Preface Section 41(1) of the Environmental Protection (Water) Policy 1997 under the Environmental Protection Act 1994 requires Council to develop and implement an environmental plan about trade waste management. It is therefore no longer acceptable for liquid trade wastes to discharge to stormwater, streams, gullies, or uncontrolled to sewers. Trade waste is defined in the Water Supply (Safety and Reliability) Act 2008 and is generally referred to as any liquid waste that is not domestic sewage. Domestic sewage is household waste such as toilet waste and domestic waste from kitchens, laundries, bathrooms. Under that Act, Council is charged with the control of any trade waste discharges to its sewerage system so that if a business discharges other than domestic sewage to the sewer then a permit is required. Trade waste can include items such as greases, chemical wastes, organic matter etc. Illegal trade waste discharges can cost the community money by blocking the sewage system, damaging parts of the sewage system, or adversely affecting the treatment process. Illegal discharges can also harm or injure Council workers. The rate and volume of discharge into the sewage system affects pumping costs, while the composition of the sewage affects the cost of treatment. Council aims to control the discharge to sewer by issuing permits for the amount and type of trade waste disposed to sewer. The environmental management plan also aims to reduce pollution, reduce risk to public health, promote resource conservation, and provide information for future planning.

TRADE WASTE ENVIRONMENTAL MANAGEMENT PLAN

1.0 INTRODUCTION The Cassowary Coast Regional Council provides a sewerage system for the transport and treatment of domestic sewage. Payment for this service is collected through sewerage charges on each property. Council must meet all legislative environmental requirements relating to the disposal and/or reuse of effluent and sludges from its sewerage system. Under the Environmental Protection Act 1994, all discharges to receiving waters are required to be treated to a standard set down in licences which will maintain or enhance water quality and environmental values. Under the Act, Council is also held responsible for any pollution from stormwater outfalls under its control, hence this system must only be used for the disposal of uncontaminated stormwater runoff. Domestic sewage consists mostly of water which, after treatment to reduce biodegradable material, suspended solids and nutrients, can be disposed of in accordance with licence requirements. Trade waste may have an organic strength many times that of domestic sewage and may overload the treatment facility. Trade waste may also contain a variety of exotic substances such as heavy metals, organic solvents and chlorinated organics which sewerage systems are not designed to treat. These substances may: • pass through the plant untreated resulting in environmental contamination; • pose a serious risk to the safety and health of sewerage workers; • damage the fabric of the sewerage system; • inhibit biological treatment processes; or • accumulate in sludges. Council's policy is to accept biodegradable waste into the sewerage system provided that the system is of adequate capacity to effectively collect, transport and treat the waste. Council may consider the acceptance of trade waste containing toxic or hazardous substances and non-degradable pollutants to sewer only after the waste has been pre-treated by on site "best practicable treatment” to ensure sewer admission limits are not exceeded.

2.0 DEFINITIONS Authorised Agent Person or firm appointed by the owner to act on their behalf.

Notification of such appointment is to be lodged in writing with Council.

Domestic sewage Faecal matter and urine of human origin and liquid household

wastes from water closet pans, sinks, baths, basins and similar fixtures designed for use in private dwellings.

Measuring Trade Wastes For charging purposes trade wastes are measured by quantity

(Volume discharged) and quality (Contamination level).

- The QUANTITY discharged is measured in kilolitres (kl). - The QUALITY of waste is measured in chemical terms.

The following common quality measures give indications of the amount of organic matter in the trade waste.

Biochemical Oxygen Demand (BOD5) Suspended Solids (NFR) Total Oil and Grease (TOG) These terms are measured in milligrams per litre (mgl-1) or kilograms (kg). Owner As defined in the Water Supply (Safety and Reliability) Act 2008. Premises As defined in the Water Supply (Safety and Reliability) Act

2008. Trade waste As defined in the Water Supply (Safety and Reliability) Act

2008. Trade Waste Approval Written approval by Cassowary Coast Regional Council for a

person to discharge Trade Waste to Cassowary Coast Regional Council sewerage system issued under section 180(1) of the Water Supply (Safety and Reliability) Act 2008.

Trade Waste Generator Any person, owner, occupier, company or body whose activity

produces or has the potential to produce trade waste.

Trade Waste Inspector A person appointed by the Council to carry out inspections of

premises from which trade wastes are being discharged or proposed to be discharged to its sewerage. The term includes a person appointed in an acting capacity to carry out the duties of a trade waste officer.

Trade Waste Officer A person appointed by Council to oversee the disposal of trade

waste in accordance with Council's trade waste environmental management plan and provide advice on acceptable methods of disposal of trade waste, including legal, economic and environmental aspects. The term includes a person appointed in an acting capacity to carry out the duties of a trade waste officer.

All other terms have the meaning given to them in the following Act/s (as applicable):

• Water Supply (Safety and Reliability) Act 2008; • Plumbing and Drainage Act 2002; • Environmental Protection Act 1994; • Local Government Act 1993.

3.0 TRADE WASTE POLICY Policy Number 3.8.1 1. Authority The Environmental Protection (Water) Policy 1997, made under the Environmental Protection Act 1994, requires the establishment and implementation of an environmental plan for trade waste management. The Local Government Act allows for the levying of utility charges and general charges. Section 193 of the Water Supply (Safety and Reliability) Act 2008 prohibits the discharge of trade waste into sewers without Local Government approval.

2. Policy Objective The objective of this Policy is to ensure the provision of a liquid waste disposal service for domestic, commercial and industrial waste in accordance with the principles of environmental sustainability with council’s legal responsibilities and obligations. The policy will also assist council to meet all legislative environmental requirements relating to the disposal and reuse of effluent and sludge from its wastewater system and assist in the control of pollution from stormwater outfalls under its control.

3. Policy Statement Council will commit Cassowary Coast Regional Council Water & Sewerage Section: 1. To develop, implement and adequately resource the administration and enforcement of a Trade

Waste Environmental Management Plan which:

a) Fulfils all of Council’s legal requirements and obligations and minimises its liability under the Environmental Protection (Water) Policy 1997 and related legislation.

b) Establishes adequate controls, systems, objective, policy instruments and discharge standards

which: • Protects the Health and safety of employees; • Protects all wastewater infrastructure; • Excludes non-biodegradable and potentially harmful substances that may cause the

treatment process to fail or render effluent or sludge unacceptable for reuse or disposal; • Considers the requirements for waste prevention, recycling and pre-treatment measures; • Prevents any other detriment to the environment.

2. To recover the cost of services to commerce and industry, including the cost of conveyance, treatment and any damage to the wastewater system.

3. To provide operational data on the volume and composition of industrial effluent to assist in the

operation of the wastewater system and the design of augmentations or new wastewater systems.

4.0 CONTROL OF TRADE WASTE A list of legislation relevant to trade waste control and acceptance to sewer is given in Appendix 1. This is not a complete listing of all legislation pertaining to the control of trade waste. It is an offence to discharge trade waste to the sewer unless a trade waste approval has been issued by Water and Waste Water Supply (Safety and Reliability) Act 2008. Any person wishing to discharge trade waste to sewerage must apply for a trade waste approval (see section 8). A trade waste approval is the written approval from Water and Waste that states the requirements and conditions under which discharge to sewer is allowed. It is an offence for a person to discharge waste (including trade waste) other than uncontaminated stormwater drainage (Local Government Act 1993). 4.1 SUSPENSION, CANCELLATION OR AMENDMENT OF TRADE WASTE

APPROVAL Grounds and procedures for suspension or cancellation of a trade waste approval are defined in section 182-184 of the Water Supply (Safety and Reliability) Act 2008. Terms and conditions of a trade waste approval in respect of any matter occurring before the suspension or cancellation, including the payment of charges owing, shall continue to have force and effect after the suspension or cancellation of the trade waste approval. Grounds and procedures for amending a trade waste approval are defined in section 185 of that Act. 4.2 PENALTIES AND RECOVERY OF COSTS Council may prosecute any person who commits a breach of the relevant Acts and Regulations, or who refuses or neglects to comply with any direction or requirement by Council pursuant to the relevant Acts and Regulations. Penalties are set out in the appropriate Acts and Regulations, and include substantial fines. Council may recover costs of repairing the damaged sewerage system from a person causing damage to the system by discharging unauthorised material, making an unauthorised connection or interfering with infrastructure.

5.0 SEWER ADMISSION LIMITS Any waste discharged to Council's sewer shall at all times comply with the Trade Waste Sewer Admission Limits as set out in Appendix 2 unless otherwise specified in the trade waste approval. These limits are subject to periodic review. The sewer admission limits, unless other wise specified in the approval are absolute maximums. The dilution of trade waste with water to achieve compliance with the sewer admission limits is prohibited. The trade waste stream and domestic waste stream should, where ever practicable, discharge separately to the sewer. Where there is a common discharge pipe, allowance for the domestic component will be made to estimate the actual trade waste component strength. Council requires that trade waste generators implement waste minimisation practices and install best practice pre-treatment processes to reduce both the volume and the contaminant load of wastes discharges to sewer. The dilution of trade waste with water to achieve compliance with the sewer admission limits is prohibited. Council has obligations to avoid sewer overflows and consequently will impose limits on the rate and timing of trade waste discharges.

5.1 EFFLUENT IMPROVEMENT PROGRAMS For Category 1 and 2 waste, the installation of a properly sized, approved best practice pre-treatment device, together with an acceptable maintenance program in accordance with the trade waste approval conditions will be deemed to provide a satisfactory effluent with respect to the General Limit Parameters(s) (Schedule 1, Appendix 2). Council may, at is discretion, allow a Category 3 trade waste generator to accept waste to sewerage that exceeds the Sewer Admission Limit(s) for certain General Limit Parameter(s) (Schedule 1, Appendix 2). Additional charges (section 7.1.2) may apply for such parameters. Where such an allowance is made, Council may, as a condition imposed on the trade waste approval, require the trade waste generator to undertake an effluent improvement program. This program should include:

• a description of the effluent quantity and quality; • provision for monitoring and reporting waste quantity and quality; • an examination of waste prevention and recycling options; • an examination of options for the conservation of water; • a program involving the development of waste reduction and pre-treatment

aimed at reducing contaminant levels over a period of not more than three years to be prescribed admission limits. An action program must be provided, including expected outcomes, timelines and milestones;

• a report for Council, including a summary of achievements and options. If, at the time the trade waste approval falls due for renewal, the holder of the approval has not completed a satisfactory effluent improvement program, the approval holder is required to write to Council requesting an extension of time with reasons. Council may issue a new trade waste approval, subject to conditions that:

(a) a satisfactory effluent improvement program be submitted within 14 days; and (b) that the trade waste approval may be varied after submission of the effluent

improvement program as necessary to enforce the implementation of the program.

Acceptance of waste under any category is conditional on the waste meeting Council's Sewer Admission Limits (clause 5.0 and Appendix 2) unless otherwise specified in the trade waste approval. It is the responsibility of the trade waste generator to install, operate and maintain "best practicable" devices or process to ensure sewer admission limits as approved are not exceeded. In the event of a significant change in the strength or volume of a waste approved under Category 1 or Category 2, the waste will be treated as a Category 3 waste for the purposes of charging and monitoring.

7.0 TRADE WASTE CHARGES AND FEES Charges to be levied in respect of trade waste for the ensuing financial year will be determined by Council resolution passed at the Budget Meeting in any financial year. Trade Waste charges shall be levied annually and the amount so levied shall be deemed to be levies on the Trade Waste generator of the premises at which the charge relates. Trade waste fees and charges are levied under sections 36, 973 and 1071A of the Local Government Act. The amount levied shall be due and payable within 30 days of the date of issue of the notice levying the charge and if not paid within that time shall become a debt recoverable by the Council in the same manner as general rates. Any amount remaining unpaid as at the end of the rating period to which the notice relates shall bear interest at such rate per centum per annum as shall be fixed by Council by resolution. Trade waste charges and fees categories for the current financial year are listed in Appendix 3. 7.1 TRADE WASTE CHARGES Trade waste is divided into three categories for charging purposes (clause 6.0). Charges are based on actual quality and quantity of discharge for the period, not on figures described in the trade waste approval. Accounts for trade waste discharged to sewer will be: a) forwarded YEARLY for Category 1 and Category 2; b) forwarded quarterly for Category 3; c) a debt due by the waste generator; d) if not paid within 1 month, thereafter bear interest at such rate per centum per

annum as shall be fixed by the Council; and e) recoverable in the same manner as sundry debtors excepting the case where the

owner of the land is the waste generator and all such outstanding charges shall be and will remain a charge against the land and as such shall be recoverable from the owner of the land from time to time.

Charges are based on the actual quality and quantity of discharge for the period, not a figure described in the trade waste approval. Charges will be levied as follows: Category 1: � Flat fee to cover treatment, administration, overhead costs

and inspection shall apply. Maximum of 500kl waste per year.

year. Quantity charge on total annual volume of trade waste discharged to the sewer to be calculated as follows:

C = Qk where C is the annual charge ($) Q is the annual volume (kl) [refer to Section 11] k is the unit charge rate ($/kl). The unit charge, k, is based on the cost of providing and

maintaining the sewerage system for the total annual wastewater flow to the sewerage plant(s) including administration, inspection and compliance testing for trade waste control;

� A minimum fee to cover administration, inspection and compliance testing shall apply when the charges calculated by the above formula are less than the minimum fee.

7.1.2 EQUIVALENT ARRESTOR CHARGES This charge applies where an existing waste stream requires the installation of an arrestor to provide best practice pre-treatment for category 1 and category 2 wastes, but site specific conditions do not allow for appropriate device to be installed. 7.1.3 CHARGES FOR FOOD WASTE DISPOSAL UNITS Trade waste Generators in Categories 1 and 2 with food waste disposal units (garbage grinders, fruit & vegetable peelers) shall be charged a fee based on the power of the motor: This charge is an addition to generator charges under section 7.0. Category A: To 700W rating Category B: Above 700W rating Category C: Garbage grinders in public and private hospitals and aged nursing homes An additional charge per kilo watt or part thereof will be applied as per the Schedule of charges register.

7.2 TRADE WASTE FEES 7.2.1 INSPECTION AND ANALYSIS FEES Additional inspection and testing fees, to be paid by the holder of the trade waste approval on a sundry debtor basis, shall apply in all categories where more than the number of Council inspections and quality compliance tests allowed for under the trade waste approval and covered by the minimum fee are required because of non-compliance. Inspection fees shall be as per current trade waste fees and charges. The full cost of laboratory analyses shall be recovered from the holder of the trade waste approval. The waste generator may arrange for laboratory analyses independently at a NATA registered laboratory. 7.2.2 APPLICATION FEES Applicants for an approval to discharge under Category 3 shall be charged an application fee to cover the cost of processing the application and issuing the approval. This fee must accompany the application. No application fee shall be charged for approval applications for Category 1 and 2 wastes.

7.2.3 SEPTAGE AND OTHER LIQUID WASTE FEES Licensed waste transporters (clause 13.0) disposing of septage, portable toilet or

other approved liquid waste to the sewer under approved conditions shall be charged on a calculated volume basis ($/kl) which takes account of both the volume and strength of the waste.

7.2.4 ADDITIONAL CHARGE(S) Where Council agrees to accept to the sewer waste which has properties in excess of those defined in the General Limits (Schedule I, Appendix 2) of the Sewer Admission Limits, an additional charge will apply for each agreed non-complying parameter. The formula for calculation shall be: Charge = (actual/approved)d x charge rate ($/kg) x kg pollutant where d is a constant to be determined by Council; the minimum ratio for (actual/approved) is 1.0; and approved means the sewer admission limit value or other negotiated value defined in the trade waste approval. The period of the charge will be the time period, based on the sampling frequency, over which the limits are considered to have been exceeded. Exceeding the approved limit is an offence under the Act 7.3 REFUND ON CESSATION OF DISCHARGE No refunds on Cessation of discharge shall apply.

8.0 APPLICATION PROCEDURES An application for a trade waste approval, signed by the Generator and/or Owner or duly Authorised Agent, must be lodged at the following times in respect of any premises where trade waste is generated or likely to be generated: . during the processing of a Building Application for new premises or extensions

intended for industrial and/or commercial usage; . change in tenancy of such premises; . shop fit-outs of such premises; . during the processing of an application to strata title such premises; . existing premises where trade waste is generated and no approval or

agreement has been issued; . change of ownership of such premises; . where a change in process technology occur. Liquid waste disposal contractors wishing to discharge septage, portable toilet waste or other approved holding tank or liquid waste to the sewer or sewage treatment plant must be licensed (section 13) and must apply for an approval. Applications for discharge approval under Category 3 must be accompanied by the Application Fee (Section 7.2.4 and Appendix 3). Applications should include details of the proposed method of pre-treatment to be used to ensure waste meets sewer admission limits. Treatment plans should be forwarded in triplicate with the application. One copy will be returned stamped "approved- trade waste only" if satisfactory.

Where a waste is deemed to be non-sewer-able, an approval will not be issued and alternative arrangements for disposal of wastes will have to be made. Advice on treatment and disposal options for non-sewer-able wastes may be available from the Trade Waste Officer, Cassowary Coast Regional Council. Any plumbing and drainage work associated with the installation of any treatment process shall be in accordance with the Plumbing and Drainage Act 2002 and the Standard Plumbing and Drainage Regulation 2003, the National Plumbing and Drainage Code (AS/NZS 3500) and the approved sewerage drainage plan. It must be carried out by a licensed plumber and drainer. Applicants are referred to Council's publication “Pre-treatment Guidelines for Trade Waste Discharges" for further guidance. 9.0 TRADE WASTE APPROVALS 9.1 CATEGORY 1 & 2 The Waste Generator or Authorised Agent, of a premise from which waste classified as Category 1 or Category 2 is being discharged, shall be issued with a written approval which shall remain in force for the specified period unless cancelled sooner. Trade Waste approvals are not transferable. The Trade Waste approval states the terms and conditions the Owner or Authorised Agent and the Generator must observe to discharge trade waste to Council's sewerage. These include, but are not limited to:

• expiry/renewal date (to be received annually) • the location of the premises and nature of the occupancy; • the type and composition of trade waste that may be discharged; • the quantity of trade waste that may be discharged; • the rate of discharge, including maximum rate of discharge (in litres per second

l/s or kilolitres per hour); • the time when trade waste may be discharged; • the period for which trade waste may be discharged; • the method for estimation or measurement of discharge volume; • provisions for measurement and sampling of discharge prior to entry to sewer; • details of any pre-treatment required; • conditions for maintenance of and removal of waste from pre-treatment

equipment, including the contractor to be used; • records to be kept concerning the cleaning and maintenance of pre-treatment

equipment; • the powers of Council to enter premises in relation to any matter with regard to

trade waste control; • termination conditions; • additional charges for non-compliance; • the obligations of the owner and generator with respect to payment of charges,

fees and penalties; and • any other conditions considered by Council to be appropriate.

9.2 Category 3 The Trade Waste Generator, when the Owner is not the Generator, of a premises from which waste classified as Category 3 is being discharged, shall be issued with a trade waste approval by Council. The approval will remain in force for a period of three (3) year(s) unless cancelled sooner. Trade Waste approvals are not transferable.

The Trade Waste approval states the terms and conditions the Owner, Authorised Agent or the Generator must observe to discharge trade waste to Council's sewerage. These include but are not limited to:

• the location of the premises and nature of the occupancy; • quality of waste that may be discharged; • quantity of waste that may be discharged; • rate of discharge - maximum instantaneous, maximum daily; • hours of day, days of week discharge is allowed; • details of self regulation monitoring program

- sampling point - frequency of sampling - method of sample collection and type of sample to be collected - analyses required - methods of analyses - laboratory to be used - data transfer and availability to Council;

• type, design and location of flow measuring equipment and requirements for calibration;

• methods to be used for estimation of data lost due to failure of sampling program or flow measurement instrumentation;

• provision for measurement and sampling of discharge prior to entry to sewer; including the frequency of cleaning waste transported to be used.

• pre-treatment processes to be used; • conditions for maintenance of, and removal of waste from, pre-treatment

equipment; • records to be kept concerning the cleaning and maintenance of pre-treatment

equipment and disposal of waste; • the powers of Council to enter premises in relation to any matter with regard to

trade waste control; • the obligation of the Owner or Authorised Agent and the Generator concerning

any variations to operation or treatment processes that may affect discharge quantity or quality including change of business type;

• the obligations of the Owner or Authorised Agent and the Generator on suspension or cancellation of an approval;

• the obligations of the Owner or Authorised Agent and the Generator with respect to payment of charges, fees and penalties;

• additional charges for non-compliance; • a force majeure clause; • the conditions by which any difference or dispute between Council, the Owner

or Authorised Agent and the Generator arising from the terms of the approval which are not resolved to their mutual satisfaction may be submitted to arbitration; and

• any other conditions relevant to the particular discharge as agreed to.

9.3 CHANGE OF RELEASES The trade waste generator shall immediately and without delay, inform Council of any changes of trade waste discharges from conditions from those specified in the conditions of an approval. Changes shall include, but not limited to:

• Change in quantity (instantaneous flow rate or overall permitted quantity)

• Any significant change of physical, chemical, or bacteriological constitution of the discharged water.

10.0 INSPECTION AND MONITORING For the purpose of monitoring and auditing the conditions of discharge, Council routinely and randomly inspect all premises occupied by the holder of a trade waste approval. Inspections may include, but not be limited to, the following:

• Checks of all chemical storage areas to ensure that they are properly bunded are not improperly connected to sewer.

• Checks to ensure that there are no illegal stormwater connections to the trade waste system or sewerage.

• Checks to ensure that there are no illegal trade waste connections to stormwater or sewer and that there is no potential for trade waste to overflow improperly to sewer, stormwater or waterways.

• Checks to ensure that pre-treatment facilities are regularly and properly serviced and standby equipment is available where necessary.

• Monitoring of strength and flow is undertaken as required under the trade waste approval.

• Assessment of work practices to ensure that they do not result in a breach of the trade waste approval or legislation.

10.1 INSPECTION CHAMBERS AND/OR GAUGING FACILITY Category 3 wastes shall be discharged to Council's sewerage system via an open channel inspection chamber and/or gauging facility. The inspection chamber and/or gauging facility shall be located on the trade waste discharge line in an area which is accessible at all times to Council's officers thus allowing for sampling and/or monitoring equipment to be installed and operated. A suitable 240 volt power outlet and a standard water supply outlet with back-flow prevention device installed in accordance with AS 3500 Part 1 and As 2845.3 and approved by Council is required at all gauging facility sites. For new Category 2 and 3 installations, the trade waste discharge line shall be separate from the domestic waste discharge line. For existing installations retrofitting is not required except where it may be completed during any proposed upgrading or alterations to the installation. Where a non-domestic premises does not have a separate trade waste discharge line to Council's sewerage system, an open channel inspection chamber shall be installed on the house drain, in an accessible location, prior to leaving the property and/or connecting into the Council sewer. Arrestor trap installations and other pre-treatment devices on premises discharging Category 1 and 2 wastes shall have an inspection opening provided externally to the building, within the premises, at finished ground level.

Council officers shall be permitted entry to the premises at all reasonable times and not obstructed from carrying out inspections. The trade waste generator shall immediately and without delay, inform Council of any changes of trade waste discharges from those specified in the conditions of an approval. Changes shall include, but not limited to:

• Change in quantity (instantaneous flow rate or overall permitted quantity) • Any significant change of physical, chemical, or bacteriological constitution of

the discharged water

11.0 DETERMINATION OF DISCHARGE QUANTITY 11.1 CATEGORY 1 AND 2 The volume of trade waste discharged shall be estimated from total metered water consumption, less an allowance for domestic waste based on 136.5 kl/annum per pedestal and an allowance for water consumed on the property, based on a discharge factor. Investigations have established a basis for estimation of the proportion of water consumption discharged as trade waste by various types of trade and manufacturing processes. These are presented below and will form the basis of the initial fraction applied when a permit is issued. Where there is no fraction available, 100% discharge will be assumed. 11.2 CATEGORY 3 The volume of trade waste discharged to the sewer shall be measured by an approved flow measurement device calibrated as specified in the approval. This should be located on the trade waste discharge stream which should be separate from the domestic waste discharge stream. Where the flow measured includes domestic waste, an allowance of 136.5 kl/annum per pedestal shall be made. Generators exempt from installing a flow measurement device shall have the volume of discharge estimated as under section 11.1.

12.0 DETERMINATION OF DISCHARGE QUALITY 12.1 CATEGORY 1 AND 2 Quality measurements for Category 1 and 2 discharges are required for compliance checks only. This shall be done by Council as part of the inspection and monitoring program. The cost shall be covered by the annual trade waste fee except where additional inspection and testing is required because of non-compliance when Council shall charge the waste generator as prescribed in Section 7.2.1 and Appendix 3. 12.2 CATEGORY 3 Quality measurements are required for both charging and compliance purposes. For charging purposes a system of self monitoring by the discharger shall be used to collect sufficient data to enable the average mass load for the designated charging period to be calculated. Where pre-treatment is required to meet sewer admission limits for specified parameters, self monitoring will be required for those parameters, or a suitable surrogate, to confirm satisfactory pre-treatment. Requirements for self monitoring and auditing by Council shall be specified in the Agreement. The generator shall meet all costs of self monitoring. Council shall inspect the premises and audit the test results as agreed to at Council's expense. All laboratory analyses shall be performed by NATA registered laboratories. Council will collect and analyse samples for overall assessment of compliance with Sewer Admission Limits at its own cost. Where additional inspection and testing is required to be done by Council as a result of non-compliance, Council shall charge the owner as prescribed in Section 7.2.1 and Appendix 3.

13.0 REMOVAL OF INDUSTRIAL LIQUID WASTE FROM PREMISES No person shall discharge or cause to be discharged directly or indirectly to the sewer, wastes from any liquid transport vehicle without Council approval through the issue of a trade waste approval. Removal of scheduled liquid wastes from a premises shall only be carried out by a waste transporter licensed in accordance with the Environmental Protection Act 1994 and Environmental Protection Regulation 1998 and transported, stored, treated or disposed of in accordance with the requirements of the Environmental Protection (Waste Management) Regulation 2000. All Contractors shall be required to maintain records as prescribed by Council to account for all waste collected and disposed of within or outside the Council's boundaries. Waste Transporters shall dispose of septage and/or other approved liquid waste into the sewerage system in accordance with their approval conditions. Trade waste charges in accordance with Clause 7.2.3 and Schedule VI, Appendix 3 will apply. Grease interceptor waste and oil interceptor waste other than treated effluent from approved installations (Section 14.2) shall not be disposed of to the sewerage system. Such wastes shall be disposed of in a manner and/or at a site approved in accordance with requirements of the Environmental Protection Act and the Environmental Protection Regulation 1998 and operated in accordance with the requirements of the Environmental Protection (Waste Management) Regulation 2000. Advice on the disposal of liquid waste which is not suitable for discharge to sewer may be obtained from the Trade Waste Officer, Cassowary Coast Regional Council.

14.0 ARRESTOR TRAP INSTALLATIONS Where arrestor installations are required to pre-treat waste before discharge to sewer they will be of a design and capacity approved by Council. In a situation where a grease arrestor is required for pre-treatment but can not be installed because of specific site constraints, an additional charge (clause 7.1.2) will apply. 14.1 GREASE INTERCEPTOR The use of solvents, enzymes, bacterial cultures, odour control agents or pesticides in grease interceptors is prohibited unless specifically approved by Council. Conditional approval may be given to allow the generator to demonstrate to Council that the product to be used does not adversely impact on the sewerage system or the environment. The maximum capacity of an individual grease interceptor shall be 2000 litres. The minimum capacity of an individual grease interceptor shall be 550 litres. Where the capacity requirement for a premise is greater than 2000 litres, additional interceptors shall be used, with each interceptor to be a discrete installation separately treating a defined waste stream. Where it is intended that several trade waste generators share the use of a grease arrestor, the following information is required to be clearly tabled on the plan submitted with the application for approval: the size of the arrestor; details of the loading to be discharged by each trade waste generator; the names of the businesses and shop number(s) sharing the arrestor; Grease arrestors must be located so as to allow appropriate access for inspection, pump out and cleaning. Where practicable, a hose cock with suitable backflow prevention is to be provided for cleaning. The location must be approved by Council prior to installation. For the purpose of odour control, Council may, at its discretion, require grease arrestors to be fitted with full length and width opening, gas tight covers and frames. Maintenance cleaning of grease arrestors shall be carried out on a regular basis in accordance with conditions of the trade waste approval by a waste transporter licensed under the Environmental Protection Act 1994 and the Environmental Protection Regulation 1998. All final decisions on the size and type of grease arrestors will be made by Council Trade Waste Officers.

14.2 OIL INTERCEPTORS Oil Interceptor traps shall be of the Coalescing Plate type or other Council approved design with a minimum capacity 1kl/hour. Only Council approved "Quick Break Detergents" may be used where waste is discharged to sewer via an oil interceptor. Maintenance cleaning of oil interceptors shall be carried out on a regular basis in accordance with conditions of the trade waste approval by a Council approved Industrial Liquid Removal Contractor licensed under the Environmental Protection Act and the Environmental Protection Regulation. Existing triple interceptor oil traps will not be an acceptable form of treatment. 14.3 OTHER ARRESTOR APPLICATIONS Arrestor installations may be used for other Trade Waste treatment applications such as: • silt separation; • oil & grease (non-petroleum); • cooling; • neutralisation, and • other specific applications approved by Cassowary Coast Regional Council. Each application will be assessed on the nature of the waste to be treated, the proposed treatment method and site location. Maintenance cleaning of arrestors shall be carried out on a regular basis in accordance with conditions of the trade waste approval by a waste transporter licensed under the Environmental Protection Act 1994 and the Environmental Protection Regulation 1998.

15.0 ENZYMES/BACTERIAL CULTURES IN PRE-TREATMENT SYSTEMS Enzyme and bacterial cultures may be permitted for use in certain biological pre-treatment systems by way of specific application to Council. Conditional approval may be given to allow the discharger to demonstrate to Council that the product to be used does not adversely impact on the sewerage system. 15.1 GENETICALLY MODIFIED ORGANISMS (GMOs) Any person wishing to discharge commercial products containing genetically modified organisms to sewerage must first obtain approval for release to coastal and inland waters from the Genetic Manipulation Advisory Committee, Canberra. Council may then grant approval for discharge to sewerage. Laboratories and other facilities which culture, package or transport GMOs should have in place sufficient procedures and pre-treatment equipment to ensure that no live GMOs are discharged to sewerage. 16.0 FOOD WASTE DISPOSAL UNITS Food waste disposal units (garbage grinders / in sink waste disposal units) are not normally approved for non-domestic use by specific application to Council. Where installation is approved, an annual charge based on motor power shall apply (Section 7.2 and Appendix 3). 17.0 COMMERCIAL SWIMMING POOLS/ORNAMENTAL PONDS The back wash and pool water from commercial and public swimming pools and ornamental ponds constitute a trade waste and may not be discharged to sewer without approval through the issue of a trade waste approval. The application for a permit to discharge a trade waste shall include a description of backwashing and pool emptying procedures. These procedures shall include details of the anticipated discharge volume, the flow rate and the frequently of discharge. The owner/authorised agent or generator will be required to record all backwashing and pool emptying operations as specified above in a log book. The discharge volume may be calculated as the product of the rated capacity of the backwash pump and the term of operation of the pump as recorded in the log book. Records shall be forwarded to Councils Trade waste inspector on a monthly basis. These requirements will be included as a special condition of the approval.

18.0 MEDICAL, CLINICAL, VETERINARY AND INFECTIOUS WASTES Solid wastes from any hospital, clinic, office or surgery of a medical or veterinary facility or laboratory, convalescent or nursing home or health transport facility; including, but not limited to, hypodermic needles, syringes, instruments, utensils, swabs, dressings, bandages, or any paper or plastic item of a disposable nature, or any portions of human or animal anatomy; shall not be discharged to the sewer. Discharging liquid wastes including faeces and body fluids to sewer from any hospital, clinic, office or surgery of a medical or veterinary facility or laboratory, convalescent or nursing home or health transport facility is permitted in accordance with the National Guidelines for Waste Management in the Health Industry, 1999, National Health and Medical Research Council. Infectious or hazardous wastes deemed to pose a threat to public health and safety may not be discharged to the sewer without approval of Council. Such wastes shall require treatment to render them non-infectious or non-hazardous prior to discharge. When approved for discharge, trade waste charges will apply. 19.0 CONTAINMENT OF TOXIC/HAZARDOUS SUBSTANCES Any potentially toxic or hazardous substances shall be stored in bunded areas where leaks, spillages, or overflows cannot be drained by gravity or by any automated mechanical means to the sewer or the stormwater system. Bunding of toxic or hazardous substances shall meet recommendations of applicable best practice guidelines, standards or codes of practice.

20.0 DISCHARGE OF LIQUID WASTES FROM BUSES, AIRCRAFT & VESSELS The discharge of certain galley and toilet wastes from recreational vessels may be permitted via approved “pump out” facilities at Ports and Marinas. The waste discharged from these facilities must meet Sewer Admission Limits as set out in Appendix 2. The operator of such facilities must hold a trade waste approval for discharge. Charges will be in accordance with the category classification. The discharge of untreated bilge water to the sewer is prohibited due to the possible presence of volatile substances. The discharge of toilet waste from buses or other recreational vehicles may be permitted at approved discharge locations such as bus or transport depots, terminals, and caravan parks. The generator at which such facilities are located must hold a trade waste approval and discharge must be in accordance with the approval conditions. Trade waste charges in accordance with Schedule VI, Appendix 3 for septage and other approved liquid waste will apply. Depending on the quality, the discharge of certain galley and toilet wastes may be permitted via approved “Pump out” facilities at Ports & Marinas. The operator of such facilities must hold an approval for discharge to sewerage. Charges in accordance with Section 7.1 will apply. The discharge of untreated bilge water to the sewer is prohibited. 21.0 LANDFILL LEACHATE Leachate from landfill sites and wastewater from waste treatment/disposal facilities constitutes a trade waste and may not be discharged to sewer without approval through the issue of a trade waste approval. Trade waste charges in accordance with the discharge category will apply.

22.0 DISCHARGE FROM OPEN AREAS The discharge of rainwater or stormwater to sewer is prohibited. The ingress of surface water from a potentially contaminated open area to the sewerage system can cause severe operational problems to Council. However, there may be circumstances when it is environmentally beneficial to accept these wastes to the sewer under strict controls. A Permit/Agreement is required to discharge such waste. Controls will be required to ensure the discharge quality and quantity meet the requirements set by this policy and will include:

• all such water is pumped to sewer at a rate acceptable to Council;

• measures to ensure the discharge to sewer ceases automatically after a predetermined level of rainfall volume (mm) and/or intensity (mm/hr);

• measures to collect, segregate and treat the "first flush" volume, equivalent to

10mm X open area (m2), during wet weather with additional runoff directed to the storm water system;

• the "first flush" volume collected is pumped to sewer, after any necessary pre-

treatment, no sooner than one (1) hour after the cessation of rain;

• a suitable device for the determination of sewer discharge volume to be installed; and

• any additional conditions as applicable.

All conditions will be specified in the approval. Trade waste charges in accordance with the discharge category will apply. 23.0 DISCRETIONARY POWER Not withstanding the provisions of this policy, given the complexity of many industrial wastes and the need to protect Council's sewerage system, staff and the environment, acceptance of any given trade waste to sewer shall always be at the discretion of Council. 24.0 REFERENCE TO COUNCIL In this policy, reference to Council means any person appointed or authorised by Council to act on behalf of Council as the case may require.

25.0 FORCE MAJEURE If at any time by reason of an act of God, accident, break-down, war, civil disturbance, fire, flood, drought, strike, industrial dispute, shortage of power, water or material, government or legal restraint restriction or embargo or any cause or reason whatsoever whether of like or unlike nature to the foregoing beyond the Council’s control in the opinion of the Council the ability of the Council to accept trade waste into its sewers from the Premises is interfered with impasse or prevented directly or indirectly the Council may suspend the trade waste approval either wholly or partly for the period of such inability without any liability to the Occupier whatsoever for any loss or damage suffered or incurred by the Occupier whatsoever. 26.0 ADOPTION This environmental management plan adopted, by Council at …………….. meeting on ………………….

CASSOWARY COAST REGIONAL COUNCIL’S PRE-TREATMENT GUIDELINES FOR TRADEWASTE DISCHARGES

1.0 INTRODUCTION

As part of its trade Waste Environmental Management Plan, Cassowary Coast Regional Council will be strictly regulating the discharge of trade waste to the sewer. All discharges must comply with the Sewer Admission standards as set out in the Trade Waste Environment Management plan. Trade Waste is the liquid waste generated from any industry, business trade or manufacturing process. It does not include human waste. The following information is provided as a guide to assist waste generators. As waste quality may vary both within a given industry and between individual industries of the same type, the adequacy of these guidelines will need to be verified for each discharge. 2.0 WASTE FROM COMMERCIAL AND SERVICE INDUSTRIES.

Owners of all premises where commercial or service enterprises are undertaken, or likely to be undertaken, must apply to the Cassowary Coast Regional Council for a Trade Waste approval to discharge waste to the sewer. Discharge without approval is an offence under the Water Supply (safety and Reliability) Act 2008. Commercial and service enterprises include, but are not limited to, the following: Restaurants, Coffee shops, Cafes Fast food outlets/Take-a-ways Butchers Bakers/Hot bread shops Seafood shops Delicatessens Pie/Pastry outlets Ice-cream Parlours Hotels Motels Hospitals Clubs Laundromats Hairdressers Nursing homes Medical surgeries (includes dental, veterinary, chiropractic – where have X-rays) Garbage collection areas in commercial buildings Service stations/ other automotive related businesses (small scale) Small engineering works Photographic/X-ray/Graphic arts/Mini labs Air-conditioning waste-condensates, Cooling tower wastes Commercial refrigeration condensates Swimming pool backwash water Supermarkets/Shopping centres In most cases wastes from these businesses would be termed as minor generators and would be suitable for discharge to the sewer after appropriate pre-treatment as indicated in Table 1. However, the Trade Waste Officer will access all trade waste generators and determine their category.

3.0 GREASE ARRESTOR REQUIREMENTS

Table 2 outlines different methods for estimating the size of grease arrestors. The final determination of adequate capacity will be done by the Trade Waste Officer. The maximum allowable capacity of an individual grease arrestor is 2000 litres. Where the capacity requirements for a premise are greater than 2000 litres, additional arrestors shall be used, with each arrestor to be a discrete installation separately treating a defined waste stream. The use of solvents, enzymes, mutant bacteria, odour control units or pesticide in grease arrestor traps is prohibited unless specifically approved by the Trade Waste Officer. Cleaning and maintenance of grease arrestors will be carried out by Cassowary Coast Regional Council approved liquid waste disposal contractors at minimum 3 monthly intervals or more frequently as specified in the approval Conditions. A hose tap is to be installed with-in 5 metres of the grease trap; this hose tap is to be used for grease trap cleaning purposes only. A backflow prevention device is to be installed immediately prior to the hose tap. A permit to undertake plumbing work must be obtained from Council prior to installation. All work to be performed by a licenced Plumber/Drainer. 3.1 INSTALLATION WITHIN BUILDINGS

Grease arrestor traps installed inside buildings will normally not be allowed, except in exceptional circumstances, and only with the approval of Cassowary Coast Regional Council’s Trade Waste Officer and Council’s Environmental Health Officers. When installed and requiring remote pump-out, the arrestor must be of the “Boat Bottom” design and fitted with gas tight lids. 4.1 COVER AND FRAME INSTALLATION

The cast iron interceptor trap frame shall be jointed to the thickening rib and or wall extension of the interceptor trap by Araldite Epoxy or similar Council approved material. The “in-situ” concrete surround around the frame shall be 200mm wide and extend below the angle of the thickening rib of the interceptor trap. 4.2 GREASE INTERCEPTOR TRAP COVERS

• Installation of covers and cast iron frame shall comply with Councils requirements and the Sewerage and water Supply Act to ensure that a gas tight seal lids obtained between cover and frame. Covers shall be machined edged.

• The cast iron frame shall be full strength and full width of the trap opening and placed

on the thickening rib of the interceptor trap or the vertical concrete extension thereto of the interceptor trap wall and flush with the inside of the vertical wall extension and or the thickening rib of the interceptor trap.

• Loose checker plate steel lid may be used in open air and un-trafficable areas only. Top of the grease trap will be a minimum of 50 mm above the surrounding surface area or flood level with a tapered concrete apron.

Pre-cast and “in situ“ concrete wall extensions and or surrounds shall be vertical, smooth and free of air holes and jointed flush with the inside of the interceptor trap wall. Potato peelers also come within this category and are subject to the same charges and conditions.

7.0 OIL ARRESTORS

In ground triple chamber type oil arrestors are no longer permitted for oil and grease separation. Oil arrestors are to be of the Coalescing Plate type, Vertical Gravity arrestors, Hydro-cyclones, or other Cassowary Coast Regional Council approved devices. Cassowary Coast Regional Council Trade Waste Officer is available on 0447 794 153 or 4030 2295 to answer any queries on trade waste matters. PUMPS

Only non – emulsifying pumps such as an electrically driven diaphragm pump ( at less than 40 cycles per minute) may be used to pump the wastewater to an arrestor. The pump discharge must not be greater than the capacity of the arrestor. Any person wishing to sell a Oil Arrestor system which includes the pump for treatment of wastewater going to sewer must confirm to these guidelines. BUNDING

The area around all treatment installations must be bunded. There must be no spillage or overflow of trade wastewater influent or effluent, sludge or treatment chemicals to the stormwater or sewerage systems (by gravity or by automated mechanical means). OIL ARRESTORS

Installation requirements for oil arrestors are as follows. • Only council approved equipment to be installed • Installation must comply with relevant Council Building and Plumbing by-laws • Minimum capacity 1,000 litres per hour • Where required pumps to be sized so as not to exceed the capacity of the arrestor • Only approved non-emulsifying pumps to be used • Sludge outlet to be fitted with a full flow valve • Manufacturers recommended servicing/clean schedules must be adhered to • Servicing records to be kept and made available to Trade Waste Officers • Cleaners and detergents must be of “Quick Break” formulation

N.B. In-ground oil arrestor grease silt traps are no longer acceptable HOUSEKEEPING

“Housekeeping” refers to all work practices and activities which minimize waste. There are a number of housekeeping practices which can be adopted to reduce wastewater levels and lessen the load placed on pre-treatment facilities. Good housekeeping procedures should be adopted wherever possible and in some circumstances can even classify the generator as a non discharger. Some of the practices are:

• Use less water by adopting dry cleaning methods. The less water used the less trade waste wastewater to be treated.

• Dry cleaning methods include wiping up spills and sweeping, rather than hosing. There are absorbent packs available to soak up oil spills.

• Ensure that all equipment is properly cleaned and maintained.

• Don’t pour oil down the drain, Ensure that adequate storage is provided for used oil and that a collection program is arranged with an oil recycler.

• Use “Quick Break” detergents. These help remove oil at the pre-treatment stage. • Use cleaning products that have a PH of between 7 -10 at working concentrations.
