Notices were served on' the lessees in which the proposed modifications were mentioned and the Learned Counsel for th~ lessee argued that the leases are not liable to be modified because firstly his clients are not lessees, but concessionaires and secondly' the Mining Lease (Modification of Terms) Rules, 1956 (hereinafter caUed the 'Rules') defines the term 'existing mining lease' as those Mining Leases which were granted before the 25th day of October, 1949, hence the leases which were granted after the 25th October, 1949 cannot be modified.

I have given my anxious and careful consideration to . .the above po1i1ts and. in my view, these contentions have got no force.

The first contention was that the Mines and Minerals (Regulation and Development), 4-ct, 1957 (hereinafter called the 'Act') and the Rules db not apply to these cases as these persons are concessionaires and not lessees. In my view this contention has got no force, a~ we have to look to the pith and substance of the case and not to the form or words which have been used under the "Portuguese Law. The Act defines the Mining Lease and Mining operations as follows:

Section 3 (c): «mining lease» means a lease granted for the purpose of undertaking mining operations, and includes a sub-lease granted for such purpose.

Section 3 (d): «mining operations» means any operations undertaken for the purpose of winning any mineral.

These definitions are very wide and include any deed granted for mining operations and the mere fact that under the Portuguese Law they were called mining concessions instead of Mining Leases would not make any difference,

The concessionaires cannot deny that they are operating the Mines under the deeds called Concessions. It will be significant to note that under the Portuguese Colonial Laws, Mining Concession was defined in almost similar manner and gave the power to the. concessionaires to operate the mines.

The relevant definitions· read as follows:-

Section I (u): «Mining Concession» is that which is granted to the manifestor and permits him to explore a mining pro­

. perty and to enjoy thereon all mining rights. It is unlimited in -duration as long as the concessionaire complies with the conditions which the law and the title of concession imposed on him.

Section I (v): «Title of Concession»; A document legally establishing a concession.

Article 2 says that tlie proprietorship of deposits of metals and metaliferous minerals, belongs to the State and such beds cannot be prospected or worked without licence and concession by Government in" terms of the present Decree.

Article 9 is very significant to note because it uses the word 'Concessionaires or Lessees' of mines. It shows that eve.n under the Portuguese Law Concessionaires and Lessees were synonymous.

Article 14 says that the concession of an ore does not imply possession of the surface of the ground in which it is found, but involves for the concessionares and the pro­prietor of the ground certain rights and reciprocal obligations in accordance with the terms of law.

Articles 42, 73 and 91 prescribe the tax etc. whiQl) are to be paid by the Concessionaires.

Thes~:,provisions of the Portuguese Colonial Mining Law clearly show that the concessionaires and Lessees are the same and· the difference w~ only of nomenclature.

I accordingly hold that the concessions .are in essence Leases and as such they can be modified under the Act and Rules. <

The se.q;pnd and last ppint 'which was urged before me was that according to the Rules 'the"'existing mining leases, mean a lease executed before .the 25th October, 1949 hence the leases or concessions which were executed after the 25th October, 1949. cannot be .modified. In my view this contention has also got no force.

'

~ndo apreciado, cUidadosruh~nte, as aleg~6es .acima feltas, sou do parecer que as mesmas nao tern for~a de lei.

A . primeira alegagao e de que 0 «Mines and Minerals (Reg~lation and Development Acb, 1957 (referido daqui em dlante como «citado Act») e as normas formuladas ao abrigo do mesmo, nao tinham aplicagao aos casos vertentes porque as partes interessadas eram concessionarios e n.i.o arren~atarios. No meu parecer esta alegagao nao tern for~a de leI porque 0 presente caso tern de ser encarado a fundo e nao simplesmente baseado na forma ou pal8.vras empre­gadas pela lei portuguesa. 0 citado Act, define 0 arrenda8 mento e exploragiio de minas como a seguir se indica: -

Artigo 3 (c) «arrendamento mineiro» significa urn arren­d<:m~nto c0I:Icedido para os fins de se fazer explora~oes mmelras e mclue Urn sub-arrendamento concedido para 0 mesmo iim.

Artigo 3 (d) «explora~oes mineiras» slgniflcam quaisquer ex:plo~ag5es feitas ·para os fins da extracQao de qualquer mmeno.

Estas definiQoes acima mencionadas sao bastante amplas e ,incluem ~ualquer titulo concedldo para a explorac;ao de mlllas e 0 sImples facto de que ao abrigo da lei portuguesa os mesmos eram chamados «concess5es de minas» em vez de «arrendamentos de minas» nao deve fazer nenhuma diferenQa.

Os concessionarios nao podem negar que exploram as minas ao abrigo dos tftulos chamados concessoes. :m de toda a significiincia notal' que ao abrigo da Lei Colonial Portuguesa, uma concessao mineira achava-se definida de maneira quase identica e concedia poderes aos concesslo­narios para explorarem as minas.

Sao seguintes as definiQoes:-

Artigo I (u): «concessao mineira» e aquela que e dada ao manifestante e Ihe permite explorar uma propriedade mineira e exercer sobre. e1a todos os direltos mineiros. Tem duragao ilimitada enquanto 0 concessionario cumprir as condi~oes que a lei e· 0 titulo de concessiio the impuseram. . .

Artigo I (v): «Titulo de concessao» - Documen.to que prova legaImente a conceSSao.

o artigo 2.0 diz que a propriedade dos dep6sitos de metals e minerios metalicos pertencente ao Estap.o e os respectivos jazigos nao poderao ser pesquisa~os nem lavrados sem licenQa e concessao do Governo, nos termos da presente lei.

o artigo 9.0 'e de toda a conveniencia frisar, porque emprega a expressao «concessionarios ou arrendatarios» de minas. lsto demonstra que mesmo, ao abrigo da lei portugu.esa os termos concessionarios e arrendatarios eram sin6nimos.

o artigo 14.0 diz que a concessao de urn jazigo mineiro nao implica a posse da superficie do terreno em que ele se encontra, mas envolve para 0 concessionario e para 0 proprietario do solo direltos e obrigag5es reciprocas, em harmonia com as disposigoes que foram legaImente estabe­lecidas.

Os artigos 42.0, 73;0 e 91.0 fixam as taxas a serem p~a8 pelos concessionarlos.

Estas disposigoes da Lei Colonial Portuguesa, acima citadas c1aramente demonstram que os conces.siona-rios e arrenda­tarios eram a mesma coisa e que a diferenQa era apenas de nomenclatura.

Eu, de conformidade, entendo que as concessCies sao, na sua essencia, \ arrendamentos e, por Isso podem ser modifiea-das ao abrigo das exlstentes leis e nonnas. .

A segunda e ultima alegaQao fetta e, que: de hal'JIlonia com as normas;'~a expressao «actuais ··arrendamentos minei­ros» significa os' arrendamEmtos executados antes ae+25 de Outubro de 19.49,. e que POl' isso, os arrendament08 execu4: tados depois,.de,· 25 de Outubro de 1949, nao podiam ser modificados. It is true thai under the Rules 'existing Mining Leases'­h~v& been defined as those-leases:whlcn were executed before the 25th October, 1949 but we have to look to the provision of Section -16 of the Act which says' that all Mining Leases granted in the territory of Goa, Daman and Diu before the commencement of the Act therein shall, as soon as may' b:e after the commencement of this Act. be' brought in.to confor­mity with the provisions of this Act and the RuleS: made under Sections 13 and 18. The Act was applied to Goa from 1-10-63 hence aU the leases or Concessions which were granted before 1-10-1963 are to be brought into conformity with the provisions of the Act and the Rules. It would be significant to note that under Section 16 of the Act all the Mining Leases executed before- 1st October, 1963 are ~o be modified to bring them in conformity with the Act and Rules and there is no rider that only those Leases which were executed before the 25th October, 1949 are to be modified.

Section 3 of the Rules - provides for the appointment of a Controller of Mining Leases and that appointment has not been challenged. Once a controller of Mining Leases has· been appointed he derives his jurisdiction to modify the leases to bring them in conformity with the provisions of the Act and Rules. The main modifications which have been proposed are regarding the period of the lease, the royalty to be paid and the maXimum area permissible to one lessee. All these provisions are found in the Act itself. Section 8 provides for the period for which a lease can be granted. Section 9 fixes the royalty to be paid and Section 6 fixes the maximum area for which a mining lease can be granted.

The Rules only details the procedure which is to be fol­lowed in giving notice etc. and can never over-ride the specific provisions of the Act. Indeed if there is any con­tradiction between the provlsions of the Act and those of the Rules, then the provisions of the Act shall prevail. It is thus clear that once a Controller is appointed, he shall modify the Leases in conformity with the Act and Rules, and the mere fact that the «existing Mining Leases» have been defined to be leases granted prior to 25th October. 1949 does not bar the Controller to modify any lease granted up-to 30th September, 1963 to bring them in conformity with the Act. The position would have been different if the existing mining leases would have been defined as leases granted before the 25th October, 1949 in the Act itself.

For the aforesaid reasons, I hold that all the leases or Concessions granted before the 1st October, 1963 would be modified in accordance with the modifications proposed In

the Notices and the above mentioned Leases shall stand modified as follows:-

1) The period of the leases shall be 20 years commen­cing from 15th January, 1966 in all· the cases.

2) The dead rent shall be payable at the rate of Rs. 25/­per annum, from 15th January, 1966 in all the cases.

3} The royalty shall be payable in respect of any mineral removed by the Lessees from the leased area after 15-1-66 at the rate for the time being specified in the second Sched:uIe of the Mines and Minerals (Regulation and Development) Act; 1957 in respect of that mineral.

4) The lessee shall also pay, for the surface ar.ea used by him for the purpose of mining operations, sur­face rent and water rate at such rate, n'ot exceeding the land revenue, water and cesses assessable on the land, as may be specified by the State Govern­ment.

~5) The following' clause shall be deemed to be inserted in the lease deed and shall fonn part thereof; «Except for the modifications made by this order, the lease shall be subject to the rules made or deemed

<>to have been made under Sections 13 and 18 of the 'Mines and Minerals (Regulation and Development) Act, 1957 and orders and Notifications published by the Government of India, from time to time.

li: verdade que ao abrlgo das normas os «actuais arren­damentos mineiros» acham-se definidos como arrendamentos executados antes de 25 de Outubro de 1949 mas e neces­sario referir-se ao disposto no artigo 16.0 'do citado Act, que.: . diz ql}.e todo§: os arrendamentos mineiros Goncedidos no teri;it6rio da Dniao de Goa, Damao e Dio, antes da entrada em vigor do mesmo Act, deverao, logo ap6s a entrada em vigor do mesmo Act, ser trazidos de conformi­dade com as disposi~oes do mesrno Act e das normas for. muladas ao abrigo dos artigos·13.0 e 18.°. 0 Act foi tornado extensivo a Goa, a partir ·de·l de Outubro de 1963 e por isso, todos os arrendamentos ou concessees conCedtdOS antes de 1 de Outubro de 1963, deverao ser trazidos de con­formidade com as disposi~oes do citado Act e normas. Convem frisar que, ac;> abrigo do artigo 16.0 do mesmo Act, todos os arrendamentos mineiros executados antes de 1 de Outubro de. 1963, tern de ser modifiCados para que estejam de conformldade com 0 citado, Act e normas e em nenhuma parte esta previsto que s6rnente···. os arrendamentos execu­tados antes de 25 de Outubro de 1949 tem de ser modificados.

- 0 artigo 3.<> das citadas normas 'preve a nomea~ao dum controlador de arrendamentos mineiros e ninguem se opos a essa nomea~ao. Uma vez que tenha sido norneado, urn con­trol~d?r de arrendamntos rnineiros, e da sua jurisdi~ao modlflcar o~ arrendamentos a fim de que os mesmos estejam de conformldade com as disposi~oes do citado Act e normas. As principais modifica~5es que se propoe referem-se ,. ao perfodo do arrendamento, direitos de privilegio a serem pagos e a area maxima que se pode permitir a cada arren­datarto. Todas estas disposi~oes estao previstas no proprio Act. ~ artigo 8.° preve o· perfodo dUrante 0 qual pode ser concedido urn arrendamento. 0 artigo 9.0 fixa os direitos de privilegio a serem pagos e 0 artigo 6.<' fixa a area maxima que se pode atribuir a urn arrendamento mineiro.

As normas sornente indicam, em detalhe, 0 procedimento a seguir no respeitQlnte aos avisos a serem expedidos, etc. e jamais podem ir de encontro com as disposi~5es do Act. Supondo mesmO, que existe qualquer contradi~ao entre as disposi~oes do Act e as disposigoes das normas, as disposi­goes do Act prevalecerao. Fica assim claramente estabele­cido que uma vez que seja nomeado urn controlador de arrendamentos mlneiros, 0 mesmo podera modificar os arrendamentos de conformidade com 0 Act e iDormas, e 0 simples facto de que os «actuais arrendamentos minei­ros» que se acham definidos como arrendamentos conce­didos antes de 25 de Outubro de 1949, nao impede 0 con­trolador de modificar qualquer arrendamento concedido ate 30 de Setembro de 1963. a fim de que 0 mesmo possa pstar de conformidade com 0 Act. Q- caso teria sido diferente se os .«actuais arrendamentos mineiros» tivessem sido definidos como arrendamentos concedidos antes de 25 de Outubro de 1949, no pr6prio Act.

Pelas razoes acima expostas, sou do parecer que todos os arrendamentos ou concess5es concedidos antes de 1 de Outubro de' 1963, devem ser modiflcados de acordo Gom as modificag6es propostas nOs respectivos avisos e, por iSso. os arrendamentos acima mencionados sao modificados como a seguir se indica:-

1) 0 periodo do arrendamento sera de 20 anos, a partir de 15 de Janeiro de 1966, em todos os casos.

2) A 'renda ftxa devera ser paga a razao de Rps. 25/- por ano, desde '1-5 de Janeiro de 1966, em todos os cases.

3) Os direitos de priviIegio serao pagaveis em rela~ao a cada minerio extraido pelo arrendatario da area arren­dada, depois de 15 de Janeiro de 1966, na percentagem que presentemente se acha indicada na segunda ta­bela do «Mines and Mineral (Regulation and Develop­ment) Act, 1,957», em relagao a este minerio.

4) 0 arrendatario tambem pagara pela area superficial por ele utilizada para a exploragao da mina, a renda de superficle e a taxa de agua segundo a percentagem. nao excedendo a contribulgaO predial e outros impos· tos pagaveis pelo terreno, que vier- a ser indicada pelo Governo Estadual.

5) A seguinte clausula devera ser acrescentada no con­trato do arrendamento e ,devera considerar-se como sendo parte do mesmo: «Com excepgao das modifica­~oes feitas por esta -portarta, 0 arrendameIito fica sujeito as normas formuladas ou que se considerem formuladas ao abrigo dos artigos 13.0 e 18.0 -do «Mines ~nd Mineral (Regulation an.d Development) Act, 1957» e das portarias 'e de.spachos pubUcados pelo Governo cia India, periodicamente.

6) It is further clarified that the royalty, shall be paid in accordance with Section _9 of the Mines and Mine­rals (Regulation and Development) Act, 1957 instea1 of according to the stipulations in the lease deed. and secondly the Mining Lease (Modification of Terms) Rules 1956 (hereinafter called the 'Rules') defines the term 'existing mining Ie'ase' as those Mining Leases which were granted before the 25th day of October, 1949, hence the leases which were granted after' the 25th October, 1949 cannot be modified.

I have given my anxious and t;!areful consideration to' the above points, and. in my view, these contentions have got no force.

The first contention was that the Mines and Minerals (Regulation and Development) Act, 1957 (hereinafter called the 'Act') and the Rules do not apply to these cases as these persons are concessionaires and not lessees. In my view this contention has got no force, as we have to look to the pith and substance of the case and not to, the form or words which have been used under the Portuguese Law. The Act defines the Mining Lease and Mining operations as follows:

Section 3 (c): «mining lease» means a lease granted for the purpose of undertakin.g mining operations, and includes a sub-Ieaose g.ranted for such purpose.

Section 3 (d): «mining operations» means any operations undertaken for the purpose of winning any mineral.

These definitions are very wide and include any deed granted for mining operations and the mere fact that under the Portuguese Law they were called mining concessions instead of Mining Leases would not make any difference.

The concessionaires cannot deny that they are operating the Mines under the deeds called Concessions. It will be significant to note that under the Portuguese Colonial Mining Laws, Mining Concession was defined in almost similar man­ner and gave the power to the concessionaires to operate the mines.

The relevant definitions read as fonows:-

Section I (u): «mining concession» is that which is granted to the manifestor and permits him to explore a mining pro­perty and to enjoy thereon all mining rights. It is unlimited in duration as long as the concessionaire complies with the conditions which the law and the title of concession lmposed on him.

Section I (v): «TiUe of Concession»; A d.ocument legally establishing a concession.

Article 2 says that the proprietorship of deposits of metalS and metaliferous minerals, belongs to the State and such beds cannot be prospected or worked without licence and concession by Government in terms of the present Decree.

Article 9 is very significant to note because it used the word 'Concessionaires or Lessees' of mines. It shows that even under the Portuguese Law concessionaires and Lessees were synonymous.

Article 14 says that the concession of an ore does not imply possession of the surface of the ground in which it is found, but involves for the Concessionaires and the pro­prietor of the ground certain rights and rec!procal obligations in accordance with the terms of law.

Articles 42, 73 and 91 prescribe the tax etc. which are to be paid by the Concessionaires.

These provisions of the Portuguese Col(;mial Mining Law clearly. show that the concesSionaires and Lessees are the same and the difference was only of nomenclature. "

I accordingly hOld that the Concessions are in essence Leases and as such they can be modified under the Act and Rules.

The second and last point which was urged before me was that according to the Rules the existing mining leases mean a lease executed before the 25th October, 1949 hence the leases or concessions which were executed after the 25th October, 1949 cannot be modified. In my view this contention has also got no force.

n is true that under the Rules 'existing Mining Leases' have been defined as those leases "which were executed before the 25th October, 1949 but we have to look to the provisions

Tendo apreciado, cuidadosamente, as alegagoes acima feitas, sou do parecer que as mesmas nao tern forga de lei.

A primeira alegagao e de que 0 «Mines' and Minerals (Regulation and Development Act», 1957 (referido daqui em diante como «citado Act») e as normas formuladas ao abrigo do mesmo, nao tinham aplicagao aos casos vertentes porque as partes interessadas eram concessionarios e nao arrendatarios. No meu parecer esta alega.gao nuo tern forga de lei, porque 0 presente caso tern de ser encarado a fundo e nao simplesmente baseado na forma ou palavras empre­gadas peia lei portuguesa.·O citado Act define 0 arrenda­mento e exploragao de minas como a seguir se indica:

Artigo 3 (c) «arrendamento mineiro» significa um arren· damento concedido para os fins de se fazer exploragoes mineiras e inclue um sUb-arrendamento concedido para 0 mcsmo fim.

Artigo 3.0 (d) «explorag6es mineiras» significa quaisquer explorag6es feitas para os fins da extracgao de qualquer minerio.

Estas definigoes acima mencionadas sao bastante amplas e incluem qualquer titulo concedido para a exploragao de minas e 0 simples facto de que ao abrigo da lei portuguesa os rnesmos eram chamados «concessoes de minas» em vez de «arrendamentos de minas» nao deve fazer nenhuma diferenga.

Os concessionarios nao podem negar que exploram as minas ao abrigo dos titulos chamados concess6es. li: de toda a significancia notal' que ao abrigo da Lei Colonial Portuguesa, uma concessao mineira achava-se definida de maneira quase identica e c6ncedia poderes aos concessio­narios para explorarem as minas.

Sao seguintes as defini!::oes:-

Artigo I (u): «concessao mineira» e aquela que e dada ao manifestante e Ihe permite explorar uma propriedade mineira e exercer sobre ela todos os "direitos minetros. Tem duragao ilimitada, enquanto 0 conceSSionario cumprir as condigoes que a l~ e b titulo de concessao !he hnpuseram.

Artigo I (v): «Titulo de concessao» - Documento que prova legalmente a conce.ssao.

o artigo 2.° diz que a propriedade dos dep6sitos de metais e minerios metalicos pertencente ao Estado e os respectivos

,jazigos nao poderao ser pesquisados nem lavrados sem licenga e concessao do Governo, nos termos da presente lei.

o artigo 9.° e de toda a convenN~ncia friBar, porque emprega a expressao «concessional~ios ou arrendatarios» de minas. Isto demonstra que mesmo, ao abrigo da lei portuguesa os tcrmos concessionarios e arrendatarios eram sin6nimos.

~ artigo 14." diz que a concessao de urn jazigo mineiro nao implica a posse da superficie do terreno em que ele se encontra, mas envolve para 0" concessional'io e para 0

proprietario do solo, direitos e obriga~6es reciprocas, em harmonia com as disposigoes que foram legalmente estabe­lecidas.

Os artigos 42.0 , 73.° e 91.° fixam as taxas a serem pagas pelos concessionarios.

Estas disposigoes da Lei Colonial Portuguesa, acima citadas claramente demonstram que os concessionarios e arreno.atario~ eram a mesma coisa e que a diferenga era apenas de nomen­clatura.

Eu, de conformidade, entendo que as concessoes sao na sua essencia, arrenuamentos e, POl' isso podem ser modificadas ao abrigo das existentes leis e normas.

A segunda e ultima alegagao feita e, que de harmonia com as normas, a expressao «actuais arrendamentos minei­rOs» signifiea os arrendamentos executados antes de 25 de Outubro de 1949, e que pOl' isso, os arrendamentos execu­tados depois "de 25 de Outubro de 1949, nao podiam ser modificados. No meu parecer esta a1ega~ao. tambem, nao tern forga de lei.

of Section 16 of the Act which says that all Mining Leases ~ante4 in the territory of Goa, Da.man and Diu befpre the commencement of the Act therein shall as soon as may be after the commencement of this Act, be brought into confor~ mtty with the provisions of this Act and the Rules made under Sections 13 and 18. The Act was applied to Goa from 1-10-63 hence all the leases or Concessions which were granted before 1-10-1963 are to be brought into conformity with the provisions of the Act and the Rules. It would be significant to note that under Section 16 of the Act all the Mining Leases executed before 1st October, 1963 are to be modified to bring them in conformity with the Act and Rules and there is no rider that only those leases which were executed before the 25th October, 1949 are to be modified.

Section 3 of the Rules provides for the appointment of a Controller of Mining Leases and that appointment has not been challenged. Once a controller of Mining Leases has been appointed he derives his jurisdiction to modify the lease to bring them in conformity with the provisions of the Act and Rules. The main modifications which have been proposed are regarding the period of the' lease, the royalty to be paid and the maximum area permissible to one Lessee. All these provisions' a.re found in the Act itself. Section 8 provides for the period for which a lease can be granted. Section 9 fixes the royalty to be paid and Section 6 fixes the maximum area for which a mining leases can be granted.

The Rules only details the procedure which is to be fol­lowed in giving notice etc. and can never over-ride the specific provisions of the' Act, Indeed if there is any con­tradiction between the provisions of the Act and those of the Rules, then the provisions of the Act shall prevail. It is thus clear that once a Controller is appointed, he shall modify the Leases in conformity with the Act and Rules, and the mere fact that the «existing Mining Leases» have been defined to be leases granted prior to 25th October, 1949 does not bar the Controller to modify any lease granted up-to 30th September, 1963 to bring them in conformity with the Act._ The position would have been different if the «existing mining leases» would have been- defined as leases granted before the 25th October, 1949 in the Act itself.

For the aforesaid reasons, I hold that all the leases or concessions granted before the 1st October, 19-63 would be modified in accordance with the modifications proposed in the Notices and the above mentioned Leases shall stand modified as follows;-

1) The period of tlle leases shall be 20 years COmmen­cing from 15th Janu~ry, 1966 in all the cases. , -

2) The dead. rent shall be payable at the rate of Rs. 25/­per annum from 15th Januao:y -1966, in all the cases.

3) The royalty shall be payable in respect of any mineral removed by the Lessees from the leased area after 15-1-66 at the rate for the time- being specif.i.ed in the second Schedule of the Mines and Minerals (Regulation and Development) Act, 11957 in re~pect of that mineral.

4:) The lessee shall also pay, for the surface area used by him for the purpose of mining operations, sur­face rent and water rate at such rate, not e~ceeding the lap.d revenue, water and cesses assessable on the l~d, as. m.ay be- specified by the State Govern­ment.

SariO referir-se ao disposto no arUgo 16.° do citado A,ct. qu~ diz que todos os arrendamentos mineiros concedidos no territ6rio da Uniao de Goa, Damao e Dio, antes da entrada em vigor do mesmo -Act, deverao, logo ap6'S a entrada em vigor do mesmo Act, ser trazidos de conformi­dade com as: disposig5es d,o meS~Q Act e das normas for­muladas ao abrigo dos artigos 13.0 e 18.°. 0 Act foi tornado extensivo a Goa, a partir de 1 de Outubro de 1,963 e, por isso, todos os arrendamentos ou concess5es concedidos aJ;ltes de 1 de Outubro de 1961:>, deverao ser trazidos de con­formidade com as disposigoes do citado Act e norm as. Convem frisar que, ao abrigo do artigo 16,0 do mesmo Act, todos os arrendamentos mineiros executados antes de 1 de Outubro de 1·963, t(;m de ser modificados para que estejam de conformidade com 0 citado Act e normas e em nenhuma parte esta previsto que somente os arrendatarios execu­tados antes de 25 de Outubro 'de 1949 tem de ser modificados.

o artigo 3.° das citadas normas preve a nomeagao dum controlador de arrendamentos mineiros e ninguem se opos a essa nomeagao. Uma vez que tenha sido nomeado um COD­trolador de arrendamentos mineiros, e da sua jurisdigao modificar os arrendamentos a fim de que os mesmos estejam de conformidade com as disposigoes do citado Act e normas, As principais modificagoes que se propoe referem-se ao perfodo do arrendamento, direitos de privilegio a serem pagos e a area maxima que se pode permitir a cada arren­datario. Todas estas disposigoes estao previstas no proprio Act. 0 artigo 8.° prey€! 0 periodo "durante 0 qual pode ser concedido Urn arrendamento. 0 artigo 9.° fixa os direitos de privilegio a serem pagos e 0 artigo 6.° fixa a area maxima q.ue se pode atribuir a urn arrendamento mineiro.

As Dormas somente indicam, em detalhe, 0 procedimento a seguir no respeitante aos avlsos a serem expedidos etc. e jamais podem ir de encontro com as disposigoes do Act. Supondo mesmo, que existe qualquer contradigao entre as disposigoes do Act e as disposigoes das normas, as disposi­goes do Act prevalecerao. Fica assim claramente estabele­cido que uma vez que seja nomeado urn controlador de arrendamentos mineiros~ () mesmo podera modi-ficar os arren-

I damentos de couformida-de com 0 Act e nOl'mas, e 0 simples facto de que os «actuais arrendamentos mineiros» que se acham deHnidos como arrendamentos concedidos antes de 25 de Outubro de 1949, nao impede 0 controlador modificar qualquer arrendamento concedido ate 30 de Setembro de 19B3, a fim de que 0 mesmo possa estar de conformidade com 0 Act. 0 caso teria sido diferente se os «actuais arrendamentos mineiros» tivessem sido definidos como arrendamentos concedidos antes de 2.5 de Outubro de 1949, no' proprio Act.

Pelas raz5es acima expostas, sou do parecer que todos os arrendamentos ou concess5es concedidos' antes de 1 de Outubro de L963 j devem ser modificados de acordo com as modificagoes propostas nos respectivos avisos e, por isso, os arrendamentos acima mencionados sao modificados como a seguir se indica:-

1) 0 periodo do arrendamento sera de 20 anos, a partir de 15 de Janeiro de 1966, em todos os casos,

2) ~ renda fixa devera ser paga a razao de Rps. 25/­por ano, desde ·15 de Janeiro de 1966, em todos os casos.

3) Os direitos de privilegio serao pagaveis em relagao a cada minerio extraido pelo arrendatario da area arren­dada, depois de 15 de Janeiro de 1966, na percentagem que presentemente se acha indicada na segunda tabe~a do «Mines and Mineral (Regulation and Development) Act, 1957», em relagao a este minerio.

4) 0 arrendatario tambem pagara pela area superficial por ele utilizada para a exploragao da mina, a renda de superficie e a taxa de agua segundo a percentagem. naO excedendo a contribuigao predial e outros im­postos pagaveis pelo terreno, que vier a ser indicada pelo Governo Estadual.

On the recommendation of the Union Public Service Com­mission Dr. F. M. Rebello is temporarily apPointed to' the post of Lecturer ~ in Obstetrics and Gynaecology in the Goa Medical College carrying the scale of pay' Rs. 530-30-650 with effect from 21-3-1969. His initial ,pay in the scale is hereby fixed as shown below:

The Union Public Service Commission have recommended that Dr. ~. M. Rebello may be given the initial'''l'pay of Rs. '620/- p. rn. (Rupees six hundred and twenty only) or according to rules whichever is higher in the scale of Rs. 530--aO-650. His initial pay is accordingly fixed at Rs. 620/­(Rupees six hundred and twenty only) p. m. £rom 21-3-1969. The next increment will accrue in the scale on 10-3-1970.

The above pay fixation is made in exercise of the powers under F. R. 27 and is in accordance with the instructions contained in the Government of India, Ministry of Finance" Department of Expenditure Office Memorandum No. F.2(36)­-E. III (A)/60 (Pt.
