* The Second Session (June-July) 1995 of the Second Legislative Assembly of the State of Goa commenced at the Assembly Hall Panaji on Monday, the 26h Juae, 1995. The House-was adjourned on 3 1 st July, 1995.

Governor's Address C

Shri Gopal Ramanujam addressed the Legislative Assembly under 176(l) of rhe Constitution of India on 24.3.1995. A copy of the Governor's Address was laid on the Table of the House on the same day. The motion of Thanks to Governor's Address was moved on 26.6.1995. Discussion on the Motion of Thanks took place on 26th 27th aad " 28th June, 1995.

Government Resolution

Resolution to withdraw the Goa, Daman and Diu Protectq of Land Bill, 1982 (Bill No. 5 of 1982) which is pending for Presidential assent is adopted on 3 1st July, 1995.

The General discussion on the Budget for the year 1995-96 took place for three days i. e. 29th June, 1995,3rd and 4th July, 1995. In all 66 Demands were set forth for discussion and voting. The discussion and voting on Demands took place for 15 days i. e. 5th. 6th, loth, 1 lth, 12th, 13th 17th, 18th, 19th, 20th, 24th, 25th, 26th, 27th and 31st July, 1995.

1 . Hon. Speaker presented the Report of the Business Advisory Committee to the House. The Minister for Legislative Affairs moved that the Report be adopted. Motion was proposed. Motion was put to vote and carried.

\'I Shri Manohar Parrikar, MI-A called the attention of the Minister for Power to the following matter of urgent public importance:-

"Anxiciy created In the mlnds of the people of Goa over the reported news rn tile Maharashtra Times and other National Dailies of 25/6/95 that power ilnlt at Koyna in Maharashtra IS likely to be shut down in 7-8 days and the Goa being the tail ender in recei~ring the power from Maharashtra vla Kolhapur area (Koyna) is likely to undergo the power crisis due to &version of power supply to the other parts in Maharashtra which may further Jetenorate the power situation when Goa State is already facing

problems of low voltage and frequent shut down and therefore the steps government intends to take in the matter."

The Minister for Power promised to make as statement on 30/6/95

VII. Shri Aleixo Sequeira, MLA moved the following Motion:

"That an Address be presented to the Governor in the following terms:

"That the Members of the Legislative Assembly of Goa assembled in this Session are deeply geateful to the Governor for the Address which he has been pleased to deliver to the House on 24th March, 1995.

The motion was seconded by Shri Krishna Kuttikar, MLA. Dr. Kashinath Jhalmi, Leader of Opposition moved the following amendments to the Motion of Thanks to the Governor's Address.

"But regrets that there is no mention of:-

1) Failure of Government to spell out the industrial p~licy thereby giving a bad industrial signal for foreign investment in the State, pmicularly in light of rejection of projects like Nylon 6,6.

2) Failure of Government to arrive at an amicable settlement between the Management and striking workers of Hindustan Ciba Geigy, Corlim.

3) Failure of the Government to curb the alarming rise in mime rate.

4) Unwarranted plan of the Government in allowing the Govt. land in front of Circuit House Altinho, to be developed by private developer.

5 ) Unjust, unlawful conversion of land at Ana Fonte spring aEMargao, by SPDA for the benefit of private land developer.

6 ) Failure of Government to complete in time the works of Chapoli Tank at Canacona thereby allowing the price escalation to the benefit of contractor.

7) Inordinate delay in issuing the Sanads to the Kume~i cultivators as also to the tenants all over the State.

8) Failure of the Government to implement the Satelite township project at Colvale, thereby not utilizing the sanctioned amount of over twenty crores rupees to Government of India for the reason of non utilisation.

9) Plans of the Government to have untimely transfer orders of Primary ( t

10) Complete disregard to the feeling of peqle in general and teachers in i

12) Failure of Government to select site and dispose off efficiently the garbage in cities in Goa." -.

Shri Shfipad N&, MLA moved the following Amendments to the Motion of Thanks to the Governor's Address.

"But regrets that there is no mention of:-

1. Failure of Employment Exchange in providing adequate job opportunities to the unemployed youths resulting into massive increase in the live register. >

2. Furtherfailure in computerising the live register of Employment Exchange at Margaa.

3. Failure in widening the roads to cater the needs due to manifold rise in I

vehicles resulting into increase of accidents in the State.

4. Failure to implement K. T. C. plateau, power sub-station for Tiswadi-Taluka within schedded time period forcing Tiswadi into power problems.

5. Failure in providing permanent solution to the garbage disposal issue in Panaji City. I

6. Failure in providing smooth and proper water supply to the Urban Centres like Panaji, Vasco, Mapusa and many other villages as also failure to implement water supply to Pernem Taluka.

7. Down scaling the target of foodgrain production as compared to the previous yes.

8. Faillure to disbwse subsidy to industries in time for the the needy.

9. Failure to formulate proper policy of education and transfer of the teachers.

/' 0 Failure to provide necessary staff including doctors and para medical staff of

various hospitals and health centres in the State.

1 1. Failure to implement its own promise of regularising MR/ daily wages who have completed 5 years in the daily service.

12. Failure to formulate proper policy on NCERT mattcxs resulting in permanent damage to the future of the children.

"This House expresses its deepest sorrow at the passing away of Shri Morarji Desai, Ex-Prime Minister of India aprominentfreedom fighter, an ardent Gandhian, a staunch prohibitionist and a geat son of India and an able Administrator. In his death on 1014195 India has lost a great and illustrious statesman."

Motion was proposed. -.A

Seven Members took part in the Debate. One minute silence was observed as a mark of respect to the departed soul.

ID. Shri Shripad Naik,'MLA called the attention of the Chief Minister to the following matter of urgent public importance:-

"Anxiety and fear in the minds of the students due to failure of the Goa Board of Secondary and Higher Secondary Education to implement the direction given by the Government and non availability of the books prescribed by the Board of NCERT. The steps Government intends to take in the matter."

II. ii) Shri Manohar Parrikar, MLA ':Icatlled the attention of the Dy. Chief Mirrister to the following matter of urgent public importance:

"Grave anxiety in the minds of the people of Panaji and Porvorim in particular and Goa in general due to detection of large number of cases of Malaria in Panaji and Porvorim and steps Government taken in the matter."

Dy. Chief Minister promised to make a statement on 28/6/95.

11. i) Shri Surendra V. Sirsat, MLA called the attention of the Minister for Uhan Development to the following matter of urgent public impor- tance:-

"Serious anxiety, concern and apprehension in minds of the people of the S w e and specially the people of Mapusa due to illegal allotment of space for gadas by Mapusa Municipal Council and the steps taken by the Government in the matter."

Minister for Urban Development made a statement thereon.

Few querries were asked and replied to by way of clarification.

ii) Shri Maimhar Parrikar, MLA called the attention of the Minister for Co- operation to the following matter of urgent public importance:-

"Co~stemation in the minds of 73 employees of Bicholim Urban Co- o p & v e Ban,k fof their retrenchment due to the internal problem of the rnanaplernent for not following the required procedure as laid down and the

steps taken by the Government to enquire into the dispute and issue necessary direction to re-employ these employees if there is no adverse involvement on their part and immediate election of the B oard of Directors of the Bank so as to streamline its functioning."

Minister for Co-operation promised to make a statement on 3/7/95.

iii) The Dy. Chief Minister made a statement to which his attention was called by S k i Manohar Parrikar, MLA on 2716B5. A few quenies were raised and replied to by way of clarification.

111. Resumption of Discussion on Governor's Address.

Thirteen Members took part in the debate.

The amendments moved by Dr. Kashinath Jalmi, Leader of Opposition to the Motion of Thanks to the Governor's Address was put to vote and ckfeated.

"Serious consternation in the minds of the workers and the people of Curchorem, Quepem and nearby areas about the shut down of 'Nova Dhattu' factory thereby retrenchment of number of workers and the steps Government intends to take in the matter."

"This House strongly recommends Government that a House Commit- tee be constituted to evaluate the performance of the University in terms of the Goa University Act and examine possibie linkage with industries to re-structure training course to make available trained personnel need by Industries."

Resolution was moved and proposed. Three lMembers took part in the debate. The Resolution was put to vote and defeated.

2. Resolution No. 2 by Smt. Victoria Fernandes, MLA.

''This House strongly recommends Government tkat special incentives for conservation, upgradation and modernisation of traditional salt indus- try be provided on priority basis."

3. Resolution No. 3 by Smt. Victoria Fernandes, MLA.

"This House strongly recommends Government that in view of wide powers given in Panchayati Raj Act 1993 ail the functions of these Tenants Associations be transferred to respective Village Farrchayat."

"Whereas the women have been provided equal rights and oppumnities with the men and increased involvement in Panchayats, Municipdities, Assemblies etc as well as every sphere of day to day working, but are given discriminatory treatment in vaious legislationslike Code of Comunkiades, Mahajan Act etc. and therefore resolves that a committee of the House be set up to examine discriminatory attitude on ground of sex and suggest remedial steps to enhance the status of women and install them with rights and p i v i b g a as available in Panchayats, Municipalities etc, in Code of comuRidades ;md Mahajan Act etc."

Resolution was moved and proposed. Fifteen Members took part in the debate, Resolution was withdrawn by leave of the House.

And Whereas the said Bill, 1982 provides inter-alia f o ~ removal of Mining rejects and also for payment of compensation to the affected parties for bss caused due to dumping of rejects;

And Whereas the Mines and Minerals (Regulation and Development) Act 195 7 as m & d by the Central Act NO. 37 of 1986 empowers the Central Government to frame rules on various matters specified therein, inter-alia, the manner in which the right of third parties to be protected whether by way of payment af compensation or otherwise;

And Whbreas in pursuance of the Mines and Minerals (Regulation and Development) Act, 1957 the Central Government have suitably modified

the provisions of the Mineral Concession Rules, 1960 in s c h amanner that even though there is no specific provision relating to removal of mining rejects as providedunder the Goa, Daman and Wu h ~ t i o n of Land Bill, 1982, the payment of compensation in respect of dmage caused to the land under surface operation have been adequately provided which woufd be sufficient towards determination of compen&on by the officer appointed by the Government in terms of Rule 72(1) of the Mbra l Concession Rules, 1950 and the rights of such person affected by miming operation are safeguarded to certain extent by awarding compensation for agricultural land as well as non-agricultural land;
