Scammers make easy assumptions about their victims and seem to “know” a great deal about them to bol- ster their credibility. And they count on others to be too polite and respectful of the privacy of their elders—particularly with respect to financial maers—to offer help or even raise the topic without being asked. Some of us fear that such a gesture may be mistaken for snooping or bad manners or worse—opportunism. Do it any- way! Raise the topic of scammers who pose as tax collectors, law enforcement, banking or service providers with whom your older friends deal. Even when elderly victims are not perceptibly frail or failing in mind or body, they can be vulnerable at times just the same. Recently I was saddened and shocked to learn that a dear friend some 30 years my senior had been defrauded of a lifetime of retirement sav-ings—everything but the house to which my

friend’s family had moved during the Eisenhower administration. Shortly after the death of my friend’s last immediate family mem-ber, my friend was targeted, threatened, harassed and then de-frauded. More than a half century of savings and pension benefits relied upon to support a comfortable retirement were gone in a few days’ time. Even though the scam was discovered fairly quick-ly, less than 7% can be recovered. My friend was lucky to preserve the family home.

The Honorable Gale E. Rasin (Ret.) served Baltimore City admirably for more than twenty years, starting in the District Court for Baltimore City and later in the Circuit Court for Baltimore City. Prior to her judicial career, Judge Rasin was the Director of the Maryland Attorney General’s Office Medicaid Fraud Control Unit. NEW DEADLINE FOR CIVIL TRACK III- JOINT PRETRIAL STATEMENTSEffective September 1, 2016 all civil cases assigned to Track III have an advanced deadline for the filing of the Joint Pretrial Statement. The deadline will now be seventeen (17) days pri-or to the Pretrial Hearing. The new deadline will only effect cases filed on or after Septem-

ber 1, 2016 and will be reflected in both the Scheduling Order and the Order for Mandatory Settlement Conference/Pretrial Hearing. If you have any ques-tions regarding this change, please contact Rick Dabbs, DCM Coordinator at 240-777-9358 or [email protected].

ONLINE TRANSCRIPTION ORDERING PROCESSIn an effort to streamline the process of ordering tran-scripts, you no longer need to place orders through the Court’s Technical Services De-partment.    To order a tran-script, simply go to the Court’s website home page and click on the link on the left hand side to submit a Transcript Request.  The request will be forwarded to the transcription contractor, Deposition Ser-vices, Inc., and the contractor will provide you with an esti-mate.  You will work directly with the Deposition Services

Montgomery County Police detectives to investigate and prosecute scammers. Program Manager Kelly Davis will work with attorneys to put them in touch with MCP personnel to investigate and take action (including the issuance of war-rants to recover any funds that can be located) immediately when such a crime has oc-curred. The State’s Attorney’s Office has published a helpful brochure describing the work of this Unit.

In addition to law enforcement resources, the Aging and Dis-ability Resource Unit of the Montgomery County Depart-ment of Health and Human Services provides general—yet personalized—assistance to seniors, persons with disabili-ties and caregivers. The Unit not only offers referrals, but it helps those in need to de-termine their eligibility and to apply for services. Its staffers are on duty covering phones, meeting with clients at senior and community centers, and even making home visits and conducting other outreach ac-tivities.

On a related note, after helping my friend I saw a posting on the MSBA Criminal Law Sec-tion listserve seeking advice on obtaining screening dispo-sitions of crimes committed by seniors—perhaps due to the onset of depression, dementia or some other psychological or physiological issue. Unbe-

knownst to me at the time, these crimes are all too com-mon. Also unbeknownst to me, the DHHS Area Agency on Ag-ing and our State’s Attorney’s Office are part of a working group formed months ago to address this issue and others. Just this month County Execu-tive Ike Leggett joins the group to kick off Montgomery Coun-ty’s Dementia Friendly Amer-ica Initiative. Seizing the Moment

On Saturday November 5, 2016, around 8:00 a.m. at the Montgomery County Circuit Court Courthouse, fi � een law student candidates, along with a� orneys and judges quietly fi led on to the 8th fl oor to begin the process of match-making. This of course was no ordinary big dance, but a measured movement of selecting Summer Scholars for the Montgomery County Summer Scholar Pipeline Program. A steady din of noise began as members of law fi rms se� led in and gathered at their respective rooms to interview the candidates for the long day ahead.

For the last six years, the Diversity Commi� ee of the Montgomery County Bar Foundation has organized and im-plemented the Summer Scholars Pipeline Program. Along with the participating Montgomery County law fi rms, the specialty bars such as the J. Franklyn Bourne Bar Association, the Maryland Hispanic Bar Association and the Asian Pacifi c American Bar Association, participated in the program to fulfi ll its mission of diversifying the legal community in Montgomery County, Maryland.

Each of the specialty bars nominates fi ve student candidates, and the total group of fi � een law students become interviewees for summer clerkships. The Speed Interviews, as they are called because they resemble speed dating, all took place on November 5th, with the fi � een candidates interviewing with all ten fi rms. Because of their ongo-ing commitment to the program and to diversity in our County, we are honored to recognize these fi rms by name. They are:

One of the highlights during the Interview day were remarks made by Montgomery County Circuit Court Judge Sharon V. Burrell. The Honorable Judge Burrell, reminded the audience of treating each other civilly and with re-spect because you never know with whom you may come across down the road. With leaders from all three of the specialty bars also present that day, it is clear that this program holds a distinctive place in Maryland, with Mont-gomery County leading the way by example.

Over the years, Summer Scholars have gone on to serve as law clerks to Montgomery County Circuit Court judges as well as federal judges, and some have found permanent homes with the fi rms they were recruited by for the sum-mer. The program provides a tremendous opportunity for the fi � een candidates to showcase their talents in ways that their resumes alone may not reveal. In turn, the fi rms have an opportunity to gain from cultural perspectives and viewpoints that they may not already have on board. By connecting law student nominees of the specialty bars with participating law fi rms for summer clerkships, it is the goal that these students may later become associates of the fi rms following graduation and members of our County Bar.

The commitment to diversity and inclusion is a call to action, not just rhetoric, by working to make the halls of our courts and our law fi rms look more like the community-at-large. We refl ect upon what it means to have a legal sys-tem that works for all. We applaud the fi rms who participate year a� er year and who strive to promote the promise of opportunity and achieve the goal of diversity in their own ranks.

Ethics: On-Line Matchmaking Services Revisited and the Latest from the MSBA Ethics CommitteeDavid Briglia, Esquire Legal Ethics Committee

SheaLast February, this column featured an article about the recent crop of online, for-prof-it legal matchmaking services which offer to match those seeking legal services with a qualified attorney who can meet a client’s specific needs. The article highlighted two sig-nificant ethical obstacles facing Maryland attorneys who wish to accept referrals through on-line legal matchmaking sites: the prohibition against fee-sharing with non-lawyers under Rule 5.4(a) of the Mary-land Lawyer’s Rules of Profes-sional Conduct (“MLRPC”); and the prohibition against referral fees under MLRPC Rule 7.2(c).

Recently, the MSBA’s Commit-tee on Ethics issued an opinion on the subject — Ethics Dock-et No. 2016-14. This opinion is important, not only because it provides timely guidance in a rapidly evolving area in the le-gal profession, but also because it directly addresses the ethical propriety of an online match-making service model.

The company in question in Docket No. 2016-14 allows law-yers to advertise their availabil-ity to provide fixed-fee, limit-ed-scope legal services, at prices set by the marketing company, through its website. The client uses the company's website to purchase legal services, choos-es the lawyer the client wishes to hire, and pays the company a fixed-fee in advance for those services. Once the lawyer com-pletes the service, the company

pays the lawyer the full fixed-fee paid by the client. In a sep-arate transaction, the lawyer pays the company a per-service "marketing" fee, which is set by the company and differs in amount depending upon the fixed-fee paid by the client. Al-though the Committee’s opin-ion does not specifically iden-tify the marketing service in question, it appears to closely resemble the service offered on Avvo.com.1

Under MLRPC Rule 7.2(c), law-yers generally cannot pay re-ferral fees. But the company in question in Docket No. 2016-14 does not recommend or refer a client to a particular lawyer. Rather, the client chooses the lawyer from the company's online directory of lawyers in a particular geographic area. For this reason, the Committee concluded that the company is not operating a referral service

Lawyers also cannot share le-gal fees with non-lawyers un-

der MRPC Rule 5.4(a) (except in certain limited situations that do not apply to an online legal services program). An at-torney may, however, pay the reasonable cost of advertising under MRPC 7.2(c). Thus, what the Committee regarded as the “key question” in the sce-nario presented was whether a per-service "marketing" fee charged by the online legal ser-vice was a fee for legal services impermissibly shared with a non-lawyer, or instead a rea-sonable cost paid for advertis-ing.

In deciding whether the fee paid would constitute imper-missible fee-sharing or a per-missible advertising fee, the Committee reviewed several of its past opinions. In Docket No. 2012-07, it was concluded that the fee paid to a daily deal website was an advertising cost, even though the website collected fees from the client in advance, and the fee paid by

the lawyer to the website was based on a percentage of the fee paid by the client. In doing so, the Committee determined that a daily deal website was merely a form of advertising and the fee paid by the lawyer was the cost of advertising.

In Docket No. 2007-01, the question was whether a law-yer could pay a fee to appear in an online directory. Because the fee paid by the lawyer was not tied to any payment by a client, the Committee deter-mined that the fee paid by the lawyer was an advertising fee and, therefore, did not violate Rule 5.4(a).

In Docket No. 2004-21, the Committee focused on wheth-er a lawyer could pay a fee to be listed in an online legal directo-ry when the fee was paid only when the lawyer was retained by a client who learned of the lawyer through the directory. The company providing the online directory required law-

yers to pay the fee to the com-pany from the lawyer's operat-ing or business account and to agree not to charge the fee to the client. The Committee de-termined that because the fee was contingent upon the client retaining the lawyer, the fee ef-fectively came from the client even though the fee was paid from the lawyer's operating or business account. The Com-mittee concluded that such an arrangement constituted an impermissible fee-sharing ar-rangement with a non-lawyer.

In its recent decision, after re-viewing the above opinions, the Committee concluded that the fee charged for participa-tion in an online fixed-fee legal program is most analogous to the fee charged to participate in the online legal directory discussed in Docket No. 2004-21. The lawyer would pay the fee only if the lawyer was re-tained by the client. Regardless of the fact that the fee arrange-

ment would be structured as two separate transactions, the Committee found that the fee would effectively be paid by the client because the fee paid to the company is tied directly to the fee earned by the lawyer.

Other facts suggested to the Committee that the service model considered in Docket No. 2016-14 was an impermissi-ble fee-sharing arrangement: The company, rather than participating attorneys, speci-fied the types of legal services that may be provided, set the fees for each legal service, and changed the fee due from the lawyer depending upon the amount of the fee charged to the client.

The Committee concluded its opinion in Docket No. 2016-14 by noting that a lawyer's rela-tionship with online, fixed-fee, legal services programs can present other potential ethi-cal issues under the Maryland

Lawyers’ Rules of Professional Conduct, some of which are discussed in Docket No. 2012-07. The Committee thus rec-ommended that any lawyer considering an arrangement with an online fixed-fee legal

A CALL FOR MENTORS

How to Ask for HelpAs attorneys, we provide help to others every day, whether it’s working with our clients to resolve their problems or pro-viding advice to an associate or colleague. But when it comes to ourselves, we are awful at seek-ing out assistance. Psycholo-gist Ellen Hendriksen, PhD, ex-plains the top reasons we don’t ask for help and how to get over them.

1. Fear of being a burden. Remember that most people love to help. It makes them feel good!

2. Fear of admitting we are out of control. Look at your problem as a separate “thing” that needs to be defeated. You and your helper become a team.

3. Fear of owing a favor. Rather than thinking of yourself as in-debted, think about feeling grateful.

4. Fear or appearing weak. Reframe your need for help from one of failure to handle something on your own to one of seeking out expert advice on the issue.

5. Fear of rejection. Include your insecurity about asking in your request. “I’m hesitant to bring this up but…”

RANDOM SCREENINGThe random screening process has been in use for six months and means that attorneys will occasionally have to go through full screening just like the pub-lic. The court is satisfied that it is working smoothly and not causing undue delay so the proj-ect will continue at least several times per month at each court lo-cation. There is a possibility that it will be expanded to full time, so attorney input to the Bench Bar co-chairs would be appreciated.

CONTINUANCE REQUESTS AND MOTIONSOnce again the court is re-questing attorney cooperation with continuance requests and motions.

a. Put the pending court date under the case number.

b. State what the conflict is with the court date, which court date was set first, any good cause claimed, and the position of opposing counsel.

c. In civil cases it is essential to seek agreement on new date(s)

that are proposed and noted in the motion.

d. If a motion concerns a crimi-nal case where the defendant is incarcerated, it is probable that the ruling will be deferred to the judge in open court.

OVERSCHEDULINGInsurance defense counsels are requested not to have more than two trials at the same time. The court does not want to tie up resources, parties and witnesses waiting for attorneys.

CRIMINAL CASESIf a bench warrant has been is-sued for a defendant who failed to appear for a DUI Prelimi-nary Inquiry, the Clerk’s Office is being instructed to withdraw the bench warrant if defense counsel enters an appearance and makes that request.

If a defendant failed to appear to a date where he was issued a summons to received charges, counsel must appear personal-ly at the Clerk’s Office to sign a special waiver that only the Clerk’s Office can provide you.

Again, a bench warrant could be recalled more simply.

Attorneys seeking to waive a preliminary hearing must file a written waiver not later than 4:00 p.m. on the Wednesday be-fore the Friday preliminary hear-ing. If that deadline is missed, the lawyer and the client must appear personally on Friday. No State’s Attorney has authority to waive either the appearance of the attorney or the client.

Where the Maryland Rules per-mit a special appearance in a criminal case, the exact nature of the limitation must be set forth in the line of appearance. Failure to do so might result in the attor-ney remaining generally.

EMPOWERING THE ENDOWMENT FUNDThe Endowment Commi� ee of the Montgomery County Bar Foundation is responsible for managing the Endowment Fund established by the Foundation more than 20 years ago primarily through the initial kind and substantial contribution of the estate of Bill Canby, Esq., a past president of the BAMC and the Foundation. The primary focus of the Endowment Fund, as set forth in its Operating Proce-dures, is the promotion of social welfare by supporting projects or programs that benefi t the Mont-gomery County community in whole or in part and/or demonstrate the Bar Foundation’s ability and interest in assisting others in the Montgomery County community. It is a mechanism for the members of our Bar Association to contribute fi nancially to the needs of our community in a way that allows the Bar Association and its members to interact and support the community outside of its need for legal services.

To pursue these directives requires a substantial sum of money. As recently as 2014, the balance of the Endowment Fund peaked in the vicinity of $120,000. In addition to the Canby family contribution, several members routinely make contributions in recognition of other members or in response to the referral of clients to their offi ces from bar members. The Endowment Commi� ee has pursued various

ventures to raise funds for the Endowment Fund, such as the dunking booth at the Ba� le of the Barristers and the Honor a Lawyer program. While successful in their own ways, the income from these eff orts cannot commence to allow for the ongoing support of the programs to which the Endowment Fund has been contributing, or allow for the continued growth in the number of community programs that it can support.

In recent years, we have made annual contributions to Drug Court and the Special Olympics. As well, we have assisted the Bernie Scholarship Awards Program to allow it to complete an Eff ectiveness Study required for supporting its numerous grant requests to fund its scholarship programs in Montgomery County. The Endowment Commi� ee has a strong desire to increase the presence of the Bar Foundation and its members in various local programs, but the funding is not where it needs to be for this goal to be pursued further.

As many of you are no doubt aware, the idea behind an endowment is to have suffi cient capitalization to provide for a steady stream of income to meet the goals and programs of the endowment. The increased activity of our Endowment Commi� ee has resulted in a substantial erosion of the principal balance of our Endowment Fund over the last several years due to insuffi cient income and donations. The Bar Foundation has its own annual budget, reviewed and approved by the Board of Directors, and the usual budgeted income of the Foundation is not a source of revenue for the Endowment Fund. The BAMC has a Strategic Planning Commi� ee chaired by Casey Weinberg Florance. Under the direction of her predecessor, James Mood, a new fi ve year plan was established for the Association and Foundation. One of the Operational Priorities of the Strategic Plan approved by the Executive Commi� ee is the full development and funding of the Endowment Fund to provide greater infl uence and a more comprehensive presence of the Bar Association and Foundation in the community through the Fund.

A signifi cant step has already been initiated in pursuit of this priority by this year’s Leadership Development Academy fellows. They have made the fi nancial growth of the Endowment Fund the Leadership Development Academy’s annual program. Please look to their eff orts in the next several weeks to initiate recurring automatic, electronic fi nancial contributions by members to the Fund in whatever amount each member feels comfortable in making. Bill Canby would be proud to know that Joe Suntum’s diligence is responsible in no small part for making this program a recurring source of revenue for the Endowment Fund. We ask that everyone consider their charitable contribution goals before the tax year comes to an end and support the eff orts of the younger members of the Bar Association, through the Leadership Development Academy, in this regards.

It is the season of Giving and Thankfulness. We have a lot to be proud of and thankful for due to our professional experiences. Please allow us to help our neighbors and clients through the Endowment Fund of the Bar Foundation.

Please give thought to, old school style, writing a check to the Bar Foundation and noting in the “memo” section that it is for the Endowment Fund. Electronically, you can make a contribution by going to the BAMC’s website and access the donation site through the Bar Foundation’s link to the Endowment Fund. As well, for our long term goals, please assist the Leadership Devel-opment Academy fellows’ eff orts to satisfy the objections of their project by contributing to the Fund through their project in the coming weeks and months.

• The Montgomery Coun-ty Office of Consumer Protec-tion (OCP), is responsible for enforcing consumer protec-tion laws to ensure a fair mar-ketplace for consumers and businesses.  Its investigators have expertise in many types of consumer transactions and they investigate and resolve consumer complaints, engage in consumer education and outreach, license certain busi-nesses, and administer sever-al programs.  Of relevance to the Real Estate Section, the OCP administers the Estimate Real Property calculator, with the assistance of the Board of Registration for Building Contractors licenses new home builders, enforces the County’s new home warranty law, engages in enforcement

actions against unlicensed contractors, and investigates complaints involving home improvement.  The OCP also provides free mediation ser-vices to consumers and to merchants and otherwise welcomes the involvement of counsel in the process.

• The CCOC conducts admin-istrative hearings on disputes between members of condo-minium and homeowner as-sociations and issues binding decisions.  The CCOC also provides a mandatory training class for directors of the asso-ciations and is an advocate for the well-being of the County’s 1000+ community associa-tions.

When people earn little income and need assistance, it doesn’t make a difference to them what others in Maryland are earning. With our small staff in place, we continue to try and help as many people in need as possi-ble. There are many county res-idents that are in great need of pro bono services. As of July 1, 2016, 984 clients contacted the Pro Bono Program, seeking as-sistance for their legal issues; 596 community residents were advised at our five legal clinics

by an unfailing group of very committed attorneys.

In her Oct. 25, 2011 USA Today article, “Law Schools Pressed to Tell the Truth on Job Place-ment, Debt,” Mary Beth Mar-klein pointed out some very important specifics which in-cluded information pertaining to “burnout”. This is where you come in and can make a differ-ence. So that our Program can continue to thrive for our com-munity residents, let us work together to prevent that from ever happening. I am asking those of you who are not cur-rently volunteering to join our panel, even if it is just a couple of hours every other month.

There are two ways for coun-ty residents to receive FREE LEGAL SERVICES in civil cas-es – at a legal advice clinic or through the client intake line for referral to an attorney vol-unteer for direct representa-tion. The legal advice clinics operate in five locations across the county and provide resi-dents the opportunity to walk in and meet with an attorney volunteer without scheduling an appointment. Eligible cli-

ents present their legal prob-lems to an attorney and receive free immediate legal advice and/or referral to a non-profit or government social service agency that may be helpful. Cases referred to attorney vol-unteers include family law, debt collection, bankruptcy, limited employment, limited immigration, wills and power of attorney.

Our Family Law Training Ses-sions known as the Rita Rosen-krantz Family Law Training are currently available via webcast to attorneys for free in exchange for agreeing to accept a family law case.
