Two people represented by the law firm of Robbins Arroyo filed the suit last Wednesday in federal court in California against Diageo, the makers of Red Stripe, historically a Jamaican beer. They claim Diageo commit- ted unfair and deceptive practices and have been unjustly enriched by marketing and selling beer in a way that misleads consumers into believing that its Red Stripe is still being imported from Jamaica. Aclass-action suit has beenfiled against the manufactur-

ers of Red Stripe beer in theUnited States, for allegedly de-ceiving consumers into thinkingthe beverage is made in Jamaica.

Two people represented bythe law firm of Robbins Arroyofiled the suit last Wednesday infederal court in California againstDiageo, the makers of Red Stripe,historically a Jamaican beer.

They claim Diageo commit-ted unfair and deceptive practicesand have been unjustly enrichedby marketing and selling beer in away that misleads consumers intobelieving that its Red Stripe is stillbeing imported from Jamaica.

Some 150 years after Abra-ham Lincoln's Emancipation

Proclamation freed the slavesand set the stage for equality andcivil rights for everyone, AfricanAmericans continue to face dis-crimination and other forms ofinjustice.

The Republican Party ofLincoln promoted individualfreedoms of all men as well asthe right for all to receive a pub-lic education. Democrats, at thetime, spoke of social progres-sion, but did not act on it. Some150 years later, so much haschanged and the DemocraticParty is now regarded as theparty that supports AfricanAmericans.

Nevertheless, we must ac-knowledge that while we con-tinue to see tangible progressand achievements for BlackAmerica, they continue to be atthe bottom of the poverty scalewith low income and poor edu-cational attainment.

They also continue to expe-rience overall poor living condi-tions.

African Americans, for ex-ample, account for less than 10percent of the US population butrepresent up to 70 percent of thenation’s prison population. AndBlacks appear to be the target ofvarious agencies of government,including police and other secu-rity personnel at the city, stateand federal levels. It would ap-pear that in too many cases#BlackLivesDon’tMatter as theyare being killed, abused and dis-criminated against without theperpetuators (cops) facing penal-ties.

African Americans are veryactive in politics, with the major-ity of the leaders Democrats.Yet, in several New York Citycommunities that they dominate,the agents of the state and citytreat black people with utter con-tempt.

It would appear that ourelected black leaders are notdoing enough to protect the peo-ple who put them in office. Per-haps they are too comfortableand would not want to disturb

those misguided minority, butinfluential racists that alwaysseek to harass African Ameri-cans as #BlackLivesDon’tMat-ter.

But there are millions ofAmericans, include Whites whoare embracing the hashtag andslogan “#BlackLivesMatter” – agrassroots movement of ordi-nary people such as activistShaun King, who claimed foryears that he is biracial but re-cently uncovered document re-vealed that he is in fact white,and ex-NAACP chapter leaderRachel Dolezal, the whitewoman who posed as black formost of her life and was one ofthe most outspoken and aggres-sive advocates for black people.The #BlackLivesMatter move-ment will continue to attractpeople of various races and cul-ture and may be the real solutionto bring racism under control.

We must embrace #BlackLivesMatter

Organizational politics are ac-tions by individual members

of the organization and in somecases groups, such as teams, toobtain, develop, and exercisepower to achieve a desired out-come.

Organizational politics arethe natural outcome of situationsin which members of the organi-zation share power but differ as tothe strategic direction the organi-zation should take, the way strat-egy should be implemented, andthe resources that should be allo-cated to the various units in theorganization.

In most situations, organiza-tional politics result in a negoti-ated settlement to resolve thedifferences based on some degreeof compromise among the com-peting interests. As a result, orga-nizational politics is notinherently harmful to the organi-zation because it functions as ameans to balance the relationshipbetween the internal structuresand groups.

The concept of influence ex-erted by leaders is closely relatedto the concept of power. Influenceis the ability to motivate individ-uals by persuasion and noncoer-cive techniques. Power is theability to motivate individualsthrough the use of control, whichcan but does not necessarily in-clude coercion.

From this perspective, powercan be considered in terms of thepossibility but not the certaintythat an individual will exercisecontrol over others.

Leaders in an organizationare more likely to adopt politicalbehaviors when decision-makingprocedures and performancemeasures are unclear or complex.

For example, in an organiza-tion without specific rules con-cerning individual accountabilityfor decisions, a leader may preferto achieve some degree of con-sensus with peers or superiors be-fore making a decision. Thissituation could result in the leaderusing various forms of power toinfluence peers to agree with theleader’s position.

Leaders may also behave po-litically when resources arescarce and there is substantialcompetition to secure sufficientresource allocation. In this situa-tion, political behaviors such astrade-offs and maneuvering tomaintain competitive positioningamong peers are rewarded whenthe leader obtains sufficient re-sources.

The leaders in an organiza-tion can also use the performanceappraisal process to foster politi-cal behaviors among followers,which is an example of a negativeform of organizational politics.

The political approach toperformance appraisal occurswhen some criteria other than

performance is the basis for theappraisal, such as support for theleader’s agenda.

As a result, the employee’sperformance is no longer con-

nected to the organization’s goalsand objectives, undermining theorganizational effort to imple-ment its strategic plan.

Brooklyn District Attorney Ken Thompsonon August 7, 2015 announced that a 35-

year-old Brooklyn man has been sentencedfor stealing $120,000 from a Brownsvillebranch of Modell pawn shops, where heworked as a manager.

The defendant said he took the money topay off debts. He was sentenced to six monthsof weekends in jail and there was a full orderof restitution filed against him.District Attorney Thompson said, “We in-

tend to make sure that the defendant paysback every dime that he stole from his em-ployer and also serves jail time for his crimi-nal conduct.”

The District Attorney identified the de-fendant as Timmy Harrison, 35, of RyderStreet, in Flatlands. The defendant pleaded

guilty before Brooklyn Supreme Court JusticeDanny Chun on May 26, 2015, to one countof fourth-degree grand larceny. He was sen-tenced today to six months of weekends in jailand signed a judgment for a full order of resti-tution.

The District Attorney said that, accordingto the investigation, the defendant had beenemployed at the Pitkin Avenue Modell Pawn-brokers since May 2010. As manager of thatlocation, he was responsible for all cash andhad exclusive access to certain secured areasof the branch.

In August 2014, owner Eric Modell be-came aware of financial irregularities in thePitkin Avenue location and sent the Directorof Security to investigate.

NEW YORK CITY:Four CUNY schools have beenlisted as some of the highest per-

forming and most affordable schoolsin the Northeast.

Governor Andrew Cuomo saysBaruch College, Lehman College, QueensCollege, and John Jay College of CriminalJustice were all ranked in the top five ofWashington Monthly's list of "Best BangFor The Buck" four-year schools in theNortheast.

According to Washington Monthly,the schools were evaluated on three cate-

gories: social mobility, research, and serv-ice.

Baruch came in first place, whileLehman, John Jay and Queens Collegeranked third to fifth respectively.

An Ozone Park auto body repair shop andits owner have been charged with crim-

inal tax fraud, grand larceny and othercharges for allegedly stealing more than$125,000 in collected taxes that were owed toNew York State and local municipalities.

Queens District Attorney Richard A.Brown identified the defendants as StephanieDavino, 31, of Howard Beach, Queens, andher business, A&W Auto Collision Center,Inc., located at 104-11 101st Street in OzonePark, Queens. Davino was arraigned earlierlast week before Queens Criminal CourtJudge Ernest Hart on a criminal complaintcharging her and the business with second-,third- and fourth-degree criminal tax fraud,second- and third-degree grand larceny, first-degree scheme to defraud and fifth-degreeconspiracy.

Davino, who faces up to 15 years inprison if convicted, was released on her ownrecognizance and ordered to return to courton September 30, 2015. In the case of a cor-

poration, conviction of a felony is punishableby a fine of up to $10,000 or double theamount of the illegal gain.

According to the criminal complaint,said District Attorney Brown, Davino, who islisted as the owner and president of A&WCollision on tax and finance records, failed tofile a single sales tax return between January26, 2012, and March 3, 2014. However, dur-ing that period of time, the auto body shop al-legedly performed repairs totalingapproximately $1.4 million and received pay-ment for the repairs from GEICO, State Farm,Allstate, Progressive and USAA insurancecompanies. The total amount of sales tax al-legedly due and owing to the city and stateamounts to approximately $125,700 ($61,965to New York State and $63,735 to local mu-nicipalities).

“When an auto body shop, or any busi-ness, fails to remit sales tax to the state it hascommitted a serious crime – with serious con-sequences,” said Commissioner Jerry Boone.

Brooklyn:

Attorney General Eric T. Schneidermanon Monday announced a $6 million

settlement with Empire State Home CareServices, Inc. (Empire), a home care agencyoperating out of Brooklyn.

The settlement resolves claims thatEmpire improperly reported its home healthaide hours as well as administrative andgeneral expenses on cost reports filed be-tween 2002 and 2005. These cost reportswere used to set the reimbursement ratesthat Empire received from the state for theyears 2004 through 2007 and resulted inover $3 million in reimbursements to whichEmpire was not entitled.

The audit revealed that Empire reportedthe salaries and benefits of administrativepersonnel under direct care cost centers,rather than administrative and general costcenters. By improperly placing these costs

in direct care cost centers, Empire receivedinflated Medicaid reimbursement rates dur-ing the audit period. The settlement stipu-lates that Empire will pay $6 million to thestate, including penalties on top of the justover $3 million that was improperly reim-bursed.

“Many New Yorkers count on Medi-caid for important health services, and I willcontinue to safeguard Medicaid funds to en-sure they are being used for their intendedpurpose,” said Attorney General Schneider-man. “When Medicaid reimbursements areinflated by providers, it causes funds to bediverted from those most in need.”

The audit also found that Empire im-properly allocated certain home office coststo the direct care cost centers, thereby fur-ther inflating their reimbursement rate.

The underreporting of home health aidehours as alleged in this case increased the

hourly rate at which the state would reim-burse the agency for such services. Further,improperly reporting administrative costsunder the category of nursing services alsoinflates the size of a home health agency’sreimbursement.

Feeling trapped in his nursing home,Hamilton Smith, a Bronx resident, and

three other people with disabilities filed aclass action lawsuit last week in federal courtto end the illegal administration of a programdesigned to transition them to their ownhomes with the care and support they need tolive independently.

Represented by MFY Legal Services,Inc. and Patterson Belknap Webb & TylerLLP, the suit alleges that the New York StateDepartment of Health (DOH), DOH Com-missioner Howard Zucker, and Visiting NurseAssociation Health Care, Inc. (VNA) haveadministered the Nursing Home Transitionand Diversion Medicaid Waiver Program(NHTD Program) unconstitutionally and ille-gally. New York’s Medicaid Plan trumpetsNHTD as a program that helps senior citizensand individuals with disabilities avoid unnec-essary confinement in nursing home facilities.

Hamilton’s story is a common one. Hefirst applied to the NHTD Program nearlythree years ago and VNA found that he qual-ified to transition out of a nursing home. Hewas unable to complete his application de-spite his repeated requests to VNA for assis-tance allegedly due to a lack of programresources. After two years of trying to com-plete his application, VNA informed Mr.Smith during a routine status update that hiseligibility determination had “expired” andthat he would need to reapply to the NHTDProgram.

WASHINGTON, USA:US Secretary of Homeland Secu-rity Jeh Johnson has extended

Haiti’s designation for Temporary Pro-tected Status (TPS) for an additional18 months. The extended designationis effective January 23, 2016, throughJuly 22, 2017.

Current TPS Haiti beneficiaries seek-ing to extend their TPS status must re-reg-ister during a 60-day period that runs fromAugust 25, 2015, through October 26,2015. US Citizenship and Immigration

Services (USCIS) encourages beneficiariesto re-register as soon as possible once the60-day re-registration period begins.USCIS will not accept applications beforeAugust 25, 2015.

The 18-month extension also allowsTPS re-registrants to apply for a new em-ployment authorization document (EAD).Eligible TPS Haiti beneficiaries who re-register during the 60-day period and re-quest a new EAD will receive one with anexpiration date of July 22, 2017. USCISrecognizes that some re-registrants may notreceive their new EADs until after their

current EADs expire. Therefore, USCIS isautomatically extending current TPS HaitiEADs bearing a January 22, 2016, expira-tion date for an additional six months.These existing EADs are now validthrough July 22, 2016.

Haiti was initially designated for TPSon January 21, 2010, after a major earth-quake devastated the country. Followingconsultations with other federal agencies,the Department of Homeland Security hasdetermined that current conditions in Haitisupport extending the designation periodfor current TPS beneficiaries.

Three money transfer services have struckan eleventh hour deal to continue offering

remittance services in the Cayman Islands,thereby averting a shutdown.Jamaica National Money Transfer, Money-

Gram, and Quik Cash have all made newarrangements to stay in business.The money service businesses will remain

under the oversight of the Cayman IslandsMonetary Authority (CIMA).Uncertainty plagued the money transfer busi-

ness in the Cayman Islands, following a suddenclosure of Western Union by Fidelity Bank inearly July. The companies had been given adeadline of August 31 to make new bankingarrangements.

A remittance report released last year bythe CIMA revealed that Jamaicans send homemore money than any other group of foreignnationals living in the Cayman Islands.

The American Immigration Lawyers Association (AILA)and the American Immigration Council (Council) wel-

come a decision released Friday evening by U.S. DistrictJudge Dolly Gee in Flores v. Lynch, No. 85-04544 (C.D.Ca.),which ruled that children should generally be released fromdetention within five days—preferably to a parent, includinga parent with whom they were apprehended. The governmentmust implement the Court’s ruling by October 23, 2015.

“There is no denying that the government has breachedthe Flores settlement agreement. The status quo is unaccept-

able, and the government must take immediate and dramaticsteps to end family detention,” said Victor Nieblas Pradis,AILA President. “Our CARA Project staff and volunteers sub-mitted numerous declarations to the Court showing how thegovernment is still detaining accompanied minors in secure,unlicensed facilities. It can no longer hide from the Americanpeople the ugly truth of how it treats children fleeing perse-cution,” said Nieblas. “Just as striking is how the Court con-demned the ‘deplorable’ conditions in temporary border jails,”said Nieblas.

Bolt finished with a 9.79, his fastest ofthe year time of the year, but slowest of all hischampionship victories. Bolt has been strug-gling with injuries for most of the season, andbeat Gaitlin by only 0.01 seconds. He said hewanted this win for himself, and called it a bigdeal.

Fraser-Pryce on Sunday retained her num-ber one title in the women’s 100 metres, bywinning gold in 10.76 seconds, just .05 secondsfaster then the silver medal winner from theNetherlands. American Tori Bowie finishedthird for the bronze and Fraser-Pryce’s compa-triot, Veronica Campbell-Brown finishedfourth.

Both Bolt and Fraser-Pyrce each holdthree 100-metre world titles. Fraser-Pryce also

GEORGE TOWN, Cayman Islands:The Cayman Islands sports minister haspulled government’s contribution to the Cay-man Islands Football Association (CIFA)after the row over the refusal by the localfootball body to accept two challengers tothe long-entrenched members of the execu-tive committee escalated this week.

Bodden said that the government will,in the current circumstances, redirect the an-nual payment give to CIFA of $127,775(US$159,000) from the public purse to othersport associations in the face of real concernsthat CIFA is failing to clean house and recog-nise the need for change.

The withdrawal of government fundsfollows a statement from CIFA on Tuesdayin which officials made it clear that theywere not going to honour nominations fromtwo challengers to existing executive mem-

bers, citing alleged infractions, despite ac-cepting the nominations in the first instance.

The challenge to the current leadershipcame from Renard Moxam and Sharon Roul-stone but the CIFA committee is refusing toallow the pair to stand during this weekend’sannual executive election, which has causedwide public outcry, as many believe the cur-rent leadership of CIFA is not only out oftouch and failing the sport but also tainted bythe wider FIFA probe, in which the sus-pended president, Jeffrey Webb, is deeplyentrenched and refusing to admit anything iswrong.

Bodden said on Tuesday that the “tech-nicality used to block the bids of those seek-ing office” may be in the rule book but, inlight of all that has happened, it was time toallow some changes to the CIFA executive.

The Caribbean may be missing an im-portant opportunity by not fully tap-

ping into the growing volunteer tourism or"voluntourism" market, according to vet-eran community development expert andnonprofit advisor Kwayera Archer-Cun-ningham.

With more than 25 years of experienceas a nonprofit leader, Archer-Cunningham,who travels frequently between her Jamaicaand New York offices, said many touristsare traveling to the region with a desire tohave a positive impact and make a differ-ence in addition to having fun.

"Unfortunately, too often there are notenough avenues that are visible for visitorsto figure out how they can help before theyleave and go back home," she lamented.

"Many people have great intentions.They want to figure out how they can makethe region a home away from home, notjust by enjoying the beach, but also volun-teering for an hour or helping a school -whether by contributing towards the cost ofa computer or a smart board," said Archer-Cunningham, who specializes in commu-nity and organizational development,philanthropy, and social entrepreneurship.

Archer-Cunningham believes that thehospitality industry, especially hotels,should be encouraged to establish strategicpartnerships with local and regional mediato increase awareness of the social and phil-anthropic needs within the destination. "Weneed broad communications channels sothat people traveling to the Caribbean - ei-ther single or multiple destinations - receivethe information and access they need tomake decisions about how they can con-tribute their time, dollars and energy," shecommented.

According to Carrie Kahn, NationalPublic Radio's international correspondent,more than 1.6 million volunteer tourists arespending about US $2 billion each year.

My focus in the past article was hair re-moval for men. In this article I will

continue on the same thread however themethod of hair removal is Electrolysis forboth men and women.

Electrolysis is the process of removingone hair at a time. The hair can be removedfrom the face or body. The electrolysis de-vice destroys the growth center of the hair.

The hair is destroyed either by chemicalor heat. Note, a probe is inserted into the hairfollicle and the hair is removed needle elec-trolysis which is the only way to ensure per-manent hair removal.

Although the method is very similar tolaser removal there are differences in theamount of time to obtain permanentresults, the cost variable and thequality of work from the Electrolo-gist. Never can it be said all Elec-trologists are the same! The level ofcare, time and concern for theclients differentiates and distin-guishes one Electrologist from another.

As a perspective client take time and doyour homework if you are considering elec-trolysis as a means of hair removal. Keep thefollowing in though as you go through theprocess:

Ask for consultation, meet the elector-ogist one on one for a private consultation.

Ask a friend who may have had theelectrolysis done in the past; ask them forfactual information and also personal expe-rience working with the Electrologist.

Inquire into professional certification ofthe Electrologist

Ensure the Electrologist attended an ac-credited school and the certification isprominently displayed in the place of busi-ness.

Find out the type of techniques that isbeing use by the Electrologist. Ask aboutNeedle Electrolysis which is the only per-manent way of hair removal; in other words

the hair does not grow again.Lastly, be observant during yourconsultation, look closely at the fa-cility and ensure the place is clean.Ask questions a lot of questions,do not be shy.

Note, there are many promotions onlineadvertising for inexpensive services – keepin mind you want to get the best for yourmoney. Electrolysis is extremely time con-suming however the benefit is that the hairremoval is permanent.

Just as an example an area as the upperlip may on average cost between $400 to$900 and will involve many hours. Thetreatment for that small area requires retreat-ment that may last up to 2 years for ongoingsessions.
