RECOMMENDATION:
1. That, Report PD-035-16, regarding “Revised Request for Half Load Limit Exemption byFWRN LP Industrial Wind Turbine Project”, dated March 14, 2016, be received; and,
2. That an exemption be and is hereby granted to Schedule ‘Y’ of the Half Load By-law(89-2000 as amended by 2003-24) between March 1st and April 30, 2016, as required,relating to the use of the following roads for the FWRN LP project:

REPORT TOWNSHIP SPECIAL COUNCIL
OVERVIEW:
On February 29, 2016, Staff Report PD-024-16 outlined a number ofrequests and consideration of a number of issues that relate todevelopment of the FWRN LP project.
Township Staff has had numerous and extensive discussions withrepresentatives of the wind turbine proponent in an effort to keep on topof the many issues affecting the Township and our residents.
The representatives of FWRN LP have recently provided an updatedrequest to Township staff (see Attachment No.1) for exemptions from theHalf Load Limit By-law 89-2000 (as amended by By-law 2003-24).
Since February 29, 2016, additional discussions have occurred betweenstaff and the proponent. As a result, more refined and updatedrecommendations relating to exemptions from the Half Load By-law arenow provided for Committee and Council to consider.

Elcho Road (from T32 to Wellandport Road (Regional Road 27) Vaughan Road (from Gee Road to Wellandport Road (Regional Road 27)) Gee Road (from Vaughan Road to Highway 20); and,
That all provisions of the Road Use Agreement continue to apply.
3. That the proponent shall provide bi-weekly updates to the Township CAO (or morefrequently, as required) on the status of the Half Load exemptions, the constructionprogram, all complaints and road repairs; and,
4. That FWRN LP be advised that they shall be responsible to receive, log, and respondto all complaints relating to the exemptions noted in #2 above and that the proponentshall also be required to provide written notice to all property owners along eachexempted road section, which notice shall include the names and phone numbers tocall regarding complaints about the project. The CAO shall be briefed bi-weekly on thestatus of all complaints; and,
5. That, as bi-weekly reports are received, and specific works are refined, the CAO beand is hereby delegated the authority to permit minor and reasonable variances fromthis approval, as appropriate, and shall report back to Council, as required.
ALIGNMENT TO STRATEGIC PLAN Value

ObjectiveFacilitate effective community consultations and communications to improve the coexistence of green energy technologies and farming industries.
BACKGROUND:Staff was instructed to further discuss the request from FWRN LP for Half Load By-law exemptions and obtain more details with respect to their needs. This report outlines new detailed recommendations for consideration by Council.
CURRENT SITUATION:Staff, as directed by Council on February 29, 2016, met with representatives of FWRN LP on March 1, 2016 and March 8, 2016. The recommendations of this report now provide more detail and refinement of the detailed discussions and requests as originally presented in Staff Report PD-024-16.

provided to Council as an attachment to Staff Report PD-024-16. The request for exemptions from the Half Load By-law (Schedule ‘Y’ of 89-2000) relates to those roads restricted by the Half Load Limit By-law for the construction of the transmission route; the movement of cranes from turbines T56, T32, T08 and T94; as well as the movement of reels of collector line cable to various locations. The table that outline the exemption requests is found at Attachment No. 1.
The Road Use Agreement as dated October 9, 2014 will continue to apply and will require that all roads, notwithstanding this exemption, be maintained and returned to their original, or better condition to the satisfaction of the Director of Public Works. On the basis of the language of the Road Use Agreement, Township Staff advise that there is adequate language and authority to protect township roads and require that they be maintained in an acceptable manner. Should proper maintenance not occur, the Township can step in and charge all repairs against the proponent’s Letter of Credit.
As a result of discussions with FWRN LP, these recommendations have been refined. The CAO will be briefed bi-weekly, or more frequently as required, about the project and compliance with the Half Load Limit By-law and this recommendation.
FINANCIAL IMPLICATIONSThere are no financial implications associated with this report.
INTER-DEPARTMENTAL COMMENTSThis report has been discussed and reviewed with the CAO, Clerk, Director of Public Works and Township legal counsel.
CONCLUSIONStaff recommends that this report and its detailed recommendations be approved.

As per conversation between WL representative (Mark Slade) and Borea
Construction, WL suggested that the best route for the crane move from T56 to
Haldimand county should follow the description above.

Borea Construction is not requesting all of Vaughan Rd. Only request is for Borea
Construction to access the regional roads from the laydown yard. Borea
Construction is requesting to leave the laydown yard towards Wellandport Rd (27)
and Laydown yard towards Gee Rd, head north on Gee Rd towards Highway 20.
Until the culvert issue has been resolved on Vaughan Rd, Borea Construction is
planning to use Gee Rd to access Highway 20. From Highway 20, Borea is able to
access all the regional roads. Once the culvert is fixed, Borea will be able to use
Vaughan Rd to access Wellandport Rd (27).

FWRN LP Industrial Wind Turbine Project”, dated March 14, 2016, be received; and, 2. That an exemption be and is hereby granted to the Township of West Lincoln Noise
By-law (2013-50), as follows: Category 4 of Schedule ‘A’ (construction equipment) – extension to permit work
at 11 turbines from 6:00 a.m. to 7:00 a.m. and 9:00 p.m. to 12:00 a.m., Monday to Saturday
Category 5 of Schedule ‘A’ (beepers) – extension to permit work at 11 turbines

The representatives of FWRN LP have recently provided an updated and refined request to Township staff (see Attachment No.1) for exemptions from Categories 2, 4 & 5 of Schedule ‘A’ of the Noise By-law 2013-50.
Since February 29, 2016, additional discussions have occurred between staff and the proponent. As a result, more refined recommendations relating to the Noise By-law exemption requests are now provided for Committee and Council to consider.

from 6:00 a.m. to 7:00 a.m. and 11:00 p.m. to 12:00 a.m., Monday to Saturday
No exemption is granted on Sunday. The 11 turbines that are subject to the exemptions are as follows:

to all complaints relating to the exemptions noted in #2 above and that the proponent shall also be required to provide written notice to all property owners within 1 kilometre of each turbine noted above, which notice shall include the names and phone numbers to call regarding complaints about the project. BACKGROUND: Staff was instructed to further discuss the FWRN LP project requests and determine more details with respect to their needs. This report outlines new refined and detailed recommendations for consideration of Council. CURRENT SITUATION: Currently, the Noise By-law restrictions are as follows:
Category 2 (deliveries) – no restrictions in rural area; Category 4 - construction related activities prohibited between 9:00 p.m. to 7:00
a.m. (Monday to Saturday) and 9:00 p.m. to 9:00 a.m. (Sunday and holidays);
Category 5 – (beepers) are prohibited between 11:00 p.m. to 7:00 a.m. (Monday to Sunday), 11:00 p.m. to 9:00 a.m. (Sunday and holidays).
Exemptions are requested and Staff has undertaken a full review of their requests. It is noted that Staff do not support any change to the Sunday hours of operation. Staff, as directed by Council on February 29, 2016, met with representatives of FWRN LP on March 1, 2016 and March 8, 2016. The recommendations of this report now provide more detail and refinement of the requests as originally presented in Staff Report PD-024-16. All residents of non-participating properties are setback in excess of the minimum required provincial setbacks for these turbines. Specific weeks are proposed for each exemption as noted in Attachment No. 1 to this report which represents a new letter of request from Borea Construction. The exception is generally required to operate the crane which will include noise from a motor. The Noise By-law provides an exemption process subject to Council approval. At most, not more than 7 nights of extended hours will be required per turbine, subject to weather conditions. The most recent exemption request that Council has supported was considered as part of the Ministry of Transportation request during the PanAm/Parapan Am games. Similar discussions and exemptions have occurred with developers from time to time due to special circumstances and the impact on neighbouring residents. Allowing extended hours will reduce the construction exposure period during peak commute times and will also help to reduce exposure to traffic safety concerns and reduce the length of time staff will spend on this project which will allow administrative

staff to focus on other projects and/or requirements. In order to regulate and control noise, road impacts and complaints, the proponent has agreed to provide residents within 1 kilometre of each turbine, a written notice that will outline who to contact regarding complaints and the phone numbers of these staff contacts. These contacts will be available on a 24/7 basis to address any and all concerns of the residents. These recommendations have been refined since Staff Report PD-024-16. The CAO will be briefed bi-weekly, or more frequently as required, about the project and compliance with the noise by-law and this recommendation. The purpose of this letter is to request an exemption to Category 2, 4 and 5 in noise bylaw No. 2013-50
from the Township of West Lincoln.
The relevant sections are highlighted below:
Category 2 - “Loading, unloading, delivering, packing, unpacking, or otherwise handling
any containers, products, materials, or refuse, whatsoever, unless necessary for the
maintenance of essential services or the moving of private household effects”
Category 4 - “The operation of any equipment in connection with construction”
Category 5 - “The operation of any auditory signaling device, including but not limited to
the ringing of bells or gongs and the blowing of horns or sirens or whistles, or the
production of any similar sounds by electronic means, except where required or authorized
by law or in accordance with good safety practices”
Duration
From 2016/03/15 (yyyy/mm/dd) to 2016/08/24 (yyyy/mm/dd)
The work being performed during this time will be the wind turbine erection. It involves the use
of cranes to lift and stack tower components. The main source of noise will be the engine of the
crane which is in use. Below is a description of the various crews and their equipment who may
work a night shift should an exemption be granted. Note that not all equipment will be running
simultaneously for the duration of the shift.

Reasoning:
For Borea Construction, the safety of our crews are paramount. Each turbine component
has a prescribed maximum wind speed at which it can be safely lifted. If granted this exception,
crews would be able to assemble components starting earlier in the morning, or later at night when
wind speeds are at the lowest. The exemption to By-Law 2013-50 would allow Borea Construction
to schedule work during the lowest forecasted wind hours, when lifting the components is safest.
Mitigation:
In order to mitigate the noise, only essential personnel will be allowed on site during the
night shift. Additionally, only the Foreman from a particular crew and the site Safety Officer will
be allowed to leave a site throughout the shift. Every attempt will be made to prepare a site for
work during the regular working hours to minimize the effects of the night shifts on the
community.
We believe that it will be most beneficial for the local community for our construction
works on the Niagara Region Wind Farm to be finished as soon as possible so as to make the
minimum disruption to everyday life in this area.
