As I welcome each new year, my thoughts inevitably turn to changes that will occur in the months to fol- low. I suspect that the same occurs for most of our members. A new calendar year is a nat- ural time to take stock of where things stand and, if necessary, resolve ourselves to make necessary changes. One particular change that is on the horizon for our members is the adoption of electronic filing in our courts. During the past year, I have aended numerous bar events and meetings where the conversation turned to how this will affect the daily practice of law. While younger aorneys are unfazed, I can assure you that many of our more seasoned members are terrified by what they view as a fundamental change to the practice of law. My belief is that we ain’t seen nothin’ yet. Our lives are already dominated by machines. Computers now manage nearly every aspect of a modern law practice. Like many of our members, my career has straddled the conversion from typewriters to computerized word processing, fax machines to email and library research to Westlaw. Simply keeping pace with emerging technology requires significant time and effort. Last year, my office made the decision to aempt what can best be described as a technological tri-fecta: the simultaneous updating of our bookkeeping soſtware, our time and billing system and our firm’s website. Researching the available options required phone calls to trusted colleagues in the bar and a great deal of hard work. The task was intimidating to say the least. By comparison, the conversion to the M-DEC filing system will be a breeze. Admiedly, I have the advantage of having e-filed in the District of Columbia, the U.S. District Court and Prince George’s County. I can assure our more concerned members that, aſter you get the hang of it, you will be a convert. The system is user-friendly, intuitive and, frankly, much more efficient than paper filing. And, there is nothing to prevent you from stopping by the Clerk’s Office if you want to visit with the fine folks who work there. What is truly intimidating to me is the unknown. During the past year, I have attended numerous bar events and meetings where the conversation turned to how this will affect the daily practice of law. Keating, Esq., the Judges of the Circuit Court for Mont-gomery County have appoint-ed Steven J. Bienstock, Esq. as a Standing Examiner, pursuant to MD Rule 2-542. Effective No-vember 26, 2017, Mr. Bienstock will be the court’s Standing Ex-aminer for all Discovery In Aid of Enforcement ordered pursu-ant to MD Rule 2-633 (a) and (b). The party requesting Discovery In Aid of Enforcement must schedule a hearing date with the Standing Examiner, prior to the filing of its motion for examina-tion. The Special Examiner’s fee is set at $150.00, payable to the Special Examiner, by the sched-uling party, and exclusive of any filing fee. The Special Examiner’s

fee shall be taxed as a cost to the judgment debtor. Examinations may be scheduled by contact-ing the Law Office of Steven J. Bienstock at 301-251-1600. computerized record keeping, research and communication into our offices over the last two decades, the actual prac-tice of law is, for the most part, remarkably similar to how it was practiced one hundred years ago.

The concern that we should all have as attorneys is that real change will happen, and hap-pen quickly. Few could have predicted that a ride-sharing app on a mobile phone would be able to take down the taxi-cab industry in what seems like the blink of an eye. And I get it — with just a few taps on my phone, I am virtually assured of a clean car and a polite driv-er who will deliver me quickly to my destination. I don’t even have to take out my wallet. Amazon has, likewise, changed my life. Instead of dreading December trips to the mall for Christmas shopping, stacks of boxes with Amazon Prime stickers magically appear on my desk. I haven’t entered a mall in years.

The same brilliant minds who brought you Uber and Amazon are now eyeing our profession. And there is plenty of incentive to do so. It is predicted that, by 2018, the legal services industry will generate nearly $300 bil-lion in revenue. We are already familiar with companies such as Avvo which operates like an Angie’s List for lawyers. Others such as Hire An Esquire and Priori Legal have similar mod-els and offer “hand-curated” lawyer referrals. These com-panies have changed how the public searches for an attorney

but not necessarily how those services are provided once a lawyer is identified.

The real change will come from companies attempting to ac-tually replace what lawyers do. LegalZoom and Nolo al-ready promise direct delivery of legal contracts and estate documents via the internet. A mobile app called Shake offers instantaneous binding con-tracts via mobile devices. Cli-ents are more “do-it-yourself” than ever and even those who ultimately hire an attorney are far better educated in the law. Many of the new clients I meet have already researched their issues on-line and have, at a minimum, a working un-derstanding of the legal issues presented.

The American Bar Association, in an effort to get out in front of these developments, recent-ly commissioned a two-year study on the future of legal services and the effects of tech-nology, globalization and “oth-er forces” that will transform their delivery. Virtual lawyer-ing and artificial intelligence are common examples along with e-discovery, alternative billing, legal outsourcing and unbundled legal services. Ac-cording to the commission’s understated conclusion, emerg-ing technology has placed our profession at the “cusp of a dis-ruption.”

Another major “disruption” that is currently affecting the legal industry is the effect of “millennial” attorneys on the profession. At some confer-ences, I have heard significant

(Continued from page 1) criticisms by older attorneys regarding the headaches that they claim to have experienced in attempting to integrate mil-lennials into their firms and bar associations.

I can tell you, however, that my experience as bar president has been far different. The young-er members of our Association are incredibly motivated and involved. We have created a Leadership Development Academy that is forging the next generation of bar leaders. Members of our New Practi-tioners Section often provide the heavy lifting for our com-mittees and sections and are the go-to members for our com-munity outreach initiatives.

But here’s the really important part: our millennial members are going to be responsible for ushering our Association — and

the practice of law — into the next generation of law practice. They have been immersed in technology for their entire lives. Computers and technology are not feared by them; they are embraced. Social media is how they communicate. We need to recognize and utilize these skills to adapt and compete.

If we, as attorneys, are to avoid the fate of taxicab companies, it is the next generation of law-yers who will be instrumental in accomplishing that. Change is coming. That is assured. The question is whether our profes-sion will be able to identify and utilize emerging technologies to better deliver legal services before someone else does.

use disorders, depression, eating disorders and adult self-harm. The stress of practicing law can be an

As technology has progressed, the use of social media has be-come a necessity for many law firms. In 2016, seventy-four per-cent of lawyers said their firms maintained social media net-works, and seventy-six percent reported that they individually had social media accounts for professional purposes.1 Lawyers also commonly find themselves in a position to give clients ad-vice about the disposition of the client’s social media. This article explores ethical issues posed by social media in two contexts: when the lawyer ad-vises a client about the client’s social media, and when the law-yer advertises his own services using social media online.2

Advising clients about the use and management of social media: Lawyers typically deal with their clients’ social media in the context of a dispute or a transaction. Maryland Rule of Professional Conduct (MRPC) 19-301.1 imposes a duty of com-petence. Comment 6 requires a lawyer to “keep abreast of changes in the law and its prac-tice.” It does not touch upon social media or the internet. The analogous ABA rule does contain amended comment 8, which explains that the duty includes staying abreast of “the benefits and risks associated with relevant technology.

While the standard is not ex-plicit, a lawyer should assume that “competence” in the mod-ern age includes the obligation to understand whether and how social media may affect a client’s rights in various cir-cumstances. That would en-compass the context of litiga-tion or transactions, where a lawyer should assume a duty to warn a client that existing social media might be accessi-ble to third parties and could be used against him.

There is a countervailing re-sponsibility, however, to avoid “spoliation” of information that may be relevant to a dispute.

This is not merely a procedural issue. Maryland Rule of Profes-sional Conduct 19-303.4 admon-ishes that a lawyer shall not “unlawfully obstruct another party’s access to evidence or unlawfully alter, destroy, or conceal a document or other material having potential ev-identiary value. An attorney shall not counsel or assist an-other person to do any such act.” A lawyer who warns a cli-ent that his social media may be deleterious cannot disregard the risk that this may motivate the client to “take care of it” in the underworld sense.

While formal published cases are scant, the DC Bar issued an ethics opinion giving guid-ance on these issues.3 The DC committee held that a lawyer’s duty may include the duty to review the client’s social media for information inconsistent with the client’s legal position in a matter. The lawyer must address any inconsistencies be-fore striking a legal posture for the client to ensure that any claims or positions asserted are meritorious. The same consid-eration arises in transactions, where social media content could potentially contravene representations, warranties, covenants, conditions, restric-tions, and other terms or pro-posed terms of agreements.

With respect to litigation, the committee advised that, because of the duty to preserve, a lawyer may need to include social media in advice and instructions about the litigation-hold. It held that the lawyer also “may need” to determine whether clients may permissibly modify their social media content once litigation is anticipated. While the committee characterized these obligations as possible, experience teaches that most courts would probably consider them mandatory.

There are meaningful examples. In one Virginia case, a plaintiff’s lawyer told his client to “clean up” his Facebook page, despite

having received discovery re-quests from the opposing par-ty.4 The lawyer did not advise the client to preserve the con-tent, and the circumstances in-dicated the lawyer intended for the data to disappear. Ultimate-ly, the court imposed a sanction on the lawyer of $542,000 and on the plaintiff of $180,000.

In another case, a plaintiff al-leged that work-related injuries rendered him disabled. The de-fendant employer sought access to the plaintiff’s Facebook page.5 When the defendant accessed the page, Facebook sent an alert to the plaintiff. The plaintiff then deactivated his account, and, pur-suant to Facebook’s policy, the page was deleted after fourteen days. Since the plaintiff’s posts were unrecoverable, the judge ruled the jury should be given an adverse inference instruction unfavorable to the plaintiff.

While deleting relevant con-tent permanently could likely be problematic, lawyers are not bereft of tools to protect their clients. The North Carolina Bar published an opinion with some useful guidance.6 It counseled that lawyers can, and probably should, warn clients not to post additional harmful content on their accounts in the future. It also pointed out that a lawyer might comply with rules con-cerning preservation by advis-ing the client to delete the posts while retaining possession of dig-ital or printed images. Finally, it suggested that changing the pri-vacy settings on open material to make it private may be compli-ant with the applicable duty to preserve. This would be the case in Maryland where the duty to preserve does not include a duty to gratuitously make adverse in-formation available to the public.

Advertising and Endorse-ments on social media: Anoth-er potential snare for attorneys is the website, LinkedIn. Every user’s profile contains a “skills and experience” section, and is followed by a section where

third parties can “endorse” the user for specific skills. While many lawyers use this site pri-marily to create professional networks, the rules of ethics still govern these interactions.

• Endorsements: Specifical-ly, MRPC 19-307.1 states, “[a] lawyer shall not make a false or misleading com-munication about the law-yer or the lawyer’s services.” The Maryland State Bar has opined that it is an eth-ical violation not to remove misleading endorsements even if the content is post-ed by a third party to that user’s page.7 It is important that users regularly check their endorsements and verify that they accurately reflect their abilities.

• Skills and Experience: A more complex question is: how can an attorney ethically list her skills on LinkedIn? MRPC 19-307.4(a) permits an attor-ney to communicate that he or she does or does not practice in a particular field of law.  The rule was expanded in 1992 with the addition,”[a] lawyer shall not hold himself or herself out publicly as a special-ist.” This amendment has created uncertainty about LinkedIn because attor-neys want to advertise the focus of their practice, but they fear the repercussions of holding themselves out as a “specialist.” The Mary-land Committee opined that listing skills or prac-tice areas in this section is not a violation of 19-307.4 because it is unlikely to be misleading to the public. As long as the user does not use words like “expert” or “specialist” the skills and experience section can list specific areas of practice without violating the rules of ethics.

Chief Judge Thomas E. Dew-berry of the Maryland Office of Administrative Hearings (OAH) will be the section’s guest lec-turer for the annual meeting. The working theme is “Meet

the Chief of OAH!” Please plan to attend!

The members also discussed further programming for up-coming section meetings where guest lecturers will be featured.

What is Ligamentous Damage?The spine is held together by muscles, tendons and ligaments. They give the spine its flexibility and stability. When there is damage to a muscle, it is called a "strain". When there is damage to a ligament, it is called a "sprain". While the majority of muscle injuries are transient (4-6 weeks), ALL ligament injuries are permanent. ("once stretched, always stretched") They do not heal the same way that muscles do, and that is why some patients heal in 4-6 weeks (muscle damage) while others suffer for months and even years (ligament damage). That is why it is crucial to visualize and document these ligament injuries. Without this documentation, it is very difficult (if not impossible) to prove that your clients are injured and insurance adjusters will often make "low ball" settlement offers, especially if there is minimal property damage.The Importance of an Early Diagnosis:Auto insurance claims adjusters are notoriously skeptical of "soft tissue" injuries where there is no demonstrable evidence of injury. If ligament damage can be documented at the onset of treatment, carriers set aside higher "reserves" for the BI claim, as they know this is a much more serious injury than a simple "muscle strain" and will likely settle for a higher dollar amount. With a simple "strain" diagnosis, they are skeptical of all treatment beyond 6 weeks, but with a ligament "sprain" diagnosis, there is no arbitrary treatment cutoff.Ligament Injuries Settle for Higher Dollar Values:When it comes time to settle a case, almost all carriers utilize a computerized program known as "Colossus" to generate ranges in settlement offers. Colossus heavily weighs documented evidence of spinal ligament damage (verifiable with DMX digital motion X-Ray), and that often equates to a permanent impairment rating, which results in increased settlement offers or jury awards.

This is the tragic story of Amanda B.In January of 2014, Amanda was involved in a rear end collision that severely injured her neck and back. She suffered for months with severe and debilitating headaches, neck and back pain. After five normal MRIs, two CT Scans and dozens of static X-Rays, the insurance carrier stated that she was not injured and that everything was in her head, or even worse, that she was faking it.Luckily, her attorney recently learned of an emerging imaging technology known as DMX (digital motion x-ray), and referred her for a cervical (neck) scan. FOR CIVIL CASES AND PROCEDURES, OR OF GENERAL INTEREST

HOLIDAY SCHEDULE:District Court will close early on Friday, December 22, 2017 and again on Friday, Decem-ber 29, 2017, closing at 2 PM on each of those dates.

During the week of December 26-29, 2017, many courtrooms will be dark because of the limited availability of “visiting judges.” Check the Judges Schedules section of the BAMC website for up to date informa-tion.

COURT CLOSINGS DUE TO INCLEMENT WEATHER:As we get into the winter and possibility of bad weather, the court advises that the weather closing procedure will be the same as last year. The Circuit Court and the District Court will make a joint decision re-garding whether there will be any court closing due to bad weather. The decision is made no later than 5:00 in the morn-ing. As soon as a decision is made the major news outlets are notified, as well as the Judi-ciary website.

DATE ON PLEADINGS:This has been mentioned be-fore, but it is important to re-member to put the pending trial or hearing date on the caption of your pleadings un-der the case number, especially with motions. The clerk’s offic-es get backed up and will try to

give more immediate attention to pleadings that involve cases that are coming up in the near future.

PROCEDURESDISTRICT COURT COMMISSIONERS; PUBLIC DEFENDER ELIGIBILITY:As a reminder, District Court Commissioners are still re-quired to conduct interviews and provide forms for all peo-ple who are seeking represen-tation by the public defender’s office. Although commission-ers can conduct eligibility in-terviews 24 hours per day, an applicant must still complete the process more than 10 days before the trial date set in the case. Applicants must also see the public defender’s office within the same deadline if they expect to talk with their assigned public defender.

We have been informed that the District Court has recently been down four commission-ers, causing some backlogs to occur.

MENTAL HEALTH COURT:The District Court has been re-viewing standard procedures for mental health court in an effort to make it more predict-able when persons in the pro-gram are being moved through the system and out into civilian life. Incentives are currently being discussed.

The court is still at full capaci-ty but there is a waiting list for people interested in the pro-gram who have not yet been assessed and admitted.

Althought Judge Mitchell is still involved in the program, Judge Sabett is handling the Thursday dockets more fre-quently. Judge Sarsfield is pro-viding backup.

Alternative Client Invoicing – PayPal

No attorney wants to spend 20 minutes or longer for the time it takes to faithfully the follow the data entry rules and the several steps required of the big dog software packages in or-der simply to generate a small invoice. It’s just not worth it. And that’s the dilemma. But instead of writing it off or hop-ing that client will call back when a meatier, more “worth it”

matter comes along, consider this alternative. PayPal is a highly successful online billing portal with excellent security that offers a very quick and highly effective online method of invoicing that’s perfect for those small bills or the one time client billable consultations we might other-wise write off.

It’s often written that as a group, attorneys are the worst when it comes to the business side of practicing law. You know — billing, collections, profit and loss, that sort of thing. And while I ba-sically agree with that particular nugget of conventional wisdom, I do try and stay on top of the back office side, so critical in private practice. But for a while today I was stymied when trying to generate a quick invoice on a new client-consultation-only fee. Full disclosure, it’s been many years since I’ve offered clients free in-office consultations in my practice specialty (education and school law exclusively for students and families).

The problem for me (and many of you, I suspect) is when, like earlier today, I need to generate a quick invoice but refused the hassle of having to input bunches of data otherwise required of my gimongous law practice management program. So, when faced with my frustrating billing dilemma I suddenly came up with a quick online solution that you too can benefit from know-ing. Normally, I send out invoices using Clio, a full turnkey law office practice management program. QuickBooks is another outstanding online program commonly used to invoice clients. Clio and QuickBooks are but two of the software packages from the current listing of many large dedicated programs lawyers and law offices call upon regularly. But the problem with us-ing these big data programs is simply that to be fully functional, they are integrated into every aspect of the practice and are just not set up for a fast one time client invoice.

Instead sign on as a (free) merchant with PayPal and use the no cost customizable invoicing software available to merchant users. I predict, you’ll be super glad you did!

PRO BONO PROGRAMBy Debbie Craven, Program CoordinatorLet’s give a Warm Welcome to the year that starts a new! Happy New Year 2018! As you get busy making New Year’s resolutions, here is a quick wish from the Pro Bono Pro-gram. Please Volunteer!

When people earn little in-come and need assistance, it doesn’t make a difference to them what others in Maryland are earning. With our small staff in place, we continue to try and help as many people in need as possible. This is where you come in and can make a difference. The Montgomery County Bar Foundation Pro Bono Program continues to seek volunteers – whether experienced or newly barred attorneys – to join our panel. There are many county resi-dents that are in great need of pro bono services. Within the last five months alone, 1094 cli-ents contacted the Pro Bono-Program, seeking assistance for their legal issues; 649 com-

munity residents were advised at our five legal clinics.

There are two ways for county residents to receive FREE LE-GAL SERVICES in civil cases – at a legal advice clinic or through the client intake line for refer-ral to an attorney volunteer for direct representation. The legal advice clinics operate in five lo-cations across the county and provide residents the opportu-nity to walk-in and meet with an attorney volunteer without scheduling an appointment. Eligible clients present their legal problems to an attorney and receive free immediate le-gal advice and/or referral to a non-profit or government so-cial service agency that may be helpful. The client intake line operates out of the main office where the staff screens calls from potential clients. The Pro Bono Program staff conducts all screenings over the phone only. Cases referred to attorney volunteers include family law, debt collection, bankruptcy, limited employment, limited immigration, wills and power of attorney.
