed BMX trails from Bonner Park. 4. Met with Eagle Scout Ryan Nowell to mark out trails at Palmer Park. 5. Boy Scout Troop 260 is camping out at Martin Park on October 1st and 2nd. 6. Painted lower level foyer at Township Building. 7. Cleared stormwater inlets throughout the Township as a result of two storms. 8. Cleared roadways, closed roadways and directed traffic as a result of Thursday night’s rain

storm. All traffic was being directed by State Police off of Route 1 onto Cheyney and Locksley Roads and off of Route 352 onto Slitting Mill, Locksley and Cheyney Roads.

9. Discussing preparations to Martin Park for Fishing Derby. Road work and tree removal

will be necessary as a result of Thursday night’s rain storm. 10. Milling and paving work completed on Dilworthtown Road from Route 202 to county line. 11. Received approval from the Park and Rec Board to remove one tree from

Thornbury Park and plant three Douglas Fir trees adjacent to the Christmas Tree. Received approval from Park and Rec Board to relocate the information sign at Thornbury Park off of Glen Mills Road by an additional 8' in an attempt to avoid future vandalism. Received further approval from Park and Rec Board with respect to the proposed stone finish on the information sign.

12. Need to address parking area issues with Blossom Hill regarding Bonner Park. Possible

resolution would be to potentially close the parking lot and make three parking spots along the road edge. Waiting for input from Park and Rec Board.

Solicitors Report

October 6, 2010 The Township Solicitor, Robert P. Anderman, Esquire, reports as follows: I. LUCKENBACH PROPERTY In this matter, the Seller, Mrs. Luckenbach, has retained an attorney who will attempt to clear the title on the property and the settlement date has now been rescheduled to a further date. At the present time the attorney for Mrs. Luckenbach is negotiating with the attorney for the Estate of the mortgage holder in order to clear title to the property. The Solicitor has been advised that the Executor for the Estate of the previous owner will make a decision on this matter within a few weeks. II. CARBUTT CONDITIONAL USE HEARING In this matter, the Solicitor has advertised the Application for Conditional Use for a hearing to be held on Wednesday, October 20, 2010 at 7:00 p.m. The Solicitor has also obtained the services of a Court Reporter for the hearing. III. ORLEANS – ASSIGNMENT AND BILL OF SALE The Solicitor has received the fully executed Assignment and Bill of Sale for the Thornbury Township Sewage Facilities associated with the Greenbriar Development from Orleans Homebuilders. The assignment has been executed by all parties to the four party agreement. The Solicitor has reviewed this matter with the Township Manager and the Township Sewer Engineer and recommends approval and execution at this time.

Work completed for the period:

Greenbriar Dallett - Residence construction continues. Completed E & S inspections.

Blantyre - Building construction is continuing. Completing periodic erosion and sedimentationinspections.

Mill Creek - House construction continues. All lots have been sold. Completing periodic erosion andsedimentation inspections. The Developer has indicated work will be completed by the end of October. Grading and Encroachment Permits - Working with the Township Licenses and Inspections onseveral permits.

Honig - Keswick Drive - completed inspection of obstructions created by landscaping on therights of way of Slitting Mill Road and Keswick Drive. Recommendations for removal of some andmodifications to others have not been completed. Andover - Construction continues on houses. Completing sedimentation and erosion controlinspections.

Guilday Subdivision - Revised plans have been submitted and will be reviewed for the next PlanningMeeting.

Cheyney University - Construction has begun. Water line and geothermal field have been started. Arevision to the geothermal field grading is proposed. This should be completed with the grading permit. The final land development plans have been reviewed for recording.

Cheyney University- Treatment Plant Upgrade - Received plans for upgrade of systems for DEPcompliance. The Sewer Engineer has provided verbal comment. No further action.

Joseph Gricco - Received land development plans for a combined driveway for the Locksley Roadproperty. A waiver of the separate driveway requirement is being sought. The plan has been revised toincorporate the single drive access and review completed. There is some items that remain such asthe feasibility of the one lot with pipeline crossings, steep slopes, septic system requirements, etc. Theapplicant has been asked to address this item.

Collins Subdivision - Final plans have been submitted. The plan is recommended for conditionalapproval. A review was completed and there are items, including PaDOT comments that must beaddressed.

Wills - Plans have been received and reviewed. The Applicant is investigating alternative means ofingress and egress. No further submission has been received.

Cherry Creek - Met with representatives of the three developers to discuss sidewalk conditions. Developers to prepare a response for the Boards consideration. The Solicitor has forwarded a letter torequest resolution of the matter. I am not aware of an resolution.

Tall Trees - Toll Brothers has responded to our request and will endeavor to comply. Dan Furtek isindicating he has engaged Eastern States to complete basin info.

Carbutt Subdivision - Plans have been submitted for a two lot subdivision. This will require aconditional use hearing.

Floodplain Ordinance - Revision of ordinance for consideration by Supervisors has been completed. The Ordinance is being put in proper form.

Road Program 2010 - Contractor has substantially completed work and a punchlist has beengenerated. Final quantities measurement was to be completed on Friday, Sept. 30. Due to floodingand rains, this has been delayed.
