The subject Council Agenda Report and PowerPoint were presented to Council on May 9, 2017, by Lisa Arroyo, Wastewater System Manager. The report details the maintenance and management activities completed in calendar year 2016 along with staff’s goals for calendar year 2017. It also touches on some of the collection system program changes as a result of the recent amendment to the Consent Decree. As you may recall, items involving sensitive legal matters would be presented to Council ahead of Water Commission. Given the importance of our collection system activities and the input of the Commission, I have included this item on the administrative calendar for information and discussion. In particular, any input the Commission might have on the Collection System goals for 2017. To streamline the discussion and avoid complete duplication of the Council presentation, Lisa Arroyo will be on hand to review the Collection System goals for 2017 in further detail and answer any questions the Commission has. Please visit the Council agenda website to view Lisa’s presentation to Council ahead of the Water Commission meeting. We will have a copy of the presentation on hand if there are questions about specific slides. Background: The Wastewater Collection System Report started as a requirement of the Consent Decree. The report details the previous year’s activities and the current year’s work, particularly as it relates to the rehabilitation, replacement, and/or repair of wastewater collection system pipes. Although presentation of the report is no longer a requirement of the Amended Consent Decree (2017), the Annual Report will continue to be presented to Water Commission and Council as an annual progress report on the status of Collection System Operations.

RECOMMENDATION:

That Council receive a report from staff on calendar year 2016 wastewater collection system maintenance and management activities.

DISCUSSION:

The City operates 257 miles of wastewater collection system pipelines, the majority of which are six or eight inches in diameter and convey wastewater to the City’s El Estero Wastewater Treatment Plant. The operation of the wastewater collection system is regulated by the State Water Resources Control Board under a Waste Discharge Requirement Permit.

In April 2011, Santa Barbara Channelkeeper (Channelkeeper) filed a lawsuit against the City in Federal District Court, alleging violations of the Clean Water Act caused by spills from the wastewater collection system pipelines. The City and Channelkeeper agreed to the terms of a Consent Decree in March 2012. By the time the Consent Decree was negotiated, the City had already committed over $400,000 and substantial staff resources to the development and implementation of management practices to improve collection system operations, with the ultimate external outcome of spill reduction. This work was incorporated into the Consent Decree and is the basis for most of the requirements of the Consent Decree.

In 2016, the City and Channelkeeper agreed to amend the Consent Decree to extend the term for up to three additional years, among other things. This amendment became effective in March 2017 and includes additional management practices to further improve collection system operations. The requirement to repair, rehabilitate and/or replace collection system pipes each year was reduced by one mile. Excess funding from this reduction in capital work, estimated at approximately $450,000, will be moved to the operating fund for increased cleaning activities.

The City must continue to produce a written annual report by March 31 of each year for the duration of Consent Decree. The report details the previous year’s activities and the current year’s work, particularly as it relates to the rehabilitation, replacement, and/or repair of wastewater collection system pipes. Although no longer a requirement of the Amended Consent Decree, the Annual Report will be presented to Council. This report is available for review in the Council Reading File and in the City Clerk’s Office, and will be summarized in the staff presentation. Also, in accordance with the Amended Consent Decree, the City will provide Channelkeeper with a semi-annual report by September 30 of each year for the term of the amended Consent Decree. In 2016, the City was successful in meeting or exceeding the maintenance practices and capital improvement work objectives required by the Consent Decree. The City met the Consent Decree Sewer System Overflow Reduction Performance Standard goal (SSO standard) for collection system spills. The SSO standard for 2016 was eight spills; the City had seven. None of the spills caused a beach closure, and the volume spilled to public waterways was approximately 73 gallons. The Amended Decree retains the annual SSO standard of eight. Staff will continue to undertake additional measures to achieve this goal. BUDGET/FINANCIAL INFORMATION: Funding for the implementation of the Consent Decree, along with other wastewater system operations, maintenance and capital improvement costs is provided through the Wastewater rates. In Fiscal Year 2013, the rates were increased to provide sufficient revenue to fund increased costs of compliance with the Consent Decree and to meet other Wastewater Fund needs. From Fiscal Year 2014 through Fiscal Year 2017, rates were increased to generate sufficient revenue to cover the operating and capital costs of the Wastewater Fund, including the costs associated with the Consent Decree. The Consent Decree caps the amount the City must expend to comply with its terms. The cap is increased by one percent each year. If the City fails to meet the SSO goal for a given year, the cap will be increased by an additional three percent of the wastewater collection system operating budget, or approximately $100,000. Per the Amended Consent Decree, a one-time increase to the cap of $150,000 will occur in Calendar Year 2017. To ensure adequate funding for collection system and treatment plant costs, staff will be recommending a wastewater revenue increase for Fiscal Year 2018.
