For the benefit of all, I offer the cau- tionary observation that our society often publicly associates the holiday season with the notion of happy times. I hope all of us achieve that goal of true happiness. The reality, however, is that we may want to keep in perspective the fact that the pressures of life and work, as well as the conflicts and challenges in our relationships with others, do not simply disappear this time of year. In fact, December brings colder weather, shorter daylight hours, and sometimes the added pressure to be “happy” in our lives during the holidays, “just like everyone else seems to be.” As a result, some of us may experience unrealized expectations and related sadness and loneliness that make this time of year more difficult (not easier) to find happiness. Accordingly, please consider the benefits in both heightening our awareness of the hidden challenges this time of year may bring, and making extra efforts to reach out to people in a friendly, compassionate, and civil manner. During December, let’s enhance our individual and collec- tive personal and professional lives by: looking out for and assisting one another; giving others the ben- efit of the doubt in addressing conflict; encouraging understanding and trust; not holding grudges; and, encouraging open and constructive communication. Sharing a kind act may mean a great deal to another person, and may also improve our own well-being. Also, remember that the BAMC’s Lawyer-to- Lawyer Committee is here to help those of us who may be going through a difficult time during the holidays, or at another time of the year, in a confi- dential and caring way. Ceremony, led by Circuit Court JudgesNelson Rupp and Joseph Quirk. This pro-gram, which the BAMC strongly sup-ports, provides non-violent drug offendersan opportunity to avoid stronger sentenc-ing consequences, and to positivelychange the direction of their lives, if theystay clean, sober and employed during aprobationary period. The program partic-ipants face addiction issues, and manyhave been incarcerated. They have beenexposed to dangerous situations, commit-ted serious crimes, and brought turmoil tothemselves and those who care most aboutthem. At the ceremony, each of the pro-gram’s graduates presented a thoughtfuland inspirational speech that expressedremorse and gratitude, and described anawe-inspiring level of commitment, willpower, and personal growth. I recallthat, several years ago, while attendingone of these graduation ceremonies, I wasre-acquainted with a participant who I hadknown in high school. He had been an all-star athlete who seemingly had everythinggoing for him. In speaking with me at theceremony that day, he expressed regretregarding some choices he had made inhis life, and how appreciative he was toget this second-chance to succeed. Thatconversation reminded me that, throughthese and other programs, we as lawyershelp plant the seeds to build a strong, sup-portive, collaborative community thatencourages people to become account-able, productive, and responsible citizens.By planting these seeds, the people whoparticipate, and our society as a whole, reap huge benefits.

As always, I invite you to work and

New Attorney’s Fees Rules

The court of appeals has adopted a new rule for awarding attorney’s fees incivil cases. The new rule, which is Rule 3-741, is effective January 1, 2014.

Below is the Rules Committee note which explains what is intended by thenew rule.

Committee note: Subsection (e) (2) (B) of this Rule follows theapproach set forth in Monmouth Meadows v. Hamilton, 416 Md. 325(2010), for contractual fee-shifting cases generally. Subsection (e) (3) ofthis Rule is intended to permit the court to excuse the need to considerall of the Rule 2-703 (f) (3) factors where the claim for attorney’s feesdoes not exceed the lesser of 15% of the amount due or $4,500.00. Feesin those limited amounts are common in consumer transactions andhave been found reasonable by the General Assembly in some of thosesettings. See Code, Commercial Law Article, §§12-307.1 ConsumerLoans) and 12-623 (Retail Installment Sales).

Defender, State’s Attorney’s Office, andChild Support Enforcement Unit hasimplemented the temporary use of remotevideo from the Central Processing Unit toallow Bench Warrant and BodyAttachment Hearings to be conducted inthe same manner as Circuit Court FridayVideo Bonds for approximately 5 to 6months during the construction/renovationperiod. New exhibit series:

People in the PagesThis month, walkwith wandering poetturned judge, John F.Gontrum, in our newexhibit: People in thePages. This exhibit is

the first of a small series exploring thefascinating lives of local judges andlawyers of long ago who have inscribedbooks in our historic collection.

Judge Gontrum is one of our mostprolific inscribers. He was born inGardenville, Baltimore and lived from1857 to 1909. When he was nine, Gontrumbefriended his teacher, Edward F. Leyh, who was a well-known poet at the time. Itwas this early friendship and Gontrum’slifelong passion for nature that inspiredhim to start writing poetry. AlthoughGontrum wrote poetry on a range of sub-jects, such as family, politics, and mortali-ty, he most often drew inspiration from hisfrequent walks through fields and woods.Within, “In the Greenwood,” Gontrumexpounds: “When the silent mood o’er-takes me, /To the woodland green I hie.”Two volumes of his work were publishedposthumously. Gontrum’s literary abilitywas extensive: while attending St. John’sCollege, Gontrum founded the St. John’sCollegian, a magazine for long formessays and fiction, which continues to thisday.

Gontrum’s literary aptitude fueledhis initial desire to become a journalist. However, his father convinced him other-wise and so in 1880, Gontrum opened upa law office in Towson. Later in life, likehis father, Gontrum presided overBaltimore Orphans’ Court. AlthoughGontrum never cared for public office, hewas admired for his earnest service anduniform courtesy. Until he died, he con-tinued to write in and out of the court-room.Remember – Find your answer fast atthe Montgomery County Circuit CourtLaw LibraryHours: M-F, 8:00 a.m.-5:30 p.m.50 Maryland Avenue, Rockville MD240-777-9120; [email protected]

(Continued from preceding page)

A BALANCING ACTThis is the part of the newsletter that is here to help you de-stress and lead a

more balanced life. Each month, our newsletter will give you a tip thatyou might implement.

Do you feel great about practicing law?

Lawyers take it on the chin in public opinion for a number of reasons, all ofwhich may be untrue and may have nothing to do with you. Law is a helping pro-fession. We help the public. We do it in cases where we get paid and cases wherewe volunteer.

It's important for your own mental and physical health that you own the goodthat you do in the world. You can write it in a mission statement about your practice."I help those charged with crimes exercise their rights before and during proceed-ings" might be an example for a criminal defense attorney.

Ask yourself how each case you are handling might have resolved without yourhelp. This may be why your work matters. We all went to law school to help others.Think of the cases you feel the best about in your career. What happened? Who didyou help? Why do you feel great about that case?

Staying in touch with why we matter as attorneys can mean the differencebetween going to work or being in love with the work you do. It affects your stresslevels, your psyche and your body.

What do you do in your practice that you feel great about?

LAWYER’S LITERARYCIRCLE

The following are the dates of ourfuture meetings and the books which wewill be discussing:

On Thursday, December 12:

Thérèse Raquin, by Émile Zola. IsabelleRaquin (I do not believe that Thérèse andIsabelle are related to one another) -another one of our new members - select-ed this book. Amazon writes that thisbook: “caused a scandal when it appearedin 1867 and brought its twenty-seven-year-old author a notoriety that followedhim throughout his life. Zola’s novel isnot only an uninhibited portrayal of adul-tery, madness, and ghostly revenge, butalso a devastating exploration of the dark-est aspects of human existence.” Whatelse could you ask for?

On Thursday, January 23, 2014:

The Invisible Bridge, by Julie Orringer.Amazon (again) writes that “Andras Lévi,a Hungarian-Jewish architecture student, arrives [Paris, in 1937] from Budapestwith a scholarship, a single suitcase, anda mysterious letter he promised to deliver. But when he falls into a complicated rela-tionship with the letter’s recipient, hebecomes privy to a secret that will alterthe course of his – and his family’s – his-tory.”

On Thursday, February 20, 2014,

we will be discussing one of JudgeHamilton’s recommendations - Giant, byEdna Ferber.

With some rare exceptions, all of ourmeetings are held in the offices of Miles& Stockbridge P.C., 11 North WashingtonStreet, Suite 700, Rockville, Maryland20850, and begin at 4:30 in the afternoon. If any of your friends and associateswould like to join our group, all they needto do is to show-up for any of our meet-ings – everyone is always welcome toattend and snacks are always served.

And, as I sometimes ask: Please giveme any of your comments, or sugges-tions, as to how our group is doing.

for information.

Technology is perhaps the most constant-ly and rapidly changing field of modernbusiness, and its ubiquitous incorporationinto other fields – including the law –often means that those other fields strug-gle to keep pace with its newest develop-ments.

One of the technological develop-ments reshaping the legal field today isthe expansion of “cloud computing.”Broadly speaking, cloud computingrefers to an entire suite of services offeredby providers, including off-site informa-tion storage, transmission and processing.Among the types of services offered bycloud computing providers are web-basedemail (such as Gmail or Outlook) andonline data storage (Carbonite, Dropbox,or Apple’s iCloud).

The service providers, which typical-ly own (but sometimes lease) the hard-ware which processes, transmits, and/orstores the information, allow their cus-tomers to take advantage of economies ofscale. Customers essentially share accessto the off-site hardware at a very smallfraction of what the hardware would cost. The customers also benefit from reducedinformation technology service and main-tenance costs. Thus, the use of cloudcomputing in an attorney’s practice canmake business sense.

The use of cloud computing in busi-ness raises ethical considerations forattorneys, particularly with respect totheir duties when handling client infor-mation. There are many ethical rulesimplicated by such use. The most notableinclude:

• Diligence (MD Rule 1.3);• Confidentiality (MD Rule 1.6);• Communication – specifically, therequirement that an attorney “promptlycomply with reasonable requests forinformation” (MD Rule 1.4); • Safekeeping property (MD Rule1.15).

One can imagine the problems thatthe use of cloud computing may raisewith respect to these ethical rules. For

example, accidental disclosures of orunauthorized access to a client’s informa-tion stored in an online data storage facil-ity could violate the rule of confidentiali-ty. An attorney’s temporary inability toaccess the client’s online-stored informa-tion (due, for example, to the serviceprovider’s website crashing) could vio-late the communication rule articulated inMaryland Rule 1.4(a)(3).

Although the Maryland State BarAssociation’s Ethics Committee has notissued a formal opinion regarding the use ofcloud computing in the practice of law, itnoted in its 2012/2013 Annual Report a“marked increase…in the number of hot-line inquiries, particularly related to…cloudcomputing” (http://www.msba.org/sec_comm/committees/ethics/). Otherjurisdictions have squarely addressed theissue. Until Maryland issues a formalopinion on the matter, its attorneys cantake guidance from the opinions issuedby other states.

At the end of 2012, the American BarAssociation conducted a survey of ethicsopinions that dealt with the use of cloudcomputing technologies, and it found that14 states – almost all of them locatedeither in New England or on the westcoast – have addressed the issue. TheABA published a helpful chart on thestates’ opinions, including “specificrequirements or recommendations” con-tained in each state’s opinion. The ABA’schart can be found here:(http://www.americanbar.org/groups/departments_offices/legal_technology_re sou rce s / r e sou rce s / cha r t s_ fy i s /cloud-ethics-chart.html).

Particularly persuasive for attorneysusing cloud computing and wonderinghow they can do so ethically is the fact thatevery one of the 14 states in the ABA’sreport concluded that the use of cloudcomputing by attorneys is permitted. Inaddition, each state opined that the stan-dard of care required of attorneys usingcloud based services is “reasonable care.”

Common elements of this standardseen across the multiple opinions general-ly obligate the lawyer to:

• Know how the provider handles thestorage and security of data;• Assure that the vendor has anenforceable obligation to maintain confi-dentiality;• Assure that the vendor is obligated togive notice if there's a breach;• Assure that data is transmitted to thevendor in a secure fashion; • Assure adequate backup; • Consider getting express client per-mission for especially sensitive data.

A useful example is the informalopinion issued by the Professional EthicsCommittee of the Connecticut BarAssociation quoted at the beginning ofthis article. The Connecticut Committeelikened cloud computing vendors to othervendors hired by an attorney, in whichcase the attorney is required to undertake“reasonable efforts” to ensure that theservice provider is “competent and reli-able.” The opinion can be read in itsentirety here: (http://www.ctbar.org/userfiles/Committees/ProfessionalEthics/Opinions/Informal_Opinion_2013-07.pdf).

Maryland attorneys should be mindfulof the central rule underlying the cloudcomputing ethics opinions issued by otherstates. Even though cloud computing is anew technology, traditional ethics rulesapply to its use within the practice of law.Maryland attorneys remain bound by thoserules, and should take reasonable care thattheir use of cloud computing satisfies theirethical obligations.

THE ETHICS OF CLOUD COMPUTING FOR LAWYERS“[T]he need for a lawyer to thoughtfully and thoroughly evaluate the risks presented by the use of

current technology remains as vital as ever.”-Connecticut Bar Association Professional Ethics Committee, Informal Opinion 2013-07, June 19, 2013

December 4, 2013 March 5, 2014January 8, 2014 April 2, 2014February 5, 2014 May 7, 2014

June 4, 2014All meetings are open and any mem-

bers of the BAMC are welcome to attend.Meetings are held on the 1st Wednesdayof the month at 8:00 a.m. in theAdministrative Judge’s ConferenceRoom 309 on the 3rd floor of the CircuitCourt building in Rockville

The Clerk of the Court, LorettaKnight, brings the following matters toyour attention:

Rule 1-322.1: Exclusion of Personal

Identifier Information in Court Filings.

By a Rules Order filed on May 1, 2013,the Court of Appeals adopted new Rule 1-322.1, effective July 1, 2013, to requirethe exclusion of certain personal identifierinformation from court filings.Subsequently, by a Rules Order filed onJuly 2, 2013, the Court of Appeals amend-ed Rule 1-322.1 on an emergency basis(effective July 9, 2013), and also adopteda new companion rule, Rule 1-322.2 (witha deferred effective date of July 1, 2014).The amended Rule 1-322.1 differs fromthe original in several important ways.First the amended Rule now applies onlyto “pleadings and other papers filed in anaction” – in other words, litigation records– and not to “administrative records, busi-ness license records or notice records” asdefined in the Rules. Second, the amend-ed Rule clarifies that it does not apply tofilings by “a judge or judicial appointee.”Third, the amended Rule no longer classi-fies birthdates as personal identifier infor-mation requiring exclusion from filings.Fourth, the amended Rule now allowsonly two exceptions, for: financialaccount identifiers specifying the propertyallegedly subject to forfeiture in forfeitureactions, and the record of an administra-tive agency proceeding. The companionrule, Rule 1-322.2, when it takes effect onJuly 1, 2014, will require filers to include,in each covered filing, a certificate con-firming their compliance with Rule 1-322.1.

SUMMER SCHOLARS PIPELINE PROGRAM

December, 2013 The Bar Association of Montgomery County, MD Newsletter 15

Nearly four years ago theMontgomery County Bar Foundationpartnered with three specialty bar associ-ations and leading law firms inMontgomery County to launch theMontgomery County Summer ScholarsPipeline Project (the “Pipeline”). Wereport that the Pipeline is doing well, thanks to the dedication of our participat-ing law firms, in conjunction with ourlocal and specialty bar associations.

The Pipeline is the Bar Foundation’s pro-active effort to enhance MontgomeryCounty’s legal community by reaching outto talented and diverse individuals tolaunch their legal careers here in our coun-ty. Outstanding law students from theregion are recruited to work as interns atlocal law firms each summer in exchangefor a modest stipend and the opportunity todevelop relationships with practicing attor-neys and our legal community.

On Saturday, November 2, 2013, we spon-sored our annual “Kick-off,” featuringspeed interviews with ten leading lawfirms of the county. The students selectedfor the interviews were rigorously vettedand nominated by the Maryland Hispanic,Asian Pacific American, and J. FranklynBourne Bar Associations. Over the courseof six hours, each nominee interviewedwith every law firm and they are nowawaiting the matching process for a sum-mer placement. We had a luncheon as partof the program, which was well attendedby leaders of our bar association and thisyear, those present were treated to two fas-cinating presentations. MontgomeryCounty’s own, Mayda Colon-Tsaknisspoke of the day she entered law schooland was told by the dean that as a Hispanic

female he was expecting her to fail. Notonly did she prove him wrong, but Ms.Tsaknis has enjoyed a wonderful legalcareer and is personally responsible for thecreation of a state-wide bar association, theMaryland Hispanic Bar Association.

We also heard from “the Godfather of diver-sity” in Montgomery County, the HonorableAndy Sonner. Judge Sonner reflected ontimes when there were no persons of colorworking in the courthouse or on the countypolice force. He spoke passionately, encour-aging those present to continue the marchtoward making a community that welcomeseveryone. Both presentations were spell-binding and inspired the younger ones in theaudience to think long and hard about mak-ing Montgomery County the final destina-tion of their legal careers.

The Pipeline is a success and is prov-ing to be a win-win for both the law firmsand the students. The law firms enjoy theopportunity to bring in legal interns from apool of candidates that are sometimes diffi-cult to find. The students enjoy the oppor-tunity to experience our legal communitywith the support of our bar associations asa whole. Some of the participating lawfirms only accept Pipeline Scholars as legalinterns during the summer. Nearly all haveoffered their Scholars bonuses and/or part-time work after their summer internshipshave concluded. The Summer Scholarsrave about their “real work” experiencesand have come to love the legal culture ofMontgomery County. They return to theirlaw schools and eagerly spread the wordabout how great it is to work as a lawyer inthe county. We are proud of the three

Summer Scholars who have been hired toserve as law clerks. Carolina Rizzo clerkedfor Judge Marielsa Bernard, JourdanBrooks clerked for Judge Herman Dawson, and Yisel Valdez will be clerking for JudgeRonald Rubin in the year to come.

Of course, none of this would be possiblewithout the leadership and assistance pro-vided by our Bar Foundation staff, name-ly Yesenia Mendez. The DiversityCommittee also wants to express itsappreciation for the assistance that theJudges of the Circuit Court and theMontgomery County Sheriff’s Officehave given to this project.

DISTRICT COURT BENCHBAR COMMITTEE

December 5, 2013 March 6, 2014January 2, 2014 April 3, 2014February 6, 2014

Meetings are held at 8:00 a.m. in theJudges Conference Room in the DistrictCourt Building, 191 East Jefferson St.,Rockville, MD.

The District Court Bench BarCommittee held its November, 2013,meeting on November 7, 2013.

There are several topics of interestthat the Bar should be aware of.

New Rules of Procedure

Criminal Rules: There has been asignificant amount of controversy anddiscussion concerning the Court ofAppeals decision in DeWolfe v.Richmond. This is the decision that dealswith the right to counsel at the earlieststages in a criminal matter.

The implementation of the require-ments of the DeWolfe v. Richmond casewere on hold due to a Motion forReconsideration which has recently beenruled upon. The case has been remandedfor the Circuit Court of Baltimore City toissue a declaratory judgment in accor-dance with the mandate of the Court ofAppeals. This declaratory judgment willpresumably be issued in the near future.

In the meantime, the Court ofAppeals has adopted emergency rules onNovember 6, 2013, which is the samedate as the Court of Appeals order thatresolved all of the other pending issues inthe Richmond appeal.

The Rules that were adopted by theCourt of Appeals on November 6, 2013,govern the implementation of theRichmond decision, but as of that time, andthe time of submission of this article to theBar Newsletter, the rules are not in effect. The rules will take effect upon further orderof the court, and will apply to all actionscommenced on or after the date specified inthe further order. Accordingly, these newrules are on hold as of November 6, 2013.

Civil Rules: The Court of Appeals hasadopted a new rule concerning the awardof attorney’s fees in District Court civilcases. Elsewhere in this Newsletter are thecomments from the Rules Committeeregarding the intent of the new rule. Thisrule will be effective January 1, 2014.

Court Administration

Continued Trial Dates: It is a sug-gested practice for attorneys who requestcases to be continued due to conflicts, toclear dates with both sides so that furtherconflicts can be minimized. The courtwill honor those requests subject to avail-

ability and scheduling on the appropriatedocket. However, due to case and docketmanagement issues, the new proposedcourt date should be within 60 days of theinitial court date being continued. This isdue to limitations on cases being resolvedwithin time constraints that are imposedon the court.

Time Limits for Court Hearings andTrials: The court has a policy that trialsshould not be started if the trial can notbe concluded by 4:30 pm. The courtdoes not want to unnecessarily incon-venience court staff by requiring thecourt to remain open after normal busi-ness hours.

STATE’S ATTORNEY’S ASSIGNMENTS

WE NEEDVOLUNTEERS

The Family Law SelfHelp Center is in need of vol-unteer attorneys to help selfrepresented litigants in fami-ly law matters with legalinformation and/or legaladvice. If you have a desireto serve self represented liti-gants you can help in one oftwo ways:

1. Impromptu Volun -teering: If you happen to beat the Courthouse between12:00 pm and 2:00 pm andhave a little time to spare, stop by and see one, ormaybe two, clients. Wealmost always have clientswaiting during lunch hours, and could use your assis-tance.

2. Scheduled Volun -teering: If you have moretime to spare or prefer a morestructured arrangement, please contact our Bar liaison:Judi Bluefeld, (301) 279-7817, [email protected],or stop by and consult withthe Center staff. In that way,we can let you know when theCenter will be shorthanded, and can most use your valu-able assistance.

Time that you volunteerat the Family Law Self HelpCenter can be counted as ProBono hours to the Court ofAppeals.
