RESOLUTION 16-13
WHEREAS: Minnesota Statute 117.226 provides for the sale of excess property purchased for right of way purposes to the former owner of the land for the original purchase price; and
WHEREAS: Stearns County purchased parcel 98.60575.0095 from Margaret Hartneck for the construction of an interchange at the intersection of CSAH 84/Trunk Highway 15, (SAP 073-684-004); and
WHEREAS: a portion of the original property is no longer needed for permanent right of way; and
WHEREAS: the former property owner has chosen to purchase said property in accordance with Minnesota Statute 117.226; and
WHEREAS: the purchase value of the remnant has been determined to be $106,648.75 based on the original appraisal.
NOW, THEREFORE, BE IT RESOLVED: That the Stearns County Board of Commissioners hereby authorizes the sale of the property described in Exhibits A and B of the Purchase Agreement signed by the buyer and the Stearns County Engineer attached to this resolution.
BE IT FURTHER RESOLVED: That the Stearns County Board of Commissioners approves all conditions set forth in the attached Purchase Agreement.

Environmental ServicesPresentation by Chelle Benson, Environmental Services Director, re: consideration of:

Approve as recommended by the Stearns County Planning Commission an after-the-fact Conditional Use Permit application for a Major Shoreland Alteration submitted by Christopher Prior of Richmond MN, according to the requirements of Sections 4.15.2., and 10.2.14 D. of Stearns County Land Use and Zoning Ordinance #439 to keep as placed, fill and graded material that was moved without a permit. The property under consideration is located at 19427 226th Street, Richmond, MN 56368 on 3.26 of Government Lot 1 in Section 24, T123N, R31W, Munson Township.
The following conditions apply:A. All disturbed areas that have been seeded with oats shall be
snow-mulched by February 15, 2016.B. Payment of the remainder of the after-the-fact fee ($495) prior
to the February 2, 2016 County Board Meeting or addition ofthis amount to the property taxes.
The following Findings of Fact apply:A. The alteration was done to improve aesthetics for future accessory
structure construction.B. The applicant felt he did not need a permit for the work performed.C. No other permits were required for the project.D. The alteration did not occur in a sensitive area.E. The alteration is not visible from a public water.F. The alteration did not affect the character of the neighborhood
as it was previously there from work that took place in the past.G. The alteration did not reduce or eliminate an existing buffer
between the area and the Ordinary High Water Level or createa more direct conduit for stormwater flow to public waters.
H. The alteration did not change the aesthetics of the shore asviewed from the public water, it did not change the character of the neighborhood or shoreline, it did not lessen the vegetativebuffer, a silt fence is in place between the work area and thewetland, there is not a stormwater device or system, it did notimpact fish or wildlife habitat and did not impact water quality.
I. The applicant cannot mitigate the change without restoring the site, restoration to pre-altered conditions would be difficultand would pose more risk by restoring.

The property under consideration is located at 33739 County Road 32, Belgrade MN 56312 in the NW1/4NE1/4 of T123N R33W in Section 10 in Lake Henry Township.
The following conditions apply:1. The applicant shall contact the Environmental Services Department within
three days of construction completion so a post construction inspection may be completed.
2. The applicant shall schedule a pre-construction conference with the Environmental Services Department, design engineer, excavators andcontractors one week prior to starting construction.
The following Findings of Fact apply:A. The proposal is consistent with Sections 4.4, 4.8, 4.14, 6.7
and 9.2 of Ordinance #439.B. There are no EAW, EIS or SDS permits required.C. The proposed use is consistent with these sections of the Stearns County

WHEREAS, Minnesota Statutes, Chapter 400, authorizes the County to conduct solid waste management programs; and
WHEREAS, Minnesota Statutes, Section 375.18, authorizes the County Board to be the Solid Waste Authority within the County; and
WHEREAS, Minnesota Statutes, Section 145A.05, Subdivision 4, provides that a County Board may adopt ordinances to provide for or regulate the disposal of sewage, garbage, and other refuse; and
WHEREAS, the Stearns County Board of Commissioners is responsible to ensure that all solid waste generated in Stearns County is disposed of in a manner that protects the state’s air, water, and land resources so as to promote the health, welfare, and safety of its residents; and

WHEREAS, the Stearns County Board of Commissioners has adopted Ordinance 193, the Stearns County Public Solid Waste Service Ordinance; and
WHEREAS, Section 4.4 of Ordinance 193 prohibits the unauthorized accumulation or deposit of solid waste in the County; and
WHEREAS, the Director of Environmental Services may in writing require the owners of property to remove any unauthorized accumulation or deposit of solid waste with specified time; and
WHEREAS, the Director of Environmental Services did serve on December 21, 2015 to Eric J. Kohorst of 21692 Deep Lake Road, Richmond a letter of Unauthorized Accumulation or Deposit of Solid Waste giving Mr. Kohorst ten (10) days to remove the solid waste from the property; and
WHEREAS, Mr. Eric J. Kohorst has not complied with the notice to abate the unauthorized accumulation or deposit of solid waste at the property.
NOW, THEREFORE, BE IT RESOLVED, that, in accordance with Stearns County Ordinance 193 Section 4.4 the Stearns County Board of Commissioners grants the Director of Environmental Services authority to provide for the removal of the unauthorized accumulation or deposit of solid waste.

1. A public hearing was held to review a Rezoning Application submitted by Rod Gertken, Richmond, MN on behalf of Sauk River Hog Farm Inc., Montevideo, MN to rezone approximately 50 acres from the Agricultural 40 Zoning District to the Residential 1 Zoning District in accordance with Section 4.10 of Stearns County Land Use and Zoning Ordinance No. 439. The property under consideration is part of the SE1/4SE1/4 in Section 19, part of the E1/2 NE1/4 and part of the NE1/4SE1/4 in Section 30, lying southwesterly of Frostview Road, easterly of Fortress Road and northerly of Zumwalde Lake in Wakefield Township (123/30). Chair Notch opened the public hearing. Virgil Plath, Cold Spring MN, who lives on Frostview Road spoke of his traffic concerns on this road if request is granted; Katy Kirchner, Cold Spring MN, stated her concern of having a residential development in this area and what a drastic rezoning change this would be; Rachel Schaefer, who owns 20 acres along property requested to be rezoned, stated she bought her property to raise her horses and fears that if request is granted, she

will be forced to give up her horses when development is built; Todd Schaefer, co-owner if property with Rachel Schaefer, stated he opposes the rezoning request and is concerned about the amount of traffic this would bring to Fortress Road; Dan Lang, Richmond MN, stated if rezoning request is approved, he will be back with a request to rezone his acreage also zoned as agriculture; Denis Mehr, who recently purchased 6 acres on Frostview Road, stated he purchased his property to be in the country and is concerned because the roads in this area are not adequate for the amount of traffic this development would bring; Troy Hennen, who also lives on Frostview Road, also stated he purchased his property to be in the country and is concerned about the amount of traffic this request would bring; Katy Kirchner spoke again stating she holds the easement for access to the other 3 properties on this road and does not allow for more access; John Lang stated this is an agricultural area and his major concern is the complaint of odors from people who would move into this area; Rod and Lois Gertken, who submitted the rezoning application, stated the easement would no longer be necessary to access property because a road would be built for new residents and they also stated their rezoning request is not suitable for 50 homes that area residents are concerned about; Brian from Jennings Well Drilling, stated that water samples have been taken and sent to a lab to be tested. Chair Notch closed said public hearing. The property is located in part of the SW1/4 in Section 13, lying easterly of Dutch Avenue and westerly of County Road 9 in Munson Township (123/31). Chair Notch opened the public hearing. Ruppe, attorney for Munson Township, stated this request is for a lease of the land for 20 years at which time property could be developed and not impact future growth; Brian Gertken, son of Gerald Gertken, stated there is no room for the City of Richmond to expand if this request is granted; Jim Hemmesch, Mayor of Richmond, stated the best area for the city to grow is to the north where the proposed solar garden would be located; Pat Evens, Richmond City Councilman, spoke of his opposition due to the negative impact it would have to property values in Richmond and prevent future growth of the city; Tim Paczkowski, Richmond City Councilman, clarified that he stated they have a verbal agreement for a comprehensive plan with the township and not a verbal annexation agreement; Leroy Gondringer, Stearns County Planning Commission, stated his biggest concern is if the proposed solar garden was a good fit for this area; Ken Stang, Richmond MN, stated his concern for how fast this proposal is happening and questions if this could bring any health issues; Ann Brady-Kronen, member of the Gerald Gertken family, stated this request should not be put in a residential area and it will affect the entire community. I am writing to propose changing a .75 FTE position to a 1.00 FTE in the Administration License Center.
The .75 FTE position is currently vacant. A recent law change requiring the addition of insurance
information to license tab renewals and title transfers has resulted in more staff time needed to
complete these transactions. See below for transaction time details. The additional .25 FTE will be paid
for by wage and benefit savings from another current Administration License Center employee who is
going on maternity leave.
How our transaction times have been affected by the new law:
The new insurance requirement has increased transaction times an average of 1.5 minutes per
transaction. One result of this is longer customer wait times.
January transactions were 1,949 X 1.5 minutes/transaction = 49 additional hours for the month.
January is a slow month and this number can be expected to increase as we approach summer. We are
reviewing our procedures to see if we can shorten transaction time.
Proposed Increase of .75 FTE to 1.00 FTE
Hoffman maternity LOA 12 weeks savings = $8,406
Cost of changing .75 FTE to 1.00 FTE = $7,126
Net Savings = $1,280
In addition, the position was vacated at the top step of $22.74, and a new hire will come in at the
bottom step of $15.49. Even though the position is changed from .75 FTE to 1.00 FTE, there still are
$3,000 plus in savings from the wage differential.

RESOLUTION AFFIRMING THE COUNTY ADMINISTRATOR PLAN OF
GOVERNMENT
WHEREAS, Stearns County currently operates under the County Administrator plan of
government; and
WHEREAS, Stearns County has operated under this plan for the past twenty-five plus years;
and
WHEREAS, Stearns County wishes to reaffirm the designation of the County Administrator
plan of government pursuant to Minnesota Statutes, Section 375A.01.
NOW, THEREFORE, the Stearns County Board of Commissioners, after examining the
different models of county government as provided by Minnesota State Statutes, resolves as
follows:
1) Pursuant to Minnesota Statutes Section 375A.06, the selection and establishment of the office
of Stearns County Administrator is hereby reaffirmed with the following objective:
The County Administrator manages and oversees the administration and coordination of
County services in accordance with County Board ordinances, regulations, resolutions,
policies and state laws. The Administrator will accomplish the fulfillment of state law
and County policies within established budget parameters. The Administrator shall serve
as the chief administrative officer of the County per Minnesota Statutes 375A.06, and
thus is responsible for the overall operation of County government under general
direction of the County Board.
2) All duties and responsibilities are hereby assigned to the office of County Administrator, as
well as the following summary of duties:
a. Shall exercise general supervision over all county institutions and agencies and,
with the approval of the County Board, coordinate the various activities of the County
and unify the management of its affairs.
b. If required by the County Board, the Administrator may act as the head of any
department, the appointment of which is made by the County Board, provided the
Administrator has the qualifications required by law.
c. Hire qualified staff to assist the Administrator in the performance of duties as
approved by the Board;
d. Provide for the execution of all ordinances, resolutions and orders of the Board
and all laws of the state required to be enforced through the County Board, by the
Administrator or by officers who are under the Administrator's direction and supervision;
e. Appoint, suspend, and remove with the approval of the County Board all County
personnel whose appointment, suspension or removal is a function of the County Board
under general law and make such appointments with the approval of the County Board to

additional offices, boards, committees and commissions both advisory and otherwise as
the County Board may direct;
f. Provide for County purchases including purchases of service as directed by the
County Board and pursuant to purchasing regulations established by the Board;
g. Prepare and submit to the County Board a proposed annual budget and long-
range capital expenditure program for such period as the County Board may direct, each
of which shall include detailed estimates of revenue and expenditures and enforce the
provisions of the budget when adopted by the County Board;
h. Attend all meetings of the County Board and recommend measures for adoption
as the Administrator deems advisable or expedient;
i. Examine the books and papers of officers and departments of the County as
directed by the County Board and report the findings to the County Board, keep the
County Board fully advised as to the financial condition and needs of the County and
make such other reports from time to time as required by the Board or the Administrator
deems advisable.
j. Carry out day-to-day administrative functions of the County.
k. Manage the office of County Administration, including preparation for official
Board proceedings.
l. Provide the County Board with appropriate data and information concerning
current or future County programs and services, goals, policies and procedures.
m. Evaluate, on a continuing basis, the services provided by County departments
and recommends changes in policy and procedure.
o. Perform other duties and exercises other responsibilities as may be necessary and
appropriate, or directed by the County Board.

County continues to be responsible for infrastructure needs, Americans with Disabilities Act
(ADA) requirements and security. The County is also responsible for providing "suitable space"
for court operations which includes facility upgrades, remodeling, or potential new construction.
Budgeted funds from the County's Capital Improvement Plan are available to fund the project's
$175,000 estimated cost.

The Stearns County Parks Department is seeking grant funding to assist with the purchase of a
dual turbine tow-behind leaf and debris blower. This blower will be used on the Lake Wobegon,
Dairyland, and Beaver Island Trails, as well as on the trails within the County's Parks. The dual
turbine leaf and debris blower will increase staff efficiency because they will only have to travel
the length of any given trail once in comparison to the single turbine debris blower that requires
the Parks Staff to travel the trails twice in order to get them clear of debris. Thus, if the grant is
received, the addition of the dual turbine blower will increase staff efficiency.
The MN DNR Federal Recreation Trail Equipment Grant request will be for $13,000. There is a
25% ($3,250) hard match requirement in which these funds will be incorporated/taken from the
Park Departments 2017 budget.

To consider a one (1) lot plat entitled “Ruff Country Acres” Submitted by Justin & Deonna
Bouska, Clearwater MN according to Stearns County Subdivision Ordinance No. 230 and Land
Use and Zoning Ordinance No. 439. The property is zoned Residential 10 (R-10). The 10.1
Acre plat is located in part of the W1/2SE1/4SW1/4, Section 9, lying northerly of County Road
46, Lynden Township (122/27).
Lynden Township approved the preliminary plat on November 12, 2015 and the final plat on
February 1, 2016.
The Department reviewed the preliminary plat on December 21, 2015 and recommended
approval with the following conditions:
. A Declaration of Restriction will be required stating, in order to protect the two soil
treatment areas on each lot for sewage treatment use, they shall be maintained in an
undisturbed and natural state.
. A Subdivision Agreement will be required stating the following:
a. Construction site best management practices (BMPs) shall be required during
construction of any new structures in accordance with Section 7.10 of Stearns
County Land Use and Zoning Ordinance 439, or successor Ordinance.
b. In order to protect them for sewage treatment use, the two soil treatment areas on
each lot, as designated on the preliminary plat, shall be staked and roped off prior
to any ground disturbing activity on each lot.
c. The soil borings indicate there are redoximorphic features within 6 feet of the
natural ground surface. Therefore, the bottom floor elevation for a residential

dwelling within the plat of Ruff Country Acres shall be restricted to 1 foot above
the ground water table or redoximorphic features or as an alternative, the
installation of an engineered groundwater drainage system that adheres to a plan
developed by an engineer licensed in the State of Minnesota or an equivalent will
be allowed as approved by the Director.
d. The proposed driveway will impact wetland. The driveway will avoid Type 3
wetland. The maximum width of the driveway (including side slopes) can be 26ft
and still meet the deminimus requirements for a Type 2/6/7 wetland (impacting
2000sqft or less).
e. According to the Stearns County Geologic Atlas, there are very high groundwater
sensitivity features on the plat. Precautions should be taken to avoid groundwater
impacts for on-site well(s) or offsite groundwater resources.
f. The plat of Ruff Country Acres is located in an agricultural area and the
construction, expansion, and operation of animal feedlots and other agricultural
uses are permitted in this area. The Developers, therefore, acknowledge that
future buyers may be exposed to the sights, sounds, smells, and conditions of
modern agriculture.
. A Highway Certificate is required to be recorded with the comments from the County
Highway Department.
. An ingress/egress easement is required to provide access across the platted lot to the
residual parcel.
. Water Supply Verification is required to be recorded with the final plat (acceptable
water test results for nitrates shall be taken and completed by a laboratory certified by the
Minnesota Department of Health. Water test results can be from within the plat boundary
or from a well within 300 feet of the plat boundary).
. A title opinion or title commitment (less than 30 days old) shall be submitted to the
County Surveyor’s office.
. A $250 park dedication fee is required.
. The plat approval is contingent upon the rezoning to R-10 being approved.

RESOLUTION ADOPTING FINDINGS OF FACT FOR THE PROPOSED SOLAR FARM SUBMITTED BY SUNDEDISON LLC ON BEHALF OF
MARVIN AND SANDRA RAMLER
WHEREAS, the Stearns County Planning Commission conducted a public hearing on the proposed conditional use permit on December 17, 2015, and adopted a motion recommending denial of the proposed solar farm to the Stearns County Board of Commissioners by a 6-1 vote; and WHEREAS, during their January 5th, meeting, the Stearns County Board of Commissioners adopted a motion to establish a public hearing date of February 2, 2015 to take testimony regarding the proposed conditional use permit; and WHEREAS, the Stearns County Board of Commissioners is the final approval authority on conditional use permits for the County of Stearns; and WHEREAS, it is the intent of the Stearns County Board of Commissioners to protect the public health, safety and welfare of County residents and the environment of the County. NOW, THEREFORE, the Stearns County Board of Commissioners, after receiving and considering the Planning Commission recommendation, testimony from the public and staff of the Environmental Services Department regarding the conditional use permit for a solar farm, hereby denies the conditional use permit for a solar farm and makes its Findings of Fact in support of the decision:
A. The proposal is not consistent with the Future Land Use Map-Urban Expansion which is described as, “Areas anticipated to be annexed and provided with municipal services during the time frame of this plan. Also includes areas under Orderly Annexation Agreements. Variety of land uses to be determined through joint city-township planning. Residential uses remain restricted until annexation occurs. Limited commercial/industrial uses may be considered.” The letter provided by the City of Richmond indicates their desire as a city to be afforded the opportunity to expand where adjacent infrastructure investments have been made, in this case to the north and east of their municipal boundary (Ramler property/project site).
B. The proposal is not consistent with the following goals and objectives of the Stearns County Comprehensive Plan, adopted March 4, 2008. Land Use Plan, Agriculture

Land Use Plan, Growth & Development
Goal 3. Manage the impacts of growth and development on the County’s rural landscape.
Objective 1. Discourage incompatible land uses through effective land use controls.
Objective 2. Identify appropriate areas for commercial, industrial and non-farm rural residential developments.
Objective 3. Deter premature development in rural areas and in urban expansion areas around cities.
Limiting incompatible uses in Urban Expansion areas allow municipalities to plan for their infrastructure investments.
C. The zoning district is Agricultural 40. The purpose of this District it to preserve the agricultural and rural character of land within the A-40 District. The A-40 district is also used in proximity to growing cities and areas away from cities where agricultural resources and practices are intermixed with other uses. Residential land uses are limited to a density of one residential dwelling per forty (40) acres. This district is often used adjacent to cities to minimize residential density so future service extension can be completed cost effectively.
D. The Land Evaluation Site Assessment score for the property is 74.06, exceeding the threshold of 65 for non-agricultural conversion. The LESA system was designed specifically to access where the best farmlands are located locally. The system provides an objective and consistent tool for evaluating the relative importance of specifics sites for continued agricultural use. The Land Evaluation Site Assessment Score for the property is 74.06 – the LE score of 49.8 out of 50 indicates that the soil is excellent for farming and should not be converted to non- agricultural use. However in evaluation the SA score of 24.26 out of 50 this shows that this site is becoming less agricultural through encroachment of city residents. Continued use of this site as agricultural until annexed by the City of Richmond is consistent with the Comprehensive Plan
E. The proposal is a conditional use permit in the Agricultural 40 zoning district. The Ordinance requires a showing by the applicant that the requirements and standards of Land Use and Zoning Ordinance #439, and other applicable ordinances, rules and statues will be met, the use conforms to the comprehensive plan and is compatible with the exiting neighborhood. The applicant was not present at the public hearing to prove this standard and to answer questions raised by the public and the Commissioners related to conformance with these requirements.
F. The proposed use is not compatible with present and future land uses in the area and cannot be fully screened from adjacent land uses. There are approximately 99 homes, 2 schools, a church and a cemetery within one-quarter mile from the footprint of the proposed solar farm.
G. The Township and the City have not designated any unincorporated areas as in need of orderly annexation pursuant to Minnesota Statutes, Section 414 making it difficult for the Board to manage their competing interests for land use.

H. According to information supplied by the County Assessor, it is premature to determine what affect this use may have on property values in this area. Any valuation adjustments would be based on historical sales data. Sales in a given neighborhood would be monitored and values adjusted if warranted. There is no evidence at this time that the property values in the area will increase or decrease.

accept and adopt an annual delegation agreement with the Department of Natural Resources.
Attached for your review is said delegation agreement. This agreement, is the same as last year's
agreement which was reviewed and modified by the County Attorney's Office.

DRAFT STEARNS COUNTY REPORT ON AQUATIC INVASIVE SPECIES
PREVENTION IN 2015 The year 2015 saw many good initiatives in Stearns County to prevent the spread of aquatic invasive
species. There were, however, three more lakes identified as infested by zebra mussels and two lakes
identified as infested by starry stonewort. The continued spread of invasives is extremely disheartening
to those who care about the quality of our lakes and rivers. It is essential that efforts to contain the
spread of invasives continue.
The Stearns County Aquatic Invasive Species Plan was approved by the Stearns County Board of
Commissioners on February 17, 2015. The Plan was developed by the Stearns County AIS Task Force,
comprised of a wide range of local stakeholders. The members of the Stearns AIS Committee are a
subset of volunteers from the Task Force who were willing to serve on an on-going basis. The AIS
Committee meets regularly to guide the initiatives that carry out the goals of the Plan. The members
donate considerable time and energy and are essential to the AIS prevention efforts. Members of the
AIS Committee are listed in the Appendix.
All the AIS initiatives are funded by the County’s receipt of Local Aquatic Invasive Species Prevention Aid
from the State of Minnesota. These funds come from the general levy and, according to MN Statutes
477A.19, can be spent “solely to prevent the introduction or limit the spread of aquatic invasive species
at all access sites within the county”. Stearns County received $255,261 in aid in 2015 and expects to
receive $254,239 in 2016. Each county must submit a copy of its guidelines for use of the proceeds to
the Department of Natural Resources by December 31 of the year the payments are received.
Continuing aid is dependent on the allocation of funds by Minnesota legislature.
Most of the AIS local aid funds were spent through a Request for Proposal process. RFP’s were sent to
all the known lake associations, townships, cities, watershed districts, and watershed management
units. The AIS Committee also undertook a number of initiatives to address AIS issues on a countywide
basis.

AIS Program Management Program management is done by the Environmental Services Department, the AIS Committee and the
Stearns Coalition of Lake Associations. The ESD coordinates the meetings, manages the budget, and
assists with initiatives. The AIS Committee meets on an approximately monthly basis to determine how

to best accomplish the goals of the Plan. The Committee has undertaken and accomplished a number of
initiatives, as described below. A subcommittee of the AIS Committee is the AIS Proposal Evaluation
Committee, responsible for reviewing and ranking the applications for funding. The AIS Award Panel is
comprised of one County Board Commissioner, one representative from the Stearns Soil and Water
Conservation District and one representative from ESD. The Award Panel is responsible for assuring
ranking has been completed fairly, without conflicts of interest, and finalizing the award decisions.
Education and Awareness The AIS Committee contracted with Loewen Administrative Services, LLC to physically inspect all the
public boat launches and as many of the private launches as was feasible and document the signage at
the launch, the number of vehicle/trailer spaces, number of launches, etc. The AIS Committee will
review the survey results and take action to improve the AIS signage where needed to assure that the
risks of AIS are well known.
Watab Lake had been the only lake in the county known to be infested with zebra mussels. (Zebra
mussels have since been found in Clearwater Lake and Lake Sylvia.) There is no public boat launch on
Watab Lake, although there is a private launch owned by the St. Joe Rod and Gun Club that is used fairly
heavily. The AIS Committee worked with the St. Joe Rod and Gun Club and the Melody Park Property
Owners Association to distribute a Protect Our Waters from Aquatic Invasive Species booklet on the
proper inspection of watercraft, docks, lifts, etc. The Committee also developed a program whereby
property owners who live on the lake and are selling water-related equipment going to a different lake
are eligible for a reward of $200.00 if the equipment is kept out of the water for at least 29 days.
(Minnesota law requires the equipment to be dry for 21 days.)
Outreach on the risks of AIS to lake home owners is often most efficiently accomplished by a lake
association. The Stearns Coalition of Lake Associations has been actively working to promote the
establishment of lake associations, particularly if the lake has been identified as infested by AIS.
The AIS Committee organized and held a workshop for all of the Stearns lake associations. The primary
purpose of the workshop was to acquaint the associations with Stearns AIS program, how to engage in
the Request for Proposal process, and the County Rapid Response Plan. Contact was also made to
lakes that do not have a lake association. Attendance was good, with over 30 people from the lakes.
Proposals for education and outreach initiatives were funded for four entities – Avon Area Lakes,
Melrose Lake, Pelican Lake, and the Sauk River Watershed District. Avon Area Lakes posted signage at
the watercraft accesses for Upper, Middle, and Lowe Spunk Lakes and Ochotto Lake. Melrose Lake
Association used the following to get out the AIS message: brochures, tote bags, AIS-information ads in
the local newspapers and signage. Pelican Lake utilized a variety of tools to promote AIS awareness: can
coolers, bait buckets, stickers, litter bags and placement of articles in the local newspapers. The Sauk
River Watershed District created and implemented a multi-faceted education program. They developed
and provided AIS Education Kits for the fourteen high school science programs in the County, developed
AIS education sessions for the area Water Fests, and provided in-class demonstrations.

Inspection and Decontamination
Inspection The DNR has the authority to require that a watercraft is inspected prior to launching into a public
waters and has the authority to deny launch if a watercraft poses a threat of spreading AIS. The DNR
stations inspectors at numerous boat launches throughout the State but has not had the funds to be
comprehensive. Local units of government have the option of entering into a delegation agreement
with the DNR, which gives the LGU the authority to require inspections and to deny launch, provided the
LGU adheres to the same standards as does the DNR. Stearns County and the North Fork of the Crow
River Watershed District entered into delegation agreements in 2015, allowing both to hire inspectors
authorized to require inspection and to deny launch.
In July of 2015 Clearwater Lake was found to be infested with zebra mussels. Clearwater Lake had not
submitted a proposal for watercraft inspections. Clearwater Lake is a large, high-traffic lake and there
was a clear risk of zebra mussels being transported to other lakes. The AIS Committee arranged to have
inspectors stationed at the two public accesses as often as was possible. The DNR also stationed
inspectors at the DNR launches.
Inspections were done on other lakes in the County at the request of the lake associations. The North
Fork of the Crow River Watershed District hired its own inspectors on Rice and Koronis Lakes and was
partially reimbursed by the Stearns AIS fund. Stearns County contracted with service providers which
hired and managed the inspectors on lakes not in the NFCRWD. Inspection programs were carried out
and funded through local AIS prevention aid on Big Fish Lake, Big Watab Lake, Big Birch Lake (within
Stearns County), Clearwater Lake, Lake Koronis, Pleasant Lake, and Sauk Lake. Thirteen thousand, four
hundred and nineteen inspections were reported to the DNR. Data from the inspection reports is found
in the appendix of this report.
Local AIS funds were used for the following inspection hours:
Big Birch Lake --56 hours (Only one relatively little-used access is in Stearns County.)
Big Fish Lake -- 915 hours (Big Fish Lake also had 375 hours of inspection provided directly by the MN
DNR through a 50/50 match program)
Big Watab Lake – 703.5 hours (Big Watab Lake Association provided partial funding also.)
North Fork Crow River Watershed District -- 1476 hours (includes Rice and Koronis Lakes)
Pleasant Lake – 976 hours
Sauk Lake -- 677 hours
Clearwater Lake --770
Because of some difficulty locating a sufficient number of inspectors to take care of the planned
inspections, particularly early morning, late evening, and fall and spring, the North Fork Crow River
Watershed District requested to use some of their inspection grant to purchase an I-LIDS. This is an un-
manned system to monitor boat landing activities, capture video events, and make this information for
available for review by lake constituents. The I-LIDS system utilizes sensors that tell it when a boater
has entered the launch area and turns on video monitoring of the bottom of the boat to identify

whether there are aquatics present on the trailer or boat. It also captures clean-off activity by the user.
The premise is that the boater will behave differently if he is aware that his actions are being recorded.
The change in funding was approved by the AIS Committee because the original award included
equipment.
Decontamination One of the goals of the Stearns AIS Plan is to purchase and operate one or more decontamination units.
Although the DNR considers “decontamination” to be accomplished by thorough cleaning by hand, a
decontamination unit can effectively kill zebra mussel veligers through hot water at high pressure. The
current situation is that, if a watercraft is advised to go to a decontamination unit, there may not be any
decontamination unit within reasonable distance. The DNR has a number of decontamination units, but
there is no guarantee there would be one nearby.
The AIS Committee has spent a great deal of time and effort researching the technical and legal
requirements for a decontamination unit. There are a few issues which have not yet been resolved
concerning liability and operation, but the Committee will continue to pursue this goal.
Population Assessment and Management
Population Assessment One of the goals of the Stearns AIS Plan was to conduct baseline studies of vegetation and animals to
serve as a basis for comparison with subsequent acquired data. One of the funded proposals was from
the Sauk River Watershed District, which conducted baseline monitoring for zebra mussel veligers on 53
lakes within Stearns County. Both adult zebra mussels and veligers were monitored at each lake, using
visual monitoring of substrates for adult zebra mussels and plankton tows for veligers. There were no
adult zebra mussels or veligers found in any of the monitoring efforts.
Lakes which had an assessment done as part of treatment were Avon Area Lakes, Pirz Lake, Sauk River
Chain of Lakes
Management The intent of funding management efforts was to focus on waters with new small infestations than can
yield potentially big results in control and thereby decrease risk of spreading to other lakes.
Proposals for management activities were funded for six lake associations – Lake Augusta, Avon Area
Lakes, Little Birch Lake, Pirz Lake, Sauk River Chain of Lakes, and Two River Lake. Eurasian water milfoil
in Lake Augusta was chemically treated. Eurasian water milfoil was chemically treated in Middle Spunk
Lake and manually harvested in Middle and Lower Spunk Lakes. Eurasian water milfoil in Little Birch
Lake was chemically treated and hand-pulled by divers. Curly leaf pondweed was hand-pulled by divers
in Pirz Lake. Curly leaf pondweed was chemically treated in the Sauk Chain of Lakes. Curly leaf
pondweed was manually removed from Two River Lake.
Rapid Response The AIS Committee contracted with Osgood Consulting, LLC and Molloy & Associates, LLC to develop a
rapid response plan for Stearns County. The purpose was to provide a framework for action by lake
associations for early detection, containment and rapid response to newly-introduced, isolated AIS. The
plan is readily adaptable by local lake associations and provides a comprehensive approach. The report

emphasizes that the best defense is a strong prevention offense and, once AIS are introduced, are
usually impervious to eradication efforts.
Enforcement The supervisor of the Stearns Water Patrol attended the AIS training provided by the DNR and passed
the information on to his employees. The Environmental Services Department is working with the
Sheriff’s Department to have the deputies and Water Patrol receive AIS training.
Risk Reduction Opportunities The AIS Plan includes several ideas that can be reviewed/evaluated with legal authorities for
implementation that can potentially reduce the overall risk of AIS infestation. In 2015 starry stonewort
was found to be infesting Lake Koronis with a dense area at the Highway 55 DNR access. Every boat that
went in or out of the access was potentially carrying the invasive farther into the lake or carrying it out
and possibly infecting another lake. The AIS Committee and the Stearns COLA sought to have the DNR
access closed to boat traffic. The Stearns County Board of Commissioners sent a letter to the DNR giving
support to the closure. The DNR decided to close the access temporarily beginning the second week of
October for the purpose of treatment of the invasive algae. This was an unusual step taken by the DNR
and was done partly due to the efforts of the Committee and the COLA. The access at the Regional
County Park and the two township accesses were also closed, leaving only the City of Paynesville
(Veterans Park) access open. Through the efforts of the DNR and Koronis Lake Association, there were
inspectors at the Veterans Park access seven days a week, during all daylight hours until October 26.
Stearns County Infestations The following is a list of the aquatic invasive species infestations known at this time. The infestations
that were identified in 2015 are zebra mussel infestations in Clearwater Lake, Otter Lake and Lake Sylvia
and starry stonewort in Lake Koronis and Mud Lake.

Budget The first year of local AIS aid was a partial payment of $114,868 received in 2014. Those funds were
carried over to 2015. Starting in 2015, the payments are made in two installments, July 20 and
December 26. In 2015 each installment was $127,630.50. The intent is to not allocate the funds from
the December payment until the following year. Therefore, each year’s spendable budget is any carry-
over from the prior year and the July 20 payment received that year. The “spendable” budget in 2015
was $242,498.50. In 2015, $191,344.85 was spent from the AIS local aid. The 2015 expenditures were
as follows:

Results of Stearns County Watercraft Inspection Program During each watercraft inspection the inspectors completed a DNR survey with the watercraft operator,
discussed MN AIS laws and completed a visual and physical inspection of the boats entering or exiting
the lakes. Watercraft inspections are intended to be primarily an educational tool, rather than
enforcement, and are one of the best AIS prevention tools available. If the circumstances warrant it,
enforcement through local peace officers is also possible.

It is a violation of Minnesota State Law to transport a watercraft that has the drain plug in. Part of every
inspection is documenting whether the drain plug is in or out when entering the access.
If there is a potential invasive found on an incoming watercraft, the inspector records the incident and
makes sure it is removed prior to launch. The following shows the numbers of types of invasives and
comments recorded by the inspector. Some watercraft had more than one invasive.

DELEGATION AGREEMENT
Aquatic Invasive Species (AIS) Prevention
Inspection of Water-related Equipment
This agreement is made by and between the Department of Natural Resources (referred to as DNR), an
administrative agency of the State of Minnesota and the County of Stearns, (referred to as Governmental
Unit), a local government unit (individually referred to generally as a Party or together as Parties).
Governmental unit is defined as a tribal or local government. This agreement is entered into under
authority granted to DNR pursuant to Minnesota Statutes section 84D.105.
WHEREAS AQUATIC INVASIVE SPECIES (AIS) are nonnative species that cause or may cause
economic or environmental harm or harm to human health or threatens or may threaten natural resources
or the use of natural resources in the state;
WHEREAS DNR has been authorized and charged with responsibility by the state legislature to establish
a statewide program to prevent and manage the spread of AIS in coordination with other governmental
entities; DNR has in its employ conservation officers trained and authorized to enforce the state invasive
species laws; and DNR has developed AIS inspection protocols;
WHEREAS pursuant to Minnesota Statutes section 84D.105, Subdivision 2(a), Governmental Unit is a
Tribal or local government that agrees to assume legal, financial, and administrative responsibilities for
inspection programs on some or all public waters within their jurisdiction; and
WHEREAS DNR and Governmental Unit are committed to three core principles:
• Coordination of their authority and resources to develop a reasonable and effective water-related
equipment inspection requirement to stop the spread of AIS in the state and prevent the introduction of
new AIS;
• a collaborative, cooperative approach to AIS management and prevention;
• ensuring continued access to public waters.
NOW, THEREFORE it is mutually agreed by and between the Parties as follows:
1. PURPOSE. The purpose of this agreement is to enhance Minnesota’s capacity to prevent the spread of
AIS by enabling local governmental units to perform AIS inspections and manage access to water
resources in keeping with the three principles stated above.
2. TASKS AND RESPONSIBILITIES.
A. DNR or its delegee will provide training of individuals employed by Governmental Unit and/or
individuals working for contractors to Governmental Unit as inspectors and, upon successful completion
of training and testing requirements, the DNR will certify individuals as authorized inspectors in
accordance with Minnesota Statutes section 84D.105, subd. 2(a). DNR will assume all obligation for
training to the extent set forth in Minnesota Statutes section 84D.105.

B. DNR will provide training of licensed peace officers identified by Governmental Unit to enforce
the state invasive species law, as it pertains to the transport, possession and use of water-related
equipment.
C. Governmental Unit will work with DNR and other governmental entities to ensure that
conservation officers and licensed peace officers are available to support Governmental Unit inspectors
when inspection stations are being operated.
D. Governmental Unit will design and implement an AIS inspection program, approved by DNR, on
designated public waters (see attached listing of designated public waters) within their jurisdiction
utilizing existing authorities and the authority granted to inspectors under Minnesota Statutes sections
84D.105, subd. 2(b) and 84D.10, subd. 3(a), clauses 1, 3, and 4 (the Program). The program must comply
with all requirements in Minnesota Statutes section 84D.105 subd. 1 and subd.2 (a) through (e) and in
DNR Watercraft Inspection Program procedures and manuals.
E. Governmental Unit will designate individuals employed by the Governmental Unit and/or
individuals working for contractors to Governmental Unit to serve as inspectors for the Program and
ensure that these individuals complete the required training and certification in paragraph 2A of this
agreement prior to performing inspections. Governmental Unit will help coordinate training of licensed
peace officers as provided under paragraph 2B of this agreement.
F. Governmental Unit will provide one or more inspection stations established under the Program
with trained and certified inspectors, who will exercise inspection authorities in accordance with current
DNR procedures and manuals. General inspection procedures include:
i. Visually and tactilely inspecting water-related equipment to determine whether aquatic invasive
species, aquatic macrophytes, or water is present;
ii. Instructing persons on how to comply with AIS laws by removing AIS, draining, decontaminating,
or treating AIS and water-related equipment to prevent the transportation and spread of aquatic invasive
species, aquatic macrophytes, and water;
iii. Issuing verbal orders to prohibit placing water-related equipment, that has AIS attached or water
that has not been drained, into waters of the state;
iv. With owner’s consent, assisting with the removal of AIS and decontamination of water-related
equipment; and
v. Contacting Conservation Officers or licensed peace officers if a person transporting watercraft or
water-related equipment refuses to take corrective actions to remove AIS or fails to comply with
requirements to drain water prior to leaving the water access.
G. Governmental Unit will support education and outreach projects and programs designed to
increase public awareness and knowledge of the risks AIS pose to water resources and public capacity to
contribute to the effort to prevent and manage the spread of AIS.
H. Governmental Unit assumes legal, financial, and administrative responsibilities for their staff and
the actions of their staff and will bear costs incurred in completing the tasks and responsibilities herein,
except that DNR will provide, at its sole expense, staff and/or contracted professionals to coordinate and
conduct the training described herein.
I. Governmental Unit and DNR will regularly meet or consult with each other to collaboratively
develop the above-described elements of Governmental Unit AIS Program and potential models that
could be used by other local governments to help the prevent the spread of AIS, guided by the three core
principles stated above.

J. Governmental Unit must submit an annual report to the DNR summarizing the results and issues
related to implementing the inspection program.
3. INDEMNIFICATION. Each Party to this agreement shall be liable for its own acts and the results
thereof to the extent authorized by law and shall not be responsible for the acts of the other party, its
agents, volunteers or employees. It is understood and agreed that liability and damages arising from the
parties’ acts and omissions are governed by the provisions of the Municipal Tort Claims Act, Minnesota
Statutes Chapter 466, the Minnesota Tort Claims Act, Minnesota Statutes section 3.736, and other
applicable laws.
4. TERM AND TERMINATION. The agreement becomes effective on the date of final signature. This
agreement expires on December 31; 2016. The agreement may be terminated with or without cause by 30-
day written notice to the other Party.
5. ENTIRE AGREEMENT. This agreement supersedes any prior or contemporaneous representations
or agreements, whether written or oral, between DNR and Governmental Unit, and contains the entire
agreement with regard to the subject matter herein.
6. AMENDMENTS. This agreement may be amended only by the mutual consent of the parties in
writing, signed by each of the Parties.
7. NOTICE. Any written communication required under this agreement will be addressed to the other
Party as follows, except that any party may change its representative and/or address for notice by so
notifying the other Party in writing:

8. GOVERNING LAW AND VENUE. This agreement will be governed by and interpreted in
accordance with the laws of the State of Minnesota. Venue for all legal proceedings out of this agreement,
or its breach, must be in an appropriate state or federal court with competent jurisdiction.
9. WAIVERS. The waiver by DNR or Governmental Unit of any breach or failure to comply with any
provision of this agreement by the other Party will not be construed as nor will it constitute a continuing
waiver of such provision or a waiver of any other breach of or failure to comply with any other provision
of this agreement.
10. STATE AUDITS. Under Minnesota Statutes section 16C.05, subd. 5, Governmental Unit books,
records, documents, and accounting procedures and practices relevant to this agreement are subject to

examination by the State and/or the State Auditor or Legislative Auditor, as appropriate, for a minimum
of six years from the end of this agreement.
11. GOVERNMENT DATA PRACTICES. Governmental Unit and DNR must comply with the
Minnesota Government Data Practices Act, Minnesota Statute Chapter 13, as it applies to all data
provided by DNR under this agreement, and as it applies to all data created, collected, received, stored,
used, maintained, or disseminated by Governmental Unit under this agreement. The civil remedies of
Minnesota Statute section 13.08 apply to the release of the data referred to in this clause by either
Governmental Unit or DNR.
If Governmental Unit receives a request to release the data referred to in this Clause, Governmental Unit
must immediately notify DNR. DNR will give Governmental Unit instructions concerning the release of
the data to the requesting party before the data is released.
The state complies with Minnesota Government Date Practices Act regarding the released of any data
created, collected, received, stored, used, maintained, or disseminated by the respective party under this
agreement. The state and the local government unit shall let each other know when a data request has
been received.

RECOMMENDED BOARD ACTION: 1) Approve Purchase of Service Agreements with Albany, Holdingford, Melrose, and Rocori school
districts for the period February 16, 2016 through October 31, 2016, in an amount not to exceed
$6,581 each.
2) Authorize Board Chair to sign the above contracts.

When the SHIP grant award was accepted it was planned that Stearns County Human Services would
contract with outside entities to fulfill some of the requirements of the SHIP grant. These contracts will
enable Stearns County Human Services to meet the grant requirements of increasing the availability of
healthy food choices and healthy activity within schools in Stearns County.
By the terms of the agreements, the four schools will develop assessment tools and plans within the
respective districts and then implement changes which will further the goals of the SHIP program. The
agreements are in accordance with the Department’s current SHIP work plan. As the SHIP program
requires ongoing evaluation for effectiveness, staff will work with the schools to evaluate what is working
and changes needed to assure improvement.

County Human Services with SHIP funds.
Written report will be provided by the Public Health Law Center. Its evaluation will be shared with City
staff and suggested revisions to further SHIP goals will be recommended. The agreement is in
accordance with the Department’s SHIP work plan.

The 2016 Adult Mental Health Grant Plan awards funds to Stearns County Human Services in
two categories:
$278,335 for Community Support Program; and
$92,600 for Project for Assistance in Transition from Homelessness
In past years these funds were provided to the Department as an allocation, with no grant
agreement required. Due to recent changes in federal and state regulation, a grant award
procedure is now mandated.
These services are provided through the Community Supports and Family & Children Divisions.
The funding supports the Department’s contract with Catholic Charities for operation of the
Hope Community Supports Program, as well as contracts with Opportunity Services and
WACOSA for extended employment services. Additionally, the funding supports an outreach
social worker focusing on the homeless in Stearns County. These services will continue to be
provided as they have been in the past. The only change this year is the necessity of a signed
grant award letter. These dollars and services are provided for in the 2016 budget.

Comment is made that staff brings this grant agreement for Board approval more than one month
after the stated effective date. Implementation of the new grant award process has introduced
unanticipated challenges for DHS and recipient counties related to invoicing, audit, and sub-
grantees. Believing those challenges to have been resolved, the award is now brought forward
for approval. Retroactive application of the grant agreement to January 1, 2016, is assured by
DHS.

PREVIOUS ACTION: On December 2, 2014, the Stearns County Human Services Board approved a cooperative agreement and
memorandum of understanding among Stearns County Human Services, the Office of the Stearns County
Attorney, the Office of the Stearns County Sheriff, and the Minnesota Department of Human Services for
services associated with the administration of the Child Support Enforcement Program for the period
January 1, 2015 through December 31, 2015.
RECOMMENDED BOARD ACTION: 1. Approve a Cooperative Agreement among Stearns County Human Services, the Offices of the
Stearns County Attorney and the Stearns County Sheriff, and the Minnesota Department of
Human Services for services associated with the administration of the Child Support Enforcement
Program for the period January 1, 2016 through December 31, 2016 at the following rates:
For County Attorney (Legal Services):
$67,089 quarterly, for a total not to exceed $268,356
For County Sheriff (Service of Process):
$50.00 per service plus mileage at the rates established by the County fee schedule.
2. Approve a Memorandum of Understanding to facilitate billing and reimbursement processes
among Stearns County Human Services, the Office of the Stearns County Attorney, and the
Office of the Stearns County Auditor.
3. Authorize Board Chair to sign the agreements.

Stearns County Human Services, through the Gateway Division, makes referrals to the Office of the
Stearns County Attorney for legal services associated with the administration of the Child Support
Enforcement Program. It makes referrals to the County Sheriff for service of legal process.

The Cooperative Agreement is for the purpose of facilitating payment for legal services provided for
Child Support Enforcement. The Cooperative Agreement has been drafted in conformity with action
taken by the Board in July, 2011 to authorize two (2 FTE’s) attorneys to conduct child support legal
services. The contracted rate is established by the salary and benefits paid to the two assistant county
attorneys assigned to that activity. Inasmuch as the contract rate could not be established until County
labor contracts were settled, the Department requests Board approval be retroactive to January 1, 2016.
The execution of this cooperative agreement allows for the federal reimbursement of two-thirds of the
expenditures associated with these services. Execution of the memorandum of understanding facilitates
accounting functions for the one-third attorney costs not covered by federal reimbursement.

On January 28, 2015 the Human Services Department entered into a contract with the Collection
Bureau of Little Falls, Inc. Collection Services began in the Community Corrections Division.
Services have more recently expanded to financial obligations associated with Detox. Other
areas of collection are now being explored. The Board will receive an update on the collections
services being provided along with the revenue received. The Department's plans to use credit
card payments will also be reviewed.
