C.20A Declared capacity of CGPL in REA
a) Background: GUVNL vide letter no. GUVNL:GM(Comm):150 dated: 11.02.2019 (copy enclosed at Annex –C.20A) and letter no. GUVNL: GM(Comm):658 dated 18.06.19 informed the following –
1. State utilities are making payment to the invoices raised by generators for supply of power during the month based on the Regional Energy Account certified by WRPC for each month. M/s Coastal Gujarat Power Ltd. (CGPL) has raised invoice for power supplied during January 2019 based on the REA dated 5.02.2019 certified by WRPC for the month. It is observed that certification of the Declared Capacity (MWh) by WRPC in REA for the month is based on the "Seller DC" available on the WRLDC website which is higher than the MWh considering "Total DC" (On-bar DC +Off-bar DC) available to beneficiary for scheduling.
2. In case of CGPL it is observed that the generator has Seller DC of 3820 MW for a time block is considered as against the contracted capacity of 3800 MW. Further it is observed that though the generators are declaring higher capacity as "Seller DC", the entitlement of beneficiaries is worked out considering the "Total DC (On-bar DC + Off-bar DC) which is less than "Seller DC". Upon scrutiny of REA it is observed that similar increased Declared Capacity has also been certified in the REA for NTPC generating plants viz. Mauda, Korba, Vindhyachal, Sipat etc.
3. In this regard it is requested to kindly clarify as to under which provision of the Indian Electricity Grid Code (IEGC) the generator can declare capacity in excess of Installed Capacity which is allocated to the beneficiaries. It is pertinent to mention that Hon'ble CERC vide notification dated 12.04.2017 has issued the IEGC (5th Amendment) Regulations, 2017 w.e.f. 1.05.2017 wherein a proviso is added at the end of Regulation 5.2 (h) of Part 5 of the Principal Regulations which specifies that "For the purpose of ensuring primary response, RLDCs I SLDCs shall not schedule the generating station or unit(s) thereof beyond ex-bus generation corresponding to 100% of installed capacity "
4. Further to state that beneficiaries are paying Capacity Charge for the capacity made available by the generator during the month as per provision of Long Term PPAs under Competitive Bidding and as per CERC Terms & Conditions of tariff for power tied up with ISGS. However, since beneficiary can schedule power only against the "Entitlement" given by WRLDC based on the "Total DC", any additional capacity declared by the generator as "Seller DC" and

certified by WRPC in REA has financial implication on the beneficiaries towards Capacity Charges which ultimately leads to burden on end consumers.
GUVNL requested to verify and correct the Declared Capacity certified in accordance with the provision of CERC Regulations and to appropriately correct the REAs GUVNL informed that there is financial implication on DISCOMs due to consideration of Seller DC in REA from June 2018 onwards for CGPL and other NTPC Plants though there is no provision in IEGC regulation and amendments thereof for the declared capacity (DC) by generator in excess of Installed capacity. During the discussion it was given to understand that the certification is done by WRPC in line with the clause 13.2.8 of "Statement of Reasons" dated 13.04.2018 of the CERC IEGC 5th amendment 2017, dated 12.04.2017. GUVNL informed that the certification cannot be done by WRPC beyond what is specified in the Regulation more particularly when the SOR of the IEGC 5th Amendment came more than one year after notification of IEGC 5th Amendment and in any case SOR cannot override Regulation. Subsequently, WRPC has conveyed that similar treatment is also followed by other RPCs. However, GUVNL was not agreeable to the Seller DC certification done by WRPC since in has financial implication on DISCOM by way of payment towards the power which is not scheduled to them. The issue being critical has to be deliberated in detail with views of all DISCOMs taken in the matter. b) 80th CCM (held on 21.02.2019) CCM noted that in general Regulation shall be read along with SOR and the REA issued by WRPC are in line with the regulation and SOR. Issue: GUVNL informed that the certification cannot be done by WRPC beyond what is specified in the Regulation more particularly when the SOR of the IEGC 5th Amendment came more than one year after notification of IEGC 5th Amendment and in any case SOR cannot override Regulation.

Implementation of Fifth Amendment in DSM regulation in the WRPC software
The Fifth amendment in DSM Regulation has been notified by Hon'ble CERC vide notification no. dated 28.05.19 and this regulation amendment shall come into force with effective from 03.06.2019.
There are major changes in this Fifth amendment. In order to implement this amendment, necessary modifications need to be done in the DSM Accounting software. To incorporate all these regulatory changes in software of WRPC, it is very essential to take support/services of Software experts who has background of Foxpro based software. The approximate estimated cost for software changes is around Rs. 2 lakhs (Rupees Two lakh).
TCC/WRPC may like discuss and approve the same.
