Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

As we have stated for years, ‘knowing where to go for the answers is half the battle’ in getting good information. In most areas of California, one of the best places to start when looking for a contractor is with the local Builder’s Exchange. For those with an expired or revoked license is it necessary to show recent work experience when re-applying? …

Q: I wanted to make a suggestion regarding a question in a recent issue; but first, let me say how much I enjoy reading your column and what a fantastic resource it is for our Builder’s Exchange mem-bers. The suggestion was regarding the request for a ‘list of plumbers’. This person could also get this information for free from their local Builder’s Exchange (assuming there was one in their area; most of CA is covered). Builder’s Exchanges aren’t able to provide a list of 100% of the companies in a given trade in their area but they are a great resource for companies that are involved in the industry. Like I always tell people who call us, we can’t make guarantees about our members but they are ‘waving their hands to be seen’, rather than hiding under a rock, as so many ‘underground’ contractors are. In addition, we always tell consumers about the CSLB website too, so they can take advantage of all the consumer protection info and pamphlets and check the license of any company they consider hiring.

We may predominantly serve the construction industry, but working with consumers is an important part of that. To start with, those looking for a contractor can start by calling an Exchange, before paying $245 to the State for that ‘list of plumbers’. A: An excellent suggestion! While a local Builder’s Exchange or Contractor Association would not have a ‘list of all plumbers’ these organizations are a great resource to locate contractors from any number of trades. The question was very brief and we do not know where he was located or whether this was from a consumer or contractor. Either way, as you stated, while an Exchange may predominantly serve the industry, consumers can generally depend on these organizations to have a list of quality contractors. Again, thank you for pointing this out and for your kind words.

Q: My license expired about 7 years ago. It was officially revoked a few years later. I’ve paid all the necessary restitution and I know I must post a $15,000 Disciplinary Bond (DB) and $12,500 Con-tractor’s Bond. I want to apply to get my Sole Owner license back and am prepared to sit for the law and trade exam.

My question is how do I get work experience to cover 4 of the prior 10 years? I’ve gotten conflicting information from the CSLB regarding whether I must even file a new “Certification of Work Experience”.

A: Over the past 30 years, we’ve handled a number of applications where someone is reapplying for a license after it had been expired for more than 5 years. In our experience, and as we’ve always been told by the Board, applicants who have an expired (even revoked) license – no matter how many years ago -- do nOT need to file a new Certification of Work Experience when reapplying (although they must retake the exams).

However, when I inquired with the Board regarding their current policy, they referenced “CCR Section” (Board rule) 825(b), which states the ‘work cert’ would still be required, but the documented four years of experience does not need to have been within the last 10 years. You can therefore list the time worked while licensed a decade or more ago.

Moody’s Sours On 30 California Cities

One of the nation’s top credit rating agencies announced this

past Tuesday that it will review 30 California cities for possible

downgrades amid mounting concern over municipal bankruptcies

and bond defaults.

“California cities operate under more rigid revenue raising

constraints than cities in many other parts of the country,” said

Eric Hoffmann, who heads Moody’s California local government

ratings team. “Combined with steeply rising costs, these

constraints mean that these cities will likely recover more slowly

than their peers nationally, even if the state’s economic recovery

tracks the nation’s.”

Cities under review include Danville, Santa Monica, Sacramento

and Fresno. Moody’s will examine an array of factors, including

falling tax revenue and increased spending. The other cities that

Moody’s has targeted for possible downgrades include Huntington

Beach and Santa Ana.

Any downgrades would increase borrowing costs for cities and

could hinder their ability to borrow for infrastructure projects.

Three California cities — Stockton, San Bernardino and

Mammoth Lakes — filed for bankruptcy over the summer,

although Mammoth’s filing was the result of losing a lawsuit.

Last week, the agricultural city of Atwater declared a fiscal

emergency and became the latest embattled community to

consider bankruptcy.

Moody’s, which rates 95 California cities, said it also will review

San Francisco and Los Angeles for upgrades.

Labor Commissioner Announces Changes to Enhance Labor

Law Enforcement on Public Works Projects

I sent this out last week, but want to make sure you saw this. The

Department of Industrial Relation’s (DIR) has introduced the new

electronic Public Works PWC 100 system which allows awarding

bodies to provide notice of public works projects to ensure

compliance with state laws. The Division of Labor Standards

Enforcement (DLSE), under the direction of the California Labor

Commissioner, has oversight authority to enforce state law

pertaining to public works projects.

“This system is an integral tool that allows the Labor

Commissioner to quickly identify projects requiring monitoring

and enforcement by DLSE’s Compliance Monitoring Unit (CMU).

The awarding body will find the system to be user friendly,”

stated DIR Director Christine Baker. “This tool will assist us to

ensure the proper use of public funds dedicated towards public

construction projects.”

An awarding body is a department, board, authority, officer or

agent awarding a contract for public works. In most cases the

awarding body is a unit of state or local government, such as a

city, county, school district, water district, special district, or a

state agency.

“This new system replaces the DAS 13 form and provides a simple

and universal way to provide information on current projects,

which will benefit those who play by the rules and allow us to

better identify and enforce against those who don’t,” said Julie A.

Su, State Labor Commissioner.

In January, the CMU began monitoring and enforcing prevailing

wage laws on certain public works projects that contained state

construction bond funding. CMU enforcement was established

to quickly identify public works violations during the life of a

project, thereby creating a level playing field for public works

contractors and to ensure all workers are paid the required

prevailing wages.

The completion and the submission of the new PWC 100 system

fulfills the required public works project award notification

required by law [Labor Code Section 1773.3 and 8 California Code

of Regulation Section 16451(a)]. The new PWC 100 system will

allow multiple awarding body users to provide notice to DIR. In

addition, the functionality of the new database will allow:

• Users to save notices of projects for up to six months

• Awarding agencies to copy or save completed notices in a

PDF format

• Awarding agencies to report pre-construction professional

license numbers for soil and material testers, surveyors and

other pre-construction activities not requiring a contractors’

state license

• Awarding agencies to edit previously submitted notifications

“We are committed to enhancing our on-line functionality to bring

the state technologically into the 21st century and better serve the

public,” stated Labor Commissioner Su.

All notices will be available online for review by the public

through the public works search tool. DLSE, as well as other

enforcement groups, will be able to quickly search projects

awarded by date, awarding agency, location and by the estimated

construction start date to better ensure compliance of public works

laws early on with public projects.

The new PWC 100 application is now available for use by public

agencies. Awarding bodies who have previously registered with

the PWC 100 system will need to update their passwords by

selecting the “forgot password” icon. All new awarding agencies

should select the “first time user” icon.

In a move to be more effective, DLSE has streamlined the public

works complaint form to include reporting for general prevailing

wages and apprenticeship violations.

“I am pleased to provide a one-stop avenue for the public to

file prevailing wage and apprenticeship violations on a single

complaint form,” stated Labor Commissioner Su.

The Labor Commissioner has now made two forms available for

public works complaints: the “Public” complaint forms will be

separate from the public works Worker complaint forms. The

Worker Complaint Forms have been revised to make them easier

to complete and will continue to be available in English and

Spanish.

CARB Extends For One Year Particulate Filter Need For

Certain Cranes

The California Air Resources Board (CARB) has issued a

regulatory mail out notice that approves a one year extension

(for calendar year 2013) from the particulate matter (PM) filter

requirements for certain types of cranes that are subject to

the Truck and Bus regulation (Section 2025). CARB staff is

working with crane operators, crane manufacturers, and other

organizations to investigate and understand safety and certification

concerns and how best to determine which PM filter retrofits can

be installed.

The extension will allow additional time to collect necessary data

that can be used to determine how safety and feasibility concerns

should be addressed for cranes. For more detailed information,

Background

On December 11, 2008, the California Air Resources Board

(CARB) approved for adoption the Truck and Bus regulation to

control emissions from nearly all existing diesel powered heavy-

duty trucks and buses operating in California. The regulation

requires diesel trucks and buses that operate in California to be

upgraded to reduce emissions. Heavier trucks must be retrofitted

with PM filters beginning January 1, 2012, and older trucks must

be replaced starting January 1, 2015. By January 1, 2023, nearly

all trucks and buses will need to have 2010 model year engines or

equivalent.

The regulation applies to nearly all privately and federally owned

diesel fueled trucks and buses and to privately and publicly owned

school buses with a gross vehicle weight rating

(GVWR) greater than 14,000 pounds. This regulation does not

apply to drayage trucks that transport marine containers. Small

fleets with three or fewer diesel trucks can delay compliance for

their heavier trucks by reporting. Fleet owners can also report

and take advantage of other provisions that delay compliance for

their heavier trucks. Privately and publicly owned school buses

have different requirements.

“Toolbox” Safety Meetings – Tips for TrainersAs a safety manager, one of your key roles is to promote a safety-minded culture while maintaining costs. By alerting employees to workplace hazards, “toolbox” safety meetings are worth your time. To get the most out of your safety meetings, it’s best if the whole crew actively participates. How? Try these tips for trainers: Select relevant meeting topics. If you

have drill presses, talk about drill press safety. If you are entering confined spaces, talk about respirators and confined space entry. If you notice that spills aren't being cleaned up promptly, discuss that. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from occurring again? Lifting incorrectly can result in a variety of injuries. Back strain is a very common injury, resulting from the over-stretching of certain muscles. It can be avoided if employees are reminded to practice safe lifting techniques.

Employees are a good source for meeting ideas. Encourage your employees to suggest topics; they often know best what and where the dangers are.

Once you select a topic, research it. If you want to focus on the safe use of a specific piece of machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the safety data sheet (SDS). To source ready-to-use documents on a variety of safety-related topics, conduct a keyword

search: “Safety Matters” from the Documents on Command section of your client portal from Leavitt Group.

Ask questions instead of lecturing. Introduce each new point you want to make by asking the crew a question. Wait a short time to let people think, and then call on volunteers to answer. Use the answers as a springboard for discussion.

Ask about personal experience. If you ask a question and no one has an answer, ask if someone has had any personal experience to help the group figure out the answer.

Limit the amount of time any one person can talk. If a crew member is talking too much, invite someone else to speak.

Stick to the topic. If the crew’s questions and comments move too far from the topic, tell them that their concerns can be addressed later, either in private conversation or in an upcoming safety meeting. This will also give you ideas for future meeting topics.

Assign a crew member to assist you. Involve a crew member (or members) in choosing the next topic, and take him or her with you when you do your next “walk-around” safety inspection. You might also ask the person to help lead the next meeting.

Reuniones de seguridad de “información práctica” - Consejos para los capacitadoresComo gerente de seguridad, una de sus principales funciones es promover la cultura de seguridad al mismo tiempo que se mantienen los costos. Vale la pena que invierta tiempo en las reuniones de seguridad de “información práctica” para alertar a los empleados sobre los peligros del lugar de trabajo. Para aprovechar al máximo sus reuniones sobre seguridad, es mejor que participe todo el personal de forma activa. ¿De qué forma? Trate de seguir estos consejos para los capacitadores: Seleccione los temas de reuniones

relevantes. Si tiene prensas de perforación, hable sobre la seguridad de las mismas. Si debe entrar a espacios reducidos, hable sobre los respiradores y el ingreso a los espacios reducidos. Si observa que los derrames no se limpian de inmediato, analice este hecho. Si hubo un accidente o este estuvo a punto de producirse en el trabajo, hable acerca de ello. ¿Qué sucedió? ¿Dónde sucedió? ¿Cómo puede evitarse que vuelva a suceder? Realizar levantamientos de forma incorrecta puede derivar en diversas lesiones. La tensión en la espalda es una lesión muy común, lo que deriva de estirar demasiado algunos músculos. Esto puede evitarse si se recuerda a los empleados que practiquen las técnicas de levantamiento seguro.

Los empleados son una buena fuente para aportar ideas para las reuniones. Aliente a los empleados a que sugieran temas; a menudo, son los que mejor conocen cuáles son los peligros y dónde están.

Una vez que seleccione el tema, investíguelo. Si desea concentrarse en el uso seguro de una pieza específica de una maquinaria, consulte el manual de operaciones del fabricante. Para manipular sustancias tóxicas, obtenga una copia de la hoja de datos de seguridad de los materiales (Material safety data sheet,
