Introduction

Human trafficking is a grave violation of the most fundamen-tal human rights. According to reports published by the United Nations, 2.4 million people fall victim to human trafficking every year. In Europe alone, 140,000 cases are registered each year. Wo-men and children are particularly affected by human trafficking. Besides illicit drug and arms trafficking, human trafficking has become the largest global form of transnational organised crime. According to United Nations estimates, criminal organisations generate annual revenues of 32 billion dollars from trading in the “human being as a commodity”.

Because of its geographical location at the centre of Europe, Aus-tria is affected by human trafficking both as a transit country and target destination. Experience has shown that human trafficking in Austria predominantly involves cases of sexual exploitation, slave-like situations of domestic workers and child trafficking.Austria is a party to all relevant international legal instruments on combating human trafficking. By ratifying the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime in autumn 2005 (Federal Law Gazette III No. 220/2005), Austria undertook to take all neces-sary steps in order to combat this crime. Austria was the first EU Member State to ratify the Council of Europe Convention on Action against Trafficking in Human Beings in October 2006. Austria was also one of the first European states to be evaluated by the Coun-cil of Europe’s Group of Experts (GRETA, Le Groupe d’experts sur la lutte contre la traite des êtres humains) in the years 2010/2011. The Austrian Report as well as the recommendations from the experts’ group that were adopted by the Committee of the Parties

on 26 September 2011 are taken account of in the National Action Plan on Combating Human Trafficking 2012-20141.

The Task Force on Combating Human Trafficking (TF-HT) was set up in Austria by a Ministerial Council Resolution adopted in November 2004 (cf. item no. 22 of the Council Resolution Minutes No. 70 of 9 November 2004). It is headed by the Federal Minis-try for European and International Affairs (FMEIA) and charged with coordinating and intensifying the measures taken by Austria in combating this crime. The Task Force on Combating Human Trafficking is composed of representatives of all competent minis-tries, including outsourced agencies, the federal provinces and non-governmental organisations. On 10 March 2009, Director-General Ambassador Dr. Elisabeth Tichy-Fisslberger was appoin-ted First Austrian National Coordinator on Combating Human Trafficking (cf. item no. 13 of the Council Resolution Minutes No. 10) and chairperson of the Task Force on Combating Human Trafficking. Multi-annual reports are prepared on the activities of the TF-HT as well as on all measures taken by Austria to combat human trafficking. The First Austrian Report on Combating Hu-man Trafficking (covering the period from March 2007 – February 2009) was submitted to the Council of Ministers on 10 March 2009 (cf. item no. 13 of the Council Resolution Minutes No. 10). The Se-cond Austrian Report on Combating Human Trafficking covering the period from 2009 to 2011 is submitted to the Austrian Federal Government together with the National Action Plan on Combating Human Trafficking (NAP) 2012-2014.

A dedicated Working Group on Child Trafficking was set up within the Task Force on Human Trafficking in 2007. Headed by the

Federal Ministry of Economy, Family and Youth, this Working Group is composed of representatives of the Federal Ministries of the Interior, of Justice, and for European and International Affairs, the federal provinces’ youth welfare authorities, non-governmental and international organisations. One of the Working Group’s major goals is to facilitate and improve the identification of victims of child trafficking. To this end it prepared a folder that was made available to all authorities that may possibly come into contact with potential victims of child trafficking. Another focus of the Working Group’s activities is to improve support to victims of child trafficking by fostering cooperation and coordination. The NAP 2012-2014 provides for the continuation of the activities performed by this Working Group. Supplementing the general actions and activities in the field of prevention and victim support, the NAP 2012-14 outlines a number of actions that are specifi-cally directed at combating child trafficking. More information on actions taken by Austria in combating child trafficking is availa-ble on www.kinderrechte.gv.at and in the two reports prepared by the Working Group for the years 2007-2009 (cf. item no. 13 of the Council Resolution Minutes No. 10 of 10 March 2009) and for the period 2009-2011, the latter of which is also submitted to the Austrian Federal Government.

The Working Group on Prostitution, headed by the Women’s Directorate at the Federal Chancellery, was set up in June 2007. Experts from all competent ministries, the federal provinces, the specific non-governmental organisations active in this field, the Austrian Federal Economic Chamber and the Austrian Chamber of Labour contributed to this Working Group. The Working Group on Prostitution completed its activities in June 2008 by preparing a final progress report on “Prostitution in Austria – Legal Situ-ation, Effects, Recommendations” (“Prostitution in Österreich –

Rechtslage, Auswirkungen, Empfehlungen”). This report was also submitted to the Council of Ministers on 10 March 2009 (cf. item no. 13 of the Council Resolution Minutes No. 10). In implementing one of the recommendations contained in this experts’ report, a special inter-disciplinary working group that covers all federal provinces was set up to focus specifically on the federal provinces’ scope of responsibility. The Working Group on Prostitution – the Provinces’ Scope of Responsibility (Arbeitsgruppe-Länderkom-petenzen “Prostitution”) is charged with dealing in detail with issues and solutions that fall under the federal provinces’ scope of responsibility. The first progress report prepared by the Working Group on Prostitution – the Provinces’ Scope of Responsibility is submitted to the Austrian Federal Government in summer 2012. In order to guarantee the continuation of the information and dis-cussion platform thus set up, the NAP 2012-14 also provides for the continuation of this Working Group. One of the TF-HT’s main tasks is to prepare and implement the Austrian national action plans on combating human trafficking and to monitor their implementation. National action plans on combating human trafficking were adopted by the Austrian Fede-ral Government in March 2007 (for the period from 2007-2011; see item no. 24 of the Council Resolution Minutes No. 8 of 28 March 2007) and in May 2009 (for 2009-2011; see item no. 19 of the Council Resolution Minutes No. 20 of 26 May 2009). The Austrian national action plans reflect the comprehensive approach taken in combating human trafficking, which covers national coordination, prevention, victim protection, criminal prosecution and internatio-nal cooperation.

This Third National Action Plan on Combating Human Trafficking for the period 2012-2014 (NAP-HT 2012-2014) consists of 5 chap-

ters. The individual actions are objectives that are to be achieved in line with the Austrian legislation in force. Entitled “National and International Coordination and Cooperation”, Chapter I deals with activities aimed at further developing the TF-HT, strengthe-ning cooperation with the federal provinces and participation and collaboration in programmes and projects at international level. The actions included in Chapter II on “Prevention” are geared towards raising awareness within the Austrian population as well as among specifically identified occupational groups of the issue of human trafficking. The relevant activities include both training measures and awareness-raising events that attract public atten-tion. Chapter III deals with “Victim Protection” and contains ac-tions and activities that contribute to identifying potential victims of human trafficking and measures aimed at ensuring the provisi-on of comprehensive counselling, care and support as well as im-proving the social integration of victims of human trafficking. This chapter also includes specific supplementary measures relating to the protection of child victims. The actions outlined in Chapter IV “Criminal Prosecution” aim inter alia to promote enhanced coope-ration between law enforcement authorities and non-governmental organisations. A special action relates to the implementation of the provisions contained in Directive 2011/36/EU of the European Parli-ament and of the Council of Ministers on preventing and combating trafficking in human beings2 that entered into force on 15 April 2011 (OJ L 101, 15.4.2011, p. 1). Chapter X “Evaluation/Monitoring” assesses the measures and actions Austria has taken so far in combating human trafficking.

In line with the United Nations’ recommendations, governments play a central role in preparing National Action Plans. Thus the

competent federal ministries holding primary responsibility and/or within whose scope of competence or responsibility the imple-mentation of the relevant actions fall, are explicitly specified in the NAP-HT 2012-2014.

In this context, the role played by the Austrian Development Agen-cy (ADA) as the agency responsible for Austrian Development Co-operation (ADC) differs from that assumed by the Austrian federal ministries since it is an outsourced agency which is mandated by the State of Austria with implementing international projects aimed at combating human trafficking.

Close collaboration with the federal provinces on all levels (pre-vention, victim protection, criminal prosecution and international cooperation) is of key importance. In this context, a meeting with representatives from the federal provinces was held in June 2011 that focused particularly on trafficking for the purposes of sexual exploitation and child trafficking. As a result of this meeting, a de-dicated “contact person for matters related to human trafficking” was appointed in every federal province.

The representatives of civil society and non-governmental or-ganisations (NGOs) also play an essential role in preparing and implementing the NAP-HT 2012-2014. In Austria, NGOs are indis-pensible partners in the context of protection of victims of human trafficking and with respect to preventive measures. Without their commitment and active involvement the Austrian Federal Government would not be able to fulfil these important tasks in line with international requirements. In Austria, numerous NGOs are pro-actively involved in combating human trafficking. The NGO LEFÖ-IBF (Intervention Centre for Trafficked Women) plays a special role in this regard. In contrast to other NGOs it acts on the basis of a government mandate granted under Art. 25 of the Aust-

rian Security Police Act, which means that a legal structure in the form of a “partnership” exists between two government agencies (the Federal Ministry of the Interior and the Women’s Directorate at the Federal Chancellery) and LEFÖ-IBF. For this reason the National Action Plan includes some actions for which LEFÖ-IBF is named as the competent organisation holding responsibility for their implementation. Other players, including the NGO ECPAT Austria (End Child Prostitution, Child Pornography and Trafficking of Children for Sexual Purposes) and the research institution Ludwig Boltzmann Institute of Human Rights, are also members of the TF-HT and important partners in preparing and implemen-ting the NAP-HT 2012-2014. In contrast to LEFÖ-IBF, however, they do not explicitly act on the basis of a government mandate and thus cannot be named as being primarily responsible for the implementation of actions. The Task Force on Human Trafficking also cooperates closely with other Austrian NGOs and institutions that provide support to victims of human trafficking as well as the Human Rights Advisory Council (Menschenrechtsbeirat).

The Task Force on Combating Human Trafficking collaborates intensively with international organisations including UNODC (the Vienna-based United Nations Office against Drugs and Crime), the OSCE (Organization for Security and Co-operation in Europe, Office of the OSCE Special Representative and Co-ordinator for Combating Trafficking in Human Beings) and IOM (International Organization for Migration). The NAP-HT 2012-2014 also includes projects and initiatives that are implemented in close coopera-tion with international organisations. Furthermore, Austria is a member of the informal EU Network of National Rapporteurs or Equivalent Mechanisms on Trafficking in Human Beings and contributes pro-actively to this network that is chaired by the EU Anti-Trafficking Coordinator.
