Notice

Notice 'is hereby given to the pubHc that on behalf of the President of India, public auction wjU be held 'under' the provision~ of Legislative Order no. 114 dated 1-12-1924 as amended by Le~ls1ative Order no. 669 dated 18-7-1933, in the office of the Superintendent of Fisheries, Daman on 12-12-1969 from 10 a. m. to 3 p. m. of the localities of fishing stakes specified in schedule I appended hereto.

The auctions wHl be subject to the followLng terms and .conditions:

1. The auction will be for the lease of the localities of fishing stakes for a period of three years.

'2. The auction is subje~t.t.p confirmation by Government.

3. The annual rental fixed on the basis of the successful bid wHl be payable- "for each of three years of the lease pe~od.

4. The lease holders are not allowed to transfer their rights to other~ without the prior -sanction in writing from the Government.

6. Only such nets, as would fulfill the conditions laid down in the notice issued by the Office of the Captain of Ports', Panaji dated 4th June, 1948 and published in the Government Gazette no. 25, Series III dated 17th June, 1948, with meshes as specified 1n the Govern­ment order no. 4639 dated 8th April, 1948 shall be operated on the stakes.

'6. For non-payment of the rental in accordance with the terms of para 2 of article 2 of the stakes regulations ammended by Legislative Order no. 669 dated 18th July, 1933. the lease is subject to annulment.

"7. The lessee shall operate the stakes regularly, failing whiqh he will be subject. to a fine of Rs. 5/-. 15/- and tiO/- for the first, second and third time, respectively and his lease may be terminated.

'S. The lessee is also subject to all the other provisions of the stake regulations in force.

9. The lessee against whom' the previous dues are out­standing will be allowed to participate in the -aucNon only after clearing those dues. The decision of the

'Director of Fisheries in this behalf shall be fiinal.

':10. 'The bidders w1ll 'have to deposit a sum of Rs. 100/­'prior _to' t:q,e start 9f ,the auction. The amount thus deposited will be refunded to those others than the successful bidder.

11. In case the successful bidder does not pay 50% of the annual rental within 2 days after the confirmation of the auction is communicated to him, the bidder will lose the rights on the stakes and the amount deposited by him will be forfeited to Government. Further the fiish'1ng stakes' localdty will be put to fresh auction.

:1.Z. The Director of Fisheries 'reserves the right to Withold any locality of fishing stakes from auction at any stage on receipt of complaints_ about the same or for any other reasons. The 'decision 'of tpe Director of Fisheries in this' respect will ·be final.

:.13'. 'In'-- c'ase there is no bid 'offered for any of the fish'irig stake locality, the same -will be put ·to fresh- auction

.14. The successful bidders wiil have to bear all the expenditure towards the execution of the -contract of the fishing stakes locality.

16. Genuine fishermen and registered cooperative societies of fishe].'men will be entitled to bid in the auction.
