Commencing at a point on the west

2. That a true and correct copy of a survey of the Property is attached hereto as Exhibit A.

3. That a true and correct copy of the Plat of Oakland Beach is attached hereto as Exhibit B.

4. That the real estate taxes assessed for the Property have been paid and there are no delinquent or outstand-ing taxes.

5. That the Petitioners desire to have vacated a portion of the unim-proved and undeveloped twenty foot (20’) roadway in the Plat of Oakland Beach that runs along adjacent to the easterly portions of the Property as more fully described in the following legal description:

That part of the 20 foot Road as dedicated on the plot of "OAKLAND BEACH" described as follows: Beginning at the southeast comer of Lot 13 of said plat; thence easterly along the easterly extension of the southerly line of said Lot 13 to the east line of said 20 foot Road; thence northerly along said easterly line of said 20 foot Road to its intersec-tion with the easterly extension of the north line of the South Half of Lot 12 of said plot; thence westerly along said easterly extension to the northeast corner of said South Half of Lot 12; thence southerly along the east line of said Lot 12 and along the east line of said Lot 13 to the point of beginning.

6. That said portion of the platted road has not been improved or devel-oped for over 50 years.

7. That said roadway is useless for the purpose for which it was laid out in that homes and/or developed lots in the Plat of Oakland Beach are currently situated on the platted road and/or in the platted road right of way.

8. That the in-use, as-built road that the properties in the Plat of Oakland Beach use for ingress and egress is wholly outside the dedicated right-of-way of the portion of the road to be vacated. Consequently, vacating that portion of the roadway peti-tioned to be vacated will have no affect on the in-use, as-built road by any of the owners of the plat and will not deprive any of the owners, or members of the pubic, access to any area within the plat.

9. That the roadway does not termi-nate upon the public water.

WHEREFORE, Petitioners pray for an Order of the Court vacat-ing a portion of the dedicated road-way located in the Plat of Oakland Beach, Scott County, Minnesota, as described herein, and vesting title in the Petitioners.

County Road Ditch Spraying

Sibley County will ONLY be spraying County road ditches for noxious weeds. The spray is applied directly to the noxious weeds.

Chemicals used: Tordon K, Transline, Escort, Milestone, Forefront and 2-4D.

Anyone wishing to NOT have a specific county road ditch sprayed should contact the Sibley County Public Works Office at 507-237-4092 before May 15, 2014 for a form.

Landowners/renters are required to flag the no spray zone with “Owner Will Maintain” flags provided by Sibley County Public Works. The use of these flags will aid Sibley

County Public Works maintenance crews in identifying which areas landowners/renters do not want sprayed. Flags are available at the Public Works office in Gaylord and at all

county highway garages in Arlington, Gaylord, Gibbon, Green Isle, Henderson, Winthrop and at the Sibley County Gravel Pit.

By requesting that Sibley County does not spray your road ditch, landowners/renters agree to maintain the noxious weeds and brush in the specified road ditches in their entirety. The Belle Plaine girls more than doubled the point total of its nearest foe in running away with first place in last Tues-day’s quadrangular at Sibley East. The Tigers racked up 118 points, followed by Mayer Lu-theran (56), Sibley East (46) and Jordan (34).Finishing first individually for

the Tigers were Selin Dikmen in the 100-meter dash (13.10) and 100 hurdles (16.04), Jenna Gatz in the 200 dash (27.85) and long jump (15-02.50), Emily Berger in the 1,600 run (6:03.10), Cassie Stolt in the 3,200 run

Last Tuesday’s boys’ quadran-gular at Sibley East was basi-cally a two-team race between Belle Plaine and Mayer Luther-an, with the Tigers coming out on top 101-87. Sibley East and Jordan had 43 and 22 points, re-spectively.

Taking first for Belle Plaine were Christian Roell in the 200-meter dash (24.16) and long jump (18-03), Max Pon-ath in the 400 dash (56.37) and Braydon Setterquist in the 300 hurdles (50.18).The Tigers won two relays.

They were the 4x200 squad of Ben Dvorak, Roell, Ruben Baltierrez and Mitchell Koepp (1:38.80); and the 4x100 group of Jack Larson, Roell, Dvorak and Brenden Eyrich (47.05).Belle Plaine’s 4x800 and
