EXPLANATORY NOTE

(This note is not part of the Order)

This Order prescribes substances other than oil, the threat of pollution from which (following ashipping casualty) triggers the Secretary of State’s powers of intervention under section 137 of theMerchant Shipping Act 1995 in accordance with section 138A of that Act.The Order gives effect to the Protocol relating to Intervention on the High Seas in Cases of MarinePollution by Substances other than Oil 1973 (Cmnd. 6038) (“the 1973 Protocol”).
