8 Admission Requirements and Procedures Including Recognition of Prior

Learning (RPL)

The Admission: Recruitment and Support Policy (E1) and Recognition of Prior Learning (RPL) Policy (E4) is available for viewing in the institutional policy booklet, as well as electronically on the student and staff interactive platform (ECI). Admission to Embury’s qualifications are subject to the following requirements:

Matric obtained from 2008 onwards:

National Senior Certificate (higher certificate endorsement);

minimum rating of 3 (40 – 49%) in four subjects from the designated list; and

8.1 Admission procedure

Candidates that want to apply for Embury’s programmes need to follow the admission procedure outlined in the Admission: Recruitment and Support Policy (E1). Candidates should:

8.1.1 All applicants must complete an Application Form and submit the form together with either their Grade 11, Grade 12 mid-term or Trial Results. Application Forms, course

information and fee schedules can be obtained from the Student Recruitment Department or the website at: www.embury.ac.za

8.1.2 Successful applicants are provisionally accepted on the basis of qualifications or requirements yet to be completed. Any student receiving provisional acceptance will also receive an Enrolment Contract, which provide further information about the terms and conditions once the applicant has accepted Embury’s offer. The Enrolment Contract can be obtained from the Student Recruitment Department or the website at: www.embury.ac.za Final acceptance only takes place once the NSC Statement of Results becomes available.

8.1.3 Applicants who have completed Grade 12 and are already in possession of a matric certificate will be accepted provided that they meet all admission and institutional requirements.

8.1.4 The admission criteria are based on the applicant’s APS score and Embury’s admission requirements. The APS score is calculated by adding the levels for each subject obtained in the NSC examinations, excluding Life Orientation. A minimum APS score of 25 and a degree endorsement will give an applicant provisional acceptance into a degree programme. Applicants who do not meet the requirements for Bachelor of Education degrees may apply for either the Higher Certificate or Diploma in Pre-School and Foundation Phase Teacher Assistant programme.

8.2 Recognition of prior learning

The Recognition of Prior Learning Policy (E4) is available for candidates seeking alternative methods of application.

General guidelines 8.2.1 Embury will apply the process of Recognition of Prior Learning for access to a

qualification or module and the process of Credit Accumulation Transfer for the awarding or exemption of credits.

8.2.2 Embury recognises forms of prior learning and experience as equivalent to the prescribed formal minimum admission requirements or the award of advanced standing in particular programmes through exemption from modules.

8.2.3 Applicants who do not hold a National Senior Certificate (NSC) with the appropriate exemption may be considered for access via the RPL route. The RPL application will be evaluated against the entry requirements of the qualification in question.

8.2.4 Applicants who have prior learning and experience may be considered for award of advanced standing in particular programmes through exemption from modules at lower levels of the qualification programme. The RPL application will be considered against the module content, learning outcomes and assessment of specific modules and the overall programme outcomes.

8.2.5 The institution will not grant an individual exemption for more than 50% of the modules/courses required for any particular qualification. A person must obtain 50% of the credits at Embury for a qualification that is awarded by Embury.

8.2.5.1 The same set of prior knowledge may not be used for obtaining more than one qualification.

8.2.5.2 Credits are not awarded for modules that are exempted in terms of the RPL process and the total number of credits will be less than the minimum number of credits required for the award of the qualification.

8.2.5.3 On successful completion of the programme and award of the qualification the official certificate will be awarded. The academic transcripts of those who were

exempted from some modules will reflect exemptions achieved through the RPL process, but with no credit points attached.

8.2.5.4 Not more than 10% of a cohort of students in a programme will be admitted through the RPL process.

8.2.5.5 The assessment criteria for RPL will include the knowledge and skills gained in practices outside the higher education institution in terms of their value for the particular programme and/or modules.

8.2.5.6 The relevant academic department will be responsible for setting the assessment criteria and assessing the learning achieved by RPL.

8.2.6 RPL Approval Process

8.2.6.1 Students who do not meet the minimum admission requirements for an Embury qualification can apply for access based on their age or relevant work experience for the qualification. Students applying for access via RPL will have to undergo an assessment of prior learning.

8.2.6.2 The applicant needs to complete the Form for Recognition of Prior Learning (EITE 008) which can be obtained from the Student Support Department.

8.2.6.3 Practical work place experience and competence in the relevant field of study will be assessed by means of written proof of previous employment and/or practical on-site demonstration of a selection of skills relating to the core focus of the course.

8.2.6.4 The relevant academic department(s) will be responsible for setting the assessment criteria and assessing the learning achieved by RPL. The relevant HOD(s) will be responsible for co-ordinating the process and providing a recommendation to the RPL panel of assessors.

8.2.6.5 An RPL panel of assessors will be constituted by the Academic Committee and chaired by the Head of Faculty. It will consist of the Head of Faculty, Head: Curriculum and Programme Development, relevant programme co-ordinator, relevant Head of Department(s), and a workplace partner (where appropriate). It will consider the report tabled by the relevant academic department and provide a recommendation along with a report and supporting evidence for consideration and approval by the Academic Committee.

8.2.6.6 The Head of Faculty will table the application at the Academic Committee. Applications for RPL will considered by the Academic Committee and a decision made about admission to a programme or exemption from modules.

8.2.6.7 Student Support Department will communicate the decision of the Academic Committee to the applicant.

8.2.6.8 Applicants have a right to appeal the decision of the Academic Committee. A letter of appeal and supporting evidence must be provided to the Student Support Department. Student Support Department will table the application for appeal for consideration at Academic Board. The decision of the Academic Board is final.

9 Language policy

English is the medium of business, instruction and administration at Embury, unless the module is a non-English Home or Additional Language module.

The language modules offered in Embury teacher qualifications are informed by government policy outlined in the Minimum Requirements for Teacher Education Qualifications (MRTEQ) (19 February 2015 Government Gazette No. 38487). For more detailed information please consult the Language Policy (E5).

12 Accreditation Status of Each Registered Programme

All Embury programmes, as outlined in (11 – Details of Each Registered Programme) are accredited with the Council on Higher Education (CHE) and registered with the Department of Higher Education and Training (DHET) and with the South African Qualification Authority (SAQA) on the National Qualifications Framework (NQF).

13 Rules Relating to Assessment, Academic Credit Accumulation and

Transfer, Progression and Qualification

13.1 Assessment

Every Embury module has a clearly defined assessment strategy and assessment weighting method per mode of delivery. Embury uses both continuous assessment (CASS) – also referred to as formative assessment – and summative assessment to assess student competence. Certain Embury modules may have CASS and summative assessment in place, while others may use only CASS.

13.1.1 Types of assessments

13.1.1.1 Formative Assessment includes all assessment tasks that take place to provide feedback to the students and lecturer during the teaching and learning process. The formative assessment tasks do not contribute towards the module assessment mark.

13.1.1.2 Summative Assessment includes all assessment tasks that take place at the end of a period of learning and measures student achievement. The summative marks contribute towards the final module assessment mark.

13.1.1.3 CASS refers to all summative assessment tasks that take place during the module to assess students’ achievement. These assessments are used to calculate the student’s DP mark and final mark. Certain Embury modules may have CASS tasks and an examination at the end of the module, while others may have only CASS tasks to assess student achievement, i.e. there is no examination at the end of the module.

13.1.2 Formative and summative assessment

13.1.2.1 All Embury modules must have a clearly defined assessment strategy and

assessment weighting, per mode of delivery. 13.1.2.2 All modules must include both formative and summative assessment tasks.

Formative assessment tasks take place to provide feedback to the students and lecturer during the teaching and learning process regarding the student’s progress. The formative assessment tasks do not contribute towards the final module assessment mark. Summative assessment tasks take place at the end of a period of learning and measures student achievement. The summative marks contribute towards the final module assessment mark, for example, formal tests, assignments, presentations, portfolios, research projects, class tasks etc. Class tasks are activities that take place during the lecture that are assessed and count toward the DP Mark, for example presentations.

13.1.2.3 Continuous assessment (CASS) refers to summative assessment tasks completed during the module to assess student achievement. These are used to calculate the student’s DP mark. Certain Embury modules may have CASS tasks

and an examination at the end of the module, while a CASS module have only CASS tasks to assess student achievement, i.e. there is no examination at the end of the module.

13.1.2.4 For contact-learning (CL) students, all examinable modules of 12 credits or less are subject to a minimum of at least two summative assessment tasks (CASS) prior to the formal examination. For distance-learning (DL) students, all examinable modules equivalent to a CL semester module of 12 credits or less are subject to a minimum of at least one CASS assessment task prior to the formal examination. For all continuous assessment modules there must be a minimum of five assessment tasks.

13.1.2.5 For contact-learning (CL) students, all examinable modules more than 12 credits are subject to a minimum of at least three summative assessment tasks (CASS) prior to the formal examination. For distance-learning (DL) students, all examinable modules of more than 12 credits are subject to a minimum of at least one summative assessment tasks (CASS) prior to the formal examination. The CASS assessment tasks should include three formal tests and one formal assignment.

13.1.2.6 The number and types of assessment tasks are detailed in the study letter per module.

13.1.2.7 All continuous assessment modules must have at least 5 formal assessments tasks.

13.1.2.8 Class tests and examinations are conducted from Monday to Saturday. 13.1.2.9 For distance-learning (DL) students, tests which form part of the formative

assessment tasks will be made available online on ECI. All online tests will be auto-marked and students will receive immediate feedback on their performance and on all questions not answered correctly.

13.1.2.10 Assignment dates must be established and logged on the Embury Assessment Calendar prior to the commencement of the academic year and should be strictly adhered to. Class tests must be written during the designated weekdays and Saturdays according to the Embury Test Timetable.

13.1.2.11 Consideration will be given to ensure that students do not have to submit or write more than three assessments per week, Monday to Saturday.

13.2 Exemption from class tasks/tests/exams/ handing in of assignments

13.2.1.1 Students may only be exempted from writing a test or participating in a scheduled assessment due to medical reasons or due to death or other extraordinary family circumstances. A medical certificate must be produced within three working days of the termination of the period for which the medical certificate is issued. This can be e-mailed, faxed or delivered to the National Student Support Centre (Student Support, previously known as Student Affairs). This must be followed by the original certificate to be handed in within 24 hours of returning to campus. Requests for extraordinary circumstances must be submitted in writing to the Head: Quality Assurance and Enhancement, with proof, as soon as the student becomes aware of the event.

13.2.1.2 Students who are chosen to represent their province or country, in an official capacity in sport or culture, may also be granted exemption subject to written proof of such selection being provided by the officially appointed coach of the team. The letter must be submitted to Student Support, prior to the lectures or

test, for authorisation. Once Student Support has received the authorised letter, the relevant student/s will be notified by e-mail.

13.2.1.3 Students who are absent from lectures for any reasons other than those mentioned above, are not entitled to any further academic support from staff for lectures covered in the student’s absence.

13.2.1.4 Students who wish to be exempted from a test or exam due to religious reasons, must submit a formal, written request explaining the reasons for the request and must provide all relevant documentation in support of this request, to Student Support for due consideration. The following applies when such requests are received: Embury observes all Government recognised religious and public holidays in the planning of the academic programme, which includes recognising Saturdays as an official working day for the purpose of conducting lectures and writing of tests or exams as and when it may be required. Embury will endeavour to accommodate all major religious beliefs, doctrines and denominations, allowing individuals or groups to exercise their beliefs freely without these practices interfering with the Embury academic programme or other faiths. The accommodation of such requests should not cause an actual cost to Embury, to employees and students, or disruption, or impose an undue hardship on the conduct of the institution’s operations.

13.2.1.5 Students who are granted permission to be exempted from a test or exam based on religious considerations, are granted permission with the understanding that they will be afforded an opportunity to write the test for which exemption was granted during the next scheduled re-test day, and the missed primary exam for which exemption was granted sitting during the scheduled supplementary exam sitting (the section of this policy as it relates to the granting of a supplementary exam on compassionate grounds applies in its entirety). No further assessment opportunity will be granted after the re-test or supplementary exam has been written.

13.2.1.6 Students who qualify for assessment exemption based on the provisions above must be assessed before the commencement of the formal semester exams, during the allocated re-test period(s).

13.2.1.7 NO student may be exempted from any formal pre-set assessment periods based on reasons other than stated in section above.

13.2.1.8 On the day that their test/exam is written, lecturers must supply Student Support with the names of students who did not write, the date of the test and the module code In addition, a strict register must be kept by Student Support of the students who qualify for the re-test/supplementary exam, and submit this register to the relevant lecturers for approval at least two days before the re-test day. An official attendance register, which will provide space for the student’s name, the module and signature, must be drawn up by the National Student Support Manager. The students will sign this register during the test/examination session. No re-test/supplementary envelopes will be signed by students.

13.2.1.9 Students who do not comply with the provisions set out above will be deemed to be absent without permission, and will, therefore, not be eligible for assessment on an alternative date.

13.2.1.10 Contact-learning (CL) students are required to submit assignments, even if pending on Turnitin, for assessment on the due date into the assignment collection box, or as stipulated on the assignment calendar. Distance-learning (DL) students must upload their assignment to ECI on or before the assignment due date. Student Support staff must sign and date all late assignments received

for CL and DL students. Any assignment handed in after the stipulated date will be penalised by 5% per day, for a maximum of three (3 days), after which no assignment will be accepted by Student Support to be assessed. Student Support must inform the lecturer of all assignments received, and the lecturer must collect assignments from Student Support. For medical reasons, a Doctor’s certificate must be e-mailed, faxed or handed in to Student Support within three working days of the due date. If this is not possible, Student Support must be contacted via telephone. The original medical certificate must be handed in within 24 hours of returning to campus. The penalty clause will commence 24 hours after the final date stipulated on the medical certificate.

13.2.1.11 All students who qualify for a supplementary exam or re-test and choose to sit for this exam, will be subject to an examination fee per module written, as determined by OPCO, and communicated to students, parents and guardians on their annual Payment Schedules.

13.3 Student grievances pertaining to assessments

In the event that a student feels aggrieved by the assessor’s marking of his or her test, assignment or exam script, the student can request a reassessment only if the remark will lead to a student obtaining a pass, entrance into a supplementary exam or obtaining a distinction. The following grievance procedure must be followed for examinations:

(a) Step 1: A formal written request needs to be lodged with the Head: Quality Assurance and Enhancement (HQAE) within one working day from when the results have been released.

(b) Step 2: The (HQAE) will inform the relevant HOD and Module Coordinator who will ensure that the paper is remarked.

(c) Step 3: The student will be informed of the outcome of the re-mark at least 24 hours before the supplementary paper must be written.

The following grievance procedure must be followed for tests and assignments:

(a) Step 1: The student must discuss the issue with the Lecturer responsible for that particular assignment or test within five working days of receiving the assessment mark. If no consensus or resolution of the grievance can be reached, the student then proceeds with Step 2.

(b) Step 2: The student submits a formal written request for a re-assessment of the test or assignment script within 24 hours to the Module Coordinator, clearly stating the reasons for the request. The submission by the student must be accompanied by all relevant material that formed part of the initial assessment. No alterations may have been made on the original assessment form or work initially submitted for assessment. The Module Coordinator must lodge the submission for reassessment with the relevant HOD on the same day that the application was received. Where the lecturer is the Module Co-ordinator, the student must submit the request to the HOD.

(c) Step 3: The HOD sets a date and time (not later than five working days after the student’s submission) when to convene a meeting with the Module Coordinator and the student in order to discuss the final outcome of the re-assessment process.

(d) Step 4: The student signs a written statement of acknowledgement of receipt of the outcome of the re-assessment process.

A cost, to be determined by OPCO, is payable by a student on application for a re-mark of a test, assignment or examination. This fee will be charged to the student’s account. The student must apply for a remark using the EITE 007 form which can be obtained from Student Support Department. In the event of the remark, the mark will only change if the mark has improved – otherwise, the original mark will stand. The above does not apply to re-tests, supplementary exams and special exams.

13.4 Admission to primary examination

13.4.1 The Duly Performed (DP) certificate indicates that students have successfully

completed the coursework and minimum attendance requirements of a module (if any, as per study letter), and may write the examination.

13.4.2 Embury uses the marks achieved in tests and assignments (and class attendance in certain modules, as per the module study letter) to determine if a student has obtained a DP certificate.

13.4.3 Students have to obtain 40% in their CASS work (and may have to attend a minimum number of lectures, practicals or tutorial sessions, as per study letter) to obtain a DP, which will grant them entrance to the examination.

13.4.4 Any legitimate absenteeism from tests or a failure to submit an assignment is governed by the Embury Assessment Policy.

13.4.5 All absenteeism will be monitored by an attendance register for each module which is the lecturer’s responsibility.

13.4.6 If a student fails a year, or chooses not to progress to the following year of study, and returns to repeat the failed modules, the student may be granted permission to register for modules from the following year of study provided the student:

Takes a maximum of six modules in total for the year of study. 13.4.7 A student who has failed six or more modules may not take any modules from the

following year of study. 13.4.8 Students who are caught signing for other students will receive an immediate two-

week suspension from the academic programme, including non-participation in any assessment during the suspension period. Any further offence may result in the student being expelled from Embury.

13.4.9 Students’ DP certificate will be made available electronically. Students are issued with a unique password generated via MyEmbury, the Student MIS which is e-mailed to the students e-mail account together with steps on how to access their results via MyEmbury.

13.4.10 Students must print their DP certificates and produce them prior to entering every exam venue.

13.5 Primary exam pass requirements

Primary exam refers to the formal written 1st and 2nd Semester examinations conducted during any given academic year.

Admission to the primary exam is dependent on obtaining a minimum of 40% DP mark. A candidate shall not be allowed to sit for the primary exam unless all prescribed fees are paid up in accordance with the fee payment structure for the said academic year. All primary exams will be written only during officially scheduled semester examination sessions, as stated in the Examinations Timetable. Modules that are assessed on the basis of an accumulative continuous assessment process (CASS marks only) will be calculated according to the ratio specified in the formal mark schedule for the particular module. These ratios are clearly indicated in the module study letters. The pass mark for a CASS module is 50%. There is no opportunity for a supplementary exam. Students who have failed a module during any of the two semester’s primary exams, may request a re-mark of their exam scripts at a cost determined by OPCO. No re-marking of supplementary and special examination scripts and re-tests will be considered.

13.5.1 Pass Cum Laude and Summa Cum Laude

13.5.1.1 A student registered for the Embury degree qualifications and who passes the programme with an average mark of 75% or above, will be deemed to have passed the programme Cum Laude.

13.5.1.2 A student who passes each module in the 4-year B.Ed. Degree programme (including Teaching Practice) with a mark of 75% or above, will be deemed to have passed the Degree Summa Cum Laude.

13.5.1.3 This status will be awarded for degree qualifications completed within the minimum required duration.

13.5.2 Supplementary and special exams

13.5.2.1 The term supplementary exam refers to an additional examination of

equivalent duration, academic rigour, and content assessed during the primary exam.

13.5.2.2 The term special exam refers to a further opportunity for a student to write the exam. A special exam is a privilege and is awarded at the Dean’s discretion. A student will be considered to write the Special Examination should the student be a final year student that has one module outstanding in which the student has attempted and failed the final and/or supplementary examination with a mark between 40-49 that is preventing the student from graduating.

13.5.2.3 Students may be considered for special examinations under extenuating circumstances such as severe illness that caused the student to miss the final and the supplementary examination.

13.5.2.4 Questions may not be repeated across the examination papers. 13.5.2.5 All exam papers must be handed in by students at the end of the examination. 13.5.2.6 All supplementary and special exam papers must be internally moderated,

together with the primary exam paper, as per the Embury Moderation Policy. 13.5.2.7 Should a student pass the special exam with more than 50%, their final mark

will be reflected as 50%. 13.5.2.8 Embury may grant supplementary exams based on the following grounds:

examination, or significantly impair their preparation for an exam.

13.5.2.9 Embury may grant a special exam on the following grounds:

Compassionate Exceptional personal circumstances prevents a student sitting for both

the primary and supplementary examination, or significantly impairs

their preparation for an exam. This is at the discretion of the Academic

Committee.

13.5.2.10 The results of the supplementary exams will be calculated as follows:

13.5.2.10.1. Academic reasons

(a) If a student qualifies to write the supplementary exam (has a final mark between 40 and 49%), then the student will write the supplementary exam with the same DP as the primary exam. The final mark will be the combined average of the DP and the supplementary exam marks.

(b) In the event that the student still fails the module after the supplementary exam has been written, the combined average mark obtained for the supplementary exam will apply, regardless if it is less than the original mark before the supplementary exam.

13.5.2.10.2. Medical or compassionate reasons

(c) Should a student have missed the primary exam for medical or compassionate reasons, then the supplementary exam result will serve as the only primary result, together with the CASS mark in order to calculate a final mark (average of CASS + supplementary exam). No further assessment opportunities will be afforded to the student.

(d) No appeals for a supplementary examination, based on medical and compassionate reasons, will be accepted after a student has written the primary exam.

13.5.2.11 The results of the special exams (last course) will be calculated as follows:

13.5.2.12 Students who qualify for this exam will write a once-off exam similar in duration, academic rigour, course content and outcomes as was written during the primary and supplementary examinations for the said module. The result of this exam will not be graded above the level of 50% pass, and will be indicated as such on the student’s academic transcript.

13.5.2.13 Students who fail to attend any test or exam because they misread the timetable or accepted incorrect information from another person, are not entitled to qualify for any re-test or supplementary exam.

13.5.2.14 If illness, injury or personal circumstances prevent a student from attending a primary examination, the student should notify Embury immediately.

13.5.2.15 Supplementary examinations will be conducted shortly after the last primary exam paper was written, as per the Institutional Management Plan.

13.5.2.16 All students who qualify for a re-test, supplementary exam or special exam and choose to write this test or exam, will be subject to a fee per module written, and communicated to students, parents and guardians on their annual Payment Schedules. No supplementary examination results will be released to a student until the prescribed examination fee has been paid.

13.5.3 Copying or cheating in an exam

The following procedure must be followed when a student is caught copying or cheating:

13.5.3.1 The senior invigilator should be notified immediately. 13.5.3.2 If evidence exists that a student was in possession of incriminating evidence

which suggests transgressions of the test, examination, re-test or supplementary examination regulations, the chief invigilator will remove the student’s answer book together with the incriminating evidence.

13.5.3.3 The senior invigilator needs to indicate on the answer book the time the book was confiscated and removed, and must sign the answer book.

13.5.3.4 The student will be issued with a new test, examination, re-test or supplementary examination or special examination answer book and may proceed to answer the questions from the point where the original answer book was confiscated. A decision to mark a students work will be made pending the outcome of a disciplinary hearing

13.5.3.5 A written report should accompany the evidence, which will be placed in the student’s file.

13.5.3.6 Disciplinary action will follow where a test, examination, re-test, supplementary examination or special examination script has been confiscated by the senior invigilator, and the student is found guilty of irregularities.

A student found breaching the rules of the test or examination will be subjected to a disciplinary hearing. The Disciplinary Committee will consist of the following members for the main campus:

13.5.4 Special concessions

13.5.4.1 Should a student other than those identified at registration request a special concessions for tests and examinations such as extra time to write, the student must submit a formal written request with proof supplied to the HOD Education..

13.5.4.2 The HOD Counselling will review the request and provide a report with recommendations to the HOD Examinations and Regulatory Compliance.

13.5.4.3 The HOD Examinations and Regulatory Compliance will make a decision based on the report and recommendations and communicate the set recommendation to the student and the National Student Support Department.

13.5.4.4 All concessions granted must be flagged on the SIMS and a printed copy of the concessions must be included in the examination box for each venue kept in the exams storeroom.

13.5.4.5 Special Concessions at the site will be received by the counsellor at the site and sent to the HOD: Education before it is sent to the HOD: Examinations and Regulatory Compliance.

13.6 Credit Accumulation Transfer (CAT)

13.6.1 The institution will facilitate the articulation of an applicant or existing student between programmes and/or institutions though it’s Credit Accumulation and Transfer process.

13.6.2 Applicants may apply for credit transfer for courses/modules that they have completed at Embury or another institution.

13.6.3 A maximum of 50% of the credits of a completed qualification may be transferred to another qualification.

13.6.4 At least 50% of the credits of any qualification awarded by Embury must be completed at Embury.

13.6.5 Embury students may apply for credit transfer for an incomplete qualification offered by Embury towards another programme.

13.6.6 Applicants may apply for credit transfer for an incomplete qualification offered by another institution towards the same or a different qualification at Embury.

13.6.7 Credits cannot be transferred to more than one qualification. 13.6.8 Decisions on the transfer of credits is made on the comparability of module content,

outcomes and assessment criteria. 13.6.9 Credits may be granted for students who have studied in an international exchange

programme with a partner institution. 13.6.10 Current students who wish to take modules/credits at another institution to be

credited towards a programme at Embury must apply to do so and require approval from both institutions.

13.6.11 Credits granted for study at another institution will be identified on the student academic record.

13.6.12 Short courses which are non-credit bearing will not qualify for CAT. The learning acquired will be evaluated under the Embury Recognition of Prior Learning Policy.

13.7 Credit Accumulation and Transfer (CAT) application and approval process

13.7.1 At the time of application to the institution the applicant must complete the form for Credit Accumulation and Transfer (EITE009) which can be obtained from and returned to the Student Support Department. In addition, the applicant must supply an academic record and the official module/course curriculum outline for each module/course in order for Embury to identify areas of the curriculum for which credits may be awarded. The relevant administrative fee must be paid.

13.7.2 The Student Support Department will forward the application to the Head of Faculty who will provide the documentation to the relevant Head of Department(s). The HOD(s) will evaluate the application and provide a written recommendation with supporting evidence to the Head of Faculty.

13.7.3 The Head of Faculty will table the application at the Academic Committee. Applications for CAT will considered by the Academic Committee and a decision made about granting credits.

13.7.4 Student Support Department will communicate the decision of the Academic Committee to the applicant.

13.7.5 Applicants have a right to appeal the decision of the Academic Committee. A letter of appeal and supporting evidence must be provided to the Student Support Department. Student Support will table the application for appeal for consideration at Academic Board. The decision of the Academic Board is final.

13.8 Progression and Certification

13.8.1 If a student fails a year, or chooses not to progress to the following year of study, and returns to repeat the failed modules, the student may be granted permission to register for modules from the following year of study provided the student:

13.8.1.1 Takes a maximum of six modules in total. 13.8.2 A student who has failed six or more modules may not take any modules from the

following year of study. 13.8.3 A student enrolled in the Diploma in Pre-School and Foundation Phase Teacher

Assistant and Degree programmes may only carry a total of four modules over into the next year of study.

13.8.4 Students who require to pass only one outstanding module in order to complete a qualification may be afforded a final special examination opportunity, as per this policy.

13.8.5 In order to gain admission to the examination for any module that a student is repeating, the following applies:

13.8.5.1 The student must comply with all practical or written assignments, as well as test requirements for a particular module.

13.8.5.2 Where class work is required, students who are repeating a module will be required to complete all class work assessments. The DP mark will be calculated based on the sum total of compulsory assignments, tests and class assessments that were conducted for the particular module.

The ratification of student results and awarding of Higher Certificates, Diplomas and Degrees are subject to the following policy procedures:

13.8.6 All results will be ratified by the Exam Board, after they have been checked by the Dean of Academics in collaboration with the Student Information Management System (SIMS) Manager in order to verify compliance with the full requirements for graduation.

13.8.7 No certificate will be issued to a student who has not obtained a module aggregate of 50% per module for the full programme that they enrolled for as registered with SAQA.

13.8.8 Verification of results will be subject to the results schedule having been signed by two members of EXCO (directly involved in the verification process, as well as the SIMS Manager.

13.8.9 On receipt of the verified results, the National Student Support Manager will liaise with the outsourced printers for all certificates to be printed.

13.8.10 The completed qualification certificates will then be checked for correctness by the Dean of Academics, after which they will be validated by EXCO by means of an original signature.

14 Fees and Charges Including Refund(s) in the Event of Cancellation or

Withdrawal

If a student leaves Embury before his or her programme has ended in any particular academic year, the student must officially deregister from Embury. The following deregistration process must be followed:

1. The student must notify the Student Support Department in writing of his/her intention to

de-register from Embury.

2. A de-registration form (EITE 011) will be forwarded to the finance department for processing

of any outstanding fees and/or library books before being issued to the student.

3. The Student Support Department will then issue the completed and signed de-registration

form to the student which must be completed and signed by the student and all parties to

the contracts as indicated on the de-registration form. Faxed or electronic copies of the de-

registration form will not be accepted.

4. The date on which the properly completed and signed de-registration form is received by

the Student Support Department will be regarded as the start date of the de-registration

process. De-registration will only be finalised once the completed and signed de-registration

form has been submitted to the Student Support Department and all outstanding fees have

been settled in full.

5. Only students who have paid fees in advance for the academic year, may be entitled to a

refund of part of the tuition fees as per conditions stipulated in the Enrolment Contract.

6. All refunds due will be paid within 31 days of the finalisation of the de-registration process.

7. Any disputes regarding payments or refunds must be forwarded to the Finance Department.

15 Student Financial Aid

Embury annually allocates funding towards four types of bursaries:

Academic Excellence bursaries; and

Financial Need bursaries; and

New Student bursaries; and

Academic Merit bursaries.

A qualifying student can apply for more than one of the above bursaries in any given academic year, but will not be awarded more than one of the above bursaries in any given academic year (excluding Academic Merit bursaries). More information regarding the criteria and application procedure per bursary can be obtained from the Bursary Policy (E8).

16 Student Support Services

The following services are available to students:

The Academic Support Centre, located in Lilian House, offers a free service to help improve

students’ language and referencing skills as well as support them in other areas of the

curriculum.

The Counselling Team provides emotional support to students in need.

A library and computer rooms are open during the week and on Saturdays to support the

academic and research needs of students.

The student canteen – called EITZ Café – serves fresh meals and snacks and offers ample

space for students to relax and connect.

There is 24-hour campus security.

The entire campus is a Wi-Fi zone and the canteen has a Telkom hotspot.

17 Rules or Code of Conduct

Transgression of the following Code of Conduct may, at the discretion of the Embury Disciplinary

Committee, lead to suspension, warning or (in extreme cases) to expulsion:

1. Show respect towards lecturers as mentors and figures of authority.

2. Show respect towards fellow students as equal participants in the training programme who

enjoy equal rights and privileges as may be offered or supplied by Embury.

3. Show respect towards academic and administrative staff in day-to-day dealings with them.

4. Show respect for the good name that Embury strives to maintain and develop through

exemplary conduct at all times, and refrain from public statements that may tarnish the

good image of Embury.

5. Respect the property (fixed or movable) associated with Embury, as well as the physical

surrounding by not maliciously damaging or callously interacting with equipment (including

library books) that are deemed to be the property of Embury (rented, leased or owned).

6. Show respect towards cleaning staff by ensuring that lecture rooms are kept tidy and clear

of litter (bins are provided).

7. Students have to conduct themselves in an exemplary manner during school-based teaching

practicum and abide by the rules and policies of the hosting school during school-based

practicum (the School-based Teaching Practicum Declaration signed by students applies).

8. Under no circumstances may alcohol be consumed on the premises or may the student

enter the premises under the influence of alcohol, or having consumed alcohol (regardless

of quantity) during normal operating hours.

9. Do not engage in any activity that may tarnish or bring the good name of Embury into

disrepute.

10. Do not knowingly transgress Embury’s rules and regulations aimed at preserving academic

integrity (such as copyright infringement, or cheating in a test or exam) and the moral ethics

of Embury (such as downloading information from, or accessing websites forbidden by

Embury policies or regulations).

11. Do not disregard a lawful instruction issued by Embury management or anybody delegated

by management to issue such instruction (including instructions issued in writing and placed

on the student notice board or in the respective lecture rooms).

12. All students must be able to produce their student cards on request.

13. All students must abide by the conditions set out in the Embury enrolment contract.

14. The use of cell phones and any electronic devices in the lecture venues are for academic

purposes only.

15. The following conduct may, at the discretion of the Embury Disciplinary Committee and after

due process, lead to suspension or expulsion from Embury:

a) Physical harm or act of violence brought on any person (student, staff, or visitor)

while on the Embury premises or during school-based teaching practicum.

b) Stealing property belonging to Embury (rented or owned), Embury staff, fellow

students, visitors or staff associated with or employed by the schools where Embury

students have been placed for school-based teaching practicum.

c) Severe acts of vandalism.

d) Personal drug abuse or dealing in narcotics of any kind.

e) Entering the premises with a weapon of any sorts, regardless of the intended use or

not thereof.

f) Endangering the lives of others through negligent or reckless behaviour.

16. No use of tobacco products including cigarettes and ‘spit tobacco’ or e-cigarettes is

permitted within the facilities or on the property of Embury at any time.

Physical Education Institute of SA (PEISA). As part of a joint venture Embury trains and develops teachers from across the country in physical education.

Dokkies Educational Trust. Dokkies subsidise the training of existing qualified and under-qualified teachers through the various Embury CPTD products.

Queen Maud University College, Norway. Embury partners with this Norwegian university, which specialises in Early Childhood Development, in a student exchange programme.

Stellenbosch University. Embury hosts telematics transmissions of lectures from Stellenbosch University and is also an examination centre for the university.

19 Student Enrolment Contract

An example of the student enrolment contract is attached as an addendum to this document.

20 Policy and Procedures for Handling of Student Complaints

Students are free to raise complaints and grievances using the prescribed procedures and channels of communication without the threat of victimisation for doing so. Complaints and grievances will, wherever possible, be handled with discretion, protecting confidentiality and privacy as and where deemed appropriate. More information is available in the Student Grievance and Appeals Policy (E10).

21 Health and Wellness Policy

Embury currently does not have a separate Health and Wellness Policy.

22 Policy on Disability

No disabled student with a medical condition or learning disability whose needs can reasonably be accommodated will be excluded from participating in or denied access to any programme or co-curricular activity offered by Embury. Students must however disclose any disability or medical condition as required by the application process. More information can be retrieved from the Disability Policy (B3).

(A) Embury carries on the business of a Private Higher Education Institution, providing

teacher education.

(B) The Student is desirous of enrolling with Embury for a programme of study.

(C) The parents / guardian are in agreement that the Student enrols with Embury.

(D) Embury has agreed to enrol the Student for his/her programme of study on the terms and

conditions of this agreement.

THEREFORE THE PARTIES AGREE AS FOLLOWS

1. INTERPRETATION

In this agreement -

1.1 clause headings shall not be used in its interpretation;

1.2 unless the context clearly indicates a contrary intention –

1.2.1 an expression which denotes -

1.2.1.1 any gender includes the other genders;

1.2.1.2 a natural person includes an artificial person and vice versa;

1.2.1.3 the singular includes the plural and vice versa;

1.2.2 the following expressions shall bear the following meanings and related expressions bear

corresponding meanings:

1.2.2.1 “Embury” means EMBURY INSTITUTE FOR TEACHER EDUCATION (PTY) LTD

(Registration No. 2004/031722/07), a company duly registered and incorporated

according to the Companies Act and the rules governing companies in the Republic of

South Africa..

1.2.2.2 “the parents or guardian” means the parties as more fully described in the preamble of

this agreement on page 2.

1.2.2.3 “the Student” means the Student as more fully described in the preamble of this

agreement on page 2.

1.2.2.4 “the Premises ” means any building or site from which Embury conducts its training or

might conduct its training from in the future.

1.2.2.5 "signature date" means the date of signature of this agreement by the last of its

signatories;

1.2.2.6 “Fees” means any and all fees payable by the Student including Tuition Fees, Study

Material Fees, Tablet costs, any software costs and e-Pubs costs, as well as any

relevant Miscellaneous Fees.

1.2.2.7 “Tuition Fees” means the fees payable by the Student in respect of the Programme.

1.2.2.8 “Programme” means the study programme of the qualification for which the Student has

enrolled.

1.2.2.9 “Enrolment Conditions” means the standard enrolment conditions for all students as

stipulated or referred to in this Agreement.

1.2.2.10 “Study Material Fees” means the fees for textbooks, Embury printed manuals and any

other curriculum related courses, i.e. First Aid, Sports coaching, etc.

1.2.2.11 “Miscellaneous Fees” means all other fees which may be payable to Embury by the

Student, and may include (but are not limited to) field trips, entry to events, study visits,

library card and penalties, security discs, etc.

1.3 Clause headings in this agreement are for convenience only and shall not be taken into

account in the interpretation hereof.

1.4 This agreement constitutes the entire contract between the parties relative to the subject

matter hereof and this agreement cancels any prior agreement between the parties with

regard to the subject matter hereof unless specified to the contrary. No variation of any

of the terms and conditions of this agreement will be binding on the parties unless

committed to writing and signed by them respectively.

1.5 If any provision in these definitions is or contains a substantive provision imposing rights

and/or obligations on a party, effect shall be given to such provision as if it were a

substantive provision in the body of this agreement.

1.6 No indulgence which any party may grant to any other shall prejudice or constitute a

waiver of the rights of the grantor, who shall not thereby be precluded from exercising

any rights against the grantee which may have arisen in the past or might arise in the

future. The granting of an indulgence will not be a motivation or new course of action.

1.7 When any number of days is prescribed in this agreement, same shall be reckoned

exclusively of the first and inclusively of the last day, unless the last day falls on a

Saturday, Sunday or public holiday, in which case, the last day shall be the next

succeeding day which is not a Saturday, Sunday, or public holiday. The term “business

day” shall mean any day other than a Saturday, Sunday or public holiday.

1.8 Where any term is defined within the context of any particular clause in this agreement,

the term so defined, unless it is clear from the clause in question that the term so defined

has limited application to the relevant clause, shall bear the meaning ascribed to it for all

purposes in terms of this agreement, notwithstanding that that term has not been defined

in this interpretation clause.

1.9 Where any party successfully enforces its rights in terms of this agreement, whether

through action, application or arbitration, the successful party shall be entitled to claim its

costs on an attorney and own client scale from the unsuccessful parties.

1.10 All payments of money to be made in terms of this agreement will be made by electronic

fund transfer or direct deposit of immediately available and freely transferable funds to

such account in South Africa as the payee may reasonably designate, free of any

deductions or set-off whatsoever, in the currency of the Republic of South Africa.

1.11 The intention of the parties is that, for this agreement to be valid, it must be in writing and

a non-electronic, hard copy written version must be signed by means of handwritten

signatures by or on behalf of the parties.

1.12 Each provision of this agreement is severable the one from the other and if any provision

is found by any competent court to be defective or unenforceable for any reason

whatever, the remaining provisions of this agreement shall be of full force and effect and

continue to be of full force and effect.

2. ENROLMENT

2.1 The Student hereby enrols with Embury and Embury hereby agrees to enrol the Student

on the terms and conditions stipulated in this agreement and the various other policies

and documents as referred to in this agreement.

2.2 The parents/guardian consent to the Student’s enrolment with Embury and is bound to

the terms and conditions of this agreement and the other various policies referred to in

this agreement.

3. PERIOD OF ENROLMENT

3.1 The Student enrols for the course or programme as selected on the Enrolment

Application Form.

3.2 The Student will be enrolled with Embury for the duration of his/her selected course or

programme.

3.3 The Student’s enrolment and period of enrolment is strictly subject to the Student’s

fulfilment of all the terms and conditions of this agreement.

3.4 In the event of Embury changing the terms and conditions of enrolment, the Student and

his/her parents/guardian will attend to sign a new enrolment agreement as and when

requested thereto by Embury.

3.5 The Student will confirm the correctness of the information on the enrolment application

form on or before the final registration date for each year of the Student’s selected

course or programme.

4. PAYMENT OF FEES

4.1 Fees payable

4.1.1 Embury will provide a Fee Schedule together with the Application for Enrolment which

Fee Schedule will set out the various fees payable and the due dates. The Fee

Schedule will be available from the Embury Student Support and Finance Departments.

4.1.2 The Student will be required to pay the deposit and final registration fee as indicated on

the Fee Schedule on the due dates. These amounts will be set off against the tuition

fees for the Student’s programme.

4.1.3 Any certificate issued under the signature of a duly authorised employee of Embury, or a

duly authorised representative, that purports to certify the amount due by the Student

shall be accepted as prima facie proof of such indebtedness and shall have sufficient

probative value to enable Embury to obtain summary judgment or provisional sentence

against the Student in any competent court for the amount stated in such certificate.

4.1.4 Students registering for year two or onwards will be liable to pay the fees as stipulated in

the fee schedule for the particular year of registration.

4.2 Payment options

4.2.1 The Student or party responsible to pay the fees is obliged to pay the fees as stipulated

in the Fee Schedule for the particular year.

4.2.2 The fees can be paid up front as stipulated on the Fee Schedule on the stipulated dates.

If all Tuition Fees have been paid by the final registration date, the student will be entitled

to a 2.5% discount on the full Tuition Fee minus the Acceptance deposit.

4.2.3 The Student or third party liable for payment may elect to pay the outstanding portion of

the Tuition Fees, Study Material Fees, Tablet costs, any software costs and e-Pubs

costs, after the deposit and final registration fee has been paid, over a period of 10 (ten)

months. The portion of the fees and the monthly payment will be stipulated on the Fee

Schedule.

4.2.4 It is clearly understood by the Student, that the monthly payment terms is only applicable

to the specified portion of the fees as indicated on the fee schedule.

4.2.5 In the event of the Student or third party, liable for the payment of the fees, electing to

pay a portion of the fees over 10 (ten) months as stipulated in Clause 4.2.3, they will be

obliged to enter into and sign an Acknowledgement of Debt setting out the terms and

conditions of the monthly payment.

4.2.6 In the event of the Student or third party responsible to pay the fees, elects to pay the

fees over a 10 (ten) month period, the Student or the third party may be required to

submit proof to Embury that they can afford 10 (ten) monthly instalments as stipulated in

the Fee schedule. The following information, at the sole discretion of Embury, may be

required: Income and Expenditure Statement, asset and liability statement, proof of

income and or any other FICA documents, etc.

4.3 Liability for Fee payments

It is the Student’s responsibility to ensure that any and all fees payable to Embury are

paid at the appropriate time. Irrespective of any undertaking by a third party to pay fees

on behalf of a Student, ultimate responsibility for payment of any and all fees shall

always remain with the Student.

4.4 Payment by third parties

4.4.1 Sponsorship

4.4.1.1 A Student’s employer, or other organisation, can elect to pay the Student’s Tuition Fees

on his/her behalf. Embury will accept such sponsorship arrangements, provided that the

sponsor’s commitment to pay the fees is made by way of either a formal purchase order

or a letter to Embury confirming the amount that will be paid. Such letters must be

signed by an authorised officer of the sponsoring organisation.

4.4.1.2 Where the value of the sponsorship covers only part of the Tuition Fees, the Student

shall be responsible for paying the balance of the Tuition Fees and any other applicable

fees directly to Embury.

4.4.1.3 Embury is unable to offer sponsors the opportunity to pay by instalments. An invoice will

be issued for that element of the Tuition Fee being met by the Sponsor, with payment

due in full on receipt of the invoice.

4.4.1.4 In the event that Embury does not receive payment of fees from the sponsor, the Student

shall remain liable for payment of any fees due.

4.4.2 Other third parties (including parents or guardian)

4.4.2.1 Embury will accept payment of a Student’s fees by his/her parents or guardian or other

third party. However, the liability for making payment will always remain with the

Student. Where payment is made by a parent or other third party on a monthly basis

they will be bound by the Terms and Conditions of payment as stipulated herein or the

Acknowledgement of Debt.

4.4.2.2 In the event that a parent or other third party wishes to revoke an arrangement to pay

fees on behalf of a student, it is the student’s responsibility to inform Embury and

simultaneously, to put in place an alternative fee payment arrangement which is

acceptable to Embury. Embury will be under no obligation to release a third party from

their liability to pay fees and such release will remain in the sole discretion of Embury.

4.4.2.3 A parent or other third party shall have no right to demand a refund from Embury of any

fee payment already made on behalf of a student. All fee refunds are subject to

Embury’s Refund Policy, as stipulated herein

4.5 Implication of non-payment

4.5.1 Where the fees due from a student remain unpaid for more than 7 (seven) days after the

date when they are due, Embury shall be entitled to charge interest at the maximum

percentage rate permissible in terms of the National Credit Act, on the amount of fees

outstanding, calculated from the date of first default in payment.

4.5.2 If the Fees (or any substantial part of the Fees) due to Embury remain unpaid for 10 (ten)

days after the date they are due Embury shall be entitled to take any or all of the

following steps:

4.5.2.1 exclude the student from tuition attendance until payments are brought up to date, and or

deny access to those facilities covered by the overdue fees;;

4.5.2.2 give the student notice that unless, within a further 5 (five) day period, arrangements that

Embury considers satisfactory are made for payment of the outstanding amount, Embury

will terminate the student’s studies in which case provisions of Clause 7 of the this

Agreement will take effect.

4.5.2.3 Embury reserves the right to refuse to re-enrol students whose attendance was

terminated due to non-payment of the account, even where the account has been paid in

full.

4.5.2.4 Once the arrears amount has been settled and/or a payment plan has been accepted by

Embury, Embury may at its sole discretion, and subject to 4.5.2.3, allow the student back

on campus so that the student can participate fully in the academic and other programs.

Any assessments missed during the period the student was not allowed on campus will

not be marked after his / her return to campus. This could have a severe impact on the

student’s academic progress and could eventually lead to failing some modules.

4.5.2.5 in respect of the programme to which the outstanding Fees relate, delay in giving the

student any award or qualification which would otherwise have been made, and/or to

refuse to allow the student to proceed to any further stage of the Programme, until all

outstanding amounts have been paid, or arrangements for payment have been

established which Embury considers satisfactory.

4.5.2.6 take legal action to recover the debt together with any interest and costs incurred in so

doing. The actions that Embury is entitled to take under this paragraph do not affect

Embury’s rights to pursue any remedies permitted under any other contractual

arrangements that apply to the Miscellaneous or other fees.

4.6 De-registrations and Refund Entitlement

4.6.1 If a student decides to leave the institution prior to completion of the qualification that

he/she was registered for, the student must officially deregister from Embury by

completing the Application for De-Registration form:

4.6.1.1 The student must notify the Student Support Manager in writing of his/her intention to de-

register from Embury.

4.6.1.2 The Student Support Department will then issue a de-registration form to the student

which must be completed and signed by all parties as indicated on the de-registration

form.

4.6.1.3 The date on which the properly completed and signed de-registration document is

received by the Student Support Department will be regarded as the start date of the de-

registration process. De-registration will only be finalised once the completed and signed

de-registration form has been submitted to the Student Support Department and all

outstanding fees have been settled in full.

4.6.1.4 Any disputes regarding payments or refunds must be forwarded to the Finance

Department.

4.6.2 If a Student leaves Embury before his/her Programme has ended in any particular

academic year, the Student may be entitled to a refund of part of the Tuition Fees paid

for the Academic Year in which they leave, in accordance with the following table:

4.6.3 Such refunds only apply to the Tuition Fees paid or due in respect of the Academic Year

in which the student leaves. Refunds will normally be made within 31 (thirty one) days of

the date on which Embury considers the Student to have formally left Embury and only

after a de-registration form has been signed by all parties to this contract and the signed

deregistration form has been received and processed by the Student Support and

Finance Departments.

4.6.4 This refund policy relates only to those students enrolled for a full Academic Year and

not for students enrolled for individual modules only. The refund table stated above only

applies to full-time undergraduate programmes and part-time postgraduate taught

programmes which run on an Academic Year or yearly basis. For the avoidance of

doubt, nothing in this refund policy shall require Embury to refund the Tuition Fees (or

part thereof) unless those fees have actually been paid.

4.6.5 For the further avoidance of doubt a Student will not be able to claim that he/she has left

Embury and thus be entitled to a fee refund (whether or not they intend to commence a

new programme at Embury in the following Academic Year) unless all the following steps

have been satisfied:

4.6.5.1 Embury has received 30 days written notification that the Student wishes to discontinue

the Programme.

4.6.5.2 The Student has ceased attending lectures.

4.6.5.3 The Student has returned all items and materials owned by Embury and has paid any

outstanding sums owed to Embury; and

4.6.6 Embury may alter the Refund Policy from time to time and will publicise within Embury

any alterations made.

4.7 The Student will not be entitled to a refund in the event of the Student leaving Embury for

the reasons set out in Clauses 4.5, 5.2, 5.3 and 9.

4.8 Should a student deregister after 01 April, the student is liable for the full fees for the

academic year.

4.9 The Student, parents / guardian and or sponsor hereby authorizes Embury, through the

services of a NCR registered credit bureaux, to carry out such checks and traces as

Embury deems necessary, to report any adverse payment information, and to list the

Student, parents / guardian or sponsor as the case may be in the event of a default in

payment.

5. RULES AND REGULATIONS

5.1 The Student will abide by all relevant codes, rules and regulations of Embury in

existence during the programme which relate to the activities of the students at Embury,

or which may apply to the Student’s particular programme option, these shall include (but

shall not be limited to) the following:

5.1.1 Embury’s Academic Regulations, and the Student Code of Conduct;

5.1.2 Embury’s relevant Health and Safety Regulations.

5.1.3 Embury’s Academic Standards and Quality Assurance Regulations.

5.1.4 Embury’s Acceptable Use of Information Technology Policy

5.1.5 All programme handbooks, codes, rules and regulations of any other relevant

organisation or institution, if required as part of the programme, as such codes and

regulations are amended from time to time.

5.2 If the Student’s studies with Embury are terminated as a result of disciplinary action

taken against the Student in accordance with the disciplinary procedures of Embury this

Agreement shall end automatically without the need for any notice, unless Embury

agrees otherwise in writing.

5.3 If the Student is expelled or dismissed from any institution or organisation other than

Embury which the Student is required to attend or be a member as part of the

programme, Embury shall be entitled to end this agreement immediately by written notice

to the Student

6. INDEMNITY AND EXCLUSION OF LIABILITY

Subject to the provisions of the Consumer Protection Act, as applicable:

6.1 EITE cannot accept responsibility, and expressly excludes liability, for:

6.1.1 Any loss or damage to the Student’s property (including but not limited to any motor

vehicle or personal belongings) while that property is on the premises of Embury

6.1.2 Death or any personal injury suffered by the Student.

6.1.3 Any indirect or consequential loss or damage (including without limitation, loss of profit,

loss of earnings, loss of opportunity, and living expenses), however arising, suffered by

the Student as a result of any breach by Embury of these conditions or any other act or

omission of Embury or its employees or agents.

6.2 Legal declaration of indemnity

The Student hereby indemnifies Embury against any risk, loss or damage of whatsoever

nature or kind arising out of any claim, which may be preferred against Embury as a

result of any happening of whatsoever nature which may take place on the premises of

Embury, or in connection with the affairs and activities of Embury in which the Student

takes part. Neither Embury nor any official employee or representative of Embury acting

in his/her capacity as such shall be liable for any damage arising out of the death, bodily

harm, loss of health or illness of any Student howsoever caused.

6.3 Neither Embury nor any official employee or representative of Embury acting in his/her

capacity as such shall be liable for any damage to any property owned by or in the

custody of any Student, howsoever caused.

6.4 The Student hereby indemnifies Embury against any claim made against Embury in

respect of any damages arising out of the fault of the Student.

6.5 While Embury takes all reasonable precautions to ensure the safety and security of

students on the Embury campus, Embury cannot accept responsibility, and expressly

excludes liability for loss or damage to students’ personal property. It is recommended

that students insure personal property against the risk of loss and damage.

6.6 Embury cannot be held responsible for any injury to a student, financial or other loss or

damage resulting from such injury, or for damage to property, caused by any other

student.

6.7 The Student shall be responsible to pay for all damages or loss caused by the Student to

any property of Embury or any other person lawfully on the premises of Embury.

6.8 Although Embury shall endeavour to ensure that computer equipment and software

available for use has reasonable security and anti-virus facilities and protections, the

Student uses such computer equipment and any software provide by Embury at his/her

own risk and in accordance with the Embury Acceptable use of Information Technology

Policy. Embury shall not therefore be liable for any loss or damage suffered by the

Student as a result of the use of any computer equipment or software provided or made

available by Embury to the Student, including (but without limiting the general nature of

this condition) any contamination of software or loss of files as a result of using Embury

equipment or software.

6.9 Neither party (Embury or student) shall be liable for failure to perform its obligations to

the other if such failure arises from circumstances beyond their reasonable control,

including (but not limited to), acts of God, war, terrorism, civil commotion, fire, flood,

governmental action or industrial disputes (including disputes involving Embury

employees).

6.10 If Embury is found liable to the Student for any breach by Embury of these terms and

conditions or for any other act or omission of Embury or its employees or agents, the

liability of Embury shall be limited to the fees actually paid by the Student.

7. REQUIREMENTS ON TERMINATION

7.1 If at any time Embury terminates this agreement as a result of its rights under these

Conditions or generally or if this agreement terminates automatically:

7.1.1 Embury shall be entitled to refuse to enrol the Student on the programme, if at the date

of termination the Student has not already enrolled;

7.1.2 Embury shall be entitled to require the Student to stop studying on the programme, and

to leave Embury immediately, if at the date of termination the Student has already

enrolled;

7.1.3 Any action taken by Embury under Conditions 4.5.2, or 9 will not restrict the ability of

Embury to take any other action against the Student to which it may be entitled;

7.1.4 Embury will not be liable for any loss or damage of whatever nature which the Student

may suffer as a result of any action taken against the Student by Embury to terminate

this agreement or disciplinary action by Embury (provided the action by Embury is taken

properly in accordance with these conditions or Embury procedures; and

7.1.5 The Student is required to return the security disk and other Embury property, e.g.

Library Books in the Student’s possession.

8. PROVISION FOR THE PROGRAMME

8.1 Embury undertakes to take all reasonable steps to provide the programme and other

educational services with reasonable care and skill. Should industrial action or

circumstances beyond the control of Embury interfere with its ability to provide the

programme or other educational services, Embury undertakes to use all reasonable

steps to minimise the resultant disruption to those services.

8.2 Embury will use all reasonable endeavours to deliver the programme in accordance with

the description applied to it in Embury prospectus for the Academic Year in which the

Student begins the programme (“the Prospectus”). However, Embury has limited

resources which it has to manage in an efficient way, in the context of the provision of a

wide range of courses to a large number of students. Embury therefore shall be entitled:

8.2.1 At any time to alter the timetable applicable to the Student, to alter the number of classes

relating to the programme, alter the methods by which the programme is delivered and to

alter the location of delivery of the programme, provided such alterations are reasonable;

8.2.2 To make reasonable variations to the content and syllabus of the programme;

8.2.3 To discontinue the programme or decide not to provide the programme or to merge or

combine the programme with other programmes of study, if such action is reasonably

considered to be necessary by Embury in the context of its wider purposes. If Embury

discontinues or decides not to provide the programme, or makes any significant variation

to the programme prior to the programme commencing then it will use reasonable

endeavours to notify the Student in advance and the Student shall be entitled to withdraw

the his/her application by written notice to Embury.

8.3 Should a student decide to withdraw his/her application due to 8.2.3 above, all monies

paid to Embury by the student/sponsor will be refunded.

9. CHANGE OF CIRCUMSTANCES

9.1 Embury shall be entitled to end this Agreement immediately by notice in writing to the

Student in the following circumstances:

9.1.1 If at the beginning of the programme there is a change in the Student’s circumstances or

if Embury becomes aware of information relating to the Student not previously known to

it, which in the reasonable opinion of Embury makes it inappropriate for the Student to

study on the programme;

or

9.1.2 If, in the reasonable opinion of Embury, the Student has failed to provide Embury with all

relevant information or have supplied false or misleading information relating to the

his/her application for the programme.

9.2 In the event of 9.1.1, Embury shall refund all monies paid by the student/sponsor.

10. PERSONAL INFORMATION

10.1 Embury may use and process personal data or information regarding the Student whilst

the Student remains at Embury and after the Student has left as required by relevant

legislation.

10.2 By accepting a place on the programme and completing enrolment, the Student is

consenting to Embury processing his/her data including sensitive personal data, for the

purposes and in the manner set out in this condition.

10.3 Sensitive personal data includes information held by Embury as to the Student’s physical

or mental health or condition, racial/ethnic origin, the commission or alleged commission

of any offence and any proceedings for an offence committed or alleged to have been

committed by the Student (including the outcome or sentence in such proceedings).

10.4 The purposes for which Embury may process the personal data (including sensitive

personal data) include:

10.4.1 The administration of the Student’s enrolment on and participation on a programme

including the administration of examinations, the issue of results and certificates in

connection with the programme and (where applicable) the provision to the Student’s

employer or other sponsor/corporate sponsor of information about the Student’s

attendance and performance on a programme;

10.4.2 The provision of Embury services and facilities and the protection of the Student’s health,

safety and welfare whilst at Embury;

10.4.3 The issue and operation of the Embury Student Card;

10.4.4 The collection of tuition fees and other Embury fees;

10.4.5 Equal opportunities monitoring;

10.4.6 The provision of references about the Student; and

10.4.7 Credit checks with any credit bureau.

10.5 Embury will issue the Student with a Student Card which will serve as a means of

identification.

10.6 In some circumstances, Embury may wish to use data in the form of photographs of

classroom situations as part of general marketing materials i.e. in Embury annual report,

prospectus or course materials. Personal data alongside photographs will only be used

with explicit consent.

11. COPYRIGHT

The Student accepts that any productions, including film, video, soundtracks, writings,

recordings or any other products emanating from Student endeavours during any

programme at Embury, shall vest in Embury to whom all copyrights and ownership

therein shall belong and without whose written permission no use may be made for

broadcast or any other purpose.

12. DOMICILIA AND NOTICES

12.1 The parties choose as their chosen address for service of all documents (domicilia

citandi et executandi) for all purposes under this agreement, whether in respect of court

process, notices or other documents or communications of whatsoever nature (including

the exercise of any option), the following addresses:

12.1.1 Embury Institute for Teacher Education

Embury House

119 Lilian Ngoyi Road (previously Windermere Road)

Morningside

4001 Durban

12.1.2 The Student (The address as stipulated in the preamble on page 2 of this

Agreement)

12.1.3 Father/Mother/Parents/Guardian (The address as stipulated in the preamble on

page 2 of this Agreement)

12.2 Any notice or communication required or permitted to be given in terms of this agreement

shall be valid and effective only if in writing.

12.3 Any party may by notice to any other party change the physical address chosen as its

domicilium citandi et executandi vis-à-vis that party to another physical address in the

Republic of South Africa, provided that the change shall become effective vis-à-vis that

addressee on the 7th business day from the deemed receipt of the notice by the

addressee.

12.4 Any notice (including notices required by the National Credit Act, applicable) to a party:

12.4.1 sent by prepaid registered post (by airmail if appropriate) in a correctly addressed

envelope to it at its domicilium citandi et executandi shall be deemed to have been

received on the 7th business day after posting (unless the contrary is proved);

12.4.2 delivered by hand to a responsible person during ordinary business hours at its

domicilium citandi et executandi shall be deemed to have been received on the day of

delivery; or

12.5 Notwithstanding anything to the contrary herein contained a written notice or

communication actually received by a party shall be an adequate written notice or

communication to it notwithstanding that it was not sent to or delivered at its chosen

domicilium citandi et executandi.

13. APPLICABLE LAW

This agreement (including its validity, existence and implementation, the interpretation

and application of its provisions, the respective rights and obligations of the parties in

terms of and arising out of the conclusion, breach and termination of the provisions of

this agreement), shall be interpreted and governed in all respects by the laws of the

Republic of South Africa.

14. MEDICAL EMERGENCY

In the event of an emergency, the Father/Mother/parents/Guardian authorise Embury or

a responsible staff member to employ the services of any emergency service, medical

doctor, hospital or other competent person, any cost for such service will be borne by the

Student/Father/Mother/Parents/Guardian.

15. CHANGE OF PERSONAL INFORMATION

The Student is required to and undertakes to notify Embury of any changes to their

personal information as stipulated in their Application Form. The Student will make such

notification in writing and will hand deliver the notification to the Embury Student Support

Department within 7 (seven) days of such change taking place.
