I’m going to stick my neck out and postulate that we are definitely going to see an upturn in building activity around the country in 2013. With that in mind my theme for this message is “ growth.”

There should be significant growth across the industry as a whole this year as Auckland and Christchurch lead the way out of the slump. Consent numbers are already reflecting this.

Consequently your businesses should benefit from this upturn and hopefully we will all see growth in our profits at the end of the year. Remember that sound cashflow management is crucial to the success of any business.

It seems logical that due to the above factors building employment figures will grow as companies gear up to handle their increased forward workloads. With an impending skill shortage unavoidable it is almost obligatory for builders to take on apprentices. Not only will you benefit from the extra labour you are taking positive steps towards alleviating our high youth unemployment numbers. I strongly urge all our members to seriously consider giving a young person the opportunity to be part of a growth era in our industry.

Your Association will be keeping its finger on the pulse and rolling out some exciting new initiatives so you, our members, can derive the maximum benefit from all of this increased activity and hopefully CBANZ will experience a period of growth in membership as well.

There will be a new series of roadshows starting early this year which will be of benefit to your businesses so make sure you get along and support them.

The Builders Day Out is being held on22 March 2013 at UNITEC so if you are in Auckland please make the effort to go along with your apprentices and enjoy what will surely be a great afternoon.

And of course Conference 2013 is in Blenheim this year and is one event all our members should do their best to attend. Check out Inhouse for details.

FROM THE OPERATIONS DESK Jason McClintock - Operations Manager

We are seeing encouraging signs from the regions as the gaps between projects start to close up. Nearly all regions posted new dwelling consent increase heading out of 2011 with the exceptions being Marlborough and West Coast [SI]. Canterbury are obviously leading the charge with strong increase in consent numbers in Otago and Tasman.

These encouraging signs prompted me to look around here at National Support Office and contemplate what impact this will have on the Association. Just like your business it becomes a numbers game, so it is timely to address some housekeeping to keep things in check. Just like any Kiwi builder who has to strip the gear out of the wagon and clear the pie wrappers out from under the seat, I am doing some housekeeping of my own with services we have here at Certified Builders.

Creditworks:

The Association subscribes to a credit watch system called Creditworks, contributed to by the major building supply companies it watches building companies who owe credit or have been issued a stop credit by their supplier. This reporting system runs in parallel to the companies office site. These are just one of the reports used as a background check on new memberships; we use this trigger to monitor who might be in need of Association support, especially if a dispute is the cause of unpaid accounts.

House Inspections:

Several years ago the Board of Directors passed a resolution whereby members are not allowed to associate the brand when doing house inspections. This pertains to pre purchase inspections whereby the homeowner is acting on your professional advice. Building reports for EQC or other insurance companies are ok as the member is working under direction on these companies and under their indemnity policies.

Gold Card [individual member]:

This membership recognises you as a trade qualified individual, and that’s the wonderful thing about our Association - everyone has one of these. However it is not designed to equip you with the tools to invoice the public, by doing so the member is in breach of Association rules and you may find yourself in hot water under the Fair Trading Act. It’s better designed to keep you in the information flow of industry happenings, with limited branding that recognises you as an individual. For advice on how you can step up to a Platinum Card please feel free to call me to see how the Association can assist taking your operation from good to great.

Platinum Card [business member]:

This membership gives you full access to the business benefits, allowing you to fly the flags as a Certified Builder. Gain gearing from the national recognition the brand is enjoying and network with likeminded chippies facing the same day to day issues as yourself.

Building and Subcontractor Contracts:

It’s been an exciting time since Geoff Hardy launched the new Fixed Price + and Cost and Margin contracts. Make sure you check out the current Toolbox seminar series on contracts, pick up some contract administration tips and up skill on the gearing Geoff has written into these new contracts intended to pull the pendulum back towards the builder.

Complaints:

Contracts and complaints are a bit like a marriage. One without the other just causes a heap of emotional turmoil when things turn to custard. The Association continues to use the disputes resolution as outlined in the contract. Should you see trouble on the horizon please use the help lines for guidance.

Brand and Presentation alignment:

Government policy is now lining up the business of building for more reform through contacts and disclosures. This is a great opportunity to put the polish on your point of difference, presentation folders, Certified Builders Association branding, brochures and company personalised contracts. For the team on site keep the branding aligned with apparel available from Millie Turkington. Don’t forget to check out the online shop and Eve Cooper’s presentation on ToolTube to see how to pull it all together. Your clients have checked you out well before picking up the phone, so make sure your website has your latest creations and updated technical advice.

Technical panel:

A big thank you must go out to members who put time into being involved with advisory panels. This allows the Association a voice to feeding back to the Ministry on a diverse range of topics from presentation of rebuild Canterbury publications to the issues facing the residential sector with enforcement campaigns such as the Fall from Heights.

Stop Press:Government Announces New Apprentice Initiative:Prime Minister John Key recently announced a new initiative aimed at getting more apprentices enrolled. To encourage this, the first 10,000 new apprentices enrolled after 1st April 2013 will get from the Government $1000 towards tools and off job course costs and if the enrolment was for a priority construction trade then this would be increased to $2000. Employers would get a similar amount. What a start to take on that new apprentice utilizing our ITAB apprentice programme!!

TRADIE TALKA young family moved into a house next door to an empty section that had been cleared after the February 2011 quake. One day, a gang of building workers turned up to start building on the plot. The family’s 5 year old daughter naturally took an interest in all the activity going on next door and started talking to the workers.

She hung around and eventually the builders adopted the little girl as a project mascot. They chatted with her, let her sit with them while they had tea and lunch breaks and gave her little jobs to do here and there to make her feel important. They even gave the child her very own hard hat and gloves, to her delight. At the end of the first week, the smiling builders presented her with a

What’s NOT Covered By The Guarantee (Part One)

In this series of articles we explain in plain language the exclusions in the Homefirst Builders Guarantee. Part one covers exclusions (a) to (d).

Whether it’s a workplace injury, disease, fire, theft or car accident, most people think “it’ll never happen to me”. Despite that, most people will have insurance against one or all of these things, just in case.

The purpose of the Homefirst 10 Year Guarantee is the same. It protects homeowners from being out of pocket in the event that their builder, for whatever reason, is unable to finish their build. It will also pay to rectify defects, if they arise and their original builder is no longer around to fix them himself.

Like any insurance policy, there are exclusions to make clear some of the things that are not intended to be covered by the guarantee.

SECTION D: EXCLUSIONS

CBL (the underwriter of the Guarantee) shall not be liable for any Claim for loss or damage:

16 (a) where the Works are completed by a Builder who is not an Approved Builder as defined under this Guarantee and Indemnity;

Explanation: For the Guarantee to apply, the original builder must complete the contract. The Guarantee becomes void if the homeowner organises another builder, not the one named in the Guarantee, to complete the work.

16 (b) arising from any malfunction in any electrical or mechanical appliances except where the malfunction is attributable to the workmanship or other fault of the Builder as part of the Works;

Explanation: So a homeowner can’t make a claim on their Guarantee if the house burns down because of an electrical fault in a heat pump for example, unless it can be shown that the heat pump was installed incorrectly by the builder (or their sub-contractor) and this caused the fault.

16 (c) to retaining structures, unless such Works are integral to the Building construction, and require the issue of a Building Consent under the Building Act 2004, and the loss or damage to the Works;

(i) could result in water penetration into a Building;

(ii) could adversely affect health or safety; or

(iii) are not completed for a reason listed under Clause 2 herein;

Explanation: So a retaining structure is only covered by the Guarantee if it is essential to be able to build the dwelling and it needs a building consent. The damage must also then meet one of the criteria listed above. Clause 2 refers to making a claim because the builder can’t complete the work.

16 (d) to any landscaping, fencing or paths, swimming pools, spas or saunas, and any main supply services or drains;

Explanation: The Guarantee is intended to cover the residential dwelling only. So the things listed above, which may appear on plans and be priced as part of a contract, are not included. By listing them as an exclusion we make it clear to homeowners that these things aren’t covered by their guarantee.

As part of Certified Builders response to the Ministry of Business, Innovation and Employment – Labour Group “Working From Heights” campaign a house under construction in Tauranga was used as a “Test House” to try a range of systems and approaches in a wide range of live site and build situations.

This was invaluable to help the Certified Builders Task Group assess the impact of these ideas and work toward acceptable solutions.

Members of the region held a site meeting at the “Test House” to understand and give some ideas on the options. Other groups invited were the local inspectors

and representatives of the MBIE - Labour Group Head office to gain their feedback and ideas.

ResidentialRisks andHazards - Wrap upCertified Builders response to the Fall from Heights campaign has been an interesting journey for the Association, with a few lessons learnt about a blanket campaign enforced at a regional level.

The Ministry of Business, Innovation and Employment (MBIE) had stopped the residential sector in its tracks, got building practitioners talking and asking questions about safety practices in general. Flip the coin, and we see that their actions got us questioning the delivery of an enforcement

campaign into a sector which is dominated by small to medium enterprises geographically scatted into all corners of New Zealand.

First and foremost we needed to hit the road with some answers to keep sites operating. After consulting NZ best practice guides and other fact sheets the reality of “grey” areas soon became apparent. MBIE made it quite clear it was up to industry to come up with solutions.

Fuelled with plenty of frustration we put theory into practice with a house Allan Shaw from Atrium Homes (Past Chairman Certified Builders Association) had on the go, working through the hierarchy of controls it

was soon clear the mindset of the past was not going to get us to where we were heading. Taking lessons learnt we thought we were reasonably equipped to deliver a message. Local inspectors were invited to join the North Island leg of our seminar series, with varying results. Specifics around saw stool use, harness, purlin distance and material

grade for the dog purlin became murky. More grey areas subsequently arose as inconsistency between regional inspectors set to undermine the momentum of the enforcement campaign; this had detrimental effect on the ability to give advice. Inspectors in mid North Island would work with you on the use of saw stools; however in the far north expect a prohibition sticker, no questions asked.

A positive we can take from our dealings with the regional inspectors, it would have to be that generally their position was they are happy to consult in the first instance.

Consider the safety aspect of your task; write down the potential risks

and how you consider it is practical to deal with these. An inspector who arrives to see that you have made some basic considerations is going to more likely take on a consultation approach than an enforcement one. Those who cannot produce this very basic level of site management are considered as doing nothing, which under this campaign, is not an option. Like any other tasks on site, the level of flexibility that you can bring to your operations will depend on your current state of knowledge.

It has been very interesting to compare solutions that have worked for some and not others. Areas where scaffolding is tight or too expensive, members have been using their own mobile units and working from the inside out, not requiring perimeter platforms until soffit stage, others have been quick to fully scaffold with reported productivity gains as the spin off.

system so everyone is catered for. The woven sheet material is fitted over the top of frames; the extra top plate 135x35 is then nailed off as per usual. This enables the practitioner to walk on the top plates and install trusses as per usual. If your style is working from the outside in then this is worth checking out. This system is still in development phase, we’ll keep you posted via the knowledge section of the members’ web pages.

Summary:

Our industry is dealing with an Act that is 20 years old, regulations of which are unlike other more descriptive building controls we are used to working with. This has created uncertainty and open to interpretation. Our safety

culture in the residential sector is behind that of Australia, it appears our safety regulatory controls are also. It is no wonder inspectors have trouble delivering a consistent message leaving the practitioner struggling to put in practice, solid and consistent controls. The residential sector will be struggling for some time to gain adequate health and safety solutions that are efficient, productive and in line with our Government’s vision of affordable housing. With industry changes now coming to us in waves, one does wonder if a more holistic health and safety campaign could have achieved more efficient outcomes for practitioners already under regulatory pressure.

ARTICLE 4:

LeakyBuildings - Tendering This is the fourth article in a series of articles based on a number of workshops on weathertight remediation for builders which the Ministry of Business, Innovation and Employment – Building and Housing group has been running at centres all over New Zealand.

This article will be looking at some of the considerations when tendering for a re-cladding project. I will be sharing some of the expensive lessons I have learnt remediating hundreds of NZ homes. In the current market where rates and margins are being squeezed it is even more important that we are aware of what we are getting into and that we minimise the unknowns so we can preserve our margin.

Let’s face it, the market is largely price driven so in order to try to level the playing field with other builders less experienced in tendering, its important to be clear about what has and hasn’t been allowed for and why. This alerts the designer and client to things they may not have considered and that other tenders may not have included. This helps minimise variations and unknown

costs blowing the budget and reduces the chances of a dispute. Clearly outlining timelines allowed for each section of the build process assists not only with internal pricing clarity, but also with extension of time claims considering the common down time that can occur on such projects as various parties document the building failures or are waiting on remediation design clarifications.

Site access and storage can be more challenging on remediation projects due to the nature of the works and the fact that the site is mature with neighbours, fences, landscaping and possibly a swimming pool. These along with the scaffolding setup, have a critical impact on site productivity and therefore a builder’s bottom line and are rarely covered in a set of contract documents. Careful consideration of

the distance at which scaffolding is set up from the building for easy removal and reinstatement of the cladding and windows as well as access points, can make a significant difference to on-site efficiency. Plan carefully when the most effective time is to erect the scaffolding if concrete nibs are to be installed or decks re-laid and waterproofed? Has time been allowed for to frequently empty water from and

re-tie the tarpaulins and side mesh to the scaffolding after inclement weather over the project’s many weeks? Will there be scaffolding changes required during the project?

The use of contractors for parts of the project such as cladding removal not only fixes a difficult to quantify cost (especially tip site unfriendly EFIS), it also means a messy and unpopular job is not being done by the site staff.

Contract documents may or may not mention the reuse of some items such as spouting, insulation or downpipes. But how practical is this with the new cavity cladding thickness and damage free storage? Are roof extensions required or thought of? Will the stormwater downpipe risers have to be moved?

The new cladding thickness and weathertightness details will probably result in the windows having to bere-installed, re-jammed, with some TAs requiring the sealing and re-mitering of reused joinery. Can in these cases a 15 year durability warranty be provided or is a better long term solution to replace the windows with new ones?

Other issues that need to be considered are:

• Will additional framing need to be installed for a new cladding system?

• The need to straighten an existing structure to meet any new cladding warranty requirements is difficult to determine pre-start.

• Non-compliant work discovered during remediation is commonplace. How has this been allowed for?

Preliminary and general costs are often significantly higher than on standard projects. The additional paperwork, supervision, liaising with the various experts (both the client’s and potential defendants’) and the collection of detailed information on the cost breakdown of each of the building points of failure can take significant time and therefore money.

Due to the nature of the works, making good can be a major potential cost and cause of dispute. This can be reduced with a thoroughly documented pre-start survey. Whether the client is staying during the works can have a considerable impact on the project in many ways, which we will investigate in future articles. In this instance cleaning the affected areas every day because a client is living there can accrue a significant cost. What is the client’s expectation regarding a third party warranty and can it be provided?

If a builder allows for all of this will they get the job as others tenderers may not have? If they don’t and these costs are going to be incurred do they really want it?

Should YouSign Off An UnlicensedBuilder’s Work?By Auckland commercial lawyer and CBANZ Board member Geoff Hardy

Not every builder is licensed under the Building Act 2004, and not every builder needs to be licensed. The Act only requires the restricted building work on a residential project to be carried out or supervised by a licensed building practitioner. Technically, all the carpentry work on a residential project can be done by unlicensed builders, as long as a licensed builder supervises it.

It is the licensed builder who provides the “record of work” at the end of the project. This states which licensed building practitioners did what. And if he was the only licensed builder, then it will state that he carried out or supervised all the carpentry. The question is, is it safe to do so? And the answer is – yes, if you have confidence in the people who did the work, and/or you supervised it carefully. On the other hand, if you can’t vouch for the people who did the work, and/or you didn’t closely supervise them, then you have every reason to worry.

If you employ a bunch of carpenters and apprentices (or they work for you as independent contractors) and you are actively involved on the site, then the risk is easier for you to manage. But there are two common situations where you can’t easily manage the risk. The first is where an unlicensed builder offers to pay you a fee in return for you signing off the work on his

project. The second is where you work for a group home company and they have engaged an unlicensed builder to build one of their houses, on the basis that you (as a licensed builder) will sign it off. I have already come across both of those situations. Here are the reasons why they aren’t a good idea.

The starting point is that becoming licensed isn’t supposed to expose you to any greater liability than you had before. That is because a builder was always liable for defective workmanship, even before licensing came along. And that is true even if the builder is an employee. Everyone who does negligent work is potentially liable for it, no matter who they are. It’s just that people don’t typically sue employees when they can sue the employer instead. Employers are automatically liable for their employees’ workmanship, and the employer typically doesn’t pass the

liability onto the employee, unless the employee was particularly reckless.

However there are a few exceptions to the general rule that licensing doesn’t increase your potential exposure. First, you are now subject to being disciplined by the Building Practitioners Board. Secondly, over time the standards expected of licensed builders will gradually increase. Thirdly, the reluctance to sue employees won’t apply, if the employee was licensed, and was signing off the work. So that does put you in a riskier situation.

The licensing regime is not just a rubber-stamping exercise - it is a quality assurance regime designed to ensure that building work is done or closely supervised by individuals who have proven they have the required expertise. at compliance is going to be found out, and heavily punished.

The fact that you are signing off the work means that you are required to supervise it thoroughly. To do that diligently, you would need to carefully inspect the work on a continuous basis. In reality, if you are “hiring out” your licence number, or you are a head office employee who doesn’t spend much time on site, then your

work commitments are going to prevent you from doing that. So to avoid liability, you will be gambling that nothing will go wrong, and you will be relying on insurance.

If there is insurance (such as errors & omissions cover, or a directors & officers policy) the insurance policy will contain all sorts of exclusions and limitations. You won’t know what those exclusions and limitations are, until

someone like me goes through it line-by-line for you. And what I will tell you is that in the very situations where you are relying on the insurance cover to protect you, you probably have no protection at all.

But it gets worse. These days, these insurance policies are all “claims made” policies. That means the policy has to be in force at the time the claim is made against you

by the homeowner. And a homeowner has 10 years in which to bring a claim for defective workmanship - which is typically how long it takes for latent defects to emerge.

Therefore, you need to ensure the policy is renewed, and the premium paid, for 10 years after the last project you signed off. If you are self-employed, then this is going to be a big expense in your retirement.

And if you are employed and your employer goes out of business in the meantime, they won’t be able to keep the policy going. Or if you have a falling-out with them, they won’t want to include you in their cover any more. So you are at their mercy.

There are some possible solutions. Your employer may be able to buy a policy that covers you without exceptions for the next 10 years (although that is highly unlikely). Alternatively you could get an indemnity from the directors of the company, so that they personally guarantee to reimburse you for any liability (which is equally unlikely). There is only one sensible solution, in reality. Don’t sign off an unlicensed builder’s work, unless you have the utmost faith in his workmanship, and/or you supervised it carefully, 24/7.

IS YOURHEALTH & SAFETY UP TO SCRATCH ??There are a number of compelling reasons to have an effective health & safety system. The most obvious of these include the desire to keep everyone safe and the need to meet the legal requirements contained in the Health & Safety in Employment Act 1992.

Until recently the residential building industry appeared not to be a prime target of the Ministry of Business lnnovation and Employment (formally Department of Labour). In most parts of the country the only time you would ever see an inspector was if you reported a serious

Welcome to 2013. It’s a new year with new challenges and opportunities for you and your business. The Christchurch rebuild has had much attention in the last two years, much directed around when the positive effects of the rebuild will become more widely available. The Christchurch rebuild represents a unique opportunity for the contracting

and construction industries.

Approached correctly, firms can capitalise on the rebuild and generate exceptional earnings over the next decade, and build a successful long term future.

To do it right, firms must prepare for the key risks that arise from such a massive expansion in a short period.

What are the key risks?

1. ‘Growing pains’ – you may expand too quickly, take on too many staff and lose control over the business.

Among other issues the loss of control is likely to lead to cost overruns, and a lack of visibility over the true performance of your business.

2. Lack of working capital – have you considered the additional working capital requirements of increased business scale?

3. Invoicing and debtor collection - do you have systems in place to ensure your invoicing is carried out effi ciently? Are you able to prepare invoices in your customer’s required format, so that you can get paid on time? Do you have processes in place to manage your increased debtor book?

4. Labour shortages – it has been well publicised that the rebuild is going to require a signifi cant additional workforce. Workforce supply will be unable to meet demand, leading to heightened demand for staff and wages infl ation. Have you considered other non-fi nancial ways of retaining staff such as fl exible working hours, or improved job security?

5. Raw material cost increases – increased demand for materials will drive up prices, are your contract terms fl exible enough in this regard, and is your fi rm prepared to react to the increased cost base?

6. Plant and equipment issues – have you planned your capital expenditure programme to meet your increased business demands and worked out how you are going to fund it?

7. Limitations of management – is your business at risk of expanding past management’s existing skills set? Are you able to employ suitable new managers, or prepared to up-skill existing management?

8. Relationships with third party agencies – businesses will increasingly be at the mercy of third party agencies to be able to proceed with work, for example: government, insurance, and fi nance. Do you have processes and procedures in place for this?

9. Failure of tendering process – scale of work will no longer allow for true competitive tendering leading to a lack of competition. You may need to look to partner with developers or other businesses to protect your forward workfl ow.

10. The end of the rebuild – the end of the rebuild will see growing competition for a decreasing amount of available work. Early

planning is essential to ensure that your fi rm is not ‘left high and dry’ when the rebuild phase comes to a close.

11. Health and safety – you may now be working in new, more dangerous areas of work and your staff may not have a suitable skill set to work safely. Back offi ce staff may be required to undertake more front offi ce work which they are not suitable for. Have you got systems in place to manage these risks?

Upgradingduringearthquakerepairs pays offfor homeownersHaving their house upgraded as part of the Build Back Smarter project in Christchurch has brought homeowners David and Helen much greater warmth and comfort, an improvement which they wouldbe willing to pay for.

Build Back Smarter is a ten home project to show that performance upgrades can and should be included with earthquake repairs in Canterbury. The fi rst upgrade in the project, Huntsbury 2, has been completed with pleasing results.

The opportunity to be part of Build Back Smarter came at the end of a diffi cult 20 months for David and Helen as their earthquake repairs moved from EQC to insurer IAG. Even though this sounds like a long time, their house is still one of the fi rst to be repaired in Christchurch.

Working through the Build Back Smarter process brought David and Helen benefi ts that they didn’t expect. The process includes an independent assessment by partner Community Energy Action and a written upgrade plan which lays out the essential steps to improving the home’s performance. Working through the plan with the Community Energy Action expert helped them to make informed decisions about what upgrades were useful to include in the repair and how to prioritise them. It’s also educated

them into thinking more about the performance of their home, investing in temperature and humidity sensors and actively managing heat transfer with the thermostat.

Including Build Back Smarter upgrades did not delay or impact their earthquake repairs in any way. The upgrades were able to fi t seamlessly into the work programme, with the ebb and fl ow of work being such that the insulation and ventilation improvements were easily accommodated.

Performance Improvements

One indication of the success of the Huntsbury 2 upgrades was an increased Homestar™ rating, from a pre-upgrade rating of 2 stars to apost-upgrade rating of 5 stars.

This pleasing result was backed up by the homeowners’ experience of living in the house since the upgrades. While they have only been back in their repaired home for a short time, David and Helen are already feeling the difference. A cold October/

November in Christchurch meant that they particularly enjoyed the greater warmth in the house.

The most notable change was the ease of heating their home and the impact this had on their lifestyle. Previously they would heat their dining room/main living area with the enclosed woodburner and spend as much time as possible in this area. The rest of the house would remain cold - Helen reports that she used to put on a down jacket to go into the lounge to play her piano and listen to music. Electric heaters were used as supplementary heating, mainly when visitors came by. The bedrooms were unheated – they described going to bed as a “trip to the Arctic”.

Following the upgraded insulation and double glazing and the installation of a heat transfer kit, David and Helen have noticed warm even temperatures throughout the house. They describe this as a huge benefi t and they have also noticed some health improvements, particularly in sinus trouble.

Cost and Willingness to Pay

David and Helen spent approximately $10,000 on additional work during the repair process. This included: replacing a sagging beam from the 1980s addition; replacing rubber sheathed wiring which could be a future fi re hazard; and including fi breglass reinforcing as part of the cladding replacement to prevent damage from future earthquakes. Despite the fact that both the wiring and the fi breglass reinforcing are likely to reduce the risk of future insurance claims, these kinds of repairs are not covered in insurance companies “like for like” policies.

Having experienced full insulation compared to their old cold house, they would now not hesitate to pay for insulation. Also worth funding is the heat transfer system which is operated by a thermostat and takes warm air directly upstairs to the bedroom.

However, as a retired couple David and Helen were very aware about how much they could spend on additional work on their home, and they considered that they might not have undertaken the rangehood/external ventilation if they had had to pay for those things themselves. They were also undecided about the double glazing, which was installed to south facing windows in upstairs bedrooms alongside full (ceiling and wall) insulation. It’s diffi cult to separate double glazing and insulation benefi ts, although research indicates that over time, and particularly after experiencing a whole winter, households tend to value double glazing more.

Total extra costs for upgrade over repairs amounted to $14,524 (excl. GST). The major costs (excl. GST) were:

Ceiling insulation $2600

Very Satisfi ed Homeowners

Overall, David and Helen were very happy with the outcome of participating in Build Back Smarter. The upgrades look to have substantially improved the thermal performance of Huntsbury 2 – this will be further confi rmed next winter.

While Build Back Smarter is focused on Canterbury earthquake repairs, similar opportunities exist to improve existing house performance during major renovations when work (and disruption) is already underway. The opportunity to install wall insulation when linings or claddings are removed is particularly worthwhile, and makes all the difference to a home’s warmth and effi ciency.

Q&A - THE LAWAT WORK

Parental Leave - Returning To Work Early

Q : We are a medium sized building business. One of our office staff is currently off work on parental leave. When she applied for the leave, she requested her full entitlement of 52 weeks and we approved this. Although she is not due back from leave until the middle of the year, she has recently contacted us about returning to work early at the end of this month. She seemed to expect that she had some sort of right to return early. We had based all of our operational planning around her being absent for the full year and it just does not suit us to have her back early. What are our rights here?

A : The parental leave legislation does enable an employee to return to work early from parental leave, but only in very limited circumstances. These are set out in s45 of the Parental Leave and Employment Protection Act 1987 as follows - in the event of miscarriage, still birth, if the employee ceases to have the care of the child, if an adoption does not proceed, or if the employer consents. Unless any of the first four circumstances apply, your employee can only return early if you agree to that happening.

by employers is a specific obligation that arises when you are employing a temporary employee to replace an employee on parental leave. This requirement is for the employer to inform the temporary employee before employment and in writing that he or she is being employed to replace an employee on parental leave, and that the parental leave employee may return early in accordance with s45 of the Act. This requirement is in addition to the mandatory fixed term provisions set out in the Employment Relations Act.

Purchase Of Business- Transfer Of Employees

Q : We are a large building business. We are aiming to continue to grow and have recently agreed to purchase part of another building business. That business had some union member employees employed under a collective agreement and some employed under individual employment agreements. All employees work in building or related administration roles. We have a signed agreement for sale and purchase in place but we are struggling to properly understand our obligations. We need some advice about our options.

A : Dealing with employees on the sale and purchase of the business can become complex, particularly in the situation you outline when there is a

collective agreement in place and you are having to deal with a union. The existing employer (ie the vendor) has the primary obligation to comply with employment requirements in terms of employees. Your obligations will arise from the agreement for sale and purchase which is likely to include clauses dealing with employees. It will be important to ensure you have all of your employment matters sorted before you take over the business. As a starting point, we would need to review the sale and purchase agreement for you and then work through the applicable legal steps and timeframes for you to offer employment to any employees. You will not become the employer of those employees until you

have offered employment and they have accepted your offer.

For the future, we would recommend that if you are intending to buy or sell a business, you seek advice about employment options and implications before you enter the agreement for sale and purchase.

When Payment For Annual Holidays Must Be Made

Q : For years, we have had a standard practice of paying staff their annual leave as part of their ordinary pay on regular pay dates. Prior to Christmas, we had one employee claim that this is not lawful and that we are required to pay the annual leave entitlement in full before the leave is taken. Is he correct?

A : The Holidays Act 2003 requires that you pay an employee for his or her annual leave before the holiday is taken unless:

• you and the employee agree that payment is to be made in the pay that relates to the period during which the holiday is taken; or

• the employee’s employment has come to an end.

So yes, your employee is correct unless you and the

employee have reached agreement about this, or his employment was coming to an end. We recommend that employers include a clause in their standard employment agreements about payment of annual leave being made on the regular pay dates. That way, you ensure you have the employee’s agreement when he or she signs the agreement before commencing employment.

During the year the Trustees of the Apprentice Scholarship Trust (“AST”) decided to make available funds to each of the Polytechnic’s who partner with ITAB with grants for the “Promotion of Excellence”. Each of the Polytechnics were advised of the Grants and were encouraged to use the Grants as a way of “Recognising and Promoting Excellence” in their Apprenticeship courses.

Chairman of the Trustees of the AST Roger Duncan explained “The Trustees are very interested in using funds held by the Trust to continue to expand the ways that the AST can provide support to apprentices in our industry. These people are, after all, the future of the building industry as well as Certified Builders Association”. Roger went on to say that the Trustees were most appreciative of the support that gained from the regions

of Certified Builders, who often held local events with the proceeds going to the AST and also the key corporate sponsors that the Trust has in ITM and Winstone Wallboards.”

Representatives of the Trust and also Certified Builders were invited to a number of graduation functions across the country in December where winners of the “Promoting of Excellence” grants were recognised.their Apprenticeship courses.

We had a great evening at Auckland UNITEC which was a black tie event and a huge success. I must congratulate Daniel Fuemana and his team for putting on a fantastic evening. This for me is what makes all the hard work worthwhile to see those apprentices go up on stage and receive an excellence award knowing what they have achieved and the hard work that they have put in and to be rewarded for it is just great.

So keep a lookout for Graeme and myself we are both on the road over the next 2 months. If you see us come and say hello we would love to talk to you.

Celebrating ApprenticeAchievement in the Bay of PlentyTwo types of celebrations occurred recently for graduating

apprentices from Bay of Plenty Polytechnic’s Carpentry

apprenticeship programme.

At the Polytechnic’s graduation

ceremony in December 2012 a

number of apprentices graduated

with their National Certificate in

Carpentry L4 – these guys can now

proudly call themselves qualified

builders. Some of the graduates

couldn’t get to the ceremony as they

have picked up work, a sure sign that

the qualification they now hold is

held in high regard by the industry.

These graduating apprentices

have all completed their training

with Bay of Plenty Polytechnic –

some started by doing a one year

certificate programme and then

completed their apprenticeship on

site with an employer. Others did

it in the more traditional way, by

working on site and attending theory

block courses at the polytechnic.

pathways provide choice for both

employer and apprentice. “Most

qualified builders have been through

a block course system as part of

their apprenticeship and recognise

the value of that model, while others

prefer to take someone on who has

completed that initial year of training

at the polytechnic. Either way we continue to receive strong industry support for Polytechnic based apprenticeships, which not only provides quality training but holistic support for both apprentice and employer”.

The second celebration was for the inaugural presentations of the Excellence in Training award. This award is sponsored by the Apprenticeship Scholarship Trust (AST) and acknowledges excellence by the apprentices in their attitude and commitment to their training.

As I mentioned in the last Inhouse we held our ITAB end of year conference on 6 December in Christchurch. This is where we get together with our providers and see where we are and where we are heading to for the next 6 months.

It was here that we launched our new branding for ITAB-New Zealand’s Most Employable Apprentices. A big thank you to all those who took part, with special thanks to Aaron Kent for being

our pin up boy, (Aaron was Western Bay of Plenty ITAB 2012 Apprentice Challenge winner) and also to Brian Dillon and the team at Bay of Plenty Polytechnic for their time and effort.

Also we launched new benefits for all ITAB Apprentices in the form of a Student Card. This will go out to all existing apprentices as they renew this year and to all new apprentices when they sign up. There are some great benefits and discounts to be

had with super special deals from time to time and competitions to enter to win free stuff.

Keeping Your InformationSafe - Emailand Phone ScamsHave you ever been targeted by an email or phone scam? Fraudsters use these scams to collectpeople’s personal information.

They do this in a number of ways, such as telephoning you and claiming to be from Inland Revenue, or “phishing” - sending an email that looks like it comes from Inland Revenue or a tax refund agency. They then use this information to make false claims or access your personal details.

Phone scams often claim that you’re owed a tax refund and can collect it on the condition that you make an upfront direct payment to a bank account, usually via Western Union. They may also ask you to go to your computer to make the transfer through a website address they give you while they are still talking to you. If you are concerned that you have received a scam phone call, please just hang up.

Email scams include a link that sends you to a false website, which usually looks very similar to a real page. You will be asked to enter personal Inland Revenue information like your secure online services account (myIR) user ID and password.

Clicking on the link in the email makes a virus download onto your computer. This can give the fraudsters access to your personal information. If you have received a suspicious email please don’t click on a link, or reply to it. Delete the email from your Inbox and Trash folders.

Inland Revenue will never send you an email that: 1. asks you to provide personal Inland Revenue information such

as your secure online services account user ID and password, or

2. contains a direct link to a page which asks you to submit information such as our “Secure online services” login page.

Inland Revenue will never ask you to go to any website except www.ird.govt.nz

If you think you have replied to a scam, and given money or personal details, contact your bank or credit card provider immediately.

By being aware of these scams you keep your information secure and protect yourself from fraud.

MESSAGE FROM THE CHIEF

A warm welcome to 2013, I hope that you have come back to the new year refreshed and rested andare looking forward to the inevitable exciting challenges that lay ahead of us all over the coming calendar year.

As you will notice we have introduced a new look for InHouse. We have kept many of the same sections and subjects from past InHouse and have introduced a few new sections as well.

Thanks to the team at National Support Office and our design partners Wave Design who have all helped us put this together. I hope you enjoy the new look and would welcome any feedback you may have.

One of the new sections we will introduce over the next month or so is “Centrespread” where we would like to feature houses and the people behind them that have been built by our members. The reason for this addition is twofold. Firstly I know that many of our members complete some very impressive projects that they can be justifiably be proud of. The trouble is, as ‘kiwis’ we don’t tell anybody about them and celebrate the fantastic job done. This is a chance to do this. Secondly this is an opportunity to showcase what projects we complete to potential homeowners. Although InHouse is produced for our members we continually see it in places where potential home owners look through

it – so this is an ideal situation to show case Certified Builders and our brand to our customers.

It is however important that this section is not just about large and expensive houses. There are many jobs that are built by us that for various reasons are very much worth showcasing. These could include such things as - a difficult site, very complicated design or unique use of materials to name a few, I am sure there are many, many more.

So I encourage you to contact us if you have a project that we could use in our “Centrespread” section, we would love to hear from you.

As I have mentioned over the past few months, legislative and regulation changes continue to swirl through our industry. A review of the Construction Contracts Act has had its first reading in Parliament in late January and I am sure that as this passes through the legislative process it will result in more changes that will affect us all, on how we go about our business. The legislation regarding contracts and disclosure to potential clients is still progressing – but not yet into

law, but when completed will result in change. We will keep you informed on these issues as they unfold.

The forecast shortage of trades has started to affect the industry. In mid 2012 we started to further promote our ITAB Apprentice programme, including an updated image and other marketing material. In addition through the employment of our two Memebrship Development Managers, Buster Coughtrey and Graeme White, who are activity involved on ITAB’s, we will continue the development and promotion of this programme for the rest of this year.

It is interesting that the Government has also recently announced cash payment initiatives for apprentices and their employers in an attempt to grow the number of apprentices. Although it could be said that this is too late to fill the current looming gaps, it is important to the ongoing health and future of both our industry and our association that we have a good base of people undertaking apprenticeships.
