TOCKWITH WITH WILSTROP PARISH COUNCIL Minutes of a Council Meeting held on Wednesday 17 th February 2016 in Tockwith Church at 7.30pm Present: Councillors; Mr N Waller (Chair), Mr K Pope (Vice Chair), Mrs A Wilson, Mrs L Gill, Mrs J Wardman, Mrs S Pearce, Mr A Dyason, Ms M Thew In Attendance: Mrs D Dyason (Clerk to the Council). 16/197 Apologies for absence – Cllr J Savage, Cllr Corbett, Cllr Snook Cllr Waller welcomed all to the meeting. 16/198 Declarations of Disclosable Pecuniary and other interests Councillors agreed that if they had an interest they would declare it as it arose on the Agenda. 16/199 Minutes 16/199.1 – to resolve that the minutes of the Ordinary Parish Meeting of the Council held on Wednesday 20 th January 2016 be signed as a correct record. Resolved: that the minutes of the Ordinary Parish Meeting of the Council held on Wednesday 20 th January 2016 be signed as a correct record. All in favour. 16/200.To receive information on ongoing issues and decide further action where necessary. 16.200.1 – Update regarding the flooding matters around the Parish. Cllr Pope had attended a meeting in Harrogate at HBC, along with Cllr Savage, Ainsty Drainage Board and NYCC. Yorkshire Water did not attend. The main focus was New Road and it was agreed to go forward with funding of £5,000 per property to try to resolve the problem, although no decision has yet been made as to what to do. A surveyor has been instructed and his report is awaited. A culvert has been identified near to New Row and has been unblocked and there are plans to unlock a culvert at the bottom of the allotments opposite New Row. There are also plans to look at unblocking the ditches. NYCC have visited flooded properties on Marston Road, Prince Rupert Drive and Blind Lane and encouraged them to seek funding. The new developments were also discussed. Cllr Waller informed Council that he has sent photographic evidence etc. of the flooding to HBC Planning and asked them to rethink their decisions on the new developments.

Minutes of a Council Meeting held on Wednesday 17th February 2016

16.200.2 Update regarding issues on the Airfield – Bus Depot (Suttle Transport) Questions were raised at to what was used as a benchmark for the size of the bus depot established by the 2012 Public Inquiry and what is the size of the bus depot today. The Clerk was asked to write to HBC for clarification. Resolved: The Clerk to write to HBC. 16/200.3 Update regarding issues on the Airfield- Tyres and other issues Tyres – the deadline for the removal of the tyres is 31 May 2016 and this matter will continue to be monitored. 16/200.4 Update regarding NYCC Highways raised up to 2 years ago and still outstanding. A reply has been received from the Highways Agency detailing their proposals for the repairs. Some of the hedges have been cut and the trees cut back, the grass still needs cutting. The green traffic light is still obstructed at Cattal Bridge. The village signs are the responsibility of HBC. It was decided that Area 6 need reminding about the pot-holes on Marston Road, Southfield Lane and Cowthorpe Road and the Clerk was asked to write a letter to them and to also highlight the road edges at Rudgate as the road is subsiding which resulted in a tanker falling off the side of the road very recently. Resolved: The Clerk to write to Highways Area 6. 16/200.5 Update regarding the siting of a memorial/bench for Ms Mbanu. The Clerk informed Council that Ms Mbanu was happy for the bench to be sited in the play area. Cllrs asked the Clerk to enquire what style of bench she has in mind and whether she would be willing to fund the concrete base at an estimated cost of £400. Resolved: The Clerk to write to Ms Mbanu for further details. 16/200.6 Update on the RoSPA reports for the two play areas and repair work needed. Cllr Thew advised that she was in the process of completing the reports and would have them ready for the next meeting in March. 16/201 Report by County and District Councillor. Cllr Savage was not present at the meeting, but had sent a report on the flooding matters which was discussed earlier in the meeting. 16/202. Public Questions, Comments or Representations There were no questions or comments raised by members of the public 16/203. Police Matters PC Tim Craven listed the following crimes in his report for January: 230116 – Criminal Damage to vehicle – Moor Monkton. Car wing mirror damaged overnight, no witnesses. 270116 – Dwelling Burglary – Prince Rupert Drive, Tockwith. Garage entered overnight via insecure rear door, house keys stolen from within. 280116 – Theft from vehicle – Rudgate Business Park. Parts removed from two vans, parked outside business premises overnight.

16/204. Village Hall Mrs Unsworth was unable to attend the meeting and Cllr Pope reported on her behalf.

• The committee meeting had been cancelled this month. • A quiz is being organised for March and a May Fair on 7th May, with maypole, May

King & Queen, games, activities, stalls and local produce. There are also plans for a film night in April and a genealogy night although the date has yet to be confirmed.

• Several volunteers have been delivering leaflets around the village.

 • The tree has now been taken down in the garden. • The Pop-Up Café has had excellent reports. • The flat roof has not yet been started due to the bad weather.

16/205. Planning Applications There were no planning applications received during the month. 16/206. Planning Responses/Enforcement to receive the following planning

Information/decisions. 16/206.1 Erection of up to 80 dwellings including open space, play area and

pumping station with access into the side considered, site area 4.0ha. Appl No 15/02228/OUTMAJ – Land South of Prince Rupert Drive.

This remains outline planning and detailed plans are awaited. 16/206.2 Linden Homes proposed residential development at Southfield Lane,

Tockwith. Reference 15/01484/FULMAJ – Southfield Lane, Tockwith. Linden Homes have delivered revised plans and Council are awaiting details. 16/206.3 Possible breach of planning control at New Farm, Kendal Lane, Tockwith –

Installation of a ménage. Council are awaiting the result of the investigations. 16/206.4 Erection of 5 houses and package treatment plant – Case No

15/04730/OUT – Land West of Kendal Lane, Tockwith, YO26 7QN. The application has been refused and it is believed that they intend to appeal. 16/206.5 Possible breach of planning control – Case No 16/00033/PR15 – Go-

Karting Track, Marston Moor Airfield, Tockwith. Increase in area of bus depot. This matter had been discussed earlier in the meeting at 16/200.2. 16/206.6 Retention of 40m x 30m arena for horses and installation of lights – The

Water Tower, Wilstrop Lodge Farm, Green Lane, Tockwith. The application has been approved. It was noted that the conditions do not mention

the times of day when the floodlights can be used. 16/206.7 Enforcement Notice Appeal – Appeal Ref: APP/E2734/C/15/3140606. –

Former Agricultural Building, Tockwith. Alleged breach – Without planning permission the use of the former workshop building for staff accommodation and as a dwellinghouse.

Councillors discussed that the building should be used to provide staff facilities, but this should not mean it should be used a dwelling. It was agreed that a letter of objection be sent by the Clerk.

Resolved: That the Clerk send an objection letter. 16/207. Matters requested by Councillors 16/207.1 To discuss the problem of dog fouling in the village – Cllr Dyason It was agreed that the Clerk should contact the dog warden and ask for the dog fouling posters to be put up around the village. Resolved: The Clerk is to contact the dog warden. 16/207.2 To discuss the repair of various damaged/broken signs around the village – Cllr Pope Cllr Pope has reported the damaged signs to HBC who say it is on their action list. The state of some of the streetlights was also discussed as some are completely rotten at the base.

The Clerk was asked to point this out to HBC/NYCC as a health and safety concern and ask that they carry out safety checks. Resolved: The Clerk is to contact HBC/NYCC to advise of concerns. 16/207.3 To discuss the accidents at Cattal Crossroads. The signage is not good at the crossroads and Council felt that a “Stop” sign should be in place. The Clerk was asked to point out to Highways that there have been a number of accidents, some with injuries, and ask them to look into the issue. Resolved: The Clerk is to write to Highways to highlight the problem. 16/207.4 To discuss committee vacancy CPRE position offered to Tockwith PC. The Chair of the Campaign to Protect Rural England is resigning and Tockwith Parish Council have been offered the opportunity to take up a committee position. Councillors were asked to think about it and report at the next meeting. 16/207.5 To discuss the Tockwith CDG – Cllr Dyason. The CDG has been broken down into task forces to deal with the various issues. Some residents have been offered compensation from Yorkshire Water for the sewage problems. Cllr Dyason will forward on the minutes of the meeting when they become available. 16/208. Clerk’s update and received Correspondence 16/208.1 Relevant received correspondence in addition to email:

• Bank Statements from Lloyds Bank.

• Letter from Lloyds Bank re changes to Business Account.

• Letter from HBC re Local Government Boundary Commission electoral review.

• Letter from NYCC re fracking investigation.

• Letter from HBC re Strategic District Housing and Economic Land Availability Assessment: Initial Sites List 2016. Cllr Waller has read the plan and asked the Clerk to include this matter on the next Agenda.

16/209. Accounts - to pay/ratify invoices received, bank balances and receipt of payments.

16/209.1 To approve payment of Clerks salary and expenses up until and including 25th

February 2016 and PAYE for January 2016. Resolved That the Clerk’s salary and expenses and PAYE be approved. 16/209.2 To receive and approve this month’s bank reconciliation. Resolved: That the bank reconciliation be approved. 16/209.3 To receive and approve this month’s spend against budget report. Resolved: That the spend against budget report be approved. 16/209.4 To receive and approve payment to J Marsden for child’s picnic table for Bert’s

Garden in the sum of £190.00 plus VAT.

 Resolved: That payment for the picnic table be made once the commuted sums money

has been received by the Parish Council. 16/209.5 To receive and approve payment to J Marsden for artificial grass in the sum of

£19.12 plus VAT. Resolved: That the payment for artificial grass be approved. 16/210. Information Exchange by Councillors 16/210.1 Cllr Waller read out the relevant section of the covenant for the churchyard extension as follows: 2. The Donor hereby covenants with the Commissioners and the Incumbent that the Donor will on being afforded the necessary facilities (i) construct fences along the boundaries on the north and west sides of the said land and plant hedges along the same between the points marked A and B, C and D and E and F and forever thereafter to maintain the same. (ii) prepare the said land for use as a burial ground and the interment of ashes and forever thereafter to maintain the land and the graves 16/210.2 Cllr Pope raised the issue of speeding traffic and it was suggested that volunteers could be found to use speeding guns in the village. 16/211.
