Whereas by Government Notification No. PWD/LA/48/68 ·dated 11-11-68, published' on page 284-85 of, Series II, No. 34 of the Government_ Gazette, dated 21-11-'68 read with corri­gendum No; PWD/LA/12/69 dated 18-2-69 published in the Government Gazette No. 49, -Series n, dated 6-3-69, it was notified under section' 4 of the Land Acquisition Act, 1894-(hereinafter referred to as the «said Act») that the land, specified in the schedule appended to the said Notification (hereinafter referred to as the «said land») was likely to be needed for a public purpes viz. for widening of Utorda-Betal­batim road.

And whereas the Appropriate 'Government (hereinafter referred to as the Governmenb» is satisfied that the said land specified in the Schedule hereto is needed to be acquired for the public purpose specified above.

Now, therefore, the Government is pleased to declare under the provisions of Section 6 of the said Act that the . said land is required for the public purpose specified above.

2. The Government is also pleased to appoirit under -clause (c) of Section 3 of the said Act, the Deputy Collector. ,South Sub-DiviSion. Margao' to 'perfonn the -functions of a

Whereas it appears to the Appropriate Government (herein­after referred to as the «Government») that the land speci. fied in the schedule hereto (hereinafter referred to as the «said land») is likely to be needed for a public purpose viz. (widentng and reconstruction of culvert near Ponda Market between Kms. 29/2 to 29/4 on Ponda-Anmod Road).

Therefore the Government is pleased to notify under sub-­-section (1) of section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as the «said Act») . that the said land is Ukely to be needed for the purpose specified above.

2. All p·ersons interested in the said land are hereby warned not to obstruct or interfere with any surveyor or other persons employed upon the said land for the purpose of the said acquisition.. Any contracts for the disposal of the said land by sale, lease, mortgage, asSignment, eXChange or otherwise, or any outlay, commenced or impro­vements made thereon without the sanction of the Collector, appOinted in paragraph 4 below, after the date of the publica­tion of this Notification, will 'under clause (seventh) of sec~ tion 24 of the said Act, be disregarded by him while assessing compensation for such parts of the said land as may be fJnally acquired. ~

3. If the Government is satisfied that the said land is needed for the aforesaid purpose, a declaration to that effect under section 6 of the said Act will be published in the Go­vernment Gazette, in due course. ,If the acquisition is abandoned wholly or in part, the fact will be notified.

4. The Government is fUrther pleased to appoint under clause (c) of section '3 ()f the said Act the Land, Acquisition Officer, Panaji to perform the functions of a Collector under the said Act, in respect of the said land.

And whereas the, appropriate Government (hereinafter re­fel'redto as «the Government»_) is satisfied after considering the report made under sub-section-'(2) 'of Section 5A' of the said Act, that the saId land specified in the s~edule hereto ·is needed to be acquired for the public purpose specified above.

-Termi' and condmons for Chief Executive Officer, Goa. Daman & D,iu IndustriaJ Dev.e·lopment Corporation

Bhri R. P. Wagh, Assistant Director of Industries, Govern­ment of Maharashtra -en deputation to the post of Chief Executive Officer to the lndtistrial Development Corporation

.. shall be on the following terms and conditlOns:-

1. Pay: He will be entitled to draw his substantive pay as Assistant Director '.of Industries pluS 20% thereof as deputation (duty) allowance in terms of G. I. Ministry .of, Finance (Department of Expenditure) O. M. No. F.I0(24)-E-lli/uO dated 4th May 1961, subject to the condition that the basic pay plus the deputation (duty) allowance does' not exceed the maximum of the scale of the post under the Corpora­tion; plus Dearness allowance admissible under the rules of the Central Government. plus usual local allowances as admissible under the rules of the- Central Government.

2. Contribution on account of leave salary and pension will be paid by the Corporation at" the following rates within_15 days from the end of the month in which the pay on which it is ,based has been drawn by ShTi R. P. Wagh.

3. T. A. & D. A. sa admissible under the rules of the Corporation.

_ 4., Medical .attendance and treatment: Not inferior to that admissible to an officer of his !Status under the Central Government Rules.

6. Leave: He will remain subject to the Leave Rules applicable to the service of which he is a member.

6. Pay during joining time both on transfer to the Corporation and reversion therefrom to be regulated under the Rules of Central Government and paid by the Corporation. period of joining time being regu­lated under the same rules.

, >", . 10. If residential accommodation is provided by the Cor­

poration Shri ~. P. Wagh will be liable to pay rent as per rules framed by the Corporation for this purpose for its employees but the amount of rent shall not exceed 10% of 11:is emolwnents as defined in F. R. 45-C - or the standard rent calculated under F. R." 45-A whichever is less.

.1.1. If Shri R. P. Wagh oC,cupies accommodation provided· by the Government, the Corporation will charge from the Officer rent limited to 5% of -his basic pay and then pay rent to the Government according to the rules and orders issued by the Government from time to time.

12. The fqreign service will .commence from the date Shri R. P. Wagh makes over ch~rge and end on the date he takes over charge of his post under the Goa Administration.

13. Shri R. P. Wagh wili be" entitled to leave travel concession from the Corporation on the scale he is entitled to under the Central Govennment Rules and the cost of such concession will be borne by the' Corporation.

14. Shri R. P. Wagh will be entitled to an. advance of leave salary as admissible under the :rules of the' Central G'overnment. Shri R. P. Wagh will be" go-. verned under the above terms and conditions.

6. 0 venciniento ao entr.ar no exercicio das fungoes tanto na altura da transfer.snCia para a Corporagao' e r~versao para a mesma, serao regulados segundo as normas do Governo Central e pago pela Corpora­gao, devendo 0 periodo de entrada no exercicio das fungoes ser regulado ao abrigo das referidas normas.

1. 0 subsidio de deslocacao tanto na altura da trans­ferencia para a Corporagao e reversao para a mesma, serao regulados segundo as normas da Corporagao e pago pela Corporagao.

8. A Corporag~o ficara sujeita ao pagamento do venci"7 mento de licenga na hip6tese de, qualquer acidente sofrido por -motivo e durante 9 periodo de servigo em deputagao, mesmo quando esse ~cidente tenha sido sofrido ap6s a termina!}ao do servigo em depu­tagao.

9. A Corporacao ficara sujeita ao pagamento de qualquer gratificacao on pensao. que for admissivel ao abrigo dos «Central Civil Services (Extraordinary Pension) Rules» ou pensao extraordinaria admissivel ao abJ;'igo dos «C. S. Rules» na hip6tese de qualquer dane OU morte, iaso OCOlU'er durante 0 periodo de servu;o em deputagao.

10. Se a Corporagao fornecer acomodagao residencial, o Sr. R. P. Wagh, tera, de pagar' a renda segundo as normaS formuladas a esse respeito pela Corpo­ra~ao, para os seus empregados, mas 0 montante da renda nao devera exceder 10% dos seus emolwn~ntos conforme se acham definidos no F. R. 45-C ou a renda devera ser calculada ao abrigo do F. ~. i5-A.., 0 que for menos.· ,

11,' Se 0 Sr. R. P. Wagh, ocupar acomoda,gaQ fQrnecida pelo Governo, a Corporagao cobrara do mesmo a renda at~ ao limite de 5% do 'seu venGirn,entQ~base, e pagara. a mesma ao Governo, de acordo com as riormas for­'muladas pelo Governo, periodicamente.
