Article 187/ __________ In exercise of the powers conferred by Clause (3) of Article 187 of the Constitution of India and all other powers enabling him in this behalf, the Governor of Punjab, after consultation with the Speaker, Punjab Vidhan Sabha, hereby makes the following Rules, regulating the recruitment and conditions of Service of persons appointed to (Group "A", Group "B", Group "C" and Group "D") Services of the Punjab Vidhan Sabha Secretariat in connection with the affairs of the State of Punjab, namely : -

1. Short Title, Application and Commencement :

(1) These Rules may be called the Punjab Vidhan Sabha Secretariat (Recruitment and Conditions of Service) Rules, 2017.

(2) These Rules shall apply to all categories of posts specified in the APPENDIX-A to these Rules.

(3) They shall come into force on and with effect from the date of their publication in the Official Gazette.

2. Definitions :

In these Rules, unless the context otherwise requires -

(a) "Budget" means the Budget of the Punjab Vidhan Sabha (Assembly) and its Secretariat;

(b) “Deputation” means the temporary loan of the services of an officer/ official in the Secretariat to any office outside the Secretariat or vice-versa;

(c) "Direct Appointment" means an appointment made otherwise than by promotion or by transfer of any person already in the service of Government of India or of a State Government;

(d) "Finance Department" means the Finance Department of the Government of Punjab;

(e) "Government" means the Government of Punjab in the respective Departments of the Punjab Government;

(f) “Leader of the House” means Leader of the House in the Punjab Vidhan Sabha;

(g) “Post” means a post in the Secretariat and a post shall be deemed to be a post in Group A, Group B, Group C or Group D, according as such post is specified as Group A, Group B, Group C or Group D, as the case may be, in the APPENDIX-A;

(h) "Recognized University" or "Recognized Institution” means any University or Institution incorporated by law in any of the States of India, approved by the Government of Punjab;

(i) “Appendix” means the Appendix to these Rules;

(j) “Secretariat” means the Punjab Vidhan Sabha Secretariat;

(k) "Secretary" means the Secretary of the Punjab Vidhan Sabha;

(l) "Service" means the Punjab Vidhan Sabha Secretariat Service (Group A), the Punjab Vidhan Sabha Secretariat Subordinate Service (Group B), the Punjab Vidhan Sabha Secretariat Ministerial Service (Group C), the Punjab Vidhan Sabha Secretariat Group D Service, as specified in the APPENDIX-A to these Rules; and

(m) "Speaker" means the Speaker of the Punjab Vidhan Sabha as defined in the Constitution of India.

3. Strength and Composition of the Secretariat :

(1) There shall be a separate Legislative Assembly Secretariat independent of the financial and administrative control of the Government under the superintendence and control of the Speaker in pursuance of the spirit of the provisions of Article 187 of the Constitution of India.

(2) There shall be in the Secretariat -

(a) such number of permanent posts as are specified in the APPENDIX-A;

Provided that the Speaker may increase or reduce this number under intimation to the Finance Department.

(b) such number of temporary posts on regular basis with different designations and scales of pay as may be created or abolished by the Speaker under intimation to the Finance Department.

(3) The Speaker shall have power to re-designate or change the nomenclature of any post(s) in the existing scales of pay in the Secretariat, if it is so considered necessary or expedient by the Speaker.

4. Powers of the Speaker :

The Speaker shall have full and exclusive administrative and financial powers in respect of the Legislature Secretariat.

The Speaker shall be the overall in-charge of the precincts of the Punjab Vidhan Sabha as defined in the Rules of Procedure and Conduct of Business in the Punjab Vidhan Sabha (Punjab Legislative Assembly).

5. Powers of the Secretary :

For the purpose of the Administration of the Secretariat, the Secretary shall exercise all the financial and administrative powers, analogous to those of an Administrative Secretary to Government in dealing with the Department of Finance and Legislative Affairs.

6. Method of Recruitment :

(1) (a) Appointment to Service shall be made in the manner as specified in Appendix B -

provided that if no suitable candidate is available for appointment by promotion or by direct recruitment, the appointment to the service shall be made by transfer or deputation from the persons holding same post, under a State Government or the Government of India;

(b) No person shall be appointed to the Service unless he/she posses the qualifications and experience, as specified in Appendix-B.

(c) Appointment to the Service to the promotion shall be made on seniority-cum-merit basis, but no person shall have any right to claim promotion on the basis of seniority alone.

(2) The Speaker may, by order, from time to time -

(a) determine the method or methods of recruitment;

(b) determine the proportion of vacancies to be filled by each method.

However, up to 15% Group "C" posts may be filled by promotion from Group "D" post employees of Punjab Vidhan Sabha Secretariat Service on the basis of eligibility and seniority-cum-merit, as prescribed in the APPENDIX-B.

(3) Reservation at the time of appointment and at the time of promotion to the members of Scheduled Castes, Scheduled Tribes, Backward Classes and other categories will be applicable to Group A, B, C and D employees on the basis of instructions issued by the Government of Punjab from time to time, in this regard, and as adopted by the Speaker.

7. Appointing Authority:

Appointment to the posts in the Service shall be made -

(a) in the case of Secretary, by the Speaker in consultation with the Leader of the House;

Provided that the Speaker may grant extension in service to the incumbent for the post of Secretary for a maximum period of two years after superannuation, in consultation with the Leader of the House.

(b) in the case of other posts, by the Speaker.

8. Nationality, Domicile and Character of persons appointed to the Service:

(1) No person shall be appointed to the Service of the Vidhan Sabha Secretariat unless he is a citizen of India.

(2) No person shall be appointed to the Service by direct recruitment, unless he produces -

(a) a certificate of character from the Principal/ Academic Officer of the University, College, School or Institution last attended, if any, and similar certificates from two responsible persons not being his relatives, who are well acquainted with him in his private life and are unconnected with his University, College, School or Institution; and

(b) an affidavit to the effect that he was never convicted for any criminal offence and that he was never dismissed or removed from Service of any State Government, Government of India or any Public Sector Undertaking.

9. Academic Qualifications :

The academic and other qualifications of different categories of Services shall be as prescribed in the APPENDIX-B to these Rules.

10. Disqualifications :

No person shall be eligible for appointment to any post in the Service -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person ;

Provided that the Appointing Authority may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt such a person from the operation of this Rule.

11. Probation :

(1) A person appointed to any post in the Service shall remain on probation for a period of two years, if appointed by direct recruitment and one year if appointed otherwise ;

Provided that -

(a) any period, after such appointment, spent on deputation on a corresponding or a higher post shall count towards the period of probation;

(b) in the case of any appointment by transfer, any period of work on an equivalent or higher rank, prior to appointment to the Service,

may in the discretion of the Appointing Authority, be allowed to count towards the period of probation;

(c) any period of officiating appointment to the Service shall be reckoned as period spent on probation; and

(d) any kind of leave not exceeding six months, during or at the end of period of probation, shall be counted towards the period of probation.

(2) If, in the opinion of the Appointing Authority, the work or conduct of a person during the period of probation is not satisfactory, it may -

(a) if such person is appointed by direct recruitment, dispense with his / her services, or revert him/ her to a post on which he/ she held lien prior to his/ her appointment to the Service by direct recruitment ; and

(b) if such person is appointed otherwise -

(i) revert him/ her to his/ her former post; or

(ii) deal with him/ her in such other manner as the terms and conditions of his/ her previous appointment permit.

(3) On the completion of the period of probation of a person, the Appointing Authority may-

(a) if his/ her work and conduct has, in his opinion, been satisfactory-

(i) confirm such person, from the date of his/ her appointment or from the date he/ she completes his/ her period of probation satisfactorily, if he/ she is not already confirmed; or

(ii) declare that he/ she has completed his/ her probation satisfactorily, if he/ she is already confirmed; or

(b) if his / her work or conduct has not been, in its opinion, satisfactory, it may -

(i) dispense with his/ her services if appointed by direct recruitment or if appointed otherwise revert him/her to his/ her former post, or deal with him/ her in such other manner as the terms and conditions of his/ her previous appointment may permit ; or

(ii) extend his/ her period of probation and thereafter pass such order as it could have passed on the expiry of the period of probation as specified in Sub-Rule (1);

Provided that the total period of probation including extension, if any, shall not exceed three years.

12. Seniority :

The seniority inter-se of persons appointed to posts in each cadre of a Service shall be determined by the length of continuous service on such post in that cadre of the Service;

Provided that in the case of persons recruited by direct appointment who join within the period specified in the order of appointment or within such period as may be extended from time to time by the appointing authority subject to a maximum of four months from the date of order of appointment, the order of merit determined by the appointing authority shall not be disturbed.

Provided further that in case a person is permitted to join the post after the expiry of the said period of four months by the appointing authority, his seniority shall be determined from the date he joins the post.

Provided further that in case any person of the next selection has joined a post in the cadre of the concerned Service before the person referred to in the preceding proviso joins, the person so referred shall be placed below all the persons of the next selection who join within the time specified in the first proviso.

Provided further that in the case of two or more persons appointed on the same date, their seniority shall be determined as follows -

a) a person appointed by direct recruitment shall be senior to a person appointed otherwise;

b) a person appointed by promotion shall be senior to a person appointed by transfer;

c) in the case of a person appointed by promotion or transfer, the seniority shall be determined according to the seniority of such persons in the appointments from which they were promoted or transferred; and

d) in the case of persons appointed by transfer from different cadres, their seniority shall be determined according to pay, preference being given to a person who was drawing a higher rate of pay in his/ her previous appointment; and if the rates of pay drawn are also the same, then by their length of service in these appointments and if the length of service is also the same, an older person shall be senior to a younger person.

Note : Seniority of persons appointed on purely provisional basis or on ad-hoc basis shall be determined as and when they are regularly appointed keeping in view the dates of such regular appointment.

13. Pay, Leave, Pension and other matters :

(1) In respect of Pay, Leave, Pension and all other matters, not expressly provided for in these Rules, a member of a Service shall be governed by such rules and regulations as may have been or may hereafter be adopted or made by the competent authority.

(2) The Secretary, Punjab Vidhan Sabha, will be entitled to the same Pay scale, other Allowances and facilities etc. as are admissible to Administrative Secretary to the Government of Punjab and in case there is any revision of Pay-scale of Administrative Secretary, the same will be automatically implemented in the case of Secretary, Punjab Vidhan Sabha.

(3) The members of the Service -

(a) of common categories shall be entitled to pay-scale, grade-pay, other allowances and facilities etc., as are available to the corresponding common categories in the Punjab Civil Secretariat from time to time;

(b) other than the members of common categories carrying the equivalent pay-scale and grade-pay as that of common categories, shall be entitled to pay-scale, grade-pay, other allowances and facilities etc. as are available to the corresponding common categories in the Sabha Secretariat and as may be adopted by the Speaker from time to time; and

(c) not included in (a) and (b) above, the pay-scale, grade-pay, other allowances and facilities etc. shall be such as may be determined by the Speaker from time to time under intimation to the Finance Department.

Pay scales and other Allowances etc. as admissible to the members of the Service, with the approval of the Speaker, at present, are given in the APPENDIX-D to these Rules.

14. Age of Superannuation :

(1) Subject to the provisions of sub-rule (2) and (3) every member of the Service shall retire from Service on the afternoon of the last day of the month in which he/ she attains the age of 58 years or as per instructions issued by the Government of Punjab from time to time, in this regard, and as adopted by the Speaker;

Provided that every member of the Service whose date of birth is the first of a month shall retire from Service on the afternoon of the last day of the preceding month on attaining the age of superannuation.

(2) A Class-IV employee of the Service shall retire on the afternoon of the last day of the month in which he/ she attains the age of 60 years or as per instructions issued by the Government of Punjab from time to time, in this regard, and as adopted by the Speaker;

Provided that a Class IV employee of the Service whose date of birth is the first of a month shall retire from Service on the afternoon of the last day of the preceding month on attaining the age of superannuation.

(3) Any person (other than Secretary whose appointment is made by the Speaker in consultation with the Leader of the House in Vidhan Sabha) appointed to the Service may, in public interest, be retired at

any time after he/ she has completed 20 years qualifying Service or as per instructions issued by the Government of Punjab from time to time, in this regard, and as adopted by the Speaker or he/ she attains the age of 50 years, whichever is earlier, by giving him/ her a written notice of three months;

Provided that the retirement can be made effective forthwith on payment of three months’ salary at the rate last drawn, in lieu of the notice period.

15. Punishing and Appellate Authority :

(1) The members of the Service shall be governed by the Punjab Civil Services (Punishment and Appeal) Rules, 1970, as amended from time to time.

(2) The Authority empowered to impose penalty as specified in Rule 5 of Punjab Civil Services (Punishment and Appeal) Rules, 1970, and the Appellate Authority there under in respect of members of the Service shall be as given in the APPENDIX-C to these Rules.

16. Budget :

The Budget Estimates of the Punjab Vidhan Sabha and its Secretariat, compiled by the Secretariat and approved by the Secretary, Punjab Vidhan Sabha, shall be placed before the Committee appointed by the Speaker, headed by the Deputy Speaker (as the ex-Officio Chairman), the Chairman, Public Accounts Committee and the Chairman, Estimates Committee, as its Members. The Committee shall submit its recommendations, if any, to the Speaker within the stipulated period for its approval. The Estimates shall then be forwarded to the Finance Department for incorporation in the State Budget.

The Estimates shall not be subject to any examination by the Finance Department or any other Committee of the Punjab Vidhan Sabha. In case, the Finance Department may have any suggestion to make, it shall be done only at Officers' level and the matter sorted out. In the event of non-agreement between the Finance Department and the Punjab Vidhan Sabha Secretariat, the matter shall be discussed at the level of the Speaker and the Finance Minister. The view of the Speaker shall prevail.

17 Power to create Additional Posts :

There shall also be in the Secretariat such number of temporary posts up to and of the rank of Additional Secretary as may be created by the Speaker without consulting Finance Department for a period of not more than six months;

Provided that the expenditure incurred on such additional temporary posts will not exceed Rs.20,00,000/- (Rs.Twenty lacs only) during a financial year.

18. Payment of Honorarium :

(1) Every officer/ official of the Vidhan Sabha Secretariat will be entitled to an honorarium equal to one month’s salary i.e basic pay and other allowances every year for the Vidhan Sabha Sessions held in a financial year, starting from the first day of April of a year and ending on the last day of March of the next year, as a compensation for performing extra duty.

(2) Honorarium will be paid after 31st March of every year but not before

the expiry of Budget Session of Punjab Vidhan Sabha.

(3) Every officer/ official of the Vidhan Sabha Secretariat will be entitled to full payment of honorarium who has performed his/ her duty for a minimum 90% days of the total duration of Vidhan Sabha Sessions held in a financial year and for this purpose, the period between the date of summoning and adjournment sine-die of every Session held during a financial year will be treated as the total period.

(4) An officer/ official who has performed his/ her duty for lesser than 90% days of the total duration of the Vidhan Sabha Sessions but not less than 45% of the total duration of the Vidhan Sabha Sessions held in a financial year, the honorarium will be proportionately reduced. However, he/ she will not be eligible for the honorarium if he/ she performed duty for less than 45% days of the total duration of the Sessions;

Provided that for the purpose of payment of honorarium to the officer/ official, the Secretary will obtain a certificate from the next higher supervising officer of the officer/ official concerned regarding his/ her extra working in the Session days. The Secretary will be competent to decide the officer and official eligible for payment of honorarium.

19. Power to Relax :

Where the Speaker is of the opinion that it is necessary or expedient so to do, he may, by order, for reasons to be recorded in writing, relax any of the provisions of these Rules with respect to any class or category or persons;

Provided that the provisions relating to educational qualifications and experience shall not be relaxed.

20. Residuary Powers :

All matters not specifically provided for in these Rules, whether incidental or ancillary to the provisions of these Rules or otherwise, shall be regulated in accordance with such orders as the Speaker may, from time to time, make.

21. Application of the Punjab Civil Service (General and Common Conditions of Service) Rules, 1994.

In respect of the matters which are not specifically provided in these rules, the members of Service shall be governed by the Punjab Civil Services (General and Common Conditions of Service) Rules, 1994, as amended from time to time, and in such matters, the competent and appointing authority shall be Speaker.

22. Interpretation :

If any question arises as to the interpretation of these Rules, the Speaker shall be the final Authority.

23. Repeal and Saving :

Save as otherwise expressly provided in these Rules, all rules corresponding to these Rules and in force immediately before the commencement of these Rules, are hereby repealed ;

Provided that any order made or action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these Rules.

(ii) in case of Research Officer, the incumbent should have minimum experience of five years as such; provided that not more than one post of Under Secretary will be filled from Research Officer at any point of time;

(iii) in case of Private Secretaries, the incumbent should have minimum experience of five years as such;

(vi) in case of Section Officer, the incumbent should have minimum experience of five years as such; provided that not more than one post of Under Secretary will be filled from Section Officer at any point of time.
