INFORMATION: February 27 – Center for Transportation Studies’ Impact Assessment Results for the Charlotte Douglas International Airport Staff Resource: Brent Cagle, Aviation, 704-359-4035, [email protected] On Monday, February 27 Aviation Director Brent Cagle will share results from the recent regional economic impact assessment conducted by the Center for Transportation Studies at UNC Charlotte, focusing on Charlotte Douglas International Airport’s contribution to the economic health of the region. The event will be held at the CLT Center at 5601 Wilkinson Blvd. from 1:30-2:30 p.m. Mayor Jennifer Roberts, Chamber CEO Bob Morgan, and executives from American Airlines will also make remarks. A more detailed invitation is attached below.

March 2 – NBS Civic Leadership Academy Staff Resource: Lacey Williams, NBS, 704-336-2172, [email protected] The inaugural class of Neighborhood & Business Services’ Civic Leadership Academy begins on Thursday, March 2. It includes 35 residents, five from each council district, who represent a spectrum of diversity in terms of age, race, gender, and leadership experience. Participants will attend eight sessions focusing on:

• Using leadership styles to make a positive impact on their communities • Enhancing their understanding of Charlotte’s history and culture • Better understanding how local government works • Developing relationships with other community and local government leaders

The group was chosen from a pool of more than 250 applicants. Because the program could not accommodate all those interested, staff is encouraging the remaining applicants to participate in training opportunities available through other City programs and partners. Mayor and City Council are invited to attend the graduation ceremony on April 20. Graduation ceremony details will be shared once they are finalized. Additional information including a summary of the individual academy workshops is available online.

Notice of Quiet Zone Establishment for McLean Road Railroad Crossing Staff Resources: Debbie Smith, CDOT, 704-336-3935, [email protected] Liz Babson, CDOT, 704-336-3916, [email protected] The City will establish its first railroad Quiet Zone at McLean Road in northeast Charlotte (map attached) on March 1, 2017. The notification letter has been provided to the Federal Railroad Administration, Norfolk Southern Corporation, Amtrak, North Carolina Department of Transportation, North Carolina Department of Public Safety, and the Charlotte Fire Department. A quiet zone is a section of railroad where the train does not routinely sound its horn prior to crossing the roadway. Quiet zones were requested after several neighborhoods in northeast, west, and central parts of Charlotte expressed concerns about train horn noise. The Federal Railroad Administration established the Train Horn Rule which set national routine sounding of train horn standards at all public roadway crossings. The Train Horn Rule includes a formal quiet zone process which requires the installation of specific safety infrastructure to provide conditions equally as safe as sounding the train horn. NCDOT, as part of the Harrisburg to Charlotte Double Track Project, installed gates, warning lights, medians, and other safety infrastructure that allows the City to establish a quiet zone at McLean Road without any construction costs to the city. In the coming months, NCDOT will install the safety infrastructure at Back Creek Church Road and the City will seek to establish a quiet zone there. CDOT included a quiet zone program as part of the Transportation Action Plan (TAP) 2016 Update. City Council is scheduled to adopt the TAP update at the February 27, 2017 Council Business meeting.

SUBJECT: Week 2 State Legislative Report

What You Need to Know:

Provide Certain Property Tax Relief (HB 2 – Dollar, Saine, Hardister, R. Turner) expands

the exemption from residential property taxes for disabled veterans from the first $45,000 of

property value to 100% of the property value, and creates a new exemption for the surviving

spouses of emergency personnel such as police and firefighters. If approved, the bill would take

effect July 1, 2017. The fiscal impact of HB 2 upon the City is estimated at between $550,000

and $600,000 annually. Referred to House State and Local Government II.

Eminent Domain Constitutional Amendment (HB 3 – McGrady, Lewis, Malone, Goodman

/ SB 34 – B. Jackson): Just like the last several sessions, proposals to amend the state

constitution to prevent eminent domain from being used for economic development purposes

have been introduced. HB 3 reported out of House Judiciary I and will be debated on the House

floor on February 16. SB 34 referred to Senate Rules. The proposed amendments do not impact

the manner in which the City of Charlotte undertakes condemnation of property.

BRIGHT Futures Act (HB 68 – Szoka, Saine, S. Martin, Brenden Jones / SB 65 –

Meredith) focuses on accelerating the deployment of digital infrastructure in rural and unserved

areas by connecting them to the key markets of broadband-enabled services, retail online

services, internet of things, Grid Power, healthcare and education. HB 68 referred to House

Energy and Public Utilities. SB 65 referred to Senate Rules.

Private Action Local Compliance / Immigration Laws (HB 113 – Cleveland, Conrad, Millis,

Speciale) creates a private cause of action to force local governments to comply with state

immigration laws. It allows any person who resides within the jurisdiction of a city or city police

department that the person believes is not in compliance to bring an action for declaratory and

injunctive relief, which shall be filed in the superior court of any county in which the defendant

city or city police department has jurisdiction.

Public Meetings / Records Laws Violations (SB 77 – Cook, Sanderson) provides that the

penalty for violating the open meetings laws, denying access to public records for purposes of

inspection and examination or to deny copies of public records would be a class 3 misdemeanor,

which is a criminal offense.

Previous Week Reports:

Mecklenburg / Police Countywide Jurisdiction (SB 5 – Tarte, Bishop, J. Jackson) amends

the 1969 local legislation (SL 1969-1170) that was one of the legal basis for the consolidation of

the City and County Police Departments in 1993 and that provides the framework for Charlotte-

Mecklenburg Police Department to provide law enforcement services in the unincorporated areas

of the County. SB 5 adds police officers of the six towns (Cornelius, Davidson, Huntersville,

Matthews, Mint Hill and Pineville) to those authorized by the Board of County Commissioners

to provide law enforcement services in unincorporated areas of the County, provided that an

agreement exists to allow the exercise of this authority. SB 5 also appears to give each town

council veto power over any other municipality’s police forces exercising police powers in their

extra-territorial jurisdictional planning areas, which is a new power to each municipality. The

lead primary sponsor, Senator Tarte, stated that the legislation was requested by the County

Manager so that the County could seek the lowest cost service to provide law enforcement

services in the unincorporated areas of the County. Referred to Senate State and Local

Government.

Citizens Protection Act of 2017 (HB 63 – Warren, Collins, Jordan, Adams) amends the

sanctuary city legislation passed in 2015 (HB 318) by adding sanctions for cities and counties

that enact what are known as “sanctuary city” ordinances, resolution, policies, procedures,

practices, etc. Sanctions include withholding revenues attributable from beer and wine,

telecommunications, video programming and piped natural gas taxes, which total approximately

$21.1 million annually.

Municipal Elections (HB 64 – Warren, Conrad, Bert Jones, Collins) requires that all

elections for municipal offices filled by election of the people must be held in even-numbered

years beginning in 2022.

Charlotte Firefighters Retirement System (HB 58 – Dulin, Autry, Belk, R. Moore / SB 54 –

Waddell, Tarte, Bishop) is local legislation that enables the Retirement System to comply with

the Voluntary Correction Program entered into with the Internal Revenue Service, by which the

method for computing a firefighters final average salary is determined. The bill has no fiscal

impact upon the System.

House Bill 2: Several bills have been filed to Repeal House Bill 2 including: Repeal HB2 (SB

25 – J. Jackson, Bryant, McKissick), HB2 Repeal / Equality for All (HB 78 – Brockman),

Equality for All/Repeal HB2 (HB 82 – Harrison, Fisher, Butler, Autry / SB 84 –

Chaudhuri, Woodard, Van Duyn), and Common Sense Compromise to Repeal HB2 (HB

107 – Jackson / SB 93 – Blue, Van Duyn).
