This booklet contains a journal of the Business transacted during the First Session (March-April) 1979 of the Fourth Legislative Assembly of Goa, Daman and Diu prepared in pursuance 04 the provisions of rule 271 of the Rules of Procedure and Conduct of Business of the Goa, Daman and Diu Legislative Assembly. Statistical information in regard to some of the items is also given wherever possible.

The First Session (March-April) 1979 of the Fourth Legislative Assembly of Goa, Daman and Diu commenced a t the Assembly Hall, Panaji on Thursday, the 15th March, 1979. The Session was adjourned sine-die on 23rd April, 1979 due to grave dissorder in the Heuse. Subsequently on 27th April, 1979 the Fourth Legislative Assembly was dissolved. Twenty five meetings were held during the First Session and the total time taken for the business of the meetings was 89 hours and 19 minutes.

Administrator's Address

The Administrator addressed the Legislative Assembly under sub-section (1) of Section 9 of Government of Union territories Act, 1963 on 15th March, 1979. A copy of the Administrator's Address was laid on the table of the House on the same day. The motion of thanks to the Administrator's Address was moved on 19th March, 1979. Ameodments were moved to the said motion and were rejected by the House. Discussion on the Motion of Thanks took place on 19th and 20th March, 1979.

Obituary referenee

Orbituary reference was made on 15th March, 1979 to the passing away of Shri D. K. Chopdenkar, Ex-member of the Legislative Assembly of Goa, Daman and Diu.

Motion for oondolem

On 16th March, 1979 motion for condolence on passing away of His Holiness Pope John Paul I was moved and passed.

Other motions

The following motions were moved and carried.

1. Motion congratulating Shri Elizabeth Rodrigues, the handicapped tailor from Parods, the recipient of the National Award for the handicapped, from the President Shri Neelam Sanjiva Reddy.

2. Motion congratulating Dempo Sports Club for its victory in the prestigious Rovers Cup Foot-ball Tournament.

Financial Business

The Supplementary Demands for grants for the year 1978-79 were presented to the House on 21st ,March, 1979. In all there were 19 demands. Discussion and voting on these demands took place on 23rd March, 1979. All the demands were passed.

Vote on Account for the year 1979-80 was presented to the House on 30th arch, 1979. The discussion on Vote on Account took place on the same day and the motion for Vote on Account was carried.

The Budget for the year 1979-80 was presented to the House on 29th March, 1979. The general discussion on the Budget took place for 2 days i. e. on 2nd and 3rd April, 1979. In all there were 26 demands. These demands were set forth for discussion and voting for 11SJ: days i. e. 4th, 5th, 9th, loth, l l th , 16th, 17th, 18th, 19th, 23rd, 24th and 25th April, 1979 (upto 4.30 p.m.). The Demands set forth upto 19th April, were discussed and passed. The demands set forth for 23rd, 24th and 25th could not be passed since the House was adjourned sine-die on 23rd Apdil, 1979 due to grave disorder. Subsequently on 27th April, 1979 the Assembly was dissolved.

Government Legislative Business

Nine Bills were introduced during the Session, out of which eight Bills were passed, and one Bill was referred to Select Committee.

Three Private Members' Bills were moved during the Session, out of which motion for leave to introduce the one Bill was put to vote and defeated; One Bill

STATEMENT No. 4

Summary of Business transacted by the Goa, Daman and Diu Legislative Assembly day to day during the First Session, 1979

Thursday, the 15th March, 1979 I. The Administrator ?2olonel Partap Singh Gill delivered his address.

IT. The Secretary laid on the Table of the House a copy of the Administrator's Address.

III. Hon'ble Speaker made reference on the passing away of Shri D. K. Chop- denkar, Ex-Member of the Legislative Assembly of Goa, Daman and Diu. The Chief Minister, Leader of Opposition, Deputy Speaker, and Shri M. R. Bir, MLA also paid tributes to the departed soul. Thereafter members stood in silence for a short while as a mark of respect to the departed soul.

IV. 1) The Secretary laid on the table of the House the following Bills passed by the House and assented to by the President: -

i) Bill No. 10 of 1977-The Goa, Daman and Diu Mundkars (Protection from Eviction) (Second Amendment) Bill, 1977.

ii) Bill No. 13 of 1977-The Goa, Daman and Diu Ancient Monuments and Archaeological Sites and Remains Bil!, 1978.

11. Dr. Jack de Sequeira, moved the following motion for condolence: - "This House expresses its deepest sorrow a t the passing away of His

Holiness Pope John Paul I, after only 34 days of reign".

The motion proposed. Two members spoke. The motion was put to vote and passed unanimously.

111. The Chief Minister laid the following papers on the table of the House: - i) The Annual Report of the Economic Development Corporation of Goa, .

IV. Hon'ble Speaker informed the House about the report of the Business Advisory Committee. The Minister for Legislative Affairs moved for adoption of the Report. The motion was proposed.

Dr. Jack de Sequeira, moved an amendment to the motion that the report may be referred back to the Business Advisory Committee. Amendment proposed. The amendment was put to vote and was defeated.

The Motion for adoption of the report was put to vote and was carried.

V. The Minister for Legislative Affairs announced the Business to be transacted during the week.

VI. i) Shri A N. Naik, called the attention of the Chief Minister to the following matter of urgent public importance: -

"The accidental death of two young teachers from Cuncolim, Mahadev Patnekar and Laxmikant Desai on 13th instant along the Panaji-Agacaim road as a result of collision with a bus alleged to be plying without any breaks and apprehension in the minds of citizens since this is direct effort to road safety period."'

The Chief Minister asked for time to reply the calling attention notice.

ii) Shri S. H. Haroon, called the attention of the Chief Minister to the following matter of urgent public importance: -

"The non-lifting of ready sugarcane crop from the agriculturists from Sanguem and Satari Talukas, thereby causing great anxiety and loss to the agriculturists and resulting great set back to sugarcane development programme in the territory."

The Chief Minister asked for time to reply the calling attention notice.

VII. The following Bills were introduced.

VIII. Private Members' Business.

(A) Bills.

i) Bill no. 1 of 1979-The Goa, Daman and Diu Lokayukta and Upa-Lokayukta Rill, 1979, by Shri Ferdino Rebello, ML4.

The Motion for leave to introduce the Bill was put to vote and defeated.

ii) Bill no. 2 of 1979-The Goa, Daman and Diu Salaries and Allowances of the Members of the Legislative Assembly (Amend- ment) Bill, 1979, by Shri Leo Velho, MLA was introduced.

(B) Resolutions.

(1) Resolution No. 49 by Dr. L. P. S. Cota, MLA.

"This House urges Govt. to conduct regular inspections of the Cinema Theatres in this territory to ensure that the owners of the Cinema houses strictly comply with the provisions contained in the Cinematograph Act, 1952, and the Goa, Daman and Diu Cinematograph Rules, 1965, in order to provide for the safety and comfort of the persons attending exhibitions.:'

Shri A. N. Naik requested to take his resolution No. 14 alongwith Resolution No. 49 a s both were of similar nature. The request was agreed upon the condition that, the same will not be taken as a precedent.

Accordingly Shri A. N. Naik moved the following resolution: - Resolution No. 14 by Shri A. N. Naik, MLA.

"This House strongly urges Govt. to reduce the rates of admission for different classes of Cinema Houses in this territory by minimum of 30% of the existing rates."

Both the resolutions were proposed. The discussion on both the resolutions was taken together. Five members took part in the debate. Resolution No. 49 was put to vote and defeated. Resolution No. 14 was put to vote and defeated.

(2) Resolution No. 120 by Shri F. C. Sardinha, MLA.

"This House strongly recommends Govt. to move the Central Govt. to provide direct dialing telephone system between Margao Industrial Estate and the city of Margao."

(3) Resolution No. 62 by Shri Leo Velho, MLA.

"This House strongly recommends Govt. that area of Navelim and Benaulim constituencies be attached to Urban Health Centre at Margao in order to facilitate the public of these areas who have to attend at present Primary Health Centre a t Curtorim and Cansaulim, which are far away from Navelim and Benaulim."

The Resolution proposed. Three members took part in the debate. Resolution was put to vote and defeated.

(4) Resolution No. 144 by Shri M. R. Bir, MLA.

"This House strongly recommends Govt. to build residential quarters to the Ministers without further delay."

The resolution proposed. Shri A. N. Naik, moved the following amendment: After the word, "Xinisters" add the expression "and for the Speaker, Deputy Speaker atld Leader of Opposition". Amendment put to vote and carried. Under Rule - 16 Speaker extended the sitting of the House by '15 minutes. Resolution .n amended put to vote and defeated.

Monday, the 19th March, 1979 I. (i) Fourteen Starred Questions were answered.

11. The Minister for Revenue laid the following papers on the Table of the House: .

(i) The Goa, Daman and Diu Munakars (Protection from Eviction) Rules, 1977.

(ii) The Goa, Daman and Diu Agricultural Tenancy (Special Rights and Privileges of Tenants) Rules, 1977.

111. (1) Dr. Jack de Sequeira, and Shri Ferdino Rebello, called the attention of the Chief Minister to the following matter of urgent public importance: -

"Apprehension in the minds of the taximen that .they will not be able to continue with their trade a s Govt. has not given remedy to their grievances and steps Govt. intends to take in the matter."

The Chief Minister asked for time to reply the calling attention Notice.

(2) .Shri A. N. Naik, called the attention of the Minister for Public Health to the following matter of urgent public importance: -

"Reported threat of a Resident Doctor Ulhas Karpe to resort to an indefinite hunger strike from today on account of certain discrimination that is taking place a t the Goa Medical College."

V. Shri R. D. Khalap, MLA moved the following motion of tha.nks to the % Administrator's Address: -

"That an Address be presented to the Administrator in the following term: - "That the Members of the Legislative Assemby of Goa, Daman and Diu

assembled in this session are deeply grateful to the Administrator for the Address which he has been pleased to deliver to the House on 15th March, 1979."

The motion proposed. Shri R. H. Naik seconded the motion.

Shri A. N. Naik, moved the following amendments: - "That a t the end the following be added:

"But regrets that (a) The address consists mostly of assurances, fails to give clear

account of past assurances and achievements and on every front is vague about the pace of development; ,

(b) a t the outset itself, the address tries to create an impression that. ramponkars and students are some sort of hooligans indulging in violence ;

(6) in the address, go mention has been made to: - (1) the brutal violence unleashed by the Goa Police on agitating

ramponkars and students;

(2) the police highhandedaess in unjustifiably arresting several peaceful ramponkars and student leaders and ill-treating them police-lock-ups;

(3) the injustice meted out to the poor ramponkars for last several years due to continued sea violations by the mechanised trawlers and purse-sieners and the sinister role being played by Goa Government of a silent spectator;

(4) the refusal of Govt. to honour the assurances given to our student community regarding 50% bus concessional fare and the withdrawal of charges against their leaders;

(5) the concurrence of Goa Government to implement the prohibition policy, which will give rise to unemployment and crime, destroy our touristic potential and on the overall be disastrous to our territory; I

(6) the already deteriorated law and order situation in the territory which even warranted the import of a full company of Central Reserve Police on the eve of this budget session; '

(7) the failure to delect several murders and other gruesome crimes since last few years;

(8) the most important issue in the field of education the proposed Goa University;

(9) the failure to compensate several agricultural fields, which are simply ruined due to some murderous inflow of mining reject into them;

(10) the failure of Government to inspect the sanitary conditions as well as the safety, comfort and non-exploitation of cinegoers a t various cinema theaters in this territory;

(11) the aweful growth of unemployment in this territory and shameful failure on the part of Government to remedy the situation;

(12) the alarming increase in road accidents, which has cost - valuable lives and causing grief to so many innocent children and

families and failure of authorities to check the same; (13) the miserable delay in all round development of the

territory."

Shri M. R. Bir, MLA moved the following amendments: - That a t the end of the Motion, the following be added, namely: -

"But regrets that the Address fails to mention;

(1) the confusion resulting out of faulty steps initiated by the Administrative Reforms and Personnel Department of this Admi- nistration;

(2) the definite steps to tone up the Cooperatives to meet the undertaking of responsibility ol' massive scheme of Public Distribution system;

(3) the measures to save the only Processing Cooperative venture that of Sanjivani Sahakari Sakhar Karkhana Ltd:

(4) the measures towards the Decentralisaticm of Administration through Panchayat Raj Institution;

(5) the time-bound programme of Land Reforms especially that of Consolidation of Holdings;

(6) about the Plan imbalances;

(7) the measures to absorb workers thrown out as a result of eventual exhaustion of Mining Deposits in the year 2000;

(8) the taking over'of Passenger Road Transport."

Shri Ferdino Rebello, moved the following amendments: - That at the end of the motion, the following be added namely: -

"But regrets that no reference has been made in the Address on:

(1) the Educational Bill.

(2) the mal-administration in the Department of Education.

(3) about the steps taken for d&claring the Kunbi/Gawda Samaj as an otherwise backward community;

(4) jail reforms and third degree methods used by the Police;

Under Rule 16 Speaker extended tlie sitting of the House by 15 minutes.

Amendment proposed. Seven members took part in the debate. Discussion on the motion of thanks was not copcluded,

m. (i) Shri MJ R. Bir, Froilano Machado, Ferdino Rebello and Shri D. G. Narvenkar called the attention of the Minister for Law to the following matter of urgent Public Importance : -

"The letter reported to have been written by the Chief Mimister ta the Union Law Minister, Hon. Shri Shanti Bushan requesting him to postpone moving of the bill on propc~ued High Court Bench to this Union Territory has given rise to serious apprehensions and have caused doubts about the Government's intentions." The Minister for Law made a statement thereon.

(ii) Shri S. V. Shirsat, called the attention of the Chief Minister to the following matter of urgent public importance: -

"Anxiety prevailing among the public due to the wrongful and illegal detention of law abiding citizens by police constable, Mr. Nazir a t Bicholim and action taken by Govt. against the police personnel."

The Chief Minister made a statement thereon. Few questions were replied by way of clarification.

(iii) The Chief Minister made a statement & respect of the calling attention notice raised by Shri S. H. Haroon, MLA. regarding non-lifting of ready sugar cane crop from the agriculturists resulting great set back to sugar cane development programme in the territory, to which her attention was called on 16th March, 1979.

IV. Resumption of discussion on Motion of thanks to the Administrator's Address.

Dr. Jack de Sequeira moved the following amendments to the Motion of thanks to the Administrator's address.

That a t the end of the Motion of Thanks, the following be added, namely: - "But regrets that no mention is made in the Address of -

(1) any steps to move the Central Government to bring early legislatton in Parliament to grant statehood to Goa, Daman and Diu;

(2) any steps to move the Central Govt. to bring early legislation in Parliament to give Konkani its rightful place on the 8th Schedule of the Constitution, particularly now as it is recognised by the Sahitya Akademy;

(3) steps to rationalise public transport; (4) measures to be taken to make available sports play grounds in all

villages, or in a group of villages if contiguous;

, (7) any steps to move the Central Govt. to create a High Court for Goa, Daman and Diu;

(8) any steps in respect of improving the water supply works (piped water) which is in a disgraceful condition;"

Eleven members took part in the debate. The MinistW far Law moved a motion for extension of the duration of the House by an hour. The motion was put to vote and carried.

II. (i) S/Shri A. N. Naik and M. R. Bir called the attention of the Chief Minister to following matter of urgent public importance: -

"Humiliating treatment meted out to Shri Maruti Gajanan Karmali frOm Sanvordem by the Curchorem Police, who, without assigning any reason, roped and hand cuffed him and threw him into the Quepem Police lock-up on or about 16th instant and justified annoyance amongst the members of the public there."

The Chief Minister made a statement thereon. Few questions were also replied by way of clarification.

(ii) S/Shri I?. Machado and S. H. Haroon called the attention of the Minister for Revenue to the following matter of urgent public importance: -

"Reported move of acquisition/requisitioa of land in Non-Mon area in Mornlugao for Naval Authorities which will affect thousands of families and recently constructed High School and steps Govt. taken or intend to take in the matter."

The Minister for Revenue asked for time to reply the calling attention notice.

(iii) The' Chief Minister made a statement in respect of the calling attention notice raised by Dr. Jack de Sequeira and Shri Ferdino Rebello, MLAs regarding apprehension in the minds of the Taximen that they will not be able to continue with their trade as Govt. has not given remedy to their grievances, to which her attention was called on 19th March, 1979. Few questions were also replied by way of clarification.

(iv) The Minister for Public Health made a statement in respect of the calling attention notice raised by Shri A. N. Naik, MLA regarding reported threat of a

I (2) Bill no. 4 of 1979-The Goa, Daman and Diu Buildings (Lease Rent & Eviction) Control (Fourth Amendment) Bill, 1979 was considered.

Shri R. D. Khalap, moved an amendment to clause No. 3 of the Bill. Shri S. H. Haroon, moved an verbal amendment to clause No. 3 of the Bill. Shri A. N. IV. The Chief Minister made a statement in respect of the calling attention notice raised by Shri A. N. Naik regarding accidental death of two young teachers from Cuncolim on 13th instant to which her attention was called on 16th March, 1979. Few questions were also replied by way of clarification.

(ii) Shri S. V. Shirsat called the attention of the Minister for Public Health to the following matter of urgent public importance: -

"Serious apprehensions in the minds of public as cardiogram machine in the Asilo Hospital is out of repair and hardships suffered by the public."

As this is a serious hazard to the people doing so, what immediate steps will Government take to put a stop to it."

This House recommends Govt. to bring suitable amendments to the Goa, Daman and Diu Sales Tax Act, 1964 in order to e,Aempt from Sales Tax the goods produced by Small Scale Industries irrespective of whether the product is sold to the consumers either directly by the manufacturer or through any other dealers."

"On 16th March, 1979, after the question hour, Shri Ferdino Rebello, Hon'bk ' M e m b e r of this House raised an issue pertaining to the fencing that has been

clone around the Secretariat Building and sought to know whether that was

i done with the consent of the Speaker. So far as the Secretariat Annexe is concerned, i t does not come within the Precincts of the House as per the Report of the Privileges committee presented to the House on 25-4-74 on the question of the arrest of Shri J. B. Rao.

The footpaths facing the Fazenda Buildings, however, comes within the Precincts of the House. As such, attention of Shri R. M. Agrawal, the Chief Secretary was drawn by me a t a Social Gathering. However the Chief Secretary was hesitant to agree to my suggestion and as such I had asked him to check up, if necessary, whether the footpath did not fonn part of the 'Precincts of the House'.

the ~ o g b l e Chief Minister was not aware of the deliberate action of the Chief Secretary. I know that the Hon'ble Chief Minister has high respect for the House and the Chair and if she had learnt of this earlier, she would have definitely prevented the Officer from such acting and would have asked him to get necessary permission from the Legislature Deptt.

The attempts made in para74 and 5 of the statement to state and interpret the term 'Precincts of the House' do not hold any ground. It is clear from the ruling given by the then Speaker - on 4th March, - 1965.that the approaches to the North and South porches also form the Prscincts of the House. If by the approach to the South Porch, the then Speaker had meant only the frontage area of the South Porch, then he would have said as he had said in respect of the North Porch "the point where the Administrator is received ceremoniously by the Presiding Officer". I t is clear that the then Speaker had in his mind all the approaches to the above mentioned porches which necessarily mean the foot-paths facing the Fazenda Building as well towards the North Porch to form part of the Precincts of the House. If the approaches to the porches were to be restricted to frontage areas only, as argued by the Chief Secretary, then the Speaker would have stopped by saying a t the border point below the North Varandah and would not have added the approaches to the two porches as'said in the third para of his ruling.

However, a s I had already expressed to the Chief Secretary my interpre- tation that the said footpaths form the part of the Precincts of the House and had asked him to check up so for confirmation before going ahead with the fencing work, it was for the Chief Secretary to refer the matter to'the Legislature Department or to me as he cannot form his own conclusions and act accordingly. Because as per Rule 284 of Procedure and Conduct of Business, "If any doubt arises as to the interpretation of any of the provisions -of these rules, the decision of the Speaker shall be final". So also as per Shri S. L. Shakdher, "Officers of Parliament" in the Indian Parliament "It is the right of the Speaker to interpret the Constitution and rules, so far as matters in or relating to the House are concerned, and no one, including the Government can enter into any argument or controversy with the Speaker over such interpretation."

It may be recalled that the Committee on Privileges in the matter of breach of privileges on the question of arrest of Shri J. B. Rao was seized with the question whether the Secretariat Annexe formed part of the Precincts of the House and the question of the footpath did not arise then. No doubt, the southern gate has been closed with my permission; but it is closed tempo- rarily a ~ 2 even if it is closed, the definition of the Precincts of the House has not Leen changed and it still forms the Precincts of the House.

After a careful study of the matter, I am fully convinced that the Chief Secretary had acted deliberately showing disrespect to my ruling dated 19-4-1978

_Z_C__ in regard to the removal of portraits wherein it was ruled that whenever any alteration or modification was required to be made in the part or precincts of the House, the Speaker may invariably be consulted. In earlier two occasions, I had taken lenient view as the Officers concerned appeared to be new to the place and might perhaps not be aware of the Rules of Procedure. In this case also if any new junior officer was concerned a lenient view could have. been

taken. But, a s the officer concerned is the Chief Secretary who happens to be the top officer in tlie Administration, with whom also I had taken lenient view earlier on similar cases of which he is aware, I had to take seriaus view in the present case.

I had two ways to take action. If Shri Ferdino Rebello had given notice the matter could have been sent Lo the Privileges Committee under Rule 91 or to take action myself. As the Hon'ble Minister has, on behalf of the Chief Secretary, accepted the facts that I had told the Chief Secretary that the footpath forms part of the Precincts of the House, there is no need to refer the matter to the Committee on Privileges for the investigation.

The Officer concerned has no respect for this House is also clear from the fact that during the period of this session even as this particular matter was before the House, the Chief Secretary had asked Shri Rajgopalan, the Executive Engineer of PWD to carry out certain modifications in the Officers' Gallery and when the Executive Engineer was takiug measurements, the Marshall of the House had brought to his notice that he cannot carry out any alterations without Speaker's permission. This act of the Chief Secretary tends to deliberate disrespect to the House. Of course, then the Chief Secretary approached me in this respect and I have allowed certain modifications in the Officers Gallery.

The Officer has tried to defend himself through the statement submitted by the Hon'ble Minister. Although the. Minister is responsible to the Parliament for all acts of his Ministry, the Minister is relieved of his responsibility of protecting an Officer in case a civil servant acts deliberately or recklessly outside the policy of his Minister. The Government has internal procedure whereby undisciplined or erring civil servants are suitably punished..

This is the first instance in the Parliamentary history of this country in which the topmost officer of the Administration was found to act deliberately leading to the contempt of the House that shows how much respect and esteem the officers are supposed to give. to the House and to the rulings of the Speaker. After a careful study of tha matter I have come to the conclusion that the Officer has committed this act deliberately, and not inadvertently. As such the behaviour of the said Officer can well be termed as disrespectful, of insubor- dination misconduct and contemptous towards the ruling given by me earlier and, therefore, I recommend the Government to take appropriate disciplinary action against the Officer."

Statement of Lnw Minister

Sir,

This has reference to the observations made by the Hon'ble Speaker on 16th March, 1979 to the effect that his permission was not obtained while fencing the foot-path facing the Fazenda Building though the same forms part of the 'Precinct of the House'. It was further observed that the Hon'ble Speaker had drawn the attention of the Chief Secretary in this regard but no one paid any attention to his request and this tentamounts to contempt of the House.

The Hon'ble Chief Minister had given a general clarification in this regard on the occasion and has stated that there was na de!iberate intention on the part of the Administration to show aily disrespect to Lhis al-g~s: House or for that matter to the I-Ion'ble Speaker. However, since this issue has come up again in this House even subsequently, and the Eon'ble Speaker is committed to give a ruling in t h ~ s regard, it is considered expedient to make a statement in the House to clarify the Government stand.

3. The Kon. Speaker while attending a s ~ c i a i gathering where the Chief Secretary was also prcsent had informally mace a mention to the Chief Secretary regarding the fencing on the foot-peth facing the Fazenda Building nltd had told the Chief Secrets~ry to check up whether the foot-path did not form part of 'Precinct of the House' and in case i t is so, his permission would be required. Though it was an infromal mention, the Chief Secretary did take note of the same and after going through t6e Rulings on the subjeet came to the conclusion that the foot-path does not form part of Precinct of the House.

4. The t e r n 'Precinct of the House' has been defined in Rule 2 of the Rules ' of Procedure which says expressly that the Precinct of the House means and includes the Chamber, the lobbies, the galleries and approaches leading thereto and all other accommodation irm the possession of the Speaker or the Officers of the Assembly Secretariat in the Building in which the Assembly meets and such other places as the Speaker may from time to time specify. A ciear interpretation of this definition was given by the then Speaker on 4th March, 1965 According to the ruling given then, all the passages - w h and South porches leading up to the Chamber, lobbies and galleries on the one side and to the Speaker's chamber and the office room of the Legislature Secretary as weil, the approaches ,

House alongwith all the other places expressly mentioned in the definition.

It may be seen that neither the definition of the term 'Precinct of the House' nor the ruling given by the then Speaker indicate that the foot-path facing the Fazenda Building form part of the Precinct of the House. It would be agreed that the foot-path along the road on two sides of the South porch cannot be considered as an approach leading to the chamber etc. mentionecl in the definition. Tlie approach to the South porch can best be the frontage area of the southern gate- only and i t has been ensured that no railings have been fixed there. The ~ o n ' b i e Speaker has vested with the power to specify any area 2s Precinct of the House and to the best of my knowledge and belief, the foot-path in question has not been specified as Precinct of the House. The Report of the Committee on Privileges in the matter of breach of privileges on the question of arrest of Shri J. B. Rae, MLA has opined that according to Speaker's definition, the approaches to the chamber, the lobbies and the galleries starting on the northen side of the Secretariat building from the. North porch and the Southern side of the Secretariat building from the south porch are to be considered as part of the Precinct. Bence, it is clear that by the expression "approaches leading thereto' what is included in i'c are the passages from the north porch and southern porch towards the chamber, the lobbies and the galleries.

In any case, i t would be recalled that the southern gate has already been closed with the permission of the Hon. Speaker:

advice informally given by the Hon'ble Speaker had been duly attended to by the Chief Secretary and there was no question leave apart any intention, on the part of the Government or any official to show any disrespect to this august House or for that matter to the Hon'ble Speaker.

Under Rule 74 r~ f the Rules of Procedure, I wouid like to bring to your notice the following incident which took place on 3rd April, 1979 after the Assembly session in the precincts of the House.

On 3rd April, 1979 soon after the session was over, while I was proceeding towards my scooter which was parked by the side of the front gate meant for M,L. As. only, I saw Shri Vasm Paik Gaonkar, M. L.A. coming from the other

Side towards me. I too proceeded towards Shri Vassu Gaonkar and we met a t the foot-path infront of the canteen. I requested Shri Vassu Gaonkar to proceed to Circuit House together with scooter.

At this moment one Mr. Murlidhar Rane threatened Shri Vassu Paik Gaonkar saying that he should not go with anybody and said that he (Shri M. Rane) had orders from M. G. High Command not to allow Shri Vassu Gaonkar to move with anybody.

I told Shri Rane not to interfere in our talks. At this moment Shri Rane got excited and assaulted me. He also raised his fist and tried to hit me but some how I tried to come out of the situation. He finally caught hold of my shirt and to,m it.

Before lodging a complaint to Police, I apprised the matter to the Hon. Speaker on phone, for further necessary action.

As the incident took place in the precincts of the House and the member of this August House has been assaulted and also one of the Members of this August House was threatened not to talk to the other member of this House by a stranger, it amounts to Breach of Privilege and Contempt of the House.

I, therefore, request you to take necessary action in the matter.

At the outset I should say that it is very unfortunate t.hat an Hon. Member of this August House was alleged to be assaulted in the vicinity of the precincts of the House while proceeding to his place of residence after the rise of the sitting. As stated in the' complaint I was informed of the incident through telephone, and I had instructed him to give the complaint in writing. Next day Hon. member raised the matter before the House but he was informed that unless the complaint is received in writing, I cannot proceed in the matter ond as such Hon. Member has given notice on 5th April. In the meantime, I have received a letter from Shri Rane, against whom the complaint is made, alleging that he has been assaulted by Shri Dilkush Desai, M. L. A. I could not discard the said letter though received from non-member, a s Shri Rane was accompanied by Hon. Member, Shri Vassu Paik Gaonkar, M.L.A. to deliver the letter to me. I have therefore reason to believe that the facts mentioned in Rane's letter is supported by Hon. Member Shri Vassu Paik Gaonkar.

The Hon. Members can thus see the facts mentioned in the complaint and the letter given by Shri Rane in presence of Shri Gaonkar contradicts each other. It is, therefore, very difficult to assess the true facts. However, since I have received the complaint under Rule 74, I will proceed to examine the same;

In his complaint the Hon. Member has made out two issues, namely,-

(i) that he has been assaulted by Shri Murlidhar Rane while taking his vehicle, parked by the side of the front gate meant to M. L. As. to proceed to the Circuit House, after the session was mr .

(ii) that the incident has taken place in the precincts of the House.

Everyone of us are aware that the members of this August House are enjoying the same powers, privileges and immunities a s were prevailing in United Kingdom a t the con~mence~nent of the Constitution by virtue of Section 1G of the Government of U. T. Act read with Article 105 of the Constitution of India. In England the privilege of freedom from arrest and molestation among other privileges is considered as a right of great antiquity designed to enable a member to attend his parliamen- tary duties without interference by whosoever. The House of Commons a s early as 12th April, 1733 and Lords on 17th May 1765 resolved.

"That the assaulting, insulting or menacing any member of this House, in his coming to, or going from the House, or upon the account of his behaviour in Parliament, is an high infringement of the privilege of the House a most outra- geous and dangerous viollation of the rights of Parliament and is high crime and misdemeanour."

Again on 6th June, 1780, the Commons resolved - "That it is a gross breach of privilege of this House for any person to obstruct

and insult the members of this House in the coming to, or the going from, the House, and to endeavour to compel members by force to declare themselves jn favour of, or against any proposition then depending or expected to be brought before the House (vide page 121 of May's Parliamentary Practice 17th Edition). In 1870, Patrick Woods, a stranger, was ordered by a Resolution of the House of Representatives to be imprisoned in a civil prison for three months for assaul- ting a Member who was returning to the House."

From the facts mentioned in the complaint, it is seen that the member was assaulted while going from the House. I don't know about the scope of the expression "going from the House" used in the 1780 Resolution. But it appears to me that the expression necessarily covers the present case as when the incident took place the member was on his way to take his vehicle which was parked in the vicinity of the precincts of the House. From the wording of the Resolution quoted, it also appears to me that the assault need not be connected with the discharge of the duties of the member namely in connection with any proposition pending or expected to be brought before the House. But even assaulting a member while going from the House can be said to be interference in the discharge of duties of the membe?. The Hon. member in his complaint has stated that he has lodged a criminal com- p!aint. I don't know a t what stage the said complaint is a t present. But I can say that as far as this point is concerned, the Legislature has wider jurisdiction than the courts, for it can take cognizance of contemptuous insult, gross calumny or foul epithets by word of mouth.

Regarding the second issue, I incline to differ from the Hon. member that the footpath infront of the canteen forms part of the precincts of the House. The defin?tion "precincts of the House" given in our Rules does not include foot-path of this building as precincts of the House. As ruled by me recently the footpath of the old building forms part of the precincts of the House in view of the specif ic~t i~n given in the 1965 ruling. But this particular foot-path is of the Secretariat Annex and was not in existence in the year 1965. In the absence of any specification to the effect, this Soot-path cannot be said to form past of the precincts of the House.

Whatever may be the case made out by the complaint in question it is to be dealt with by taking into consideration the facts mentioned in the letter received from Shri Rane, which I believe is also supported by Hon. Members, Shri Vassu Paik Gaonkar.

In this connection I would like to cite a case which occurred in the united Kmgdom, which is reported by Shri V. G. Ramchandran in his book on the Law of Privileges in India a t page 347. In that case, Mr. Piratin, member was twice assaulted in the precincts of the House by Mr. Lucy of the Press Gallery. A question of Privi- lege was raised on 19th December, 1946 and Mr. Lucy apologised. The Committee of Privileges found that the allegation of assault was true and that both Mr. Piratin and Mr. Lucy were guilty of contempt since each abused the other and beat the other. An assault by a Member or non-member within the precincts is punisl~able as contempt but since both apologised no further steps were taken. The House recorded its high displeasure and its determination to proceed with the utmost severity against future offenders in like cases.

As in the above case, in the *stant case also, both the parties allege that they have been assaulted by the other.

As such in view of the contradictory evidence presently before me it is very difficult for me to ascertain the true fact and I have to refer the matter to the Committee on Privileges for investigation, examination and report or the matter can

When the Hon. Speaker proceeded to the dias a section of the members proceeded to the dias by shouting slogans and prevented the Hon. Speaker from the occupying the chair. There was tremendous uproar in the House. In the midst of uproar Hon. Speaker put the cut-motion to Demand No. 3 to the vote of the House aud declared that the cut-motion is carried. The Hon. Speaker then adjourndeed the House sine-die. When the Hon. Speaker left the House, Hon. Dy. Speaker occupied the chair on the dias and announced that the House is adjourned till 2.30 P. Nf on the next Monday. Meanwhile Hon. Speaker entered and adjourned the House sine-die.
