2nd INTRA MEDIATION AND CLIENT COUNSELING COMPETITION, 2019

In collaboration with the Hyderabad Arbitration Centre [HAC]

27th – 28th July, 2019

EVENT REPORT

I. About the competition

Centre for Alternative Dispute Resolution (CADR), Symbiosis Law School,

Hyderabad organized the 2nd Intra Mediation and Client Counseling

Competition in collaboration with the Hyderabad Arbitration Centre [HAC] on the

27th and 28th of July, 2019 respectively. The competition aimed to develop

mediation and client counseling skills which is one of the thrust areas of the

centre.

II. Objectives of the competition

By way of the 2nd Intra Mediation and Client Counseling Competition, the centre

aimed to achieve the following objectives:

To promote academic research on themes pertaining to Alternative Dispute

Resolution;

To create awareness amongst students pertaining to Alternative Dispute

Resolution Competitions;

To inculcate practical skills pertaining to Alternative Dispute Resolution

mechanisms;

To impart comprehensive training pertaining to Alternative Dispute

Resolution mechanisms.

Prior to the commencement of the competition, CADR organized a comprehensive

training session for all the participants of the 2nd Intra Mediation and Client

Counseling Competition, 2019. The Training Session was conducted by Mr.

Nisshant Laroia. The session aimed at equipping and guiding the students with

a comprehensive and detailed understanding on how to go about the Mediation

and Client Counseling competitions and further delving into the technicalities of

the same. The session was divided in two folds. The first half focused on

Mediation and detailing the various aspects of the same. It was concluded with

a brief roleplay mock done by all the participants. The second half of the session

focused on Client Counseling, and it covered the aspects to be taken into

consideration while interviewing a client as well as entire process of counseling

a client.

IV. Mediation Competition – 27th July, 2019

Centre for Alternative Dispute Resolution (CADR) conducted the 2nd Intra

Mediation Competition for the students of 2nd – 5th year in order to inculcate and

foster the skills, knowledge and proficiency in relation to the field of Alternative

Dispute Resolution by giving them a simulation of the real-life practice. There

was a total participation of 96 teams i.e. 288 students for the mediation

competition.

The primary objective of the Mediation competition was to endeavour, inculcate

and foster the skills of ADR mechanisms by giving them a platform to have a

real-life exposure of the same. Further, a parallel objective aims to select and

promote the meritorious students to represent Symbiosis Law School, Hyderabad

in various External ADR Competitions.

V. Client Counseling Competition – 28th July, 2019

The second day witnessed the hosting of the 2nd Intra Client Counseling

Competition at Symbiosis Law School, Hyderabad. The competition experienced

an overwhelming participation from a 124 teams i.e. 248 students of the

institution. The Client Counseling Competition is structured in such a manner

wherein a client approaches a set of counsels with his/her problem and further

the counsels comfort, guide and advice the client as to how their legal problem

would be dealt by them. The counsels are tested upon various aspects, including

but not limited to, building trust with the client, extracting all relevant

information, assisting the client in making an informed choice, so on and so

forth. For the purposes of the above-mentioned competition, the clients were

trained by CADR bearing in mind confidentiality of the competition.

There were a total of 12 esteemed judges invited to adjudge 124 teams, all of who

are either practicing advocates in various courts/tribunals or associates at law

firms. Mentioned hereinafter is the list of the same:

VI. Conclusion

The 2nd Intra Mediation and Client Counseling Competition concluded on 28th

July, 2019. Being the 2nd Edition, the competition witnessed an increase in

participation in both segments of the competition indicating the increased

amount of interest in the field of ADR. Further, it also reflects the interest of the

students towards resolving disputes in an amicable manner and creating a win-

win situation. The competition not only provided the participants with an insight

into a real-life mediation or client counseling but also paved way into

understanding the practice and procedure of the same. Furthermore, this

competition shall serve as a platform for the students to represent Symbiosis Law

School, Hyderabad in various External ADR competitions.

No quote better suits the ideology of mooting and this message was made very clear during

the First Moot Orientation Programme of Symbiosis Law School, Hyderabad which

introduced the 2019-24 batch to the world of mooting, an activity that will at some point of

time become the central focus of any law student’s college career. The programme was

conducted by the senior members of the Moot Court Association.

The programme began with an introduction to mooting, what it is, why it is so important and

what the procedures of mooting were. The moot problem, opinions and perspectives of the

audience were then discussed. The audience was then taught how to approach any given

problem by breaking it down and filtering out unnecessary information. Students were then

asked to highlight information they deemed necessary in the problem and were then asked to

justify why they believed the information to be important for their preparation. All the

relevant information was then organized and noted for all students to view. The students were

then given explanations as to why certain information was relevant to the problem while, the

problem also consisted of unnecessary information meant to confuse students.

The students were taught about the correct procedure to be followed while researching for the

problem and how they were to use legal authorities while mooting. Students were then taught

about the importance of a memorial, its formatting, the expected content and the order in

which it must be drafted. The next topic covered was oral pleadings and how to divide

arguments during pleadings into different stages.

The students were then briefed about the formalities of mooting, how one must address

themselves, the other side and the judges. They were then informed about mooting etiquette,

what one must do, what one must not do, how they must present themselves and how they

must present their cases. The briefings were then followed by an informative question and

answer session to clear any doubts the students had. Questions about the 4th Internal Moot

Court Competition, Zeal such as the formation of teams, the method of research and the

format of proceedings were put forward by the students and were then clarified by the

members of the Moot Court Association, thus concluding the first orientation programme.

Symbiosis Law School, Hyderabad, a constituent of Symbiosis University, Pune seeks to

provide nascent minds a strong foundation in understanding the practical implementation of

the legal system of our country. To understand law better, we believe in exposing our

students to a plethora of thought stimulating exercises to incubate and enhance advocacy

skills amongst the learners.

Similarly, bordering on this thought, the Moot Court Association which plays a major role in

training the students of Symbiosis Law School, Hyderabad organises various programmes to

introduce students to mock moot drilling, moot sessions, international and national guest

lectures, moot competitions and various other skill enhancement sessions,which are

conducted by eminent stalwarts from the ever rising legal fraternity. As Anthony J .D Angelo

said,“Develop a passion learning. If you do,you will never cease to grow.”

On the 3rd August, 2019, Symbiosis Law School, Hyderabad organised the 2nd Moot

Orientation Programme for the batch of 2019-2024 which was a lecture cum workshop on

mastering ‘Trial Advocacy Skills’ under the guidance and excellency of Advocate Vadeendra

Joshi.

Advocate Vadeendra Joshi graced this event with his excellence par wisdom. He enlightened

our students to sensitise themselves with the actual practice of advocating before a judge of a

court. The ulterior motive of the session was to instil in the young minds of the students, an

idea of how normal proceedings of the court work in the process of disseminating justice.

He also highlighted that trial advocacy is that branch of knowledge concerned with making

attorneys and other advocates more effective in trial proceedings. Unlike most law schools in

India, it is taught as an essential trade skill for litigators in law schools and in continuing legal

education programs.

The skills of trial advocacy can be broken into two categories: skills that accomplish

individual tasks (tactical skills) such as selecting jurors, delivering opening statements and

closing arguments, and examining witnesses, and those skills that integrate the individual

actions to achieve greater effects and to drive unfolding events toward the advocate’s desired

outcome (strategy) .

The attempt of the programme was to focus on tactical skills, through some integrated basic

methods of strategic planning. Although Vadeendra Joshi expressed disfavour with advanced

strategic techniques because of the imbalance they create, especially against attorneys who

are unaware of them.

However, proponents of advanced strategic techniques argue that these methods are the only

effective means to counter the already-existing imbalances in the system, as

between indigent defendants and the State and between working-class plaintiffs and well-

resourced, wealthy corporations.

Vadeendra Joshi highlighted on various factors that can enable the effective articulation of

arguments in a court before a judge. The session traversed from jury selection or ‘voir dire’,

opening statement, direct examination, cross examination, closing argument, persuasion

ultimately graduating into concepts like mock trial, basic trial strategy and advanced trial

strategy. The session drew upon some students allowing them to have a hands on experience

into trial advocacy by picking up a situation and modelling them on the basis of the

quintessential legal questioning that requires mastery over the verbatim, court etiquettes and

assimilation of characteristics worthy and appreciated of a lawyer.

The 3rd Moot Orientation Programme was

conducted by Mr. Pranay Nath Lekhi, in collaboration with the Moot Court Association of the

Symbiosis Law School, Hyderabad on 7th and 8th August. It was open to all batches. Mr. Pranay

Nath Lekhi, hailing from Delhi, pursued his LLB degree at West Bengal National University of

Judicial Sciences, Kolkata and is an LLM candidate at the University of Cambridge. He was

chosen as the Best Overall Law Student at the Ram Jethmalani Excellence Awards, 2019. He

was also adjudged as one of the best speakers in the Philip C. Jessup International Moot.

The session on 6th August was conducted in the Assembly hall, where Mr. Lekhi introduced

himself and spoke of his achievements. He then went on to introduce the concept of Moot Court

and the various aspects associated with it. Using a well formulated PowerPoint presentation, he

gave a detailed explanation and overview of the essence of public speaking involved in mooting.

He then went on to explain different aspects, giving analogies and personal anecdotes so as to

help students understand better.

Mr. Lekhi then highlighted the do’s and don’ts for the preparation of a memorial for a moot court

competition. There were several questions and queries coming from the vibrant and engaging

audience present in the hall. Mr. Lekhi threw light on the various stages and sources of research.

He also spoke about the relevance of the speakers in a moot team and how their role is crucial for

the team’s performance, after which he explained how it was important for the teams to focus on

tackling the questions that the judges would put forward and accordingly gave tips to answer

them confidently. In the end, he gave advice based on his past experiences and participation in

the various National and International Moot court competitions. Soon followed a Q&A session

with the audience members. Prof. (Dr.) Sarfaraz Ahmed Khan, Director of Symbiosis Law

School, Hyderabad felicitated Mr. Lekhi with a shawl and memento amidst sounding applause.

On 8th August, the session was conducted in the

Moot Court Association Hall. Carrying forward the interaction from the previous day, Mr. Lekhi

spoke about the process of getting into Law schools in the USA and UK for pursuing an LLM.

Along the same lines, he mentioned that acclaimed law schools preferred aspirants with prior

work experience. Emphasizing on the importance of grades and essays, he also dwelled on the

essence of writing research papers and getting them published. Then, he concluded by giving a

brief introduction to the idea of ‘vacation schemes’, which was something new for the students in

the audience.

Fit India Movement - Dated: 29th August, 2019

Symbiosis Law School, Hyderabad participated in the Inauguration of the ‘Fit India Movement’

launched by the Hon’ble Prime Minister of India at 10:00AM on 29th August, 2019. The

Director, Deputy Director, Faculty, Non-Teaching Staff and the students enthusiastically

participated in the event. The event was initiated with a brief introduction about the Fit India

Movement, the necessity of a fit lifestyle and healthy living. Thereafter, the Inauguration of the

Fit India Movement was telecast live at the Auditorium of the Symbiosis International (Deemed

University), Hyderabad Campus. The Hon’ble Prime Minister of India, Narendra Modi, launched

the Fit India Movement with collaboration from schools and colleges across India. In his historic

speech, he appealed to every citizen to take time to make themselves fit, healthy and active. The

inauguration took place at the Indira Gandhi Stadium in New Delhi and the live telecast was

screened at Symbiosis Law School, Hyderabad. The event started with a mesmerizing

performance depicting the various forms of sports, martial arts, dance and yoga in India. Further,

the Hon’ble Prime Minister paid a tribute to Dhyan Chand and appreciated the various sportsmen

of India. In his concluding remarks, the Prime Minister appealed to every individual, especially

the youth, to engage in physical activity in order to maintain their mental and physical well-

being. Subsequent to the inauguration, the Director, Deputy Director, Faculty, Non-Teaching

Staff and the students came together to take the pledge of fitness and thereafter, walking 10,000

steps across the campus. The event served as an inspiration for everyone to take time out of their

busy lives and take care of their health and fitness.

The telecast inspired and motivated the students and staff of Symbiosis Law School, Hyderabad

to adopt a healthier lifestyle.

After the telecast, the attendees pledged to adopt a healthier lifestyle and thereafter, walked

10,000 steps across the campus of Symbiosis Law School, Hyderabad. The event brought the

necessity of a healthy lifestyle and the dangers or a sedentary lifestyle into focus.

EVENT REPORT

WORKSHOP ON ADR MECHANISMS

Centre for Alternative Dispute Resolution (CADR) successfully organised a workshop

on ADR mechanisms on 21st September 2019, at Symbiosis Law School, Hyderabad

for the newly admitted batch of 2019-2024.

The workshop was conducted with an aim to introduce the various mechanisms of

Alternative Dispute Resolution prevalent in the Indian Legal System to the new batch

of 2019-24, since this field happens to be a completely new and unaccustomed field

for the 1st year students. The workshop gave them basic theoretical knowledge about

Arbitration, Mediation, Negotiation and Conciliation.

The workshop was conducted by Mr. SravanUnnam, MCIArb, Partner at Unnam Law

Firm, Hyderabad, Founder Trustee & Head – Hyderabad Arbitration Centre [HAC],

Certified Commercial Arbitrator and Accredited Mediator, IIAM, Kochi. The history

of Alternative Dispute Resolution (ADR) was briefly drawn out with interesting and

relevant examples. The important statutes on ADR were introduced with the prime

focus upon the Arbitration and Conciliation Act, 1996. The relevance of certain

sections of this Act were discussed along with the salient features of the Indian

Contract Act, 1872 which facilitate ADR. It was a very interesting and knowledgeable

experience for the students as Mr. Unnam engaged them by using real life scenarios

that he had come across in his practice. It was a successful workshop that left the

students with a new found interest and understanding of the field of ADR.

One Week Faculty Development Programme On Introduction To

Teaching, Evaluation And Research Skills from 2nd December to 7th December, 2019

Introduction: In the year 1950, North American medical schools started conducting the

activity to improve the teaching of medical professionals which was considered as the first

structured faculty development programme. It is now an ongoing and the most common

form of activity in teaching profession. Today the profession of teaching has become quite

challenging because of the latest technological development. The trend in the teaching

profession is in changing scenario, and the teachers are expected to be more effective in

teaching, evaluating and research. Being a teacher is not just about communicating

knowledge, it is about making sure that the students truly integrate this knowledge and

derive learning out of it. Any teaching that does not result in effective learning is useless.

Therefore, to be an effective teacher, one needs to be able to deliver the domain knowledge

using the most suitable pedagogical tools. An effective teacher is also required to remain at

frontiers of knowledge in his/her areas of subject expertise and gain working knowledge of

other domains as Law is essentially interdisciplinary. Hence the periodical faculty

development programme for the teachers is in high need, to continuously upgrade him/her

in teaching andresearch.

Therefore, the present Faculty Development Programme (FDP) initiated and aimed to

enhance the teaching and research skill of the faculties from college/institute/university

belongs to the broad disciplines Law, Social Science, and Management on following

objectives:

Objectives of the Faculty Development Programme

To obtain an in-depth understanding of various recent pedagogy of Law, Social

Science, andManagement

To enhance the knowledge of evaluation standards andpractices

To improve the research capabilities by understanding the elements of a good

research proposal; qualitative and quantitative and data analysis tools andtechniques

The programme was attended by 48 participants; 19 participants were from Symbiosis Law

School, Hyderabad, 22 participants were from Symbiosis Law School, Pune, 2 participants

were from Symbiosis Law School, Nagpur, 2 participants were from Symbiosis Law

School Noida and the rest from other universities. Attendees included Research Scholars

and Academicians from varied background. While designing the structure of the

programme it was kept in mind that there are going to be people from different background

that’s why

emphasiswasgivennotpertainingtoonesinglefieldsothatmaximumcanbebenefittedout of it.

Two high tea (Morning and Evening) Lunch and Dinner was provided to participants daily

and one kit was issued to each participant at the time of registration.

Prof. (Dr.) Richard Anthony Glofcheki, Honk Kong University, said that we are learners in

this lifelong learning process and a teacher must give to his student seeds to plant and not

the fruits

Prof. (Dr.) K. I. Vibhute, Director, Amity Law School, Mumbai, explained the difference

between a Teacher and Good Teacher. He also highlighted that a teacher has not become

redundant in spite of Google. He explained the 3 R’s for a teacher i.e. Reading, Retention

and Retrieval.

Prof. (Dr.) J. S. Patil, Vice Chancellor NLU Assam, in his presidential address has

questioned the audience ‘are we able to understand ourselves’ and said to search for new

things in treasure of knowledge.

Session 1:

Prof. (Dr.) K. I. VIBHUTE (Director, Amity Law School, Mumbai)

Teaching Skills – I & II: Classical Methods (Class room lecture, Interaction, etc.) & Public

Laws

During his interaction Dr. Vibhute discussed about who a teacher is, and how Law should

be taught. According to him a teacher should not be a teacher in text, but he must be a

teacher in the context. He discussed about why we must go with the context and explained

its indicators; he also referred to the platform on which we must be acquainted with. He

said every day is an examination day and the students are going to examine us. He

explained the concept of 3 R’s i.e. Reading Retention and Retrieval. Research is a

Systematic Scientific Inquire and Legal Research is a systematic investigation of a legal

fact that increases the sum of knowledge of law. It involves 2 A’s i.e. Ascertainment of

Law and Advancement of Law. He added saying that a teacher should not be redundant in

e-age. He explained about the scope and relevance of legal research and major stages in

legalresearch.

Prof. (Dr.) J S Patil (Vice-Chancellor, NLU, Assam)

Teaching Skills – 3 & 4: Legal Aid Clinic & Curriculum Designing

Dr. Patil, explained how important a Legal Aid Clinic is in a law college and shared his

experiences. He started University College of Law Legal Aid Clinic the first of its kind and

fought on various public issues to name a few, Capitation Fees, Daily Wage workers case

etc. In case of fight against capitation fees, through the legal aid clinic, he approached

Supreme Court, submitted writ petition where the presentation of the case was done by the

students and won the case (PIL) against capitationfees.

In case of Daily wage workers case – over 10 years period nearly five lakh employees were

regularised. He is the one who set Karnataka State Law University. He also played a major

role in bringing Khadi back. In case of National Register of Citizens Assam, PARICHAY is

been set up to help those people.

While talking on curriculum designing, he

discussed about the points to be considered while

designing the curriculum. He shared his

experience on how a course which was

introduced by him lasted for 10 years. He

proposed an add-on course as a 7th

paper to be

developed as indigenous course (national /

international) by any one of the centres.

He also said to integrate CBCS &CGPA, must

make curriculum simple as if it is a feast to the

students. He said there is a need to include Mahatma Gandhi’s Ahimsa in the curriculum.

He said that we must integrate past into present to go into thefuture.

Teaching Skills – 5 &6: Contemporary Methods (Case Study method, Activity based

learning, using moderntechnology)

According to Prof. Richard the seminar

outcomes were to reflect upon and

reconsider the role of teacher in higher

education, and consider and evaluate

why and howauthentic learning and

assessment can produce more

productivelearning.

He said university should not be a

disruption of learning, make our

experience meaningful. Teaching

philosophy should be personality-drive.

He explained what could be Graduate

Attributes / Learning Outcomes and

inter relationship between learning outcomes, assessment tasks and teaching & learning

activities. He explained about the centrality of assessment and role of assessment in higher

education. He said assess as you teach and teach as you assess and spoke about various

methods such as News Reports, Reflective Media Dairies, Video Documentaries, Feedback

etc.

This session started with Dr. VK Satya Prasad (Faculty SIBM Hyderabad) explaining about

Massive Open Online Courses (MOOCs). Difference between classroom learning and online

learning, difference between MOOCs and online courses and the various platforms those

are available.

Dr. Dikkatwar Ramakrishna (Faculty SIBM Hyderabad) explained about Learning Centric

MOOC and explained the difference between classroom scenario and LCM model. He also

explained how Lectures and Demos become Learning Dialogues (LeD), Assignments and

Activities become Learning by Doing (LbD), Instructor-Learner interaction becomes

Responses and Feedback (RF), Learner-Learner interaction becomes Learner Experience

Interaction (LxI), Additional Readings become Learning Extensions (LxT) and Exams and

Assessment become Knowledge Consolidation (KC). He also explained how to create LeD

Learning Dialogues.

Dr. Tanmoy De (Faculty SIBM Hyderabad) gave a presentation on how to design MOOC,

need analysis, content analysis, learner analysis, course outline, objectives, instructional

strategies, instructional material, evaluation strategies, time-wise course session plan,

implementation and duration of the course.

Teaching Skills – 9 & 10: Experiential Learning & Quality Research and Publication

Dr. Shashikala Gurpur’s discussion was about integrating experiential learning into the law

school curriculum, practice value of experiential legal education and using experiential

education to develop human resources for the non profit community. The relevant material

was shared to the participants one day prior to the scheduled session. She explained life of

law teachers in India and in other countries. She said we must respond to human suffering

and be an activist. She explained Indian tryst with Experiential learning, starting from

clinical legal education movement by Dr. N.R. Madhava Menon that has now moved from

apprentice culture to court visits through 4 clinical courses. She said experiential learning is

a degree beyond clinical learning, with experiential learning one will develop critical

thinking that will lead to stretching of mind. She explained about Legal Education Context,

also gave an activity to the participants to share their experience about experiential learning

– what worked? What did not, why? How we can move forward? Participants were divided

into three groups and shared theirexperiences.

Talking about Quality Research and Publication, she explained the concept of legal

research. She also focused on Legal Research collaboration. She explained the Quality

Research indicators like ensuring quality (original, profound, relevant), Utility and Impact

pathway.

Prof. (Dr.) Richard Glofcheski, Hong Kong University Flipped Class Room and the

Learning

Prof. Richard explained about Flipped Class, wherein “what is traditionally done in the

class is done outside the class and vice versa. He explained how the change takes place

from passive to active, teacher directed to self-directed, content centric to inquiry based,

individual to collaborative or team oriented, instructional paradigm to learning paradigm,

sage on the stage to guide on the side etc.

by university. He said evaluation should be such that the examination department has very

Dr. Atmaram Shelke & Mr. Abhijeet Vasmatkar (Faculty SLS Pune)

Aligning Course & Programme Outcomes: Drafting of Objectives in Question Paper

Mr. Abhijeet Vasmatkar explained the important aspects of the Objective Based Education,

about Programme Educational Objectives (PEOs), Programme Outcomes (Pos), Graduate

Attributes (GAs), Programme Specific Outcomes (PSOs), Course Outcomes (COs). He

explained the Blooms Taxonomy and different levels such as Level I Remembering, Level

2 Understanding, Level 3 Applying, Level 4 Analysing, Level 5 Evaluating and Level 6

Creating.

Dr. Atmaram Shelke, Dy. Director (Administration), SLS Pune, explained drafting multiple

choice question paper and different types of question which can be incorporated in multiple

choice questions.

Prof. (Dr.) G. B. Reddy (Former Dean, Faculty of Law, Osmania

University) Research Skills – I (Doctrinal and Non-Doctrinal)

Dr. Reddy explained about Legal Research in India – Contemporary Trends and the way

forward. His discussion was on what is Doctrinal Legal Research, methods of conducting

Doctrinal Legal Research, Analytical Legal Research, Historical Legal Research,

comparative methods of Legal Research. He also focussed on what is Non-Doctrinal

Research and varioustools.

Prof. (Dr.) Vishwas Devaiah (Jindal Global University, Sonipat)

Research Skills – II (Quantitative, Qualitative & Mixed Research methods)

Dr. Vishwas explained about Leal Empiricism, reasons for development, constructed

reality and new age realism. He gave example of research questions that prompt empirical

approach, various statements that cannot be proved unless there is some empirical

evidence. He discussed various quantitative research methods, but focused on questionnaire

as a tool to quantify the data. He further discussed various types of questionnaire, what

need to be done prior to designing a questionnaire and the questionnaire process.

Research Skills – III (Inter disciplinary Approach)

Dr. David Ambrose started his discussion by saying without a student we are not Teachers,

our students make us professors. He explained

research, (legal, logical and scientific), kinds

of research, qualitative, quantitative, inter

disciplinary approach and interdisciplinary

research.

Later the participants were taken to

Day 5 (Friday – 6th December 2019)

Prof. (Dr.) Bindu Ronald (Dy. Director, Symbiosis Law School, Pune) Teaching Skill

– 11 (Corporate Law)

Prof. (Dr.) Bindu Ronald in her discussion spoke about Pedagogy and Andragogy (the

methodofteachingadultlearners),expectationsasalawteacherandstudentexpectationsfrom the

teacher. She also engaged the participants with a role play exercise of enacting a board

room meeting.

(Criminal Justice Administration)

Prof. (Dr.) Balraj Chauhan discussed about the purpose of criminal Law and the principles.

He also said about four theories of teaching. Whereby, he has given special focus on 3

components of criminal justice administration – law enforcement, court system and

correctionalsystem.

Prof. (Dr.) G. Mohan Gopal (Former Director, NLSIU, Bengaluru & National

Judicial Academy,Bhopal)

Role of Law Teachers in the contemporary time

Prof. (Dr.) G. Mohan Gopal stated that law schools should be converted into think tanks,

students should be trained to reform the judicial system. His whole idea of justice was

related to Swaraj and he was of the opinion that we have to re-theorise the idea of justice.

Laws

Prof. (Dr.) Sairam Bhat discussed the nuances of the contract law. He has given special

focus on the technicalities involved in surrogacy contract.

Prof. (Dr.) Sandeepa Bhatt who is also the coordinator for society for studies in outer space

law at NUJS Kolkata, said Aviation Law and Space Law should be taught separately as

both contradict to each other. He also highlighted the differences in liability, registration

etc.

Further he explained the participant how Space Law as a course can be designed and

taught. Historical background, fundamental principles, liability and registration,

sovereignty & property rights, environment, military & IP issues, financing private space

activities & need for national space laws.

Dr. Rupal Raut Desai explained how to teach Intellectual Property Law, aspects of teaching

Intellectual Property Law, use of different pedagogy/andragogy to engage he students. She

also explained as to why practical classes to be taught by experienced practitioners covering

actual techniques of prosecution.

She covered the types of IP courses, choosing teaching material and writing syllabus or session

plan. Methods of teaching, simulations, drafting exercise and participants had a activity on

Negotiation exercise.

Teaching Skills – 17: Family Law

Prof. (Dr.) Poonam Saxena, explained the qualities that students are looking for in their

teachers and various types of students in a class room atmosphere. She said that teaching

family law is different from teaching other laws due to multiplicity of family laws and

explained how to teach family law, the importance of valid solemnization of marriage and the

fundamental aspects.

VALEDICTORY CEREMONY: At the valedictory function Mrs. Dhanya K. A. (Assistant

Professor, Symbiosis Law School Hyderabad) addressed the gathering, followed by speech by

the chief guest Dr. Poonam Saxena (Vice Chancellor, National Law School

Jodhpur).Certificates were distributed to all the participants by Dr. Poonam Saxena (Vice

Chancellor, National Law School Jodhpur), Dr. Rupal Raut Desai (Associate Professor, SLS,

Pune) and Dr. Anuradha Binnuri (Deputy Director, Symbiosis Law School Hyderabad).

Mr. Chandra Sekhar Alladi (Assistant Professor, Symbiosis Law School Hyderabad) presented

the report on Faculty Development. Later the participants shared their experiences.

REPORT ON DANCE COURSE

The Dance Club under the faculty in- charge of the Cultural Troupe conducted a dance course

for a period of 30 hours between the months of January and March 2020. Having attended the

first dance course of Symbiosis Law School, Hyderabad and being presided by an esteemed

choreographer was overwhelming for all the students attending the course. We were given

intense training throughout the course from beginners to intermediate level for various forms

including Hip – Hop, Free style, Bollywood, Krumping, Bharatanatyam, Kathak, Whacking,

Contemporary, Salsa. Classes were conducted based on weekly availability of the

choreographer and maximum turn out of students. The course turned out to be a huge success

since all the students were satisfied, have learnt something new and improved their skills. The

choreographer assisted us in preparing for an external competition at GITAM University,

Hyderabad where we gave a good performance. The course was a stress buster for most of the

students. The college constitutes of students interested and passionate about dance and most

members of the Dance Club have received professional training. This course was a blessing for

us since we could relive the feeling of attending a professional dance class in between our

hectic schedules. We are grateful to the authority to have given us such an opportunity and

look forward to receiving more courses like these in the coming semesters which will surely

help us in securing laurels for our college in the future.

WEBINAR ON ‘FUNDAMENTALS OF MEDITIATION’ on 1st May, 2020

Alternative Dispute Resolution Society (ADRS) organised the first webinar on ‘Fundamentals of

Mediation’on 1st May, 2020 for the students of Symbiosis Law School, Hyderabad. The webinar

was conducted with the objective to enlighten the students about the fundamentals of mediation.

The webinar focused around to address the complications and technicalities involved in the

process of mediation in India. Further, the webinar aimed to foster awareness amongst the

student community as to how Mediation law has developed in India.

The panellist leading the webinar was Mr. A.J. Jawad, Co-founder and Trustee of Foundation for

Comprehensive Dispute Resolution (FCDR) and was moderated by Kanishka Mittal, Vice-

President of ADRS. A few key takeaways from the webinar are mentioned hereinafter were,

brief insight into the history of Mediation, emphasis upon the concept of Mediation in India with

sufficient reliance on Section 89 of the Civil Procedure Code, 1908 and the landmark judgments

of the Supreme Court of India. He discussed various types of Mediation in India and different

styles of Mediators and outlined Director also graced this occasion with their presence in this

webinar. The event was moderated by Sriharshitha Chada. Purpose of the event was, to discuss

how confinement is a breeding ground for domestic abuse, to analyse the various immediate

resources that an individual can avail if he/she is subjected to domestic abuse, to understand the

role of organisations and NGOs while responding to domestic violence during the pandemic and

to understand the function of the law enforcement to ensure the safety of the victim and how the

cases of domestic shall be handled post lockdown.

Mrs. Ekta shared her views on the questions the moderator asked. She expressed her views on

how India is one of the leading countries in all the spheres but unfortunately ranks down in

curbing the Gender based violence where people consider it as a taboo. These cases could be

curbed only if there is a change in the mindset. She further stated the lack of awareness on these

issues would never let the violence come into limelight. Henceforth women tolerate the violence

without knowing what actually she is going through and all the onlookers and the neighbours

normalize the behaviour by not thinking it as their moral responsibility to reach out to the victim.

Mrs. Ekta further added to the webinar by stating that there is a dire need of a National Level

Campaign on these violence’s, small skits by individuals which portray domestic violence to be

shared with people through which they can be aware of it. She expressed her views on the

immediate establishment of temporary Safe Shelter homes for both women & children wherein

the victim can be transferred immediately during this kind of situation where people cannot

move freely and ensured that the gaps in the safe homes must be identified like sanitation and

infrastructure for better living. She also explained the dire need of National Level campaigns

which can bring a clever change in the society and the need of awareness in the rural areas

through their grassroot levels such as Anganwadi teachers where the villagers accept them rather

than the outsiders with whom the villagers might not be comfortable with. The young minds can

bring out a drastic change in the society if they start working on the behaviours that lead the

abuse and empower lots of people and stand by the victim along with them in this fight. She

emphasized on the issue of gender sensitisation and

the education system should also impart these values

to the students.

Mrs. Saritha Nittala has thrown light on the drastic

psychological changes a person undergoes due to

domestic violence. During the domestic abuse, the

mental status of the victim is hazy, shattered, lack of

self-esteem and self-confidence, no will power and

are hopeless. During this situation a person needs

psychological support and awareness about the

violence she faced. She explained the real root cause

of the violence is anger, because where everyone is under social pain during this pandemic and

displaced anger will definitely increase violence. On a societal level, more and more

programmes should be created to empower the people and schools should ask students to express

their anger and work in counselling them about anger management since very basic classes

through which the younger minds would create an impact in the future. Counselling must be

done to the abusers rather than victims because the change has to come within the abuser. She

expressed her views on the misconception between the emotions of Men and Women and about

the norms set up by the society for both the genders. According to societal norms, men aren't the

ones who cry and express their problems to the public at large. There is also a need for men to

form up organisations to battle domestic abuse against them like how women do. She explains

how the bystander effect makes the society not to interfere and become an active role in these

violence terming it as an issue between both the partners. She appeals to people to raise up,

create awareness about the violence because children living in these households would have an

impact in their mind and would continue to do so when they are adults. It is a moral

responsibility of people to be helpful to the person who really needs help and to open up because

it is a high time to work on these issues.

The webinar keenly emphasized on the ongoing situation and the outcomes in a victims life due

to domestic violence. This webinar gave rise to many possibilities where it motivates youth to

raise awareness on domestic abuse and stand by the victims, where law students can spread legal

awareness on domestic violence being a crime and make people know what their rights are and

how one can battle such odds in society. Vote of thanks was proposed by the faculty-in-charge.

necessary qualities of a mediator and elaborated upon the enforcement of settlement agreements

in India. Highlighted the problems faced due to lack of a legislation enforcing Mediation in India

and briefly touched upon the importance of the Singapore Convention on Mediation. The

ADRS.

WEBINAR SESSION on CYBER CRIMES DURING COVID-19 on 5th

The Centre for Specialization in Cyber Law Studies of Symbiosis Law School, Hyderabad to

propagate the knowledge of rights and duties that a person needs to be aware of, while

navigating through the cyberspace and to help the stakeholders have a better understanding of

the nuances of this field and keep them abreast with the current cyber scenario, which changes

notoriously fast, conducted its first Webinar Session on Cyber Crimes during COVID-19 on

5th of May 2020 (Tuesday). The speaker of this webinar was Mr. Ritesh Bhatia, a well-known

Cybercrime Investigator and Cybersecurity and Data Privacy Consultant and also the

Founding Director of V4WEB Cybersecurity. He is a TEDx speaker and also has been a

distinguished speaker at many national and international conferences and organizations. The

webinar witnessed participation from students of all batches and faculty members. The

webinar started with the welcome address by Dr. Anuradha Binnuri, Deputy Director of

Symbiosis Law School, Hyderabad. The cybercrimes emerging during the COVID-19 period

was addressed by Mr. Ritesh Bhatia by means of real-life case studies, making it interesting

and contemporary. He spoke about the use of

cousin domains, which are look-like domains of

trusted websites and companies, being used

extensively for committing fraud and money

theft. With respect to on line money scams.

Further, he also addressed possible solutions to

deal with email scams which extort the person for

money in exchange for sensitive information. He

advised the frequent change of passwords and

also emphasized on never keeping the same

password for multiple accounts. The next cybercrime which Mr. Ritiesh Bhatia discussed was

sextortion, a practice of extorting money for sexual favoursfrom someone by threatening to

reveal evidence of their sexual activity. He advised the attendees

tobecautiouswhilegivingpermissiontovariousappsastheappmightactlikespywareandattain

personal information from the person's phone. He also explained the improper use of Artificial

Intelligence that is taking place at this time of age. Mr. Ritesh Bhatia emphasized on the need

to sanitise each person's phone, by revoking unnecessary permissions, uninstalling unwanted

apps and deleting sensitive information to ensure that a step is being taken for protection

against the ocean of new-age cybercrimes.
