@he First Session (July) 1987 of Provisional Legislative Assembly of Goa commenced a t the ~ s s e m b l y Hall, Panaji on 2nd July, 1987. The House was adjourned sine die on 24th July, 1987, 16 meetings were held and the total time taken for the Business of the meetings was,\61 hours and 17 minutes.

Oath or Affirmation

27 elected and 3 nominated members made and subscribed the oath before Hon'ble Speaker Shri D. G. Narvekar and took their seats in House on 2nd July, 1987.

Election of Deputy Speaker

The Election of the Deputy Speaker was held on 2nd July, 1987 and Shri Shambhu Bhau Bandekar was elected as Dy. Speaker.

Motion for Condolences

On 3rd July, 1987 Motion for Condolence was made on the passing away of late Shri Charan Singh, former Prime Minister of India and late Dr. Salim ~ l i M. P. Also condolato~y motion on the death of innocent i n : ; pn-sengers by cxtremints in Punjab was passed on 8th July, 1987. \

Motion for Congratulation for granting the Statehood to Goa is moved on 3rd July, 1987. Motion for Congratulation for awarding Sahitya Academi Award of 1986 for Ronkani literature to Shri Prakash Padgaonkar, Konkani Poet was passed on 10-7-1987. Motion for Congratulation for Shri Rama Swami Venkataraman, President elect was passed on 17-7-1987.

The General Discussion on the Budget for the year 1987-88 took place for two days-f. e. 14th and 15th July, 1987. In all 25 Demands were set forth-for-rliscnssion and voting on demands took place for 4% days i. e. 16th,-20th, 21st; 22ntt and 2 M l July, 1987 (upto 4.30 p.m.). All the Demands were passed.

w. Dr. Kashinath G. Jhaimi, M.L.A. called the attention of the Chief Minister to the fo~llowing matter of urgent Public importance: -

"Anxiety and tension in the minds of people of Goa in general and Amona and Mashel in particular over alleged prressurisatim to hush up the case and free the culprit responsible for death of Mrs. Anuradha Fadte, an alleged dowry victim and failure of Govt. to investigate the case".

Chief Minister promised to make a statement on 6th July, 87.

"Whereas the Legislative Assembly of Goa Daman and Diu which was m existence for 24 years and no efforts were made by the Government to provide basic facilities for M.L.As. i. e. by providing accommodation by constructing MLAs Hostel; And whereas all States/Union Territories in India have constructed A4.L.As Hostels and provided permanent rooms for MLAs during their term in such Hostels.

And whereas Goa has now attained the Statehood and became the 25th State of India;

And whereas there are no concrete steps taken by Government to constr!!ct M.L.As Hostel. This House strongly- recommends the Government to take over the possession of Tourist Hostel a t Panaji which was parted to Tourism Deve- lopment Corporation a t a nominal rate and declare the same as WAS. Hostel to provide rooms for MLAs on permanent basis during their term till the &&As Hostel is constructed",

"This House strongly recommends Government to depute an officer from office of Registrar of cooperative Societies to B.D.O's office in each Taluka so as to overcome the difficulties of people".

The Chief Minister made a statement in respect of the Calling attention notice raised by Dr. Kashinath Jhalmi, M.L.A. regarding alleged pressurisations to hush up the case and free the culprit responsible for death of Mrs. Anuradha Fadte, an alleged dowry victim to which his attention was called .on 3rd July, 1987.

3. Failure of Governme~t to plan properly for the need of Higher Secondary/Junior colleges and Degree colleges resulting in denial

. of admission to large' number of students.

4. Failure of Government to take appropriate steps to prevent entry of water into Dinanath Mangueshkar Kala Mandir in Kala Academy Complex.

5. Failure of Goveinment to take steps for reservation in jobs and promotions for other backward classes.

6. Failure to spell out steps to solve the problem of growing unem- ployniefit to Goa.

7. Failure to mention steps to augment revenue gaps and to meet the economic needs of the new state.

The 'amendment was proposed.

(2) Shri Uday L. Bhembre, M.L.A. moved the following amendment: - But regrets that.

1. No concrete steps have been spelt out about the irnplementation of the official Language Act.

2. Konkani, the official Language of the state is neglected while bringing out publication to commemorate important occasions;

3. No assurance is given about reblrildi~g the bridge on river Mandovi and about eliminating the difficulties suffered by daily commuteers while crossing river Mandovi in ferries.

4. No concern is shown about the recurrence of malaria Eri the state.

6. No concern is shown about the detection of cases of AiDS and about the growing drug-trafficking and drug-addiction.

The amendment was proposed.

IV. Ruling by the Speaker:

Hon'Me Speaker gave the following ruling on the notice given by h. Kashinath G. Jhalmi, on breach of Privilege against Minister for Labour Shri V. G. Desai. For reading extensively from the notes brought with him in reply to the Debate.

I have carefully gone through the relevant notice of Breach of Privilege and contempt of the Speaker raised by Dr. Kashinath Jhalmi and also the relevant proceedings of the debates of 16th & 17th July, 1987 and also the explanation of the Hon. Minister, relevant statement for Breach of Privilege. The Hon. Minister fer Labour has questioned the correcimess of the rules observed by the Speaker on the earlier day i. e. 16-7-1981 a.nd stated on 17-7-87 "\fbet&ek it is correct the Rules?" antl also whether he was using his Discretionary powers? Further he has also stated "My colleague has read. He can rend, ntilerwise show me the rules."

The Hon. minister raised on 17-7-87 the above question contradicging ruling of earlier day i. e. 16-7-1987 (When the Deputy Speaker was in the Chair). I t would have been proper for the Hon. Minister to raise the question about the ruling when I was in the Chair as the Hon. Deputy Speaker would not have been aware then of the ruling of the earlier day given by me.

Now coming to the main issue, I had statearon 16-7-87 that if the Hon. Minister was going to read everything typed he could circulate the copies and I also further directed that he cannot go on reading extensively. In fact, I did not prevent him from reading. Hon'ble Minister tried to W e point of ordem on 17-7-87 against his felkw colleague in the Cabinet for reading of the bio-data of the President Elect which was not in goooil taste. The reading of the bio-data was in connection with the business of the House and was not extensive. They were details of bio-data which one cannot remember by heart and he has to refer to the notes.

In this connection, I would like to draw the attention of the Hon. Minister to page 96 "Practice and Procedure" by Kaul & Shakdhar Vol. I which reads as follows : -

"A member who protests against the ruling of the Speaker con~mits contempt or the House and the Speaker. Members cannot criticise directly or indirectly inside or outside the House, any ruling given, opinion expressed or statement made, by the Speaker. If a member desires to make a submission to the Speaker on the floor of the House, regarding a ruling, the Speaker may permit the member to do so after satisfying himself that it does not unduly interfere with the proceedings of the House. The member making such a submission cannot c~iticise the decision but can seek elucidation on any point, or request the Chair to consider the ruling in the light of the facts subndtted by him".

In view of above there seems to be prima facie some evidence to substantiate motion of breach of privilege. Similarly the Hon. Member being a senior memb~r and has held the Office of Dy. Speaker for 5 years, he should have been more careful before challenging any decision or observation or making some observatioc.

Though there is prima facie evidence against Hon. Minister I presume that Hon. Minister will act and behave as a senior member of the House in the future. Similarly he will also study and understand all the rules in future before requesting Speaker to quote the rule because it is duty of Hon. Members and specially senior

members to observe the rules and cite rules whenever required and set examples to others. The Ministers have to be more carefuI and responsible a s they are running the affairs of governn~ent and are responsible for all the utterances $I the House. The di-pity of the House and Speaker can be maintained by helping the Speaker to elucidate rules; sometimes there might be mistakes by Presiding Officers or member but the same can be corrected by becoming gracious in approach. If the ruling of the Speaker has to be reversed or modified, i t can be done by pro- cedure laid down in the rules.

The action of the Ninister was not in best tradition of Parliamentary Democracy.

ETowever, on going through the explanation of the Hon. Minister, i t is noted that Hon. Minister has stated that there was "not a protest' against earlier ruling nor ixtended to mean that the earlier ruling in anyway was wrong". The Hon. AZinitrjr has also stated that he has very high regards for the rulees and conventions of the Honse and also the n~lings of the Speaker. I a m therefore inclined to accept his sincere statement.

However this being the first occasion and as the Eon. Member being a new member of the present Government I wish to take lenient view of the entire matter.

I therefore treat the matter of Breach of Privilege and confempt of the Speakor raised by Dr. Kashinath Jhalmi as closed.
